(01)...... from DATEFF ANNEX INTERNATIONAL CONVENTION ON THE SIMPLIFICATION AND HARMONIZATION OF CUSTOMS PROCEDURES PREAMBLE The CONTRACTING PARTIES to the present convention, established under the auspices of the Customs Cooperation Council, NOTING that divergences between national customs procedures can hamper international trade and other international exchanges, CONSIDERING that it is in the interests of all countries to promote such trade and exchanges and to foster international cooperation, CONSIDERING that simplification and harmonization of their customs procedures can effectively contribute to the development of international trade and of other international exchanges, CONVINCED that an international instrument proposing provisions which countries undertake to apply as soon as they are able to do so would lead progressively to a high degree of simplification and harmonization of customs procedures, which is one of the essential aims of the Customs Cooperation Council, HAVE AGREED AS FOLLOWS: CHAPTER I Definitions Article 1 Fot the purposes of this convention: (
  1. a)the term "the Council" means the organization set up by the convention establishing a Customs Cooperation Council, done at Brussels on 15 December 1950; (
  2. b)the term "Permanent Technical Committee" means the Permanent Technical Committee of the Council; (
  3. c)the term "ratification" means ratification, acceptance or approval. CHAPTER II Scope of the convention and structure of the Annexes Article 2 Each Contracting Party undertakes to promote the simplification and harmonization of customs procedures and, to that end, to conform, in accordance with the provisions of this convention, to the standards and recommended practices in the Annexes to this convention. However, nothing shall prevent a Contracting Party from granting facilities greater than those provided for therein, and each Contracting Party is recommended to grant such greater facilities as extensively as possible. Article 3 The provisions of this convention shall not preclude the application of prohibitions or restrictions imposed under national legislation. Article 4 Each Annex to this convention consists, in principle, of: (
  4. a)an introduction summarizing the various matters dealt with in the Annex; (
  5. b)definitions of the main customs terms used in the Annex; (
  6. c)standards, being those provisions the general application of which is recognized as necessary for the achievement of harmonization and simplification of customs procedures; (
  7. d)recommended practices, being those provisions which are recognized as constituting progress towards the harmonization and the simplification of customs procedures, the widest possible application of which is considered to be desirable; (
  8. e)notes, indicating some of the possible courses of action to be followed in applying the standard or recommended practice concerned. Article 5 1. Any Contracting Party which accepts an Annex shall be deemed to accept all the standards and recommended practices therein unless at the time of accepting the Annex or at any time thereafter it notifies the Secretary-General of the Council of the standard(
  9. s)and recommended practice(
  10. s)in respect of which it enters reservations, stating the differences existing between the provisions of its national legislation and those of the standard(
  11. s)and recommended practice(
  12. s)concerned. Any Contracting Party which has entered reservations may withdraw them, in whole or in part, at any time, by notification to the Secretary-General specifying the date on which such withdrawal takes effect. 2. Each Contracting Party bound by an Annex shall, at least once every three years, review the standards and recommended practices therein in respect of which it has entered reservations, compare them with the provisions of its national legislation and notify the Secretary-General of the Council of the results of that review. CHAPTER III Role of Council and of the Permanent Technical Committee Article 6 1. The Council shall, in accordance with the provisions of this convention, supervise the administration and development of this convention. It shall, in particular, decide upon the incorporation of new Annexes in the convention. 2. To these ends the Permanent Technical Committee shall, under the authority of the Council, and in accordance with any directions given by the Council, have the following functions: (
  13. a)to prepare new Annexes and to propose to the Council their adoption with a view to their incorporation in the convention; (
  14. b)to submit to the Council proposals for such amendments to this convention or to its Annexes as it may consider necessary and, in particular, proposals for amendments to the texts of the standards and recommended practices and for the upgrading of recommended practices to standards; (
  15. c)to furnish opinions on any matters concerning the application of the convention; (
  16. d)to perform such tasks as the Council may direct in relation to the provisions of the convention. Article 7 For the purposes of voting in the Council and in the Permanent Technical Committee each Annex shall be taken to be a separate convention. CHAPTER IV Miscellaneous provisions Article 8 For the purposes of this convention, any Annex or Annexes to which a Contracting Party is bound shall be construed to be an integral part of the convention, and in relation to that Contracting Party any reference to the convention shall be deemed to include a reference to such Annex or Annexes. Article 9 Contracting Parties which form a customs or economic union may state by notification to the Secretary-General of the Council that for the application of a given Annex to this convention their territories are to be taken as a single territory. In each instance where, as a result of such notification, differences exist between the provisions of that Annex and those of the legislation applicable to the territories of the Contracting Parties, the States concerned shall enter a reservation to the standard or recommended practice in question under Article 5 of the convention. CHAPTER V Final provisions Article 10 1. Any dispute between two or more Contracting Parties concerning the interpretation or application of this convention shall so far as possible be settled by negotiation between them. 2. Any dispute which is not settled by negotiation shall be referred by the Contracting Parties in dispute to the Permanent Technical Committee which shall thereupon consider the dispute and make recommendations for its settlement. 3. If the Permanent Technical Committee is unable to settle the dispute, it shall refer the matter to the Council, which shall make recommendations in accordance with Article III (
  17. e)of the convention establishing the Council. 4. The Contracting Parties in dispute may agree in advance to accept the recommendations of the Permanent Technical Committee or Council as binding. Article 11 1. Any Member State of the Council and any Member State of the United Nations or its specialized agencies may become a Contracting Party to this convention: (
  18. a)by signing it without reservation of ratification; (
  19. b)by depositing an instrument of ratification after signing it subject to ratification; or (
  20. c)by acceding to it. 2. This convention shall be open until 30 June 1974 for signature at the headquarters of the Council in Brussels by the States referred to in paragraph 1 of this Article. Thereafter, it shall be open for their accession. 3. Any State, not being a member of the organizations referred to in paragraph 1 of this Article, to which an invitation to that effect has been addressed by the Secretary-General of the Council at the Council's request may become a Contracting Party to this convention by acceding thereto after its entry into force. 4. Each State referred to in paragraph 1 or 3 of this Article shall at the time of signing, ratifying or acceding to this convention specify the Annex or Annexes it accepts, it being necessary to accept at least one Annex. It may subsequently notify the Secretary-General of the Council that it accepts one or more further Annexes. 5. The instruments of ratification or accession shall be deposited with the Secretary-General of the Council. 6. The Secretary-General of the Council shall notify the Contacting Parties to this convention, the other signatory States, those Member States of the Council that are not Contracting Parties to the convention, and the Secretary-General of the United Nations of any new Annex that the Council may decide to incorporate in this convention. Contracting Parties accepting such a new Annex shall notify the Secretary-General of the Council in accordance with paragraph 4 of this Article. 7. The provisions of paragraph 1 of this Article shall also apply to the customs or economic unions referred to in Article 9 of this convention in so far as the obligations arising from the instruments establishing such customs or economic unions require the competent bodies thereof to contract in their own name. However, such bodies shall not have the right to vote. Article 12 1. This convention shall enter into force three months after five of the States referred to in paragraph 1 of Article 11 thereof have signed the convention without reservation of ratification or have deposited their instruments of ratification or accession. 2. For any State signing without reservation of ratification, ratifying or acceding to this convention after five States have signed it without reservation of ratification or have deposited their instruments of ratification or accession, this convention shall enter into force three months after the said State has signed without reservation of ratification or deposited its instrument of ratification or accession. 3. Any Annex to this convention shall enter into force three months after five Contracting Parties have accepted that Annex. 4. For any State which accepts an Annex after five States have accepted it, that Annex shall enter into force three months after the said State has notified its acceptance. Article 13 1. Any State may, at the time of signing this convention without reservation of ratification or of depositing its instrument of ratification or accession, or at any time thereafter, declare by notification given to the Secretary-General of the Council that this convention shall extend to all or any of the territories for whose international relations it is responsible. Such notification shall take effect three months after the date of the receipt thereof by the Secretary-General of the Council. However, the convention shall not apply to the territories named in the notification before the convention has entered into force for the State concerned. 2. Any State which has made a notification under paragraph 1 of this Article extending this convention to any territory for whose international relations it is responsible may notify the Secretary-General of the Council, under the procedure of Article 14 of this convention, that the territory in question will no longer apply the convention. Article 14 1. This convention is of unlimited duration but any Contracting Party may denounce it at any time after the date of its entry into force under Article 12 thereof. 2. The denunciation shall be notified by an instrument in writing, deposited with the Secretary-General of the Council. 3. The denunciation shall take effect six months after the receipt of the instrument of denunciation by the Secretary-General of the Council. 4. The provisions of paragraphs 2 and 3 of this Article shall also apply in respect of the Annexes to this convention, any Contracting Party being entitled, at any time after the date of their entry into force under Article 12 of the convention, to withdraw its acceptance of one or more Annexes. Any Contracting Party which withdraws its acceptance of all the Annexes shall be deemed to have denounced the convention. Article 15 1. The Council may recommend amendments to this convention. Every Contracting Party shall be invited by the Secretary-General of the Council to participate in the discussion of proposals for amendment of this convention. 2. The text of any amendment so recommended shall be communicated by the Secretary-General of the Council to all Contracting Parties to this convention, to the other signatory States and to those Member States of the Council that are not Contracting Parties to this convention. 3. Within a period of six months from the date on which the recommended amendment is so communicated, any Contracting Party or, if the amendment affects an Annex in force, any Contracting Party bound by that Annex may inform the Secretary-General of the Council: (
  21. a)that it has an objection to the recommended amendment, or (
  22. b)that, although it intends to accept the recommended amendment, the conditions necessary for such acceptance are not yet fulfilled in its country. 4. If a Contracting Party sends the Secretary-General of the Council a communication as provided for in paragraph 3 (
  23. b)of this Article, it may, so long as it has not notified the Secretary-General of its acceptance of the recommended amendment, submit an objection to that amendment within a period of nine months following the expiry of the six-month period referred to in paragraph 3 of this Article. 5. If an objection to the recommended amendment is stated in accordance with the terms of paragraph 3 or 4 of this Article, the amendment shall be deemed not to have been accepted and shall be of no effect. 6. If no objection to the recommended amendment in accordance with paragraph 3 or 4 of this Article has been stated, the amendment shall be deemed to have been accepted as from the date specified below: (
  24. a)if no Contracting Party has sent a communication in accordance with paragraph 3 (
  25. b)of this Article, on the expiry of the period of six months referred to in paragraph 3; (
  26. b)if any Contracting Party has sent a communication in accordance with paragraph 3 (
  27. b)of this Article, on the earlier of the following two dates: (
  28. i)the date by which all the Contracting Parties which sent such communications have notified the Secretary-General of the Council of their acceptance of the recommended amendment, provided that, if all the acceptances were notified before the expiry of the period of six months referred to in paragraph 3 of this Article, that date shall be taken to be the date of expiry of the said six-month period; (
  29. ii)the date of expiry of the nine-month period referred to in paragraph 4 of this Article. 7. Any amendment deemed to be accepted shall enter into force either six months after the date on which it was deemed to be accepted or, if a different period is specified in the recommended amendment, on the expiry of that period after the date on which the amendment was deemed to be accepted. 8. The Secretary-General of the Council shall, as soon as possible, notify the Contracting Parties to this convention and other signatory States of any objection to the recommended amendment made in accordance with paragraph 3 (a), and of any communication received in accordance with paragraph 3 (b), of this Article. He shall subsequently inform the Contracting Parties and other signatory States whether the Contracting Party or parties which have sent such a communication raise an objection to the recommended amendment or accept it. Article 16 1. Independently of the amendment procedure laid down in Article 15 of this convention any Annex, excluding its definitions, may be modified by a decision of the Council. Every Contracting Party to this convention shall be invited by the Secretary-General of the Council to participate in the discussion of any proposal for the amendment of an Annex. The text of any amendment so decided upon shall be communicated by the Secretary-General of the Council to the Contracting Parties to this convention, the other signatory States and those Member States of the Council that are not contracting parties to this convention. 2. Amendments decided upon under paragraph 1 of this Article shall enter into force six months after their communication by the Secretary-General of the Council. Each Contracting Party bound by an Annex forming the subject of such amendments shall be deemed to have accepted those amendments unless it enters a reservation under the procedure of Article 5 of this convention. Article 17 1. Any State ratifying or acceding to this convention shall be deemed to have accepted any amendments thereto which have entered into force at the date of deposit of its instrument of ratification or accession. 2. Any State which accepts an Annex shall be deemed, unless it enters reservations under Article 5 of this convention, to have accepted any amendments to that Annex which have entered into force at the date on which it notifies its acceptance to the Secretary-General of the Council. Article 18 The Secretary-General of the Council shall notify the Contracting Parties to this convention, the other signatory States, those Member States of the Council that are not Contracting Parties to this convention, and the Secretary-General of the United Nations of: (
  30. a)signatures, ratifications and accessions under Article 11 of this convention; (
  31. b)the date of entry into force of this convention and of each of the Annexes in accordance with Article 12; (
  32. c)notifications received in accordance with Articles 9 and 13; (
  33. d)notifications and communications received in accordance with Articles 5, 16 and 17; (
  34. e)denunciations under Article 14; (
  35. f)any amendment deemed to have been accepted in accordance with Article 15 and the date of its entry into force; (
  36. g)any amendment to the Annexes adopted by the Council in accordance with Article 16 and the date of its entry into force. Article 19 In accordance with Article 102 of the Charter of the United Nations, this convention shall be registered with the Secretariat of the United Nations at the request of the Secretary-General of the Council. In witness whereof the undersigned, being duly authorized thereto, have signed this convention. Done at Kyoto, this eighteenth day of May nineteen hundred and seventy-three, in the English and French languages, both texts being equally authentic, in a single original which shall be deposited with the Secretary-General of the Council who shall transmit certified copies to all the States referred to in paragraph 1 of Article 11 of this convention. ANNEX CONCERNING CUSTOMS WAREHOUSES INTRODUCTION It is in the nature of international trade practice that in a great many cases it is not known at the time of importation how imported goods will finally be disposed of. This means that the importers are obliged to store the goods for more or less long periods. Where it is intended to re-export the goods, it is in the importer's interest to place them under a customs procedure which obviates the need to pay import duties and taxes. When goods are intended for outright importation, it is again in the importer's interest to be able to delay payment of the import duties and taxes until the goods are actually taken into home use. In order to make these facilities available to importers, most countries have provided in their national legislations for the customs warehousing procedure. However, imported goods are not the only goods which may qualify for customs warehousing. For example, some countries allow goods that are liable to, or have borne, internal duties and taxes (whether of national origin or previously imported against payment of import duties and taxes) to be stored in customs warehouses in order that they may qualify for exemption from, or repayment of, such internal duties and taxes. Similarly, the deposit in a customs warehouse of goods that have previously been dealt with under another customs procedure or that may qualify, upon exportation, for repayment of import duties and taxes, makes it possible for the customs authorities to grant discharge of such other customs procedure or to repay the import duties and taxes, as the case may be, before the goods are actually re-exported. The provisions of this Annex do not apply to: - the storage of goods in temporary store (locked premises and enclosed or unenclosed spaces approved by the customs, in which goods may be stored pending clearance); - the storage of goods in free ports and free zones; - the processing or manufacturing, under customs supervision, of goods conditionally relieved from import duties and taxes in premises approved by the customs (inward processing warehouses). DEFINITIONS For the purposes of this Annex: (
  37. a)the term "customs warehousing procedure" means the customs procedure under which imported goods are stored under customs control in a designated place (a customs warehouse) without payment of import duties and taxes; (
  38. b)the term "import duties and taxes" means customs duties and all other duties, taxes, fees or other charges which are collected on or in connection with the importation of goods, but not including fees and charges which are limited in amount to the approximate cost of services rendered; (
  39. c)the term "customs control" means measures applied to ensure compliance with the laws and regulations which the customs are responsible for enforcing; (
  40. d)the term "security" means that which ensures, to the satisfaction of the customs, that an obligation to the customs will be fulfilled. Security is described as "general" when it ensures that the obligations arising from several operations will be fulfilled; (
  41. e)the term "person" means both natural and legal persons, unless the context otherwise requires. PRINCIPLE 1. Standard The customs warehousing procedure shall be governed by the provisions of this Annex. CLASSES OF WAREHOUSES 2. Standard National legislation shall provide for customs warehouses open to all importers (public customs warehouses). Note In accordance with the provisions of national legislation, public customs warehouses may be managed either by the customs authorities or by other authorities or by natural or legal persons. 3. Standard The right to store imported goods in public customs warehouses shall not be restricted only to importers but shall be extended to any other persons interested. 4. Standard National legislation shall provide for customs warehouses to be used solely by specified persons (private customs warehouses) when this is necessary to meet the special requirements of trade or industry. ESTABLISHMENT OF WAREHOUSES 5. Standard The requirements as regards the construction and layout of customs warehouses and the arrangements for customs control shall be laid down by the customs authorities. Note For the purpose of control, the customs authorities may, in particular: - require that customs warehouses be double-locked (secured by the lock of the person concerned and by the customs lock); - keep the premises under permanent or intermittent supervision; - keep, or require to be kept, accounts of goods warehoused (by using either special registers or the relevant declarations); - take stock of the goods in the warehouse from time to time. MANAGEMENT OF WAREHOUSES 6. Standard National legislation shall specify the person or persons held responsible for the payment of any import duties and taxes chargeable on goods placed under the customs warehousing procedure that are not accounted for to the satisfaction of the customs authorities. 7. Standard When security is required to ensure that the obligations arising from several operations will be fulfilled, the customs authorities shall accept a general security. 8. Recommended practice The amount of any security should be set as low as possible having regard to the import duties and taxes potentially chargeable. 9. Recommended practice The customs authorities should waive security where the warehouse is under adequate customs supervision, in particular where it is customs-locked. 10. Standard The customs authorities shall lay down the requirements as regards the management of customs warehouses, and arrangements for storage of goods in customs warehouses and for stock-keeping and accounting shall be subject to the approval of the customs authorities. GOODS ALLOWED TO BE WAREHOUSED 11. Recommended practice Storage in public customs warehouses should be allowed for all kinds of imported goods liable to import duties and taxes or to restrictions or prohibitions other than those imposed on grounds of public morality or order, public security, public hygiene or health, or for veterinary or phytopathological considerations, or relating to the protection of patents, trade marks and copyrights, irrespective of quantity, country of origin, country whence arrived or country of destination. Goods which constitute a hazard, which are likely to affect other goods or which require special installations should be accepted only by customs warehouses specially designed to receive them. 12. Standard The kinds of goods which may be stored in private customs warehouses shall be specified by the competent authorities in the authority granting the benefit of the customs warehousing procedure or in an appropriate provision. 13. Recommended practice Storage in customs warehouses should be allowed for goods which are entitled to repayment of import duties and taxes when exported, so that they may qualify for such repayment immediately, on condition that they are to be exported subsequently. 14. Recommended practice Storage in customs warehouses, with a view to subsequent exportation or other authorized disposal, should be allowed for goods under the temporary admission procedure, the obligations under that procedure thereby being discharged. 15. Recommended practice Storage in customs warehouses should be allowed for goods intended for exportation that are liable to, or have borne, internal duties or taxes, in order that they may qualify for exemption from, or repayment of, such internal duties and taxes, on condition that they are to be exported subsequently. ADMISSION INTO WAREHOUSES 16. Standard National legislation shall specify the conditions under which goods for warehousing shall be produced at the competent customs office and a goods declaration shall be lodged. AUTHORIZED OPERATIONS 17. Standard Any person entitled to dispose of the warehoused goods shall be allowed: (
  42. a)to inspect them; (
  43. b)to take samples, against payment of the import duties and taxes where appropriate; (
  44. c)to carry out operations necessary for their preservation. 18. Standard Warehoused goods shall be allowed to undergo usual forms of handling to improve their packaging or marketable quality or to prepare them for shipment, such as breaking bulk, grouping of packages, sorting and grading, and repacking. DURATION OF WAREHOUSING 19. Standard The authorized maximum duration of storage in a customs warehouse shall be fixed with due regard to the needs of trade and shall be not less than one year. TRANSFER OF OWNERSHIP 20. Standard The transfer of ownership of warehoused goods shall be allowed. DETERIORATION, LOSS OR DESTRUCTION OF GOODS 21. Standard Goods deteriorated or spoiled by accident or force majeure before leaving the warehouse shall be allowed to be cleared for home use as if they had been imported in their deteriorated or spoiled state. 22. Standard Warehoused goods destroyed or irrecoverably lost by accident or force majeure shall not be subjected to import duties and taxes, provided that such destruction or loss is duly established to the satisfaction of the customs authorities. Any waste or scrap remaining after destruction shall be liable, if taken into home use, to the import duties and taxes that would be applicable to such waste and scrap imported in that state. 23. Standard At the request of the person entitled to dispose of them, any warehoused goods shall be allowed to be abandoned, in whole or in part, to the Revenue or to be destroyed or rendered commercially valueless under customs control, as the customs authorities may decide. Such abandonment or destruction shall not entail any cost to the Revenue. Any waste or scrap remaining after destruction shall be liable, if taken into home use, to the import duties and taxes that would be applicable to such waste and scrap imported in that state. REMOVAL FROM WAREHOUSE 24. Standard Any person entitled to dispose of the goods shall be authorized to remove all or part of them from warehouse for re-exportation, home use, removal to another customs warehouse or assignment to any other customs procedure, subject to compliance with the conditions and formalities applicable in each case. GOODS TAKEN INTO HOME USE 25. Standard National legislation shall specify the point in time to be taken into consideration for the purpose of determining the value and quantity of goods removed from customs warehouse for home use and the rates of the import duties and taxes applicable to them. GOODS NOT REMOVED FROM WAREHOUSE 26. Standard National legislation shall specify the procedure to be followed where goods are not removed from customs warehouse within the period laid down. 27. Recommended practice When goods not removed from customs warehouse are sold by the customs, the proceeds of the sale, after deduction of the import duties and taxes and all other charges and expenses incurred, should either be made over to the person(
  45. s)entitled to receive them, when this is possible, or be held at their disposal for a specified period. INFORMATION CONCERNING WAREHOUSES 28. Standard The customs authorities shall ensure that all relevant information regarding the customs warehousing procedure is readily available to any person interested. ANNEXE CONVENTION INTERNATIONALE POUR LA SIMPLIFICATION ET L'HARMONISATION DES RÉGIMES DOUANIERS PRÉAMBULE Les PARTIES CONTRACTANTES š la prłsente convention, łlaborłe sous les auspices du Conseil de coopłration douaniųre, CONSTATANT que les disparitłs entre les rłgimes douaniers des pays sont de nature š entraver les łchanges internationaux, CONSIDÉRANT qu'il est dans l'intłrśt de tous les pays de favoriser ces łchanges et la coopłration internationale, CONSIDÉRANT que la simplification et l'harmonisation de leurs rłgimes douaniers peuvent contribuer de fa÷on efficace au dłveloppement du commerce international et d'autres formes d'łchanges internationaux, CONVAINCUES qu'un instrument international proposant des dispositions que les pays s'engagent š appliquer dųs qu'ils en ont la possibilitł permettrait d'aboutir progressivement š un haut degrł de simplification et d'harmonisation des rłgimes douaniers, ce qui constitue l'un des objectifs essentiels du Conseil de coopłration douaniųre, SONT CONVENUES DE CE QUI SUIT: CHAPITRE PREMIER Dłfinitions Article premier Pour l'application de la prłsente Convention on entend:
  46. a)par ėConseil» : l'organisation łtablie par la convention portant crłation d'un Conseil de coopłration douaniųre, conclue š Bruxelles, le 15 dłcembre 1950;
  47. b)par ėcomitł technique permanent» : le comitł technique permanent du Conseil;
  48. c)par ėratification» : la ratification proprement dite, l'acceptation ou l'approbation. CHAPITRE II Champ d'application de la convention et structure des annexes Article 2 Chaque partie contractante s'engage š promouvoir la simplification et l'harmonisation des rłgimes douaniers et, š cette fin, š se conformer, dans les conditions prłvues par la prłsente convention, aux normes et pratiques recommandłes faisant l'objet des annexes š la prłsente convention. Toutefois, il est loisible š toute partie contractante d'accorder des facilitłs plus grandes que celles que prłvoit la convention et il lui est recommandł d'accorder de telles facilitłs dans toute la mesure possible. Article 3 Les dispositions de la prłsente convention ne mettent pas obstacle š l'application des prohibitions et restrictions dłrivant de la lłgislation nationale. Article 4 Chaque annexe š la prłsente convention se compose en principe:
  49. a)d'une introduction qui constitue la synthųse des diffłrentes questions traitłes dans l'annexe;
  50. b)de dłfinitions des principaux termes douaniers qui sont utilisłs dans cette annexe;
  51. c)de normes, qui sont des dispositions dont l'application głnłrale est reconnue nłcessaire pour aboutir š l'harmonisation des rłgimes douaniers et š leur simplification;
  52. d)de pratiques recommandłes, qui sont des dispositions dont il est reconnu qu'elles constituent un progrųs vers l'harmonisation et la simplification des rłgimes douaniers et dont l'application aussi głnłrale que possible est jugłe souhaitable;
  53. e)de notes destinłes š indiquer certaines des possibilitłs qui peuvent śtre retenues pour l'application de la norme ou de la pratique recommandłe correspondante: Article 5 1. Chaque partie contractante qui accepte une annexe est rłputłe accepter toutes les normes et pratiques recommandłes figurant dans cette annexe, š moins qu'elle ne notifie au secrłtaire głnłral du Conseil, au moment de l'acceptation de ladite annexe ou ultłrieurement, la ou les normes et pratiques recommandłes pour lesquelles elle formule des rłserves en indiquant les diffłrences existant entre les dispositions de sa lłgislation nationale et celles des normes et des pratiques recommandłes en cause. Toute partie contractante ayant formulł des rłserves peut, š tout moment, les lever, en tout ou en partie, par notification au secrłtaire głnłral en indiquant la date š laquelle ces rłserves sont levłes. 2. Chaque partie contractante liłe par une annexe, examine, au moins tous les trois ans, les normes et pratiques recommandłes figurant dans cette annexe et au sujet desquelles elle a formulł des rłserves, les compare aux dispositions de sa lłgislation nationale et notifie au secrłtaire głnłral du Conseil les rłsultats de cet examen. CHAPITRE III RĮle du Conseil et du comitł technique permanent Article 6 1. Le Conseil veille, dans le cadre de la prłsente convention, š la gestion et au dłveloppement de celle-ci. Il dłcide, notamment, d'y incorporer de nouvelles annexes. 2. Ą ces fins, le comitł technique permanent exerce, sous l'autoritł du Conseil et selon ses directives, les fonctions suivantes:
  54. a)prłparer de nouvelles annexes et proposer auConseil leur adoption en vue de les incorporer š la convention;
  55. b)proposer au Conseil les projets d'amendement š la prłsente convention ou aux annexes qu'il estimera nłcessaires et, notamment, les projets tendant š amender le texte des normes et pratiques recommandłes ou š transformer des pratiques recommandłes en normes;
  56. c)fournir des avis sur toutes les questions concernant l'application de la convention;
  57. d)accomplir les tņches que le Conseil pourrait lui assigner en ce qui concerne les dispositions de la convention. Article 7 Aux fins du vote au sein du Conseil et du comitł technique permanent, chaque annexe est considłrłe comme constituant une convention distincte. CHAPITRE IV Dispositions diverses Article 8 Pour l'application de la prłsente convention, l'annexe ou les annexes en vigueur š l'łgard d'une partie contractante font partie intłgrante de la convention; en ce qui concerne cette partie contractante, toute rłfłrence š la convention s'applique donc łgalement š cette annexe ou š ces annexes. Article 9 Les parties contractantes qui forment une union douaniųre ou łconomique peuvent notifier au secrłtaire głnłral du Conseil que, pour l'application d'une annexe dłterminłe š la prłsente convention, leurs territoires sont š considłrer comme un seul territoire. Dans tous les cas oų, š la suite d'une telle notification, des divergences existent entre les dispositions de cette annexe et celles de la lłgislation applicable sur les territoires des parties contractantes, les États intłressłs formulent, en application de l'article 5 de la prłsente convention, une rłserve š l'łgard de la norme ou de la pratique recommandłe en cause. CHAPITRE V Dispositions finales Article 10 1. Tout diffłrend entre deux ou plusieurs parties contractantes en ce qui concerne l'interprłtation ou l'application de la prłsente convention est rłglł, autant que possible, par voie de nłgociations directes entre lesdites parties. 2. Tout diffłrend qui n'est pas rłglł par voie de nłgociations directes est portł par les parties au diffłrend devant le comitł technique permanent qui l'examine et fait des recommandations en vue de son rųglement. 3. Si le comitł technique permanent ne peut rłgler le diffłrend, il le porte devant le Conseil qui fait des recommandations conformłment š l'article III sous
  58. e)de la convention portant crłation du Conseil. 4. Les parties au diffłrend peuvent convenir d'avance d'accepter les recommandations du comitł technique permanent ou du Conseil. Article 11 1. Tout État membre du Conseil et tout État membre de l'Organisation des Nations unies ou de ses institutions spłcialisłes peut devenir partie contractante š la prłsente convention:
  59. a)en la signant, sans rłserve de ratification;
  60. b)en dłposant un instrument de ratification aprųs l'avoir signłe sous rłserve de ratification; ou
  61. c)en y adhłrant. 2. La prłsente convention est ouverte jusqu'au 30 juin 1974 au siųge du Conseil, š Bruxelles, š la signature des États visłs au paragraphe 1 du prłsent article. Aprųs cette date, elle sera ouverte š leur adhłsion. 3. Tout État non membre des organisations visłes au paragraphe 1 du prłsent article, auquel une invitation est adressłe š cet effet par le secrłtaire głnłral du Conseil, sur la demande du Conseil, peut devenir partie contractante š la prłsente convention en y adhłrant aprųs son entrłe en vigueur. 4. Chacun des États visłs aux paragraphes 1 ou 3 du prłsent article spłcifie, au moment de signer ou de ratifier la prłsente convention ou d'y adhłrer, l'annexe ou les annexes qu'il accepte, łtant entendu qu'il doit accepter au moins une annexe. Il peut ultłrieurement notifier au secrłtaire głnłral du Conseil qu'il accepte une ou plusieurs autres annexes. 5. Les instruments de ratification ou d'adhłsion sont dłposłs auprųs du secrłtaire głnłral du Conseil. 6. Toute nouvelle annexe que le Conseil dłcide d'incorporer š la prłsente convention est communiqułe par le secrłtaire głnłral du Conseil aux parties contractantes š la prłsente convention, aux autres États signataires, aux États membres du Conseil qui ne sont pas parties contractantes š la prłsente convention et au secrłtaire głnłral de l'Organisation des Nations unies. Les parties contractantes qui acceptent cette nouvelle annexe le notifient au secrłtaire głnłral du Conseil, conformłment au paragraphe 4 du prłsent article. 7. Les dispositions du paragraphe 1 du prłsent article sont łgalement applicables aux unions douaniųres et łconomiques visłes š l'article 9 de la prłsente convention, dans la mesure oų les obligations dłcoulant des instruments instituant ces unions douaniųres ou łconomiques imposent š leurs organes compłtents de stipuler en leur propre nom. Ces organes ne disposent toutefois pas du droit de vote. Article 12 1. La prłsente convention entre en vigueur trois mois aprųs que cinq des États mentionnłs au paragraphe 1 de l'article 11 ci-dessus ont signł la prłsente convention sans rłserve de ratification ou ont dłposł leur instrument de ratification ou d'adhłsion. 2. Ą l'łgard de tout État qui signe la prłsente convention sans rłserve de ratification, qui la ratifie ou y adhųre, aprųs que cinq États ont, soit signł la convention sans rłserve de ratification, soit dłposł leur instrument de ratification ou d'adhłsion, la convention entre en vigueur trois mois aprųs que ledit État a signł sans rłserve de ratification ou dłposł son instrument de ratification ou d'adhłsion. 3. Toute annexe š la prłsente convention entre en vigueur trois mois aprųs que cinq parties contractantes ont acceptł ladite annexe. 4. Ą l'łgard de tout État qui accepte une annexe aprųs que cinq État l'ont acceptłe, ladite annexe entre en vigueur trois mois aprųs que cet État a notifł son acceptation. Article 13 1. Tout État peut, soit au moment de la signature sans rłserve de ratification, de la ratification ou de l'adhłsion, soit ultłrieurement, notifier au secrłtaire głnłral du Conseil que la prłsente convention s'łtend š l'ensemble ou š certains des territoires dont les relations internationales sont placłes sous sa responsabilitł. Cette notification prend effet trois mois aprųs la date š laquelle le secrłtaire głnłral la re÷oit. Toutefois, la convention ne peut devenir applicable aux territoires dłsignłs dans la notification avant qu'elle ne soit entrłe en vigueur š l'łgard de l'État intłressł. 2. Tout État ayant, en application du paragraphe 1 du prłsent article, notifił que la prłsente Convention s'łtend š un territoire dont les relations internationales sont placłes sous sa responsabilitł, peut notifier au secrłtaire głnłral du Conseil, dans les conditions prłvues š l'article 14 de la prłsente convention, que ce territoire cessera d'appliquer la convention. Article 14 1. La prłsente convention est conclue pour une durłe illimitłe. Toutefois, toute partie contractante peut la dłnoncer š tout moment aprųs la date de son entrłe en vigueur, telle qu'elle est fixłe š l'article 12 de la prłsente convention. 2. La dłnonciation est notifiłe par un instrument łcrit dłposł auprųs du secrłtaire głnłral du Conseil. 3. La dłnonciation prend effet six mois aprųs la rłception de l'instrument de dłnonciation par le secrłtaire głnłral du Conseil. 4. Les dispositions des paragraphes 2 et 3 du prłsent article sont łgalement applicables en ce qui concerne les annexes š la convention, toute partie contractante pouvant, š tout moment aprųs la date de leur entrłe en vigueur, telle qu'elle est fixłe š l'article 12, retirer son acceptation d'une ou de plusieurs annexes. La partie contractante qui retire son acceptation de toutes les annexes est rłputłe avoir dłnoncł la Convention. Article 15 1. Le Conseil peut recommander des amendements š la prłsente convention. Toute partie contractante š la prłsente convention est invitłe, par le secrłtaire głnłral du Conseil, š prendre part š la discussion sur toute proposition tendant š amender la prłsente convention. 2. Le texte de tout amendement ainsi recommandł est communiquł par le secrłtaire głnłral du Conseil aux parties contractantes š la prłsente Convention, aux autres États signataires et aux États membres du Conseil qui ne sont pas parties contractantes š la prłsente Convention. 3. Dans un dłlai de six mois, š compter de la date de la communication de l'amendement recommandł, toute partie contractante ou, s'il s'agit d'un amendement concernant une annexe en vigueur, toute partie contractante liłe par cette annexe, peut faire connažtre au secrłtaire głnłral du Conseil:
  62. a)soit qu'elle a une objection š l'amendement recommandł;
  63. b)soit que, bien qu'elle ait l'intention d'accepter l'amendement recommandł, les conditions nłcessaires š cette acceptation ne se trouvent pas encore remplies dans son pays. 4. Aussi longtemps qu'une partie contractante qui a adressł la communication prłvue au paragraphe 3 sous
  64. b)du prłsent article n'a pas notifił son acceptation au secrłtaire głnłral du Conseil elle peut, pendant un dłlai de neuf mois š partir de l'expiration du dłlai de six mois prłvu au paragraphe 3 du prłsent article, prłsenter une objection š l'amendement recommandł. 5. Si une objection š l'amendement recommandł est formulłe dans les conditions prłvues aux paragraphes 3 et 4 du prłsent article, l'amendement est considłrł comme n'ayant pas łtł acceptł et reste sans effet. 6. Si aucune objection š l'amendement recommandł n'a łtł formulłe dans les conditions prłvues aux paragraphes 3 et 4 du prłsent article, l'amendement est rłputł acceptł š la date suivante:
  65. a)lorsque aucune partie contractante n'a adressł de communication en application du paragraphe 3 sous
  66. b)du prłsent article, š l'expiration du dłlai de six mois visł š ce paragraphe 3;
  67. b)lorsqu'une ou plusieurs parties contractantes ont adressł une communication en application du paragraphe 3 sous
  68. b)du prłsent article, š la plus rapprochłe des deux dates suivantes: - date š laquelle toutes les parties contractantes ayant adressł une telle communication ont notifił au secrłtaire głnłral du Conseil leur acceptation de l'amendement recommandł, cette date łtant toutefois reportłe š l'expiration du dłlai de six mois visł au paragraphe 3 du prłsent article si toutes les acceptations ont łtł notifiłes antłrieurement š cette expiration; - date d'expiration du dłlai de neuf mois visł au paragraphe 4 du prłsent article. 7. Tout amendement rłputł acceptł entre en vigueur soit six mois aprųs la date š laquelle il a łtł rłputł acceptł soit, lorsque l'amendement recommandł est assorti d'un dłlai d'entrłe en vigueur diffłrent, š l'expiration de ce dłlai suivant la date š laquelle il a łtł rłputł acceptł. 8. Le secrłtaire głnłral du Conseil notifie, le plus tĮt possible, aux parties contractantes š la prłsente convention et aux autres États signataires, toute objection š l'amendement recommandł formulłe conformłment au paragraphe 3 sous
  69. a)du prłsent article, ainsi que toute communication adressłe conformłment au paragraphe 3 sous b). Il fait savoir ultłrieurement aux parties contractantes et aux autres États signataires si la ou les parties contractantes qui ont adressł une telle communication łlųvent une objection contre l'amendement recommandł ou l'acceptent. Article 16 1. Indłpendamment de la procłdure d'amendement prłvue š l'article 15 de la prłsente convention, toute annexe peut, š l'exclusion des dłfinitions qu'elle contient, śtre modifiłe par dłcision du Conseil. Toute partie contractante š la prłsente convention est invitłe, par le secrłtaire głnłral du Conseil, š prendre part š la discussion sur toute proposition tendant š amender une annexe. Le texte de tout amendement ainsi dłcidł est communiquł par le secrłtaire głnłral du Conseil aux parties contractantes š la prłsente convention, aux autres États signataires et aux États membres du Conseil qui ne sont pas parties contractantes š la prłsente convention. 2. Les amendements qui ont fait l'objet d'une dłcision en application du paragraphe 1 du prłsent article entrent en vigueur six mois aprųs que communication en a łtł faite par le secrłtaire głnłral du Conseil. Chaque partie contractante liłe par l'annexe qui fait l'objet de tels amendements est rłputłe avoir acceptł ces amendements sauf si elle formule des rłserves dans les conditions prłvues š l'article 5 de la prłsente convention. Article 17 1. Tout État qui ratifie la prłsente convention ou y adhųre est rłputł avoir acceptł les amendements entrłs en vigueur š la date du dłpĮt de son instrument de ratification ou d'adhłsion. 2. Un État qui accepte une annexe est rłputł, sauf s'il formule des rłserves conformłment aux dispositions de l'article 5 de la prłsente convention, avoir acceptł les amendements š cette annexe entrłs en vigueur š la date š laquelle il notifie son acceptation au secrłtaire głnłral du Conseil. Article 18 Le secrłtaire głnłral du Conseil notifie aux parties contractantes š la prłsente convention, aux autres États signataires, aux États membres du Conseil qui ne sont pas parties contractantes š la prłsente convention et au secrłtaire głnłral de l'Organisation des Nations unies:
  70. a)les signatures, ratifications et adhłsions visłes š l'article 11 de la prłsente convention;
  71. b)la date š laquelle la prłsente convention et chacune de ses annexes entrent en vigueur conformłment š l'article 12;
  72. c)les notifications re÷ues conformłment aux articles 9 et 13;
  73. d)les notifications et communications re÷ues conformłment aux articles 5, 16 et 17;
  74. e)les dłnonciations re÷ues conformłment š l'article 14;
  75. f)les amendements rłputłs acceptłs conformłment š l'article 15 ainsi que la date de leur entrłe en vigueur;
  76. g)les amendements aux annexes adoptłs par le Conseil conformłment š l'article 16, ainsi que la date de leur entrłe en vigueur. Article 19 Conformłment š l'article 102 de la Charte des Nations unies, la prłsente convention sera enregistrłe au secrłtariat des Nations unies š la requśte du secrłtaire głnłral du Conseil. En foi de quoi les soussignłs š ce dūment autorisłs ont signł la prłsente convention. Fait š Kyoto, le dix-huit mai mil neuf cent soixante-treize, en langues fran÷aise et anglaise, les deux textes faisant łgalement foi, en un seul exemplaire qui sera dłposł auprųs du secrłtaire głnłral du Conseil qui en transmettra des copies certifiłes conformes š tous les États visłs au paragraphe 1 de l'article 11 de la prłsente convention. ANNEXE CONCERNANT LES ENTREPŌTS DE DOUANE INTRODUCTION En raison des pratiques du commerce international, la destination finale des marchandises importłes n'est pas connue au moment de l'importation dans un nombre łlevł de cas, ce qui oblige les importateurs š les stocker pendant des dłlais plus ou moins longs. S'il s'agit de marchandises destinłes š śtre rłexportłes, l'importateur a intłrśt š les placer sous un rłgime douanier qui permet d'łviter le paiement des droits et taxes š l'importation. Quant aux marchandises qui sont destinłes š l'importation dłfinitive, il est łgalement de l'intłrśt de l'importateur de pouvoir retarder le paiement des droits et taxes š l'importation jusqu'au moment oų ces marchandises seront effectivement mises š la consommation. Pour accorder ces facilitłs aux importateurs, les États ont głnłralement prłvu le rłgime de l'entrepĮt de douane dans leur lłgislation nationale. Les marchandises importłes ne sont cependant pas les seules qui soient admissibles en entrepĮt de douane. C'est ainsi que certains États permettent que les marchandises d'origine nationale ou nationalisłes, qui sont passibles de droits ou de taxes internes, ou qui les ont supportłs, soient mises en entrepĮt de douane afin d'obtenir l'exonłration ou le remboursement de ces droits et taxes. De mśme, la mise en entrepĮt de douane de marchandises auxquelles a dłjš łtł appliquł un autre rłgime douanier ou qui sont susceptibles de błnłficier, lors de leur exportation, d'un remboursement des droits et taxes š l'importation, permet aux autoritłs douaniųres d'accorder, selon le cas, l'apurement de cet autre rłgime douanier ou le remboursement des droits et taxes š l'importation, sans attendre la rłexportation effective des marchandises. Les dispositions de la prłsente annexe ne s'appliquent pas: - au stockage des marchandises en dłpĮt temporaire (locaux fermłs et emplacements, clĮturłs ou non, agrłłs par la douane, oų les marchandises sont stockłes en attendant leur dłdouanement); - au stockage des marchandises dans des ports francs et des zones franches; - š l'ouvraison ou š la transformation, sous contrĮle de la douane, en suspension des droits et taxes š l'importation, de marchandises dans des endroits agrłłs par elle (entrepĮts pour perfectionnement actif). DÉFINITIONS Pour l'application de la prłsente annexe, on entend:
  77. a)par ėrłgime de l'entrepĮt de douane» : le rłgime douanier en application duquel les marchandises importłes sont stockłes sous contrĮle de la douane dans un lieu dłsignł š cet effet (entrepĮt de douane) sans paiement des droits et taxes š l'importation;
  78. b)par ėdroits et taxes š l'importation» : les droits de douane et tous autres droits, taxes et redevances ou impositions diverses qui sont per÷us š l'importation ou š l'occasion de l'importation des marchandises, š l'exception des redevances et impositions dont le montant est limitł au coūt approximatif des services rendus;
  79. c)par ėcontrĮle de la douane» : l'ensemble des mesures prises en vue d'assurer l'observation des lois et rųglements que la douane est chargłe d'appliquer;
  80. d)par ėgarantie» : ce qui assure, š la satisfaction de la douane, l'exłcution d'une obligation envers celle-ci. La garantie est dite ėglobale» lorsqu'elle assure l'exłcution des obligations rłsultant de plusieurs opłrations;
  81. e)par ėpersonne» : aussi bien une personne physique qu'une personne morale, š moins que le contexte n'en dispose autrement. PRINCIPE 1. Norme Le rłgime de l'entrepĮt de douane est rłgi par les dispositions de la prłsente annexe. CATÉGORIES D'ENTREPOTS 2. Norme La lłgislation nationale prłvoit des entrepĮts de douane ouverts š tous les importateurs (entrepĮts de douane publics). Note Selon les dispositions de la lłgislation nationale, les entrepĮts de douane publics peuvent śtre głrłs soit par les autoritłs douaniųres, soit par d'autres autoritłs ou par des personnes physiques ou morales. 3. Norme Le droit d'entreposer des marchandises importłes dans les entrepĮts de douane publics n'est pas rłservł seulement š l'importateur, mais est reconnu š toute autre personne intłressłe. 4. Norme La lłgislation nationale prłvoit des entrepĮts de douane rłservłs š l'usage exclusif de certaines personnes dłterminłes (entrepĮts de douane privłs) lorsque les nłcessitłs particuliųres du commerce ou de l'industrie le justifient. ÉTABLISSEMENT DES ENTREPŌTS 5. Norme Les exigences relatives š la construction et š l'amłnagement des entrepĮts de douane ainsi que les conditions dans lesquelles s'exerce le contrĮle de la douane sont fixłes par les autoritłs douaniųres. Note Pour exercer leur contrĮle, les autoritłs douaniųres peuvent notamment: - exiger que les entrepĮts de douane soient fermłs š deux clłs diffłrentes (celle de l'intłressł et celle de la douane); - surveiller les lieux de fa÷on permanente ou intermittente; - tenir une comptabilitł des marchandises entreposłes en utilisant soit des registres spłciaux, soit les dłclarations elles-mśmes, ou exiger la tenue d'une telle comptabilitł, et - procłder płriodiquement au recensement des marchandises entreposłes. GESTION DES ENTREPŌTS 6. Norme La lłgislation nationale dłsigne la ou les personnes tenue(

  83. s)de l'acquittement des droits et taxes š l'importation łventuellement applicables aux marchandises qui ont łtł placłes sous le rłgime de l'entrepĮt de douane et dont la situation n'a pas łtł rłgularisłe š la satisfaction des autoritłs douaniųres. 7. Norme Lorsqu'une garantie est exigłe pour assurer l'exłcution des obligations rłsultant de plusieurs opłrations, les autoritłs douaniųres acceptent une garantie globale. 8. Pratique recommandłe La garantie devrait śtre fixłe š un montant aussi peu łlevł que possible, compte tenu des droits et taxes š l'importation łventuellement exigibles. 9. Pratique recommandłe Les autoritłs douaniųres devraient renoncer š exiger une garantie lorsque l'entrepĮt fait l'objet d'une surveillance appropriłe de la douane, et notamment s'il est placł sous fermeture douaniųre. 10. MARCHANDISES POUVANT ŹTRE ENTREPOSEES 11. Pratique recommandłe Devraient śtre admises dans les entrepĮts de douane publics, les marchandises importłes de toute espųce, passibles de droits et taxes š l'importation ou soumises š des restrictions ou prohibitions autres que celles fondłes sur des considłrations de moralitł ou d'ordre publics, de słcuritł publique, d'hygiųne ou de santł publiques ou sur des considłrations d'ordre vłtłrinaire ou phytopathologique, ou se rapportant š la protection des brevets, marques de fabrique et droits d'auteur et de reproduction, quels que soient leur quantitł ou leur pays d'origine, de provenance ou de destination. Les marchandises qui prłsentent un danger ou sont susceptibles d'altłrer les autres marchandises ou exigent des installations particuliųres, ne devraient śtre admises que dans des entrepĮts de douane spłcialement amłnagłs pour les recevoir. 12. Norme Les catłgories des marchandises admissibles en entrepĮt de douane privł sont dłsignłes par les autoritłs compłtentes dans l'autorisation accordant le błnłfice de ce rłgime ou dans une disposition appropriłe. 13. Pratique recommandłe Les marchandises qui, du fait de leur exportation, błnłficient du remboursement des droits et taxes š l'importation, devraient pouvoir śtre stockłes en entrepĮt de douane en vue de błnłficier immłdiatement de ce remboursement, š condition qu'elles soient destinłes š śtre exportłes ultłrieurement. 14. Pratique recommandłe Les marchandises qui ont łtł placłes sous le rłgime de l'admission temporaire devraient pouvoir śtre mises en entrepĮt de douane, en apurement de ce rłgime, en vue de leur exportation ultłrieure ou de toute autre destination admise. 15. Pratique recommandłe Lorsqu'elles sont destinłes š l'exportation, les marchandises qui sont passibles de droits ou de taxes internes ou qui les ont supportłs, devraient pouvoir śtre mises en entrepĮt de douane afin d'obtenir l'exonłration ou le remboursement de ces droits et taxes internes, š condition que ces marchandises soient destinłes š śtre exportłes ultłrieurement. MISE EN ENTREPŌT 16. Norme La lłgislation nationale dłtermine les conditions dans lesquelles les marchandises qui sont destinłes š śtre placłes en entrepĮt de douane doivent śtre prłsentłes au bureau de douane compłtent et faire l'objet d'une dłclaration de marchandises. OPÉRATIONS AUTORISÉES 17. Norme Toute personne ayant le droit de disposer des marchandises entreposłes est autorisłe:

  85. b)š en prłlever des łchantillons moyennant paiement, le cas łchłant, des droits et taxes š l'importation,
  86. c)š effectuer les opłrations nłcessaires pour en assurer la conservation. 18. Norme Les marchandises entreposłes doivent pouvoir faire l'objet de manipulations usuelles destinłes š amłliorer leur prłsentation ou leur qualitł marchande ou š les conditionner pour le transport, telles que la division ou la rłunion de colis, l'assortiment et le classement des marchandises, le changement d'emballage. DURÉE D'ENTREPOSAGE 19. Norme La durłe maximale d'entreposage est fixłe en fonction des besoins du commerce et ne doit pas śtre infłrieure š un an. CESSIONS 20. Norme Les marchandises entreposłes doivent pouvoir faire l'objet de cessions. MARCHANDISES AVARIÉES, PERDUES OU DÉTRUITES 21. Norme Les marchandises avariłes par suite d'accident ou de force majeure avant leur sortie d'entrepĮt doivent pouvoir śtre dłclarłes pour la mise š la consommation comme si elles avaient łtł importłes dans l'łtat oų elles se trouvent. 22. Norme Les marchandises entreposłes qui sont dłtruites ou irrłmłdiablement perdues, par suite d'accident ou de force majeure, ne sont pas soumises aux droits et taxes š l'importation, š condition que cette destruction ou cette perte soit dūment łtablie š la satisfaction des autoritłs douaniųres. Les dłchets et dłbris rłsultant, le cas łchłant, de la destruction, sont assujettis, en cas de mise š la consommation, aux droits et taxes š l'importation qui seraient applicables š ces dłchets et dłbris s'ils łtaient importłs dans cet łtat. 23. Norme Toute marchandise entreposłe doit pouvoir, sur demande de la personne qui a le droit d'en disposer et selon la dłcision des autoritłs douaniųres, śtre abandonnłe, en tout ou en partie, au profit du Trłsor public ou dłtruite ou traitłe de maniųre š lui Įter toute valeur commerciale, sous contrĮle de la douane. Cet abandon ou cette destruction ne doit entražner aucuns frais pour le Trłsor public. Les dłchets et dłbris rłsultant, le cas łchłant, de la destruction, sont assujettis, en cas de mise š la consommation, aux droits et taxes š l'importation qui seraient applicables š ces dłchets et dłbris s'ils łtaient importłs dans cet łtat. SORTIE DE L'ENTREPŌT 24. Norme Toute personne ayant le droit de disposer des marchandises est autorisłe š les retirer de l'entrepĮt de douane en tout ou en partie, pour les rłexporter, les mettre š la consommation, les transfłrer dans un autre entrepĮt de douane ou leur assigner tout autre rłgime douanier, sous rłserve qu'il soit satisfait aux conditions et formalitłs applicables dans chacun de ces cas. MARCHANDISES VERSÉES Ą LA CONSOMMATION 25. Norme La lłgislation nationale fixe le moment š prendre en considłration pour dłterminer la valeur et la quantitł des marchandises qui sont retirłes de l'entrepĮt de douane pour śtre versłes š la consommation ainsi que les taux des droits et taxes š l'importation qui leur sont applicables. MARCHANDISES NON RETIRÉES DE L'ENTREPŌT 26. Norme La lłgislation nationale fixe la procłdure š suivre dans les cas oų les marchandises ne sont pas retirłes de l'entrepĮt de douane dans le dłlai prescrit. 27. Pratique recommandłe Lorsque les marchandises non retirłes de l'entrepĮt de douane sont vendues par la douane, le produit de la vente, dłduction faite des droits et taxes š l'importation ainsi que de tous autres frais ou redevances encourus, devrait śtre soit remis š l'ayant droit lorsque cela est possible, soit tenu š la disposition de celui-ci pendant un dłlai dłterminł.
