1. Purpose of the Law
3. This Law shall establish the purpose of the service passport, the conditions of its issuance, validity, replacement, return, collection and declaration of invalidity as well as data to be recorded therein.
4. The provisions of this Law have been harmonised with the legal acts of the European Union referred to in the Annex to this Law. Article
5. Service Passport and Its Purpose
6. A service passport is a personal document confirming the identity, citizenship and post held by a person and intended for travelling to foreign states for service purposes.
7. The form of a service passport shall be established by the Minister of the Interior. Article
8. Persons Entitled to Be Issued With a Service Passport
9. A Service passport may be issued to: 1) civil servants in categories 18–20, senior advisers and advisers of the Office of the Seimas; 2) heads of state institutions and agencies and deputies thereof.
10. A Service passport may be issued to other persons who, while performing their official duties, travel abroad for service purposes. The list of the positions of these persons shall be established by the Government.
11. A Service passport shall be issued to persons specified in paragraphs 1 and 2 of this Article who hold a personal identity card.
12. A Service passport shall not be issued to persons who may be entitled to be issued with a diplomatic passport under the Law on the Diplomatic Service. Article
13. Period of Validity of a Service Passport A Service passport shall be valid for a period of 5 years from the date of its issuance indicated therein. Article
14. Service Passport Records
15. The following data shall be recorded in a service passport: 1) name (names); 2) surname; 3) sex; 4) date of birth; 5) place of birth (name of the State is entered); 6) personal number; 7) citizenship.
16. In addition to the data specified in paragraph 1 of this Article, the following shall be recorded in a service passport: 1) issuance date of the service passport; 2) name of the institution that issued the service passport; 3) expiry date of the service passport.
17. A service passport must contain the facial image of a person, his signature and indication of the post held. Following a change of the post held by the person, a record shall be made in the service passport indicating the new post, where the person meets the requirements set in Article 3 of this Law. *
18. The data referred to in paragraph 1 of this Article as well as the facial image and fingerprints of a person shall be recorded in a service passport electronically. *Note. The provision of paragraph 4 regarding the data about a person and the electronic recording of the person’s facial image in a service passport shall enter into force on 28 August 2006 and the provision on the recording of the person’s fingerprints shall enter into force not later than within 36 months after the establishment by the European Commission the technical specifications relating to the fingerprints. The provisions of paragraph 4 shall not apply to the service passports issued prior to the date of entry into force of the specified provisions.
19. The names of the types of data in a service passport shall be typed in the Lithuanian, English and French languages.
20. Data in a service passport shall be recorded in Lithuanian characters and the name (names) and surname of a person- in accordance with the procedure established by legal acts of the Republic of Lithuania regulating the writing of names and surnames in personal documents. The record of the post held by the person shall be made in the Lithuanian and English languages. Article
21. Issuance and Replacement of a Service Passport
22. A service passport shall be issued and replaced by an agency performing the functions of civil service management (hereinafter referred to as the “agency for civil service management”).
23. Persons specified in paragraphs 1 and 2 of Article 3 of this Law must submit an application for the issuance (replacement) of a service passport to a person authorised to appoint them to office and, where the persons have been appointed to office by a collegial state or municipal institution, to the Minister of the Interior or a person authorised by him (hereinafter referred to as “responsible persons”).
24. Upon receiving an application for the issuance (replacement) of a service passport from a person, responsible persons shall submit a conclusion on the expediency of the issuance (replacement) of the service passport. If they submit a favourable conclusion, the application for the issuance (replacement) of the service passport shall be forwarded to the agency for civil service management. The agency for civil service management shall take a decision on the issuance of the service passport.
25. A service passport shall be replaced if: 1) its period of validity has expired; 2) it is no longer fit for use; 3) passport pages designated for visas are full; 4) there are changes in the data specified in subparagraphs 1-6 of paragraph 1 of Article 5 of this Law.
26. When submitting documents for the replacement of a service passport, a person must return his current service passport to responsible persons.
27. When collecting a new service passport, the returned service passport is forwarded to the agency for civil service management for destruction.
28. A person whose service passport has been lost or stolen must immediately notify thereof the agency for civil service management and responsible persons. The lost or stolen service passport shall be declared invalid.
29. State fees in the amount prescribed by the Government shall be charged for the issuance or replacement of a service passport. The state fees shall be paid by the state or municipal institution or agency in which the person holds office. Article
30. Return and Destruction of a Service Passport
31. A person who does not meet the requirements specified in Article 3 of this Law must return his service passport to responsible persons. These persons shall forward the service passport to the agency for civil service management for destruction.
32. A person who has become entitled to a diplomatic passport must return his service passport to responsible persons. These persons shall forward the service passport to the agency for civil service management for destruction.
33. A service passport of a deceased person shall be returned to the agency for civil service management for destruction. Article
34. Invalidity of a Service Passport
35. A service passport shall become invalid upon the expiry of the period of its validity, declaration of its invalidity or death of a person.
36. A passport shall be declared invalid if: 1) it has been lost or stolen; 2) it has been replaced on the grounds specified in paragraph 4 of Article 6 of this Law; 3) it has been returned or not returned on the grounds specified in paragraphs 1 and 2 of Article 7 of this Law; 4) it has been forged.
37. A service passport shall be declared invalid by the agency for civil service management. Article
38. Procedure for Issuance, Replacement, Return, Declaration of Invalidity and Destruction of a Service Passport A service passport shall be issued, replaced, returned, declared invalid and destroyed in accordance with the procedure for the issuance, replacement, return, declaration of invalidity and destruction of the service passport established by this Law and the Minister of the Interior. 39. Seizure of a Service Passport
40. Upon establishing that a person uses the service passport of another person or a service passport declared invalid on the grounds specified in paragraph 2 of Article 8 of this Law, the State Border Guard Service under the Ministry of the Interior, police or other law enforcement institution must seize the service passport and forward it to the agency for civil service management.
41. The police or another law enforcement institution or the court shall seize the service passport, if such passport has been issued, of a person under arrest, also a person sentenced to a custodial sentence or a person who is subject to an administrative arrest and shall forward it to the agency for civil service management.
42. It shall be prohibited to seize the service passport of a person, except in cases specified by this or other laws.
