GOVERNMENT OF THE REPUBLIC OF LITHUANIA Official translation GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION 28 May 1999 No. 685 Vilnius ON APPROVING THE REGULATIONS FOR DRAWING UP AND USING THE LIST OF ALIENS WHO ARE PROHIBITED FROM ENTERING THE REPUBLIC OF LITHUANIA The Government of the Republic of Lithuania has resolved:

  1. To approve the Regulations for Drawing up and Using the List of Aliens who are Prohibited from Entering the Republic of Lithuania (attached).
  2. To recognise as invalid Resolution No. 686 of the Government of the Republic of Lithuania of 26 June 1997 “On Approving the Regulations for Drawing up and Using the List of Aliens who are Prohibited from Entering the Republic of Lithuania” (Official gazette, No. 61-1459, 1997).
  3. This Resolution shall be applicable as of 1 July

  5. These Regulations shall establish the procedure for collecting and using information about aliens who may be prohibited from entering the Republic of Lithuania under the laws of the Republic of Lithuania or resolutions of the Government of the Republic of Lithuania.
  6. The purpose of the list of aliens who are prohibited from entering the Republic of Lithuania (hereinafter referred to as the List) is to prevent entry into the Republic of Lithuania of aliens who have violated the laws of the Republic of Lithuania or whose presence in the Republic of Lithuania is nor desirable.
  7. The administrator of the List shall be the Migration Department under the Ministry of the Interior.
  8. The following information shall be submitted about the aliens who may be included in the List: 4.
  9. name (names); 4.
  10. surname; 4.
  11. date of birth; 4.
  12. place of birth; 4.
  13. male/female; 4.
  14. citizenship; 4.
  15. series, number of passport or any other corresponding travel document; 4.
  16. date of inclusion in the List; 4.
  17. reason of inclusion in the List; 4.
  18. the name of the institution of state government or administration (hereinafter referred to as the institution of administration) which submits information about the alien; 4.
  19. the date until the expiry of the recommended period of prohibition of the alien’s entry into the Republic of Lithuania.
  20. The following bodies shall have the right, under the laws of the Republic of Lithuania or resolutions of the Government of the Republic of Lithuania, to submit information about aliens who may be prohibited from entering the Republic of Lithuania: 5.
  21. Border Police Department under the Ministry of the Interior; 5.
  22. Migration Department under the Ministry of the Interior; 5.
  23. Police Department under the Ministry of the Interior; 5.
  24. Department of Security of the Republic of Lithuania; 5.
  25. Consular Department of the Ministry of Foreign Affairs; 5.
  26. Second Investigation Department under the Ministry of National Defence.
  27. Other institutions of administration which are not specified in paragraph 5 of these Regulations may also submit information about the aliens whose entry into the Republic of Lithuania must be prohibited.
  28. The information about the alien shall be submitted and included in the List according to the procedure established by the Ministry of the Interior.
  29. The information about the aliens whose entry into the Republic of Lithuania is recommended to be prohibited shall be submitted to the Migration Department under the Ministry of the Interior.
  30. The Migration Department under the Ministry of the Interior shall make a decision regarding inclusion in the List of the alien whose entry into the Republic of Lithuania is recommended to be prohibited, and shall fix the term of prohibition of entry into the Republic of Lithuania.
  31. The Migration Department under the Ministry of the Interior shall, based on the information submitted by the institutions specified in paragraph 5 of these Regulations, draw up the List of aliens who are prohibited from entering the Republic of Lithuania . The List shall be transmitted to other institutions of administration in computer media. The list of such institutions and the regularity of transmission shall be determined by the Ministry of the Interior. Other institutions of administration which have not been transmitted the List may be submitted information about the aliens who are of interest to them only upon a written request of the institutions.
  32. The Migration Department under the Ministry of the Interior shall strike off the List an alien who is prohibited from entering the Republic of Lithuania only upon co-ordinating the issue with the institution of administration which submitted the proposal to include the alien in the List if: 11.
  33. it is recommended to strike off the List an alien who has been included in the List for an indefinite term; 11.
  34. it is recommended to strike off the List an alien put on the List for a fixed time period before the expiry of the term.
  35. The information about aliens submitted to or received by the institution of administration according to the procedure established in these Regulations shall be for official use only.
  36. The administrator of the List shall have the right not to inform the alien about the reasons of his inclusion in the List.
