GOVERNMENT OF THE REPUBLIC OF LITHUANIA Official translation GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No. 1468 CONCERNING THE APPROVAL OF THE PROCEDRUE FOR THE REMUNERATION FOR WORK OF THE MEMBERS OF THE INDEPENDENT COMMISSION FOR THE EXAMINATION OF COMPLAINTS RELATING TO PUBLIC PROCUREMENT 24 December 1999 Vilnius Pursuant to paragraph 5 of Article 40 of the Law of the Republic of Lithuania on Public Procurement, the Government of the Republic of Lithuania has resolved:

  1. To approve the Procedure for the Remuneration for Work of the members of the Independent Commission for the Examination of Complaints relating to Public Procurement (appended).
  2. The Resolution shall come into force as of 1 January
  3. Prime Minister Andrius Kubilius Minister of Social Security and Labour Irena Degutienë APPROVED by the Resolution of the Government of the Republic of Lithuania of 24 December 1999 No. 1468 PROCEDRUE FOR THE REMUNERATION FOR WORK OF THE MEMBERS OF THE INDEPENDENT COMMISSION FOR THE EXAMINATION OF COMPLAINTS RELATING TO PUBLIC PROCUREMENT
  4. The Procedure shall regulate the amounts and payment of the remuneration for work of the members of the Independent Commission for the Examination of Complaints relating to Public Procurement.
  5. A member of the Independent Commission for the Examination of Complaints relating to Public Procurement shall receive remuneration for the number of hours he actually worked. His work shall be calculated according to the pay sheet which registers the working hours, transferred by the Chairman of the Independent Commission to the Public Procurement Office under the Government of the Republic of Lithuania (hereinafter referred to as the Public Procurement Office); the pay sheet shall be submitted within 3 days following the day of the decision-making together with the said decision and other documents of complaint examination. The second form of the pay sheet registering the working hours, approved by the letter of response of 22 December 1997 No. 103 “On the Approval of the Pay Sheets Registering the Working Hours” of the Department of Statistics under the Government of the Republic of Lithuania shall be filled out.
  6. The following hourly rates shall be applicable when calculating the remuneration for one hour of work for the Chairman and members of the Independent Commission (based on the minimum hourly wage approved by the Government of the Republic of Lithuania): 3.
  7. participation in the preliminary meeting - 2; 3.
  8. familiarising oneself with the material presented for the examination of the complaint or any other preparation for complaint examination: 3.2.
  9. for the Chairman - - 3; 3.2.
  10. for the member - 2; 3.
  11. participation in the meeting of the Independent Commission: 3.3.
  12. by the Chairman - 4; 3.3.
  13. by the member - 3;
  14. The rates specified in paragraph 3 of this Procedure may be increased by the Director of the Public Procurement Office taking into account the complexity of the complaint, but by not more than 30 percent.
  15. The Chairman or the member of the Independent Commission who has been removed from the complaint examination according to the terms and procedure of Complaint Examination and Removal from the Complaint Examination of the Members of the Independent Commission for the Examination of Complaints Relating to Public Procurement, approved by the Resolution of the Government of the Republic of Lithuania of 24 December 1999 No. 1467 “Regarding the Approval of Legal Acts Regulating the Activities of the Independent Commission for the Examination of Complaints Relating to Public Procurement”, shall receive remuneration for the number of hours he actually worked before his removal.
  16. The newly appointed Chairman or member of the Independent Commission who is proceeding with the already commenced examination of the complaint shall be paid for the number of hours he actually worked (according to the course of complaint examination).
  17. The Chairman and members of the Independent Commission shall be remunerated for the complaint examination by the Public Procurement Office, which will use the funds that are kept in its separate current account “Funds for transfers”; the funds, as prescribed by paragraph 5 of this Procedure, shall be paid into the account by the supplier/contractor as provided by paragraph 4 of the Procedure for the Reimbursement of Expenses relating to the Examination of Complaints in the Independent Commission for the Examination of Complaints relating to Public Procurement, approved by the Resolution of the Government of the Republic of Lithuania . They shall be remunerated within 3 days from the day of delivery of the decision, other complaint examination documents and the pay sheet registering the working hours to the Public Procurement Office.
  18. The members of the Independent Commission - civil servants of public administration shall not be entitled to the remuneration for work prescribed by this Procedure. ______________
