/me GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No. 1186 On THE APPROVAL OF EXPORT PROCEDURE OF MOVABLE CULTURAL PROPERTIES AND ANTIQUE OBJECTS FROM THE REPUBLIC OF LITHUANIA Vilnius 1 October 2001 In accordance with article 24 of the Law on Protection of Movable Cultural Properties of the Republic of Lithuania (Official Gazette No 14–352, 1996), the Government of the Republic of Lithuania has resolved:

  1. To approve the following, which is attached hereto: 1.
  2. The export procedure of movable cultural properties and antique objects from the Republic of Lithuania; 1.
  3. The list of cultural properties, which may be exported from the Republic of Lithuania only with the permission issued by the Cultural Heritage Protection Department.
  4. To charge: 2.
  5. The Ministry of Culture and Customs Department under the Ministry of Finance with the preparation and approval by 15 October 2001 of the movable cultural property export permission form, its printing, filling in and official registration requirements as well as the control procedure of the export of cultural properties with permits; 2.
  6. The Ministry of Culture – with the preparation and submitting by 1 February 2002 for the approval to the Government of the Republic of Lithuania of the import procedure of movable cultural properties and antique objects into the Republic of Lithuania; 2.
  7. The Cultural Heritage Protection Department of the Ministry of Culture – with the preparation and approval by 1 March 2002 of passport forms of stringed instruments and bows, their printing, filling in and official registration requirements as well as the control procedure of the temporary export of stringed instruments with passports.
  8. To establish that: 3.

The export procedure of movable cultural properties and antique objects from the Republic of Lithuania and the list of cultural properties, which may be exported from the Republic of Lithuania only with permits issued by the Cultural Heritage Protection Department, adopted by the present Resolution shall become valid as of 1 June 2002; 3.
  10. Permits to export movable cultural properties and antique objects from the Republic of Lithuania issued before the present procedure becomes valid, shall be valid as specified in the permits but not longer than till 1 June 2003; 3.
  11. From 1 June 2002 the following resolutions of the Government of the Republic of Lithuania shall become void: 3.3.

  15. The procedure shall regulate the export and sending (hereinafter – export) from the Republic of Lithuania of movable cultural properties and antique objects except archival documents (hereinafter – cultural properties) listed in the list of cultural properties approved by the present Resolution, which can be exported from the Republic of Lithuania only with permits issued by the Cultural Heritage Protection Department.
  16. Applicant according to the present procedure shall be a physical or legal entity, that applies with a request for a permit for the export of a cultural movable property. Other terms used in this procedure are defined in the Law On Protection of Movable Cultural Properties of the Republic of Lithuania.
  17. When irreversibly or temporarily exporting cultural properties from the Republic of Lithuania a permit for the export of a cultural property (hereinafter – a permit), shall be required, the form of which as well as the filling in and official registration requirements and the control procedure of the export of cultural properties with permits shall be established by the Ministry of Culture together with the Customs Department at the Ministry of Finance.
  18. The permit at the request of the applicant shall be issued by the Cultural Heritage Protection Department of the Ministry of Culture (hereinafter - the Cultural Heritage Protection Department) not later than within 15 days from the date of application. The Minister of Culture shall have the right to extend this period to 30 days.
  19. The permit shall be submitted to a customs institution together with a customs declaration or another document necessary for the customs for official registration of the export of cultural properties.
  20. A cultural property included in the Register of movable cultural properties of the Republic of Lithuania (hereinafter – the Register) or kept at a state museum or library may be with the agreement of the State Monument Protection Commission irreversibly exported from the Republic of Lithuania only in accordance with bilateral agreements, i.e. in cases of the exchange of cultural values, when the Expert Commission for the Evaluation of Movable Cultural Properties shall establish that the cultural property received in exchange is undoubtedly of a much higher value for the culture of Lithuania than the cultural value given away, or in the case of returning a cultural value to a state from which it was illegally exported and submitting to the customs institution a permit issued by the Cultural Heritage Protection Department.
  21. If the Expert Council decides that the object intended for export is a movable cultural property, the absence of which in Lithuania will impoverish the country’s cultural heritage, the permit for irreversible export of such a cultural value shall not be issued. Such cultural values as well as cultural values included in the Register and kept at libraries and museums may be temporarily exported from the Republic of Lithuania to cultural and arts events or for remaking (restoration, repair), when there is an invitation from the organiser of the event or a contract for the exhibition, event or remaking (restoration, repair) and a permit issued by the Cultural Heritage Protection Department which shall be submitted to the customs institution.
  22. For temporary export of stringed musical instruments and bows (codes in the Combined Nomenclature – 92.02, 9209.92.00.0) from the Republic of Lithuania a passport for the stringed musical instrument and the bow shall be necessary. The form of the passports, their printing, filling in and official registration requirements as well as the control procedure of the temporary export of stringed instruments with passports shall be specified by the Cultural Heritage Protection Department.
  23. A permit for the irreversible export from the Republic of Lithuania of special manuscripts of religious texts (toruses) included in the Register or kept at a state museum or library, rewritten for the sole purpose of rituals and identified with a ritual (hereinafter – religious texts (toruses), by a corresponding resolution of the Government of the Republic of Lithuania on handing over of the toruses to the ownership of a concrete jewish religious community or commune shall be issued by the Cultural Heritage Protection Department within 3 days after applying.
  24. Validity period of the permit – which shall not exceed 12 months after the date of issuing - shall be specified in the permit.
  25. The Cultural Heritage Protection Department, when issuing a permit for temporary export of cultural properties shall have the right to specify the period of time within which the mentioned above properties shall be returned to the Republic of Lithuania. The period of temporary export of cultural properties shall not exceed the period of temporary export specified in the Customs Code of the Republic of Lithuania.
  26. If the permit expires without having been used, the applicant shall immediately return it to the Cultural Heritage Protection Department.
  27. Stamp taxes shall be collected for the issuing of permits.
