Translation from Lithuanian Official translation 20 03 2007 GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No 226 of 13 February 2002 ON THE APPROVAL OF THE TYPES, MAXIMUM AMOUNT AND RULES OF APPLICATION OF KLAIPĖDA STATE SEAPORT DUES Vilnius (As amended by Resolution No 651 of 27 May 2003) Acting pursuant to Article 34 of the Law of the Republic of Lithuania on Klaipėda State Seaport (Valstybės žinios (Official Gazette) No 53-1245, 1996; No 75-2265, 2000), the Government of the Republic of Lithuania, h a s r e s o l v e d:
- To approve the types and maximum amounts of Klaipėda State Seaport dues (appended).
- To approve the rules of application of Klaipėda State Seaport dues (appended).
- To repeal the following: 3.
- Resolution No 495 of the Government of the Republic of Lithuania of 22 April 1998 on Klaipėda State Seaport Dues (Valstybės žinios (Official Gazette) No 40-1079, 1998); 3.
- Paragraph 1 of Resolution No 1361 of the Government of the Republic of Lithuania of 8 November 2000 on Amendments to Resolution No 495 of the Government of the Republic of Lithuania of 22 April 1998 on Klaipėda State Seaport Dues (Valstybės žinios (Official Gazette) No 98-3100, 2000).

- liner railway ferry and liner Ro-Ro passenger vessel* 0.3 litas per GT unit 1.
- liner Ro-Ro cargo vessel, liner vessel carrying only containers* 1.35 litas per GT unit 1.
- tramp vessel with GT less than 1000 units and fishing vessel holding the fishing vessel certificate 0.5 litas per GT unit 1.
- inland water vessel, non-self-propelled floating construction 0.8 litas per m3 1.
- passenger (non Ro-Ro) vessel 0.8 litas per GT unit II. NAVIGATION DUES

- For a vehicle loaded onto/unloaded from a Ro-Ro vessel: 6.

- For a vessel’s stay at the port: up to 10 days inclusive 0.25 litas per GT unit from the 11th day for each following day 0.025 litas per GT unit VI. PASSENGER DUES
- For each passenger arriving in/departing from the port by a vessel 4 litas per passenger * Shipping lines must be registered in accordance with the procedure approved by the Minister of Transport and Communications. APPROVED by Resolution No 226 of the Government of the Republic of Lithuania of 13 February 2002 THE RULES OF APPLICATION OF KLAIPĖDA STATE SEAPORT DUES
- Klaipėda State Seaport dues (hereinafter referred to as “port dues”) shall be collected by the State enterprise Klaipėda State Seaport Authority.
- The same amount of dues shall be imposed on foreign vessels and vessels registered in the Republic of Lithuania.
- Foreign naval vessels and other state-owned non-commercial vessels shall be exempt from the port dues in compliance with the procedure set forth by the Government of the Republic of Lithuania.
- Vessel dues, navigation dues, berth dues, and sanitary dues shall be calculated according to the vessel’s gross tonnage (GT) specified in the Certificate of Measurements and calculated in compliance with the International Convention on Tonnage Measurement of Ships of 23 April 1969 (TONNAGE 69).
- Tonnage dues shall be calculated for: 5.
- all vessels according to the vessel’s GT, except for the vessels indicated in points 5.2 and 5.3; 5.
- Ro-Ro vessels for each vehicle unit; for equivalent of 20 feet container (hereinafter referred to as “TEU”) loaded/unloaded by crane onto/off the vessel; 5.
- vessels carrying only containers for TEU loaded/unloaded by crane onto/off the vessel.
- For inland waters vessels, the port duties shall be calculated according to the module of the vessel’s size by applying the following formula: M = L ´ B ´ T, where: M – the module of the vessel’s size (in cubic metres); L – the vessel’s maximum length (in metres); B – the vessel’s maximum breadth (in metres); T – the vessel’s maximum draught (in metres).
- Passenger dues shall be calculated for each passenger arriving in/departing from the port by a vessel.
- Port dues shall be calculated in litas. _____________
