  1. Purpose of the Law This Law shall regulate the levying of consular fees for consular services provided abroad by the Consular Department of the Ministry of Foreign Affairs of the Republic of Lithuania, diplomatic missions and consular posts of the Republic of Lithuania as well as for the performance of notarial acts and the issue of documents having legal power. Consular fees shall be charged on the basis of treaties concluded by the Republic of Lithuania with other countries, this Law and the Law on the Notary Office of the Republic of Lithuania. This Law has the objective of ensuring the application of EU legal acts listed in the Annex hereto. Article
  2. Payers of Consular Fees Consular fees shall be paid by foreign legal persons and legal persons of the Republic of Lithuania (except for the Bank of Lithuania), foreign citizens and citizens of the Republic of Lithuania as well as persons without citizenship for consular services provided to such persons abroad by the Consular Department of the Ministry of Foreign Affairs of the Republic of Lithuania, diplomatic missions and consular posts of the Republic of Lithuania as well as for the performance of notarial acts and the issue of documents having legal power. Article
  3. Object of Charging Consular Fees Consular fees shall be charged for: 1) the issue of passports; 2) the execution of acts of civil status and the issue of documents; 3) the issue of visas or the acceptance and examination of visa application documents where a visa has been refused (hereinafter referred to as the “issue of visas”); 4) the execution and issue of documents of citizenship; 5) requesting documents from the institutions of the Republic of Lithuania and legalisation of documents; 6) the performance of notarial acts and provision of consular services in respect of guardianship, trusteeship, right of succession and other property issues; 7) the extension of validity of travel documents to persons without citizenship; 8) other consular services stipulated in international treaties, the laws of the Republic of Lithuania and the resolutions of the Government of the Republic of Lithuania. Article
  4. Consular Fee Rates Consular fee rates shall be fixed by the Government of the Republic of Lithuania. Article
  5. Adjustment of Consular Fees on Parity Basis The Government of the Republic of Lithuania shall have the right, on a parity basis, to increase, reduce or abolish consular fees charged in respect of foreign natural and legal persons for visas as well as for requesting and legalising documents, taking into account the fees charged by the relevant foreign countries in respect of natural and legal persons of the Republic of Lithuania. Article
  6. Exemptions Consular fees shall not be charged for: 1) the issue and execution of diplomatic passports of the Republic of Lithuania; 2) the issue of visas to foreigners holding diplomatic and service passports or equivalent travel documents; 3) the issue of visas to foreigners arriving to the Republic of Lithuania to participate in official meetings organised by the President of the Republic, the Seimas, the Government, ministries and other state institutions as well as to provide charity and organised aid to Lithuania, to foreigners on a Red Cross mission and to representatives of international organisations in which the Republic of Lithuania holds membership; 4) the issue of visas to family members of European Union citizens or family members of the citizens of a state participating in the Agreement on the European Economic Area; 5) the issue of visas to children under 16 years of age; 6) the issue of visas to foreigners travelling once a year to visit the graves of their family members in the territory of the Republic of Lithuania on production of an officially certified document; 7) the issue of visas to foreigners travelling to visit a seriously ill family member or a close relative on production of an officially certified document; 8) the issue of visas to seriously ill foreigners or foreigners in need of emergency medical aid on production of documents issued by the relevant organisation and attesting to the urgent need for the persons concerned to enter the territory of the Republic of Lithuania; 9) the issue of visas to foreigners accompanying persons referred to in subparagraph 8 of this Article on production of a document attesting to the need for such accompanying; 10) the issue of visas to foreigners travelling to the funeral of a family member or a close relative on production of a document to this effect; 11) the issue of visas to persons the rights of which have been restored under the Law on Rehabilitation of Persons Repressed for Resistance to Occupying Regimes (Valstybės Žinios No 14-386, 1990; Valstybės Žinios No 28-729, 1998) on production of a document to this effect; 12) the issue of visas to persons of Lithuanian origin on production of certificates issued by the local communities of the World Lithuanian Community or by the officers of diplomatic missions or consular posts of the Republic of Lithuania in the format approved by the Ministry of Foreign Affairs of the Republic of Lithuania, and also to person who have presented a document attesting to the preservation of their right to the citizenship of the Republic of Lithuania as well as to family members of such persons; 13) the issue of long-term visas (D) to foreigners who have arrived for pedagogical work in higher and college-level educational establishments, vocational and general education schools of the Republic of Lithuania; 14) requesting and legalising documents related to the enforcement of alimony payments; 15) requesting and legalising various documents, issued by the court, for a pre-trial investigation of criminal acts or the examination of criminal cases in court (where such documents are requested by state institutions or citizens of those countries which have signed agreements on legal aid with the Republic of Lithuania and where this is stipulated in such agreements); 16) consular services to protect the property of deceased crewmembers and passengers of seagoing vessels, aircraft and other means of transport of the Republic of Lithuania; 17) consular services provided in respect of fishing and trading vessels as well as aircraft of the Republic of Lithuania, except for the execution of protests or equivalent documents; 18) the issue of facilitated transit documents specified in Council Regulation (EC) No 693/2003; 19) the issue of a return certificate to persons who, for serious reasons (such as an accident, illness, having been a victim of a criminal act), cannot pay the consular fee on production of a document officially attesting to this effect; 20) the issue of a return certificate or a passport of the Republic of Lithuania or its replacement, requesting related documents from competent institutions or bodies of the Republic of Lithuania or foreign states, or other consular services required to take a child left without parental care in a foreign state, who has been issued a document attesting to his citizenship of the Republic of Lithuania or whose parents (or an only parent) are citizens of the Republic of Lithuania, back to the Republic of Lithuania. Article
  7. Payment of Consular Fees The consular fee shall be paid before consular services are provided or notarial acts are performed. The procedure of payment of consular fees shall be established by the Government of the Republic of Lithuania. Article
  8. Refunds Consular fees shall be refunded where the amount paid exceeds statutory consular fee rates. The consular fee shall be refunded within the term established in the Law on Tax Administration of the Republic of Lithuania. The procedure of refunding consular fees shall be established by the Government of the Republic of Lithuania. Article
  9. Control The levying of consular fees shall be controlled by the State Tax Inspectorate. The consular fee which is not levied or levied incorrectly shall be recovered, in accordance with the Law on Tax Administration of the Republic of Lithuania, from an institution through the fault of which the fee was not collected or collected incorrectly. Article
  10. Entry into the Budget Consular fees shall be entered in the state budget. Article
  11. Final Provisions The Law on Consular Fees of the Republic of Lithuania shall come into force on 1 January
  12. By 1 November 1994, the Government of the Republic of Lithuania shall fix consular fee rates and establish the procedure of payment and refunding of consular fees.
