Minister Algirdas Monkevičius APPROVED by order No.ISAK-1503 of 30 October, 2003 of the Minister of Education and Science THE ORDER OF ISSUANCE AND REGISTRATION OF LICENSES TO PURSUE STUDIES I. GENERAL PROVISIONS 1. The Order of Issuance and Registration of Licenses to Pursue Studies (hereinafter referred to as “the Order”) shall establish the form and the content, procedure of issuance, supplement, revocation and registration of licenses granting the right to pursue studies in non-state higher education institutions following study programmes included into the Register of Study and Teaching Programmes, also licenses granting the right to pursue studies following study programmes of higher education institutions of other countries and pursue other activities related to studies (hereinafter jointly referred to as “licenses to pursue studies”), as well as the rights and the duties of the holders of these licenses. 2. Definitions used in this Order: Entity pursuing studies – a higher education institution or another legal person having the license to pursue studies issued in the manner prescribed by this Order. Entity pursuing studies in a branch of a foreign higher education institution shall be the foreign higher education institution. Types of studies – non-university and university studies. Other definitions used in this Order shall coincide with the definitions described in the Law on Higher Education of the Republic of Lithuania (Official Gazette, 2000, No.27-715). 3. The decision concerning the issuance or revocation of the license to pursue studies shall be made by the Government of the Republic of Lithuania upon the proposal of the Ministry of Education and Science (hereinafter referred to as “the Ministry”), observing the Order of the Establishment of Higher Education Institutions and the Issuance of Licenses to Pursue Studies, approved by Decree No.1153 of 9 September, 2003 of the Government of the Republic of Lithuania (Official Gazette, 2003, No.87-3944). Licenses to pursue studies shall be issued by the Ministry. 4. Educational Registry Division of the Ministry shall register the issued licenses to pursue studies into the register of licenses to pursue studies of the established by the Minister of Education and Science form. 5. Educational Registry Division of the Ministry shall compile a file of permanent storage for every holder of the license to pursue studies and pursuing this activity. 6. The license to pursue studies shall be issued for an unlimited period of time. 7. The license to pursue studies may be supplemented with a new study field, level or type of studies (in case of the Lithuanian non-state higher education institution – also with a new type of educational activity) in the procedure prescribed by this Order issuing a new license to pursue studies. 8. The license to pursue studies shall be issued, supplemented and revoked by the order of the Minister of Education and Science. When issuing the license for the entity pursuing studies to pursue studies following study programmes of higher education institutions of other states, the order of the Minister of Education and Science must include the title (titles) of the pursued study programme (programmes). Study programmes pursued by the Lithuanian non-state higher education institution shall be registered in the procedure established by the Ministry. 9. The order of the Minister of Education and Science concerning the issuance, supplement or revocation of the license to pursue studies shall be published in the annex “Informaciniai pranešimai” (Information Bulletin) of the “Official Gazette”. On the web-site www.mokykla.smm.lt the following data shall be presented: 9.1. the title, legal format, state code, address of the seat of the entity pursuing studies; 9.2. the type (types) of the licenses to pursue studies; 9.3. the state code (codes) of the type of educational activity – of the Lithuanian non-state higher education institution; the type (types) of studies – of other entities pursuing studies; 9.4. the field (fields) and the level (levels) of studies, the title (titles) of the study programme (programmes); 9.5. the registration number of the license to pursue studies; 9.6. the date of the issuance of the license to pursue studies, dates of the supplement of the license to pursue studies and the date of the revocation of the license to pursue studies (if the license to pursue studies has been supplemented and revoked). 10. Within 5 working days from the issuance of the license to pursue studies the Educational Registry Division of the Ministry shall notify the manager of the Registry of Legal Entities concerning the data indicated in the regulations of the Registry of Legal Entities. II. TYPES AND THE CONTENT OF THE LICENSES TO PURSUE STUDIES 11. There shall be the following types of licenses to pursue studies: 11.1. license for the Lithuanian non-state higher education institution to pursue: 11.1.1. university higher education studies; 11.1.2. non-university higher education studies; 11.2. license for a branch of the foreign higher education institution to pursue studies following study programmes of that foreign higher education institution and pursue other activities related to studies; 11.3. license for the Lithuanian higher education institution or another legal entity to pursue studies following study programmes of a higher education institution of another country and pursue other activities related to studies. 12. The following properties shall be indicated in the license: 12.1. the title of the institution which has issued the license to pursue studies; 12.2. the number of the form of the license to pursue studies; 12.3. the title, state code, address of the seat of the entity pursuing studies; 12.4. legal format of the entity pursuing studies; 12.5. the field (fields) and the level (levels) of studies; 12.6. the title (titles) of the awarded diploma; 12.7. the date of the issuance of the license to pursue studies and the dates of supplements of the license to pursue studies (if the license to pursue studies has been supplemented); 12.8. the registration number of the license to pursue studies; 12.9. the first name, surname and signature of the head of the institution which has issued the license; the signature shall be certified by the seal of the Ministry. 13. The license to pursue studies referred to in paragraph 11.1. of this Order shall additionally indicate: 13.1. the type of the entity pursuing studies; 13.2. the state code (codes) of the kind of educational activity (activities) and the title (titles). 14. The license to pursue studies referred to in paragraph 11.2. of this Order shall additionally indicate the address of the seat of the branch of the foreign higher education institution in Lithuania and the type (types) of the pursued studies. 15. The license to pursue studies referred to in paragraph 11.3. of this Order shall additionally indicate the title, the address of the seat and the type (types) of the pursued studies of the foreign higher education institution, the study programmes of which are followed in the pursued studies. III. DOCUMENTS NECESSARY TO RECEIVE OR SUPPLEMENT THE LICENSES TO PURSUE STUDIES 16. The entity pursuing studies, having received the approval of the Government of the Republic of Lithuania on the issuance of the license to pursue studies and wishing to receive the license for the first time, shall submit to the Educational Registry Division of the Ministry: 16.1. a request where the following data shall be presented: the title of the entity pursuing studies, legal format, state code, address of the seat, phone and fax numbers, address of the teaching subdivision (in case when it does not coincide with the address of the seat), phone and fax numbers of the subdivision, the date and the number of the decree of the Government of the Republic of Lithuania on the approval of the issuance of the license to pursue studies, position, name and surname of the head of the entity pursuing studies or the authorized person who has filled in the request, the date of the application. The field (fields) of studies, the level (levels) of studies, the study programme (programmes), the type (types) of studies must be indicated in the request. The request of the Lithuanian non-state higher education institution shall also indicate the state code (codes) and the title (titles) of the educational activity (activities). 16.2. a document confirming that the state charges for the issuance of the license to pursue studies have been paid; 17. The entity pursuing studies and wishing to supplement the license to pursue studies with a new field, level or type of studies (Lithuanian higher education institution – with a new kind of educational activity), shall present to the Department of Higher Education and Science: 17.1. a request where the following data shall be presented: the title of the entity pursuing studies, legal format, state code, address of the seat, phone and fax numbers, address of the teaching subdivision (in case when it does not coincide with the address of the seat), phone and fax numbers of the subdivision, the date and the number of the order of the Minister of Education and Science on the issuance of the license to pursue studies to the higher education institution, the position, the name and the surname of the head of the entity pursuing studies or the authorized person who has filled in the request, the date of the application. The field (fields) of studies, the level (levels) of studies, the study programme (programmes), the type (types) of studies pursued and planned to be pursued must be indicated in the request. The request of the Lithuanian non-state higher education institution shall also indicate the state code (codes) and the title (titles) of the type (types) of educational activity. 17.2. an application for the supplement of the license to pursue studies (in the Lithuanian language or the language of origin with translation certified in the order established by legal acts) consisting of the documents listed in paragraph 18 of this Order; 17.3. a summary of the assessment of the application documents concerning the supplement of the license to pursue studies with the new field, level or type of studies (for the Lithuanian non-state higher education institution - also with the new type of educational activity) made by the Lithuanian Centre for Quality Assessment in Higher Education; 17.4. the conclusion of the State Labour Inspection that the planned workplaces and implements of work correspond to the employees’ safety and health requirements for pursuing the new field, level or type of studies; 17.5. if new buildings for pursuing the new field, level or type of studies (for the Lithuanian non-state higher education institution – also the new type of educational activity) planned by the entity pursuing studies have been constructed or existing structures have been adjusted changing their purpose, - copies of acts prepared in the order established by the Ministry of Environment recognizing that the buildings are exploitable. 18. The entity pursuing studies and wishing to receive a summary of the assessment of the application documents for the supplement of the license to pursue studies with the new field, level or type of studies (the Lithuanian non-state higher education institution – also with the new type of educational activity) indicated in paragraph 17.3, shall submit the following to the Lithuanian Centre for Quality Assessment in Higher Education (in the Lithuanian language or the language of origin with the translation certified in the manner prescribed by legal acts): 18.1. a request to assess its forwardness to pursue the new field, level or type of studies (the Lithuanian non-state higher education institution – also the new type of educational activity); 18.2. a copy of the license to pursue studies; 18.3. the Lithuanian non-state higher education institution shall additionally submit: 18.3.1. documents proving that the founders have the material basis indispensable to pursue the new type of educational activity, the field of studies or the level of studies; 18.3.2. a plan of activity (business plan) in the form established by the Ministry supplemented by the non-state higher education institution for pursuing the new type of educational activity, the field of studies or the level of studies; 18.3.3. description of the new type of educational activity, study programmes of the field of studies or the level of studies planned to be pursued, prepared in the order established by the Lithuanian Centre for Quality Assessment in Higher Education; 18.3.4. forwardness (lists of research fields, researchers who agree to work in the non-state higher education institution, description of the research activity of these researchers and the reasoning of the activity) for the planned research activity (if non-university studies are planned to be pursued – the applied research activity) of the non-state higher education institution. 18.4. the foreign higher education institution – the founder of the branch shall additionally present: 18.4.1. description of the planned study programmes of the new type, field or level of studies prepared in the order established by the Lithuanian Centre for Quality Assessment in Higher Education, where the material basis and the teaching staff for the realization of the programme shall be doubly described: available by the founder of the branch of the foreign higher education institution and those planned to be realized in Lithuania; 18.4.2. a certificate concerning the assessment and (

  1. or)the accreditation of the study programme (programmes) of the new type, field or level of studies intended to be pursued; 18.4.3. a reference letter of the regulatory authority in the foreign state supervising the quality of studies concerning the quality supervision of the realization of the planned study programmes of the new type, field or level of studies in the branch of the foreign higher education institution, schedule for the supervision and possibilities to involve Lithuanian representatives into the procedures of the quality supervision; 18.4.4. a mediation letter of the state institution of that foreign state regulating the field of higher education concerning the study programmes of the new types, fields or levels of studies planned to be pursued; 18.5. the entity pursuing studies following study programmes of higher education institutions of other states shall additionally submit: 18.5.1. description of the study programmes of the new type, fields or levels of studies planned to be pursued prepared in the order established by the Lithuanian Centre for Quality Assessment in Higher Education where the material basis and the teaching staff for the realization of the programme shall be doubly described: available at the foreign higher education institution, study programmes of which are planned to be pursued, and those planned for Lithuania. 18.5.2. a certificate concerning the assessment and (
  2. or)the accreditation of the higher education institution or its study programme (programmes) of the new type, field or level of studies intended to be pursued; 18.5.3. a reference letter of the regulatory authority in the foreign state supervising the quality of studies concerning the quality supervision of the study programmes of the new type, field or level of studies planned to be pursued in Lithuania, schedule for the supervision and possibilities to involve Lithuanian representatives into the procedures of the quality supervision; 18.5.4. a mediation letter of the state institution of that foreign state regulating the field of higher education concerning the study programmes of the new type, field or level of studies planned to be pursued in Lithuania; 18.5.5. authorization of the foreign higher education institution, study programmes of which are planned to be pursued in Lithuania, to pursue study programmes of the new type, field or level of studies where undertakings of that foreign higher education institution must be indicated; 18.5.5.1. to ensure (concrete instruments shall be pointed out) that the quality of study programmes of the new type, field or level of studies in Lithuania shall conform to the quality of study programmes in that foreign higher education institution; 18.5.5.2. to award the graduates from studies in Lithuania diploma with supplements of that foreign higher education institution recognized by that foreign state where information concerning the awarded qualification, duration and volume of the study programme of the new type, field or level shall be included; 18.5.5.3. to notify about expiration of the authorization to pursue the study programme of the new type, field or level of studies; 19. Not later that 15 days after the receipt of the documents referred to in paragraph 17 of this Order, the Department of Science and Higher Education shall be entitled to require some additional document and information, if they are necessary for the decision making concerning the supplement of the license to pursue studies with the new field, level or type of studies (for the Lithuanian non-state higher education institution - also with the new type of educational activity). IV. PROCEDURE OF AND TERMS FOR THE ANALYSIS OF THE DOCUMENTS 20. Not later that within 3 months from the day of the receipt of all the documents listed in paragraph 18 of this Order, the Lithuanian Centre for Quality Assessment in Higher Education shall make an assessment of the application documents of the entity pursuing studies for the supplement of the license to pursue studies with the new field, level or type of studies (for the Lithuanian non-state higher education institution – also with the new type of educational activity) and shall produce a summary of the assessment to the entity pursuing studies. 21. The Minister of Education and Science shall sign the order concerning the issuance of the license to pursue studies within 5 working days from the receipt of all the documents listed in paragraph 16 of this Order and the day of submission of the data. 22. The Ministry shall make a decision concerning the supplement of the license to pursue studies with the new field, level or type of studies (for the Lithuanian non-state higher education institution – also with the new type of educational activity) within 30 days from the receipt of all the documents and information referred to in paragraph 17 of this Order. The Ministry shall make a decision not to issue the license to pursue studies, if the documents listed in paragraphs 18.1-18.5. received negative assessment of the Lithuanian Centre for Quality Assessment in Higher Education. 23. If the Ministry approves the supplement of the license to pursue studies with the new field, level and type of studies (for the Lithuanian higher education institution – also with the new type of educational activity), the following shall be submitted to the Educational Registry Division of the Ministry: 23.1. by the Department of Higher Education and Science of the Ministry – an explanatory letter and the documents pointed out in paragraph 17.1 of this Order; 23.2. by the entity pursuing studies – a document confirming that state charges for the issuance of the license to pursue studies have been paid and the available license to pursue studies. 24. The supplement of the license to pursue studies shall be formalized by the order of the Minister of Education and Science. V. REVOCATION OF THE LICENSE TO PURSUE STUDIES AND ISSUANCE OF THE DUPLICATE 25. After the Government of the Republic of Lithuania passes the decree to approve the revocation of the license to pursue studies, within 5 working days from the day when the decree of the Government of the Republic of Lithuania comes into force, the Minister of Education and Science shall issue the order concerning revocation of the license to pursue studies. The Department of Higher Education and Science of the Ministry shall notify the entity pursuing studies about the reasons for the revocation of the license to pursue studies, and the Educational Registry Division of the Ministry – shall present the data indicated in the regulations of the Registry of Legal Entities to the manager of the Registry of Legal Entities. 26. Upon submission of a request to issue a duplicate of the license to pursue studies and a document confirming that the state charges for the issuance of the duplicate of the license to pursue studies have been paid, within 5 working days from day of the receipt of these documents the Educational Registry Division of the Ministry shall issue a duplicate of the license to pursue studies on the basis of the available data about the entity pursuing studies. Besides the data indicated in paragraph 12 of this Order, a date of the issuance of the duplicate shall be pointed out in the form of the duplicate of the license to pursue studies, and a word “DUPLICATE” in the upper right-hand corner. VI. THE RIGHTS AND THE DUTIES OF THE HOLDERS OF LICENSES TO PURSUE STUDIES 27. The entity pursuing studies shall be entitled: 27.1. to exercise the activity pointed out in the license; 27.2. to request the Ministry to explain the reasons of the revocation of the license to pursue studies or the refusal to supplement the license to pursue studies; 27.3. to submit a repeated application for the supplement of the license with the new field, level or type of studies (for the Lithuanian non-state higher education institution – also with the new type of activity) after at least one year after the decision by the Ministry not to supplement the license to pursue studies was made. 27.4. within 20 days from the decision of the Ministry not to supplement the license to pursue studies with the new field, level or type of studies (for the Lithuanian non-state higher education institution – also with the new type of activity), to make once an appeal to the Minister of Education and Science which shall be examined by the appellate expert commission formed by the Minister of Education and Science. 28. The Lithuanian non-state higher education institution shall be entitled to start the new activity, pursue studies in the new field or level from the day of registration of study programmes in the Register of Study and Teaching Programmes. 29. Other entities pursuing studies shall be entitled to start the activity or pursue studies of the new type, field or level from the day of issuance or supplement of the license to pursue studies. 30. The entity pursuing studies must: 30.1. observe the Law on Higher Education of the Republic of Lithuania, other legal acts and requirements prescribed by this Order; 30.2. in case of the loss of the license, to apply in writing to the Educational Registry Division of the Ministry within three days concerning issuance of the duplicate of the license to pursue studies in the manner laid down in paragraph 26 of this Order; 30.3. within 3 working days from the changes of the properties of the entity pursuing studies, to apply the Educational Registry Division of the Ministry concerning specification of the license to pursue studies. 31. The entity, which has received the license to pursue studies following study programmes of higher education institutions of foreign countries, until the beginning of each academic year must present to the Department of Higher Education and Science of the Ministry lists of newly started study programmes of the same type, field and level of studies for which the license to pursue studies had already been issued, where the following data shall be given: 31.1. the title of the study programme in the Lithuanian and the English languages; 31.2. specializations of study programmes (if any) in the Lithuanian and the English languages; 31.3. annotation of the study programme; 31.4. minimum requirements for the admission to studies; 31.5. duration, volume and mode of studies; 31.6. awarded qualification degree and (
  3. or)professional qualification; 31.7. the title of the awarded educational certificate; 31.8. the title of the institution which has carried out expert assessment. VII. FINAL PROVISIONS 32. Within 5 working days from the receipt of the data referred to in paragraph 31 of this Order, the order concerning issuance, supplement or revocation shall be amended in the established procedure indicating study programmes that start being pursued and those which have been abandoned. The list of study programmes pursued by the entity shall be updated on the web-site of the Ministry.
