Projektas GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No. 804 ON APPROVING THE SUPPLY PROCEDURE (PROVIDING SUPPLIES) FOR SHIPS AND AIRCRAFT, TRANSPORTING PASSENGERS AND/OR CARGO ON INTERNATIONAL ROUTES 24 July 1997 Vilnius The Government of the Republic of Lithuania r e s o l v e s:
- To approve the supply procedure (providing supplies) for ships and aircraft, transporting passengers and/or cargo on international routes (the procedure is attached hereto). The procedure shall be applied from August 1,
- Paragraph 3.2 of this procedure shall be valid till January 1,
- To empower the Ministry of Transport to approve norms of alcoholic drinks, machine oil and fuel, provided to aircraft and ships as supplies (depending on the types of aircraft or ships).
- To amend The Rules on Cooperation of Control Institutions, Services of Airports and Air Companies in International Airports, approved by Government Resolution No.145 of 29 January 1996 “On Approving the Rules on Cooperation of Control Institutions, Services of Airports and Air Companies in International Airports” (Official Gazette, 1996, No.10-257) as follows: 3.
- to formulate paragraph 2.21 as follows: “2.
- ‘supplies’ means goods (food products, including alcoholic drinks and tobacco products, fresh water, medicines, etc.) meant for passengers and crew members for use in aircraft during a flight, sold or not, as well as goods necessary for the functioning of aircraft, their maintenance and for guaranteeing traffic safety, including machine oil and fuel, with the exception of spare parts and equipment”; 3.
- To formulate paragraph 98 as follows: “
- No import and export duties, taxes and other fees shall be imposed on aircraft supplies (except the payment for the services provided) and the supplies shall be delivered to aircraft, transporting passengers and/or cargo on international routes in accordance with the procedure established by the Government of the Republic of Lithuania”; 3.
- To repeal paragraphs 99 and
- To amend the Rules for the Carriage, Temporary Storage and Control of Goods in the Customs Supervision Zones of the Klaipėda State Sea Port Complex, approved by Government Resolution No.482 of 23 April 1996 “On Approving the Rules for the Carriage, Temporary Storage and Control of Goods in the Customs Supervision Zones of the Klaipėda State Sea Port Complex” (Official Gazette, 1996, No.37 -944) as follows: 4.
- to add the following paragraphs 2.9 and 2.10 to the above mentioned rules: “2.
- ‘supplies’ means goods (food products, including alcoholic drinks and tobacco products, fresh water, medicines, etc.) meant for passengers and crew members for use on ships during travel sold (in restaurants, coffee shops, bars, etc.) or not, as well as goods necessary for the functioning of ships, their maintenance and for guaranteeing traffic safety, including fuel and machine oil, with the exception of spare parts and equipment; 2.
- ‘international route’ means communication by water transport from/to sea/river ports of the Republic of Lithuania, in which customs, border and other obligatory border crossing checks and procedures are carried out”; 4.
- to formulate paragraph 16 as follows: “
- No import and export duties, taxes and other fees shall be imposed on ship supplies (except the payment for the services provided) and the supplies shall be delivered to ships, transporting passengers and/or cargo on international routes in accordance with the procedure established by the Government of the Republic of Lithuania. Used materials, waste and rubbish may be loaded to a ship, unloaded from a ship, transferred from one ship to another only with the permission of the customs authorities by carrying out customs checks and clearance according to the established procedure. Used materials and waste shall be transferred only upon coordinating this issue with the Klaipėda Regional Department of the Ministry of the Environment, except in cases when the above mentioned materials or waste are transferred to special ships”. - Definitions used in this procedure: aircraft or ship supplies (hereinafter supplies) mean goods (food products, including alcoholic drinks and tobacco products, fresh water, medicines, etc.) meant for passengers and crew members for use on aircraft or ships during travel sold (in restaurants, coffee shops, bars, etc.) or not, as well as goods necessary for the functioning of aircraft or ships and their maintenance and for guaranteeing traffic security, including fuel and machine oil, with the exception of spare parts and equipment; supplier means a company, having the right (license) to transport passengers and/or cargo on international routes, or a company which has a supply contract with that company; customs supervision zone means a territory (a part of the territory of the air port or sea port complex), including premises, where customs, border and other checks of persons, luggage, goods (cargo) and means of transport are carried out; import and export duties and taxes mean all customs duties and taxes collected (paid) for imported or exported goods or related to imports or exports of goods, except payment for the services provided; international route means: international air communication means communicating by air from/and to the airports of the Republic of Lithuania, where customs, border and other checks and formalities obligatory in a border crossing point are carried out; international ship communication means communicating by water transport from/ and to the sea/river ports of the Republic of Lithuania, where customs, border and other checks and procedures obligatory in a border crossing point are carried out.
- Ships and aircraft, transporting passengers and/or cargo on international routes shall be supplied (supplies for aircraft and ships shall be provided) in accordance with the above procedure. The procedure shall be obligatory for all suppliers, registered as established by the Government of the Republic of Lithuania.
- Supplies may be provided directly to aircraft and ships or from closed customs warehouses, established by the supplier, where they are stored. Until closed customs warehouses are established, supplies may be stored in storages, the scheme (distribution) of which is coordinated with the territorial customs authorities.
- Supplies (except remaining fuel) left in an aircraft (ship), which has returned from a flight (trip) shall be returned to the closed customs warehouse established by the supplier or after informing customs authorities, shall be left for use in other flights (trips).
- Customs clearance procedure for supplying (providing supplies) and returning of supplies as well as replenishing supplies outside the customs territory of the Republic of Lithuania shall be carried out in accordance with the procedure established by the Customs Department at the Ministry of Finance, which is coordinated with the Ministry of Transport.
- Supplies of imported alcoholic drinks for ships and aircraft shall be made up by companies, registered in accordance with the procedure established by the Government of the Republic of Lithuania, which have the right (license) to transport passengers and/or cargo on international routes. For that purpose: 6.
- the above mentioned companies, after coordination with the Ministry of Transport, shall submit to the State Alcohol and Tobacco Control Service a Request based on calculations for importing alcoholic drinks into the Republic of Lithuania, specifying the quantity of such drinks in accordance with the Combined Nomenclature; 6.
- After the Government of the Republic of Lithuania at the proposal of the State Alcohol and Tobacco Control Service at the Government of the Republic of Lithuania approves the quantity (in accordance with the Combined Nomenclature) of alcoholic drinks to be used as supplies, which can be imported into the territory of the Republic of Lithuania, companies registered in accordance with the procedure established by the Government of the Republic of Lithuania and having the right (license) to transport passengers and/or cargo on international routes, shall submit the following documents to the State Alcohol and Tobacco Control Service at the Government of the Republic of Lithuania: 6.2.
- a request, specifying the name code, address, telephone number of the company, as well as listing foreign countries, names of companies and brand names of alcoholic drinks (in accordance with the Combined Nomenclature) to be imported; 6.2.
- a notarised copy of the registration certificate of the company; 6.2.
- an original certificate (for each brand name of alcoholic drinks) issued by a foreign company – producer of alcoholic drinks, certifying the quality of alcoholic products; 6.
- On the basis of the quantity of alcoholic drinks in accordance with the Combined Nomenclature to be used as supplies which can be imported into the Republic of Lithuania as approved by the Government of the Republic of Lithuania, and the documents of companies, registered in accordance with the procedure established by the Government of the Republic of Lithuania and having the right (license) to transport passengers and/or cargo on international routes, the State Alcohol and Tobacco Control Service at the Government of the Republic of Lithuania, after coordinating with the Ministry of the Interior and State Security Department of the Republic of Lithuania shall issue to the above mentioned companies a permission to import alcoholic drinks into the Republic of Lithuania (according to brand names and the Combined Nomenclature); 6.
- permissions to import alcoholic drinks into the Republic of Lithuania shall be issued for 1 year. If necessary, the quantity of alcoholic drinks, specified in the permission, may be reviewed, but not more than twice a year; 6.
- companies registered in accordance with the procedure established by the Government of the Republic of Lithuania and having the right (license) to transport passengers and/or cargo on international routes shall use the imported alcoholic dinks only for their proper purpose - as supplies provided for the passengers of ships and aircraft. Supplies shall be collected and disposed of in accordance with the laws of the Republic of Lithuania and other legal acts.
- Retail trade in alcoholic drinks on ships and aircraft may be carried out only with valid licenses, issued by the Mayor/Board of the city/region. Companies registered in accordance with the procedure established by the Government of the Republic of Lithuania and having the right (license) to transport passengers and/or cargo on international routes shall be issued one license to carry out retail trade in alcoholic drinks on all the aircraft they owe. Companies registered in accordance with the procedure established by the Government of the Republic of Lithuania and having the right (license) to transport passengers and/or cargo on international routes shall be issued one license to carry out retail trade in alcoholic drinks for every ship they owe.
- No import and export customs duties and taxes shall be imposed on goods, provided as supplies. Alcoholic drinks and tobacco products produced in Lithuania shall bear no banderoles.
- Norms (limited quantities) of fuel, machine oil and alcoholic drinks, provided as supplies shall be approved by the Ministry of Transport depending on the number of crew and passengers on an aircraft or ship and the duration of the journey.
- At the request of the customs authority the supplier shall submit all accounting documents of the supplies as well as other necessary information. ___________________________________
