Oficialus vertimas 2007 12 18 government of the republic of lithuania RESOLUTION No 1027 of 18 October 2006 ON THE MEASURES TO IMPLEMENT IN THE REPUBLIC OF LITHUANIA INTERNATIONAL SANCTIONS LAID DOWN IN THE COUNCIL COMMON POSITION 2001/930/CFSP OF 27 DECEMBER 2001 ON COMBATING TERRORISM Vilnius Acting pursuant to the Law of the Republic of Lithuania on the Implementation of Economic and Other International Sanctions (Valstybės žinios (Official Gazette) No 68-2369, 2004), implementing Articles 2 and 3 of the Council Common Position 2001/930/CFSPof 27 December 2001 on combating terrorism (OL 2004 Special Edition, Chapter 18, Volume 1, p. 213), and having regard to the Council Common Position 2001/931/CFSP of 27 December 2001 on the application of specific measures to combat terrorism (OL 2004 Special Edition, Chapter 18, Volume 1, p. 217) and the Council Common Position 2006/380/CFSP of 29 May 2006 updating Common Position 2001/931/CFSP on the application of specific measures to combat terrorism and repelling Common Position 2006/231/CFSP (OL 2006 L 144, p. 25), the Government of the Republic of Lithuania h a s r e s o l v e d:
- To approve the List of Persons, Groups of Persons and Organisations Involved in Acts of Terror (as appended).
- To restrict for the natural and legal persons included in the list referred to in paragraph 1 above (hereinafter referred to as the List) the right to manage, use and dispose in pecuniary and other assets (including interest) held by them in financial institutions, except in the cases specified in paragraph 4 below.
- To prohibit financial institutions, insurance companies and branches of foreign insurance companies from: 3.
- making any payments to or from accounts held in the financial institutions concerned by natural or legal person included in the List, except in the cases specified in paragraph 4 below. Where financial institutions, insurance companies and branches of foreign insurance companies have to make debit and credit transfers, with the exception of international credit transfers, and the financial institution of the payer is other than the financial institution of the payee, financial sanctions imposed on the payer included in the List shall be implemented by the payer’s financial institution and those imposed on the payee included in the List shall be implemented by the payee’s financial institution once the payer’s financial institution has made the payment to the payee’s account. 3.
- providing any financial services to natural and legal persons included in the List.
- To set, for humanitarian purposes, for financial institutions, insurance companies and branches of foreign insurance companies the following allowable exceptions from the requirement to apply restrictions defined in this Resolution: 4.
- payments from funds of natural persons included in the List may be made for goods and services supplied and provided to them or their family members to satisfy basic human needs, including food, medicines, health-care services, rent payments for family housing or repayments of mortgage loans; 4.
- payments may be made for hot and cold water, electricity, heat, gas, telecommunication services and utilities supplied/provided to natural persons included in the List or their family members; 4.
- payments from funds of natural and legal persons included in the List may be made if they are necessary to cover taxes and levies due to the State budget and municipal budgets, contributions due to the State Social Insurance Fund, and other compulsory insurance contributions; 4.
- financial institutions may withhold a fee specified in legal acts, as a remuneration for the administration of accounts of natural or legal persons included in the List; 4.
- payments to accounts of natural and legal persons included in the List may be made if they are due under contracts or other obligations made or assumed before the entry into force of this Resolution.
- To set that persons included in the List or natural or legal persons of the Republic of Lithuania (with the exception of financial institutions) who seek to invoke the above-mentioned exceptions shall address the authority monitoring the implementation of international financial sanctions, i.e. the Financial Crime Investigation Service under the Ministry of the Interior. This authority or the financial institution concerned shall address the Ministry of Foreign Affairs as the authority responsible for the application of exceptions from the restrictions imposed, for the application of exceptions on a case-by-case basis and shall apply the exception concerned only with the latter’s consent.
- To set that the application of restrictions imposed by this Resolution shall be monitored in accordance with the Description of the Procedure for Monitoring the Implementation of International Sanctions approved by Resolution No 1679 of 30 December 2004 of the Government of the Republic of Lithuania (Valstybės žinios (Official Gazette) No 1-4, 2005).
