Official translation REPUBLIC OF LITHUANIA LAW on the decommissioning of unit 1 of the state enterprise ignalina NUCLEAR power plant 2 May 2000, No. VIII-1661 Vilnius (As amended by 22 June 2000, No. VIII-1747) PREAMBLE The closure of the Ignalina Nuclear Power Plant is not only a problem for Lithuania alone but it is also an international issue. The Law shall be passed on the basis of the National Energy Strategy. CHAPTER ONE GENERAL PROVISIONS Article

  1. Purpose of the Law This Law shall establish legal grounds for the decommissioning of Unit 1 of the State Enterprise Ignalina Nuclear Power Plant (hereinafter referred to as the Ignalina NPP). Article
  2. Main Definitions of this Law
  3. “The Decommissioning Programme for Unit 1 of the Ignalina NPP” (hereinafter referred to as “the Decommissioning Programme”) means the totality of legal, organisational, financial and technical measures to put in order Unit 1, upon taking a decision that it will never be operated again. This Programme shall also cover the measures intended to prepare for the decommissioning of Unit 1 and solve environmental, social and economic problems related thereto.
  4. “The Decommissioning Plan for Unit 1 of the Ignalina NPP” (hereinafter referred to as “the Decommissioning Plan) means the document specifying actions pertaining to the end of operation, time limits of the performance thereof, decommissioning strategy, decommissioning-related expenses and sources of financing.
  5. “Final shut-down of Unit 1 of the Ignalina NPP” (hereinafter referred to as “the final shut-down”) means the end of operation of Unit 1 of the Ignalina NPP.
  6. “International financial assistance” means considerable and long-term support of the European Union, the G7 group, other countries and international financial institutions.
  7. “Dismissed employees” means employees dismissed due to the decommissioning of Unit 1 of the Ignalina NPP. CHAPTER TWO DECOMMISSIONING PROCEDURE Article
  8. Terms and Conditions of Decommissioning
  9. Preparation for decommissioning of Unit 1 of the Ignalina NPP must be carried out before 1 January
  10. The exact date of final shut-down of Unit 1 of the Ignalina NPP shall be set by the Government of the Republic of Lithuania taking into consideration the implementation of the Decommissioning Programme and the Decommissioning Plan and possibilities of further financing of this Programme from the sources of financial assistance of the Republic of Lithuania as well as international financial assistance. Article
  11. Planning of Decommissioning
  12. The Government of the Republic of Lithuania shall prepare and, by 1 November 2000, approve the Decommissioning Programme for Unit 1 of the Ignalina NPP.
  13. The Programme must lay down legal, organisational, financial and technical measures for the final shut-down of Unit 1, termination of operation of the equipment, dismantling, conservation, radioactive waste management, disposal, ensuring operational safety with only one Unit in operation, as well as measures for the mitigation of negative economic, social and possible health-related consequences relating to the early closure of Unit 1 of the Ignalina NPP and dismissal of employees.
  14. On the basis of the Decommissioning Programme, the operator – Ignalina NPP shall draw up a final decommissioning plan, preparatory works plans, projects pertaining to the stages and decommissioning of facilities. Projects shall be drafted on the basis of the Law of the Republic of Lithuania on Construction, the Law of the Republic of Lithuania on Nuclear Energy and other legal acts. Article
  15. Financing of the Decommissioning Programme
  16. Decommissioning of Unit 1 of the Ignalina NPP shall be financed from the Ignalina NPP Decommissioning Fund, international financial assistance funds, bank loans and other sources of financing defined in laws of the Republic of Lithuania.
  17. The Government of the Republic of Lithuania or an institution authorised by it shall establish sources and procedure for financing the stages of particular works of decommissioning of Unit 1 and projects pertaining to the decommissioning of facilities.
  18. The Government of the Republic of Lithuania shall, pursuant to the provisions of this Law, negotiate with providers of international financial assistance for support for the decommissioning of Unit 1 of the Ignalina NPP and, each year before 31 May, present to the Seimas information related to the received support and the decommissioning process of Unit 1 of the Ignalina NPP.
  19. The Government of the Republic of Lithuania shall ensure financing of control and supervision of Unit 1 of the Ignalina NPP after its final shut-down.
  20. The Government of the Republic of Lithuania shall ensure continuous financing of all stages of the decommissioning of Unit 1 of the Ignalina NPP. It shall be prohibited to commence implementing the decommissioning of Unit 1 of the Ignalina NPP or the projects concerning the decommissioning of facilities, which would irreversibly terminate operational process of Unit 1 or exert negative influence on the conditions of ensuring nuclear safety until financing of all works pertaining to the stage or decommissioning of the facility is not safeguarded.
  21. Depreciation expenses of Unit 1 of the Ignalina NPP shall be terminated upon the final shut-down thereof.
  22. Procedure of accumulation and use of the resources of the Ignalina NPP Decommissioning Fund shall be determined by the law concerning administration of such Fund. Article
  23. Social Guarantees for Dismissed Employees Social guarantees for the dismissed employees shall be defined in a separate law. Article
  24. Investment Projects Consequences of the decommissioning of Unit 1 must be envisaged in every newly drafted project pertaining to the Ignalina NPP investments, including radioactive waste storage and repositories. Article
  25. Licensing Licences for decommissioning stages and projects related to the decommissioning of facilities shall be issued in accordance with the procedure established by the Government of the Republic of Lithuania. Article
  26. Responsibility for Nuclear Safety The operator – Ignalina NPP shall, following the procedure prescribed by law, be responsible for proper and safe operation of Unit 1 of the Ignalina NPP, its maintenance and, upon taking a decision that it will no longer be operated, its dismantling and radioactive waste management, as well as for nuclear damage done to natural and legal persons, their property, the environment and health of the population. Article
  27. Final Provisions
  28. The Government of the Republic of Lithuania shall, within a month from the entry into force of this Law, prepare and submit to the Seimas a draft law on the Decommissioning Fund of Unit 1 of the Ignalina NPP.
  29. The Government of the Republic of Lithuania, pursuant to the Decommissioning Programme for Unit 1 of the Ignalina NPP, shall, prior to 31 March 2002, approve a final decommissioning plan for Unit 1 of the Ignalina NPP, prepare its economic-financial grounding and provide for cash flows.
