GOVERNMENT OF THE REPUBLIC OF LITHUANIA official translation GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No. 717 REGARDING THE AMENDMENT OF THE RESOLUTION OF THE GOVERNMENT OF THE REPUBLIC OF LITHUANI OF 26 JUNE NO. 685 “CONCERNING THE APPROVAL OF REGULATIONS FOR THE ISSUANCE OF VISAS OF THE REPUBLIC OF LITHUANIA” 2 June 1999 Vilnius The Government of the Republic of Lithuania has resolved:
- To amend the Regulations for the Issuance of Visas of the Republic of Lithuania, approved by the Resolution of the Government of the Republic of Lithuania of 26 June 1997 No. 685 “Concerning the Approval of Regulations for the Issuance of Visas of the Republic of Lithuania ”: 1.
- part 1 of paragraph 4 shall be set forth to read as follows: “
- Visas shall be issued in the diplomatic missions of the Republic of Lithuania and its consular institutions abroad, at the Consular Department of the Ministry for Foreign Affairs of the Republic of Lithuania, at the Department of Migration under the Ministry of the Interior and migration services at the district (city) Police Commissariats and, by way of exception (according to the procedure laid down by the Ministry of the Interior and the Ministry for Foreign Affairs), visas for aliens may be issued at the border control posts of the Border Police Department under the Ministry of the Interior (hereinafter referred to as the Visa Issuance Service)”; 1.
- paragraph 5 shall be set forth to read as follows: “
- The list of services at which visas for aliens are issued shall be drawn up by the Ministry of the Interior upon consultation with the Ministry for Foreign Affairs. The list of services which issue visas shall be published in the “Official Gazette”; 1.
- paragraphs 15, 16 and 17 shall be set forth to read as follows: “
- Regular visas shall be issued to aliens when they are not entitled to diplomatic and service visas or when they are not required to obtain a special visa. An alien who enters the Republic of Lithuania with a regular visa shall be prohibited from seeking employment, engaging in any other activities, should he require therefor a permit for permanent residence in the Republic of Lithuania .
- Regular or transit visas may be issued to aliens at border check points in the following cases: 16.
- when the aliens are entering the Republic of Lithuania in order to participate in official meetings of public institutions, provided that a written application has been submitted to the Border Police Department under the Ministry of the Interior by the Ministry for Foreign Affairs; 16.
- when the aliens are in need of first aid, provided that a written application has been submitted to the Border Police Department under the Ministry of the Interior by the Ministry of Health Care or the institution authorised by it; 16.
- for cargo transport drivers, carrying cargo to the Republic of Lithuania or the Kaliningrad District of the Russian Federation and to persons named in the documents confirming the transportation route, who are going in the same vehicle; 16.
- for cargo transport drivers and persons carrying cargo through the Republic of Lithuania to or from the international ferry port in Klaipėda provided that documents confirming the route of transportation are submitted; 16.
- aircraft crew members named in the crew list; 16.
- crew members of foreign ships who are replacing the crew at the Klaipėda sea port, provided that a written application has been submitted to the border check point by the Department of Migration under the Ministry of the Interior. Visas may be issued at border check points to aliens also in the cases which are not specified herein, provided that a written application has been submitted to the border check point by the Department of Migration under the Ministry of the Interior. The entire period of stay in the Republic of Lithuania with a regular visa issued at the border check point may not be longer than 10 days.
- Regular visas shall be issued at the diplomatic missions and consular offices of the Republic of Lithuania abroad, at the Consular Department of the Ministry for Foreign Affairs, at the Department of Migration under the Ministry of the Interior, at the migration services of district , city police commissariats and at the border check points”; 1.
- part 3 of paragraph 19 shall be set forth to read as follows: “A multiple entry visa shall be issued upon submitting documents confirming the necessity of the receipt of such a visa”; 1.
- paragraphs 20 and 21 shall be set forth to read as follows: “
- An alien may be issued a regular visa upon his application provided he has: 20.
- a valid travel document; 20.
- the right to return to the country of his residence of which he is a national or a permanent resident, or to proceed to another country; 20.
- an invitation of a natural or legal person of the Republic of Lithuania to come to the Republic of Lithuania and to stay in the country (hereinafter referred to as the invitation), confirmed by the migration service; 20.
- a valid document of health insurance.
- No invitation shall be required if: 21.
- the alien is a spouse or a child under the age of 18 years of the national of the Republic of Lithuania and their permanent place of residence is in a foreign state; 21.
- the alien has acquired a package tour of the form established by the Department of Tourism under the Ministry of Public Administration Reforms and Local Authorities or a voucher for treatment in a sanatoria or resort; 21.
- the alien has acquired the travel guarantees (“Carnet de Tourist”) insurance recognised by the Ministry of the interior and Ministry for Foreign Affairs; 21.
- the alien must cross the territory of the Republic of Lithuania by transit; 21.
- a written application has been submitted to the diplomatic mission or consular office of the Republic of Lithuania by the Consular Department of the Ministry for Foreign Affairs requesting the alien be issued with a visa; 21.
- the alien presents a certificate of the form approved by the Ministry for Foreign Affairs, issued by the Lithuanian Community of the country or by the officer of the diplomatic mission or consular office of the Republic of Lithuania abroad. The list of states whose nationals may be issued visas without an invitation shall be approved by the Ministry of the Interior upon consultation with the Ministry for Foreign Affairs”; 1.
- paragraph 26 shall be set forth to read as follows: “An invitation for an alien to come to the Republic of Lithuania on a temporary visit and stay in the country shall be issued for a period not exceeding 90 days”; 1.
- paragraphs 31, 32, 33 and 34 shall be set froth to read as follows: “
- Special visas shall be issued to aliens who are entitled to a permit for temporary or permanent residence in the Republic of Lithuania.
- Special visas are single-entry visas and shall be valid: 32.
- for 6 months after the decision to issue the alien with a permit for temporary residence in the Republic of Lithuania is passed; 32.
- for 12 months after the decision to issue the alien with a permit for permanent residence in the Republic of Lithuania is passed.
- Special visas shall be issued by diplomatic missions and consular offices of the Republic of Lithuania abroad after consultation with the Department of Migration under Ministry of the Interior.
- An alien who has been issued with a special visa must within 7 days from his entry of the Republic of Lithuania notify thereof the migration service on the territory serviced by which the alien has taken up residence”; 1.
- paragraph 39 shall be set forth to read as follows: “39 The aliens applications for a visa shall be considered and decided within 7 working days or, as a matter of urgency, within 24 hours. The issue shall not be treated as a matter of urgency where the question of the issuance of a visa must be agreed with the Department of Migration under the Ministry of the Interior. Where the finding of the Department of Migration under the Ministry of the Interior is necessary in order to decide the matter, the above time limit must be extended for up to 20 working days and in the case of issuance of a special visa - up to 3 months from the day of filing of the application for the issuance of a permit for temporary residence in the Republic of Lithuania or up to 6 months from the day of filing of the application for the issuance of a permit for permanent residence in the Republic of Lithuania”; 1.
- paragraph 40 shall be supplemented with the following part 2: “An alien whose stay in the territory of the state is illegal shall be refused a visa”; 1.
- paragraph 51 shall be repealed.
- The Resolution shall be applicable as of 1 July
