Official Translation Official Translation REPUBLIC OF LITHUANIA LAW ON TRANSPORT PRIVILEGES 30 March, 2000 No. VIII – 1605 Vilnius (as last amended on June 24, 2003 No. IX-1643) CHAPTER I GENERAL PROVISIONS Article

  1. Purpose of the Law This Law shall establish the categories, types of privileges, remuneration of travel expenses and expenses (income not received by carriers), procedure and sources of compensation in connection with the application of privileges, of persons, whose travel expenses shall be provided.
  2. This Law shall be mandatory for all carriers regardless of the form of their property. Article
  3. Definitions
  4. Carrier means an undertaking which has been registered in accordance with the procedure set forth by laws, having the right to engage in the carriage of passengers and baggage.
  5. Long distance regular service buses mean road transport vehicles, carrying passengers according to approved timetables along established routes extending over the territories of more than two municipalities (excluding urban municipalities).
  6. Local (urban) regular service buses and trolley-buses mean road transport vehicles carrying passengers according to approved timetables along urban routes which shall be determined by municipalities.
  7. Local (suburban) regular service buses mean road transport vehicles carrying passengers according to approved timetables along set suburban routes not extending over the territories of more than two adjacent municipalities (excluding urban municipalities).
  8. Passenger trains mean local service and international service trains of Lithuania: 1) local service trains mean ordinary and express trains running within the Republic of Lithuania; 2) international service trains mean passenger trains carrying passengers to other states.
  9. Regular service ships and ferries mean inland waters means of transport carrying passengers along urban, suburban, and inter-urban routes in accordance with an approved timetable.
  10. Taxi cars mean road motor vehicles for carrying passengers and luggage, having not more than 7 seating places, the driver’s including, fitted with a taximeter and a taxi sign and meeting the technical requirements set for taxi passenger cars. The technical requirements for taxi cars shall be set by the Ministry of Transport and Communications.
  11. Taxi mini-buses until December 31, 2004 shall mean road motor vehicles having from 6 to 17 seating places„ from January 5, 2005 - buses, which have from 10 to 17 seats, the driver’s seat included, fitted with identifying sign, which carry only seated passengers according to the approved timetables of along the established local regular service routes (urban and suburban), picking up and discharging passengers at stations or according to request, in places where stopping is not prohibited by the Traffic Regulations.
  12. General education schools mean kindergartens, primary, basic, youth, secondary schools, gymnasiums, international baccalaureate schools, special schools, boarding schools, special-boarding schools, sanatorium type boarding schools, children’s care homes, special children’s care and education homes. 10.Vocational education schools mean vocational schools and specialised (rehabilitation) vocational schools (centres), which provide basic vocational training.
  13. Colleges mean colleges and conservatories.
  14. Schools of higher education mean universities, academies, seminaries, institutes and colleges.
  15. Institutions of supplemental education mean art, (music, art, choreography), sport, languages, technology, and schools and centres of other profile. CHAPTER II KINDS OF PRIVILEGES AND CATEGORIES OF PERSONS TO WHOM THEY ARE GRANTED Article
  16. Kinds of Privileges and Areas of Application Thereof
  17. The following transport privileges shall apply in the Republic of Lithuania: 1) the right to travel free of charge; 2) the right to obtain a transport ticket at a reduced rate; 3) the right to reimbursement of transportation expenses.
  18. Privileges set forth in subparagraphs 1 and 2 of paragraph 1 of this Article, shall be extended while travelling by long distance regular service buses, local (urban and suburban) regular service buses and trolleybuses, passenger trains (2nd and 3rd class seating cars, when the passenger’s initial and final stations are located within the territory of the Republic of Lithuania) and on regular service ships and ferries. These privileges shall not apply while riding in taxi cars and taxi mini-buses. Article
  19. Right to Ride Free of Charge
  20. Each passenger shall be accorded the privilege of bringing free of charge, two children under 7 years of age, without occupying an extra seat or sleeping place, in local (urban and suburban) regular service buses and trolleybuses, long distance regular service buses, passenger trains, regular service ships and ferries.
  21. The right to travel in passenger transport free of charge shall be accorded to officers inspecting passenger transport in accordance with the procedure established by the Government or an institution authorised by it. Article
  22. Rights to Obtain Reduced Fare Travel Tickets Version of paragraph 1 applicable from January 1, 2004:
  23. The right to buy a single ticket for travel on long distance regular service buses, passenger trains or a single or fixed-term individual ticket for travelling on local (urban and suburban) regular transport buses and trolleybuses, travelling by regular ships and ferries, at a discount of 80% of fare shall be accorded to children who are disabled, group II disabled persons, group I disabled persons, persons who suffer from the diseases included on the list of diseases determined by the Ministry of Health, whose treatment constantly requires haemodialysis, and the persons escorting them (one escort per person) also persons who are 85 or older; defenders of the independence of the Republic of Lithuania, who became group II and III disabled persons as a result of 11-13 January, 1991 and subsequent aggression committed by the USSR; participants in the resistance against the occupations of 1940 – 1990 such as, military volunteers, who are aged 70 or over.
  24. The following shall have the right to obtain a single ticket for travel by long distance regular service buses, passenger trains or a single or a fixed term individual ticket at a 50% discount of the fare for travelling by local (urban and suburban,) regular buses and trolleybuses, by regular service ships and ferries: 1) group II disabled persons; 2) participants in the resistance against the 1940-1990 occupations - the military volunteers, below the age of 70, as well as the participants in the struggles for freedom; 3) persons who are the victims of the occupations of 1939-1990 - political prisoners and deportees and prisoners of ghettos, concentration or other types of forced labour camps; Version of subparagraph 4, paragraph 2 applicable from January 1, 2004: 4) the defenders of the independence of the Republic of Lithuania, who became victims as a result of the 11-13 January, 1991 and subsequent acts of aggression committed by the USSR; 5) the family members of the defenders of independence of the Republic of Lithuania, who died as a result of the January 11-13, 1991 and subsequent acts of aggression committed by the USSR; Version of subparagraph 6, paragraph 2 applicable from 1 January 2004: 6) Persons aged 70 –
  26. University and college full-time students and vocational school full-time students, travelling from 1 September to 1 July, shall have the right to obtain a single or fixed term ticket for travel on passenger trains with a 50 percent fare discount.
  27. Children aged 7-10 shall be accorded the right to obtain tickets at a 50 percent discount for a single ride on long-distance regular service buses, passenger trains, regular service ships and ferries.
  28. Passengers accompanying several children under 7 years of age, shall be accorded the right to a ticket for the third and other children at a 50 percent discount for travel on long-distance regular service buses, local (urban and suburban) transport on buses and trolleybuses, passenger trains, regular service ships and ferries.   29. University and college full-time students, students of full-time general education schools and vocational institutions as well as the pupils the pupils of the National Konstantinas Čiurlionis School of the Arts shall have the right to obtain the following fare reductions for travel on local (urban) regular transport buses and trolleybuses: 1) 80 percent for those acquiring a fixed term, individual transport ticket; 2) 50 percent for those acquiring a single transport ticket. Article 5 shall be supplemented with a new paragraph 7 and paragraph 7 shall be considered paragraph 8 from 1January 2004
  30. Pupils of the National Konstantinas Čiurlionis School of the Arts who use transport from September 1 until July 1, shall have the right to obtain a single ticket for travel on long-distance regular service buses, a single or fixed term ticket for travel on passenger trains, a single or fixed term, individual personal ticket for travel on local (suburban) regular service buses, regular service ships and ferries, at a 50 percent reduced fare.
  31. The municipalities may additionally, according to the procedure set forth by them, allow tickets at reduced fares for persons in other categories and to obtain reduced fare transport tickets on certain days of the week or hours within the 24 day period. The municipalities shall reimburse from their own budgetary funds, the expenses related to these privileges. Article
  32. Reimbursement of Travel Expenses for Pupils, Inmates of Children’s Care Institutions and Students
  33. Municipalities of the areas where educational institutions are located, shall remunerate all transport expenses for the following persons: 1) the pupils of institutions of general education, vocational education institutions and supplementary education institutions, living in rural areas, who travelled on the work days of these institutions to the schools or institutions for up to 30 km and back, along the route of local (suburban) regular bus service, long distance regular service buses, passenger trains and regular service ships and ferries indicated on the pupil’s certificate; this privilege shall apply to pupils of supplementary education on days off as well; 2) for orphans and children left without parental care, living in children’s care homes, special children’s care and education homes, for pupils of boarding schools and other general education schools and vocational training schools, residing at dormitories, who travelled on local (suburban) regular service buses, passenger trains, regular service ships and ferries.
  34. University and college full-time students and pupils of vocational training institutions may be reimbursed by these schools and institutions for up to 50 percent of their expenses for travel on long distance regular service buses from 1 September to 1 July, in accordance with the procedure established by the founders. Article
  35. Right to Reimbursement of Expenses
  36. The disabled, who have impaired motor activity, shall be entitled to: 1) reimbursement of transport expenses equivalent to 0.25 of the minimum living standard (MLS) each month; 2) once in 6 years – a compensation of up to 32 MLS for acquiring motor vehicles and the expenses for the technical adaptation thereof, provided that these persons are themselves able to drive these motor vehicles.
  37. The reimbursement shall not be paid during the time period when a disabled person, who is entitled to reimbursement of transport expenses, is serving his sentence in prison. This period shall also be excluded from receiving reimbursement of the expenses when acquiring a motor vehicle and the expenses for the technical adaptation thereof.
  38. The reimbursement set forth in paragraph 1 of this Article shall be paid from the state budget.
  39. The procedure for reimbursement of the transport expenses shall be determined by the Government or an institution authorised by it. CHAPTER III PROCEDURE AND SOURCES OF REIMBURSEMENT OF CARRIER EXPENSES (COMPENSATION OF INCOME NOT RECEIVED) Article
  40. Procedure and Sources of Reimbursement of Carrier Expenses (Compensation of Income Not Received) Carriers’ expenses (income not received), which are related to application of privileges, shall be reimbursed/compensated according to the contracts concluded with them, from the state and municipality budgets, in accordance with the procedure established by the Government, as follows: 1) concerning the privileges with regard to travel by passenger trains, set forth in Article 5, paragraphs 1-5 and 7 of this Law – from the state budget; 2) concerning the privileges with regard to travel by regular service ships and ferries, set forth in paragraphs 1, 2, 4, 5 and 7 of Article 5 of this Law - from the budgets of municipalities where the undertakings of these carriers are registered; 3) concerning the privileges with regard to travel on long-distance service buses, set forth in paragraphs 1, 2, 4, 5 and 7 of Article 5 of this Law, until 31 December 2000 - from the budgets of municipalities where the undertakings of these carriers are registered and from 1 January 2001 - from the state budget; 4) concerning the privileges with regards to travel on local (urban and suburban) regular service buses and trolleybuses, set forth in paragraphs 1, 2, 5, 6 and 7 of Article 5 - from the budgets of municipalities which have issued licenses to the carriers to carry passengers by local (urban and suburban) regular service buses and trolleybuses; 5) concerning the privileges with regard to travel on local (suburban) regular service buses, carrying passengers through territories of two adjacent municipalities of which one is the municipality of one of the major cities of Vilnius, Kaunas, Klaipėda, Šiauliai, Panevėžys and Alytus, from the budgets of the city and the adjacent municipalities jointly and severally according to a mutual agreement. CHAPTER IV FINAL PROVISIONS Article
  41. Entrance into Force of the Law This Law shall enter into force from May 1, 2000, with the exception of paragraph 1 of Article 7, which shall enter into force from January 1,

  45. Liability for Violations of this Law Persons who are in violation of the requirements of this Law shall be liable in accordance with the procedure set forth by the laws. Article
  46. Repeal of a Legal Act Upon coming into force of this Law, the Law of the Republic of Lithuania “On Privileges of Travel by Passenger Transport and the Procedure of Reimbursement of Passenger Transport Expenses of Certain Categories of Officials, Employees and Other Persons,” shall be repealed.
