GOVERNMENT OF THE REPUBLIC OF LITHUANIA Official translation GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No. 1787 ON APPROVING THE PROCEDURE FOR DRAWING UP, ADMINISTERING AND USING THE LIST OF ALIENS WHO ARE PROHIBITED FROM ENTERING INTO THE REPUBLIC OF LITHUANIA 13 November 2002 Vilnius The Government of the Republic of Lithuania has resolved:

  1. To approve the Procedure for Drawing up, Administering and Using the List of Aliens who are Prohibited from Entering into the Republic of Lithuania (appended).
  2. To recognise as invalid: 2.
  3. Resolution No. 685 of the Government of the Republic of Lithuania of 28 May 1999 “On Approving the Regulations for Drawing up and Using the List of Aliens who are Prohibited from Entering the Republic of Lithuania” (Official gazette, No. 49-1581, 1999); 2.
  4. Resolution No. 760 of the Government of the Republic of Lithuania of 20 June 2001 “On Amending Resolution No. 685 of the Government of the Republic of Lithuania of 28 May 1999 “On Approving the Regulations for Drawing up and Using the List of Aliens who are Prohibited from Entering the Republic of Lithuania” (Official gazette, No. 53-1892, 2001).
  5. This Resolution shall be applicable as of 1 January

Prime Minister Algirdas Brazauskas Minister of the Interior Juozas Bernatonis APPROVED by Resolution No. 1787 of 13 November 2002 of the Government of the Republic of Lithuania PROCEDURE FOR DRAWING UP, ADMINISTERING AND USING THE LIST OF ALIENS WHO ARE PROHIBITED FROM ENTERING INTO THE REPUBLIC OF LITHUANIA I. GENERAL PROVISIONS
  7. This Procedure shall regulate the drawing up, administering and using the list of aliens who are prohibited from entering into the Republic of Lithuania (hereinafter referred to as the List).
  8. The purpose of the List is to prevent entry into the Republic of Lithuania of aliens whose presence in the Republic of Lithuania is nor desirable.
  9. The List shall be drawn up and administered by the Migration Department under the Ministry of the Interior (hereinafter referred to as the Migration Department).
  10. Aliens may be entered in the List if: 4.
  11. the alien’s stay or residence in the Republic of Lithuania would pose a threat to national security or public order; 4.
  12. the alien has been refused a visa of the Republic of Lithuania; 4.
  13. the alien is expelled from the Republic of Lithuania; 4.
  14. the alien has been refused entry into the Republic of Lithuania. II. DRAWING UP AND ADMINISTERING THE LIST
  15. The List shall be drawn up and supplemented following submission by state institutions or agencies of written data pertaining to the alien who may be prohibited from entering into the Republic of Lithuania (hereinafter referred to as alien). The following data pertaining to the alien shall be given: 5.
  16. name (names); 5.
  17. surname; 5.
  18. date of birth; 5.
  19. place of birth; 5.
  20. male/female; 5.
  21. citizenship; 5.
  22. type, series, number of the alien’s passport or any other corresponding travel document; 5.
  23. reason for entering in the List as specified in paragraph 4 of this Procedure; 5.
  24. the date of expiry of the proposed period of prohibition of the alien’s entry into the Republic of Lithuania.
  25. The following bodies shall have the right to submit data specified in paragraphs 5.1-5.9: 6.
  26. the Migration Department; 6.
  27. the Police Department under the Ministry of the Interior and territorial police bodies; 6.
  28. the State Border Protection Service under the Ministry of the Interior of the Republic of Lithuania (hereinafter referred to as the State Border Protection Service); 6.
  29. the VIP Protection Department under the Ministry of the Interior; 6.
  30. the Financial Crime Investigation Service under the Ministry of the Interior; 6.
  31. the State Security Department of the Republic of Lithuania ; 6.
  32. the Ministry of Foreign Affairs; 6.
  33. Second Department of Operational Services under the Ministry of National Defence; 6.
  34. the Customs Department under the Ministry of Finance; 6.
  35. the Special Investigation Service of the Republic of Lithuania; 6.
  36. the courts.
  37. The Migration Department shall draw up the List based on the adopted decisions to prohibit the alien’s entry into the Republic of Lithuania.
  38. The Director of the Migration Department or the public servant authorised by him, upon receipt from the state institutions or agencies specified in paragraph 6 of this Procedure of data pertaining to the alien, shall forthwith adopt a decision to prohibit (not to prohibit) the alien’s entry into the Republic of Lithuania. The decision to prohibit (not to prohibit) the alien from entering into the Republic of Lithuania shall come into force as of the day of its adoption.
  39. The adopted decision to prohibit (not to prohibit) the alien from entering into the Republic of Lithuania shall state the term of prohibition. An alien may be prohibited from entering into the Republic of Lithuania for a definite or an indefinite period.
  40. Upon its adoption, the decision to prohibit (not to prohibit) the alien from entering into the Republic of Lithuania shall be notified to the state institution or agency which submitted the data. III.USING THE LIST
  41. The data on the List shall not be made public.
  42. The following bodies may receive and use the data from the List: 12.
  43. the State Border Protection Service; 12.
  44. the Police Department and the territorial police bodies; 12.
  45. the Ministry of Foreign Affairs; 12.
  46. diplomatic missions and consular institutions of the Republic of Lithuania abroad; 12.
  47. entities of operational activities pursuant to the Law of the Republic of Lithuania on Operational Activities (Official gazette, 2002, No. 65-2633); 12.
  48. other state institutions and agencies granted the right under the laws of the Republic of Lithuania.
  49. Under agreements on disclosure of personal data, the List shall be transmitted to the institutions and agencies specified in paragraph 12 of this Procedure on computer media once every two weeks or by direct communication. IV. FINAL PROVISIONS
  50. The List shall be administered in compliance the Law of the Republic of Lithuania on Legal Protection of Personal Data (Official gazette, 1996, No. 63-1479; 2000, No. 64-1924) and other legal acts.
  51. Data pertaining to aliens whose period of prohibition from entry into the Republic of Lithuania has expired shall be transferred from the List to the data base archives and stored for a five-year period.
  52. Decisions to prohibit an alien’s entry into the Republic of Lithuania shall be stored for a three-year period following the expiry of the prohibition period, whereas the decisions not to deny an alien’s admission to the Republic of Lithuania – for three years from the adoption thereof.
