2007 - No X-1328) CHAPTER ONE GENERAL PROVISIONS Article

  1. Purpose of the Law This Law shall set forth the rules for assigning government securities, tax stamps, public transport tickets, official marking signs and document forms the compulsory usage whereof in the Republic of Lithuania is prescribed by the state or municipal institutions or agencies of the Republic of Lithuania and other legal entities authorized by the legal acts of the Republic of Lithuania as well as the European Union institutions to a level and sub-level of technological security of security documents and security document forms, approving technological security features for security documents or security document forms, regulating the issuance and production of security documents and security document forms as well as requirements for the production thereof. Article
  2. Definitions
  3. Tax stamp means a numbered sign with technological security features issued by the State used to mark ethyl alcohol, alcoholic beverages and processed tobacco intended for sale in the Republic of Lithuania.
  4. Document form means a form approved by the state or municipal institution or agency of the Republic of Lithuania or the European Union legal act intended for filling in and using as a document, with the exception of a form that upon having been filled in may be submitted electronically.
  5. Public transport ticket means a document that entitles to the use of public transport, with the exception of international and air travel tickets and a ticket issued as a cash receipt.
  6. Unlawful production of a security document or security document form means the production of a security document or security document form in a company or foreign company branch not authorized to produce the security documents and security document forms.
  7. Official marking sign means a numbered sign that attests the verification or survey carried out by the state or municipal institution or agency or institutions or agencies commissioned thereto or the payment of tax.
  8. Sketch of a security document or security document form means an image or drawing of government securities, a tax stamp, public transport ticket, official marking sign or document form prepared in accordance with the mandatory form approved by the approving institution based on which a graphic design of a security document or security document form is created.
  9. Standard form of a security document or security document form means a security document or security document form prepared in accordance with the mandatory form of government securities, a tax stamp, public transport ticket, official marking sign or document form approved by the approving institution and in accordance with the graphic design of the security document or security document form that possesses all the technological security features specified for that particular security document or security document form.
  10. Graphic design of a security document or security document form means an explicit drawing of a security document or security document form created in accordance with the approved sketch of the security document or security document form recorded on a digital (electronic) medium and printed out on paper.
  11. Metrics of a security document or security document form means an indication on the graphic design of a security document or security document form of the year of submission of an order to a producer, the name of the producer and an identification number provided by the Service of Technological Security of State Documents under the Ministry of Finance or a code in the Register of Security Documents and Security Document Forms.
  12. Specimen of a security document or security document form means a security document or security document form complying with the requirements of the standard form of the security document or security document form with an inscription “SPECIMEN” (where the security document or security document form is comprised of more than one sheet, the inscription “SPECIMEN” must appear on every sheet or page) and a registration number.
  13. Level of technological security of a security document or security document form (hereinafter referred to as a “level of technological security”) means a level of protection against forgery of a security document or security document form based on the number of compulsory different-level technological security features used in the security document or security document form.
  14. Sub-level of technological security of a security document or security document form (hereinafter referred to as a “sub-level of technological security”) means a subdivision unit of the level of protection of a security document or security document form based on a particular combination of different-level compulsory technological security features used in the security document or security document form.
  15. Features of technological security of a security document or security document form (hereinafter referred to as “technological security features”) mean special materials and methods used to protect a security document or security document form against forgery.
  16. Description of technological security features of a security document or security document form (hereinafter referred to as a “description of technological security features”) means information on the features of technological security used to protect a security document or security document form against forgery intended for the public, specialists and experts to establish the authenticity of the security document or security document form.
  17. Description of technological security features of a security document or security document form for experts (hereinafter referred to as a “description of technological security features for experts”) means classified information on the features of technological security used to protect a security document or security document form against forgery and technical data thereof intended for bodies carrying forensic document examination.
  18. Description of technological security features of a security document or security document form for specialists (hereinafter referred to as a “description of technological security features for specialists”) means classified information on the features of technological security used to protect a security document or security document form against forgery intended for bodies supervising the circulation of the security documents or security document forms.
  19. Description of technological security features of a security document or security document form for the public (hereinafter referred to as a “description of technological security features for the public”) means publicly available information on the features of technological security used to protect a security document or security document form against forgery intended for the general public.
  20. Circulation of security documents or security document forms means the use of produced security documents or security document forms.
  21. Security document or security document form rejects (hereinafter referred to as (“rejects”) mean security documents or security document forms that prior to being released into circulation have been found not to comply with the approved standard form of the security document or security document form and their semi-finished products and waste not fit for further use in production.
  22. Security document or security document form production order means an agreement between the producer and the contracting authority in relation to the production of an issue of security documents or security document forms or part thereof.
  23. Contracting authority for the production of security documents or security document forms (hereinafter referred to as a “contracting authority”) means an institution approving the mandatory forms of government securities, tax stamps, public transport tickets, official marking signs and document forms or an institution commissioned thereof that submits to the producer a security document or security document form production order or has entered into a contract with the producer in relation to the production of the security documents or security document forms.
  24. Producer of security documents or security document forms (hereinafter referred to as a “producer”) means a company or foreign company branch that has, following the procedure set forth by legal acts, entered into a contract with the contracting authority regarding the production of security documents or security document forms or has received an order to produce them.
  25. Issuance of security documents or security document forms means the preparation and approval of the mandatory forms of government securities, tax stamps, public transport tickets, official marking signs and document forms and the preparation, co-ordination and approval of the sketches and graphic designs of security documents or security document forms.
  26. Issue of security documents or security document forms means the number of security documents or security document forms to be produced specified in the contract concluded between the contracting authority and the producer.
  27. Specialist in supervision of the circulation of security documents or security document forms means a person possessing special knowledge and skills carrying out the supervision of the circulation of security documents or security document forms.
  28. Security document or security document form production company (hereinafter referred to as a “company”) means an economic entity set up in accordance with the procedure prescribed by the legal acts that is entitled to produce security documents or security document forms.
  29. Technological security of security documents and security document forms means the totality of features used to protect security documents or security document forms against forgery.
  30. Security document means government securities, a tax stamp, public transport ticket and official marking sign that has been assigned to a specific level or sub-level of technological security.
  31. Security document form means a security document form that has been assigned to a specific level or sub-level of technological security.
  32. Special materials used for the production of security documents or security document forms mean special paper, security inks and other materials used for the production of security documents or security document forms that technologically protect them against forgery.
  33. Producer of a technological security feature means a legal entity producing a technological security feature based on the technical data approved by the Service of Technological Security of State Documents under the Ministry of Finance.
  34. Third state means any state that is not Member State of the European Union or other state that is member of the European Economic Area.
  35. Foreign company branch producing security documents or security document forms (hereinafter referred to as a “foreign company branch”) means a branch set up in the Republic of Lithuania of a company established in one of the Member States of the European Union or other states members of the European Economic Area that is entitled to produce security documents or security document forms.
  36. Mandatory form of government securities, a tax stamp, public transport ticket, official marking sign and document form (hereinafter referred to as a “mandatory form”) means the particulars and technical data (form, measurement, number of sheets, etc.) of government securities, a tax stamp, public transport ticket, official marking sign and document form.
  37. Government securities mean the securities issued by the Government on behalf of the State on domestic or foreign markets attesting to the right of holder thereof to obtain within the time limits provided for an amount corresponding to nominal value thereof, interest or another equivalent.
  38. Institution approving the mandatory form of government securities, a tax stamp, public transport ticket, official marking sign and document form (hereinafter referred to as an “approving institution”) means a state or municipal institution or agency of the Republic of Lithuania or other legal entity authorized by legal acts of the Republic of Lithuania or the European Union that approves the mandatory forms of government securities, tax stamps, public transport tickets, official marking signs and document forms. Article
  39. Service of Technological Security of State Documents under the Ministry of Finance
  40. Technological security of security documents and security document forms and licensed activity shall be supervised by the Service of Technological Security of State Documents under the Ministry of Finance (hereinafter referred to as the “Service”).
  41. The regulations of the Service shall be approved by the Government of the Republic of Lithuania.
  42. The Service shall: 1) supervise the production of technological security features and standard forms of security documents and security document forms; 2) approve compulsory and supplementary technological security features and indicate the technical data of the technological security features; 3) prepare, approve and store the sketches, graphic designs and standard forms of security documents and security document forms; 4) prepare, approve and distribute the descriptions of technological security features for the public, specialists and experts, determine the classification level of the descriptions of the technological security features; 5) organise the evaluation of technological security features and submit conclusions on the use thereof; 6) issue licenses for the production of security documents and security document forms, suspend the licenses, revoke the suspension of the licences and revoke the licences; 7) perform the supervision of compliance with the licensed activity requirements; 8) where licensed activity involves the use of classified information, provide information on the producers to the body ensuring the security of classified transactions with a view to verifying the issue of a certificate confirming the reliability of the company and the consent received from the State Security Department authorizing to work with or have access to classified information, issue authorizations to employees of the producer to work with or have access to the classified information; 9) manage the Register of Security Documents and Security Document Forms; 10) submit proposals to the Ministry of Finance of the Republic of Lithuania (hereinafter referred to as the “Ministry of Finance”) for the improvement of legal acts regulating the technological security of security documents and security document forms, the issuance and production thereof; 11) while performing its functions, co-operate with the state and municipal institutions and establishments to identify cases of unlawful production of security documents and security document forms; 12) perform other functions set out in this Law and other legal acts.
  43. The information on the forgery of security documents and security document forms and methods of forgery shall be provided to the Service by the Ministry of the Interior of the Republic of Lithuania and bodies carrying out forensic document examination. Article
  44. Register of Security Documents and Security Document Forms
  45. The Register of Security Documents and Security Document Forms shall be the database of security documents and security document forms.
  46. The object of the Register of Security Documents and Security Document Forms shall be security documents and security document forms. The database of the Register shall store data on the technological security, issuance, production and forgery of security documents and security document forms.
  47. The Register of Security Documents and Security Document Forms shall be managed by the Service.
  48. The regulations of the Register of Security Documents and Security Document Forms shall be approved by the Government of the Republic of Lithuania. CHAPTER TWO TECHNOLOGICAL SECURITY FEATURES, LEVELS AND SUB-LEVELS Article
  49. Levels and Types of Technological Security Features
  50. There shall be four levels of technological security features: 1) the first level – technological security features that shall be easy to identify, intended for the public; 2) the second level – technological security features that shall be identified by the equipment confirming the presence of a particular technological security feature, intended for specialists; 3) the third level – technological security features that shall be identified by the equipment confirming the presence of a particular technological security feature, intended for experts and made available to the Service, the approving institution, where the approving institution requests it and is the subject of secrets, and the producer, where this is necessary for the process of production of security documents and security document forms; 4) the fourth level – technological security features that shall be identified by the equipment confirming the presence of a particular technological security feature and specifying technical data thereof, made available only to the director of the Service and/or several of his authorized representatives who have permission to work with or have access to classified information marked with a classification mark “Secret” and the producer of the technological security feature.
  51. Specific technological security features shall be assigned to a particular level of technological security features and approved by the Service.
  52. Technological security features shall be divided into the following types based on their use: 1) compulsory – the totality of essential technological security features ensuring the level of technological security of security documents and security document forms; 2) supplementary – the totality of selectively used technological security features enhancing the level of technological security of security documents and security document forms; Article
  53. Levels and Sub-Levels of Technological Security
  54. Based on technological security levels, security documents and security document forms shall be assigned to: 1) the highest level of technological security; 2) the higher level of technological security; 3) the medium level of technological security; 4) the lowest level of technological security;
  55. Technological security levels shall be divided into sub-levels.
  56. The Commission in charge of establishing technological security of security documents and security document forms (hereinafter referred to as the “Commission”) shall establish technological security levels and sub-levels, specify the number of technological security features in sub-levels, distributing technological security features in sub-levels based on the levels of technological security.
  57. The Commission shall evaluate and assign government securities, tax stamps, public transport tickets, official marking signs and document forms to a level or sub-level of technological security upon the publication of the legal act setting out the mandatory form of the government securities, tax stamps, public transport tickets, official marking signs and document forms, where the law provides for it.
  58. The decisions of the Commission shall be published in the supplement Informaciniai pranešimai to the official gazette Valstybės žinios.
  59. The Commission shall consist of 7 members with one member delegated from each of the following institutions: Service, Personalisation of Identity Documents Centre under the Ministry of the Interior, Ministry of Finance, Ministry of Foreign Affairs of the Republic of Lithuania, State Security Department of the Republic of Lithuania, Forensic Science Centre of Lithuania and Lithuanian Police Criminal Investigation Centre. The personal composition, chairman and rules of procedure of the Commission shall be determined by the Government of the Republic of Lithuania or an institution authorized thereof.
  60. A representative of the approving institution must attend meetings of the Commission. Where necessary, representatives of other institutions and independent experts may also be invited to attend meetings of the Commission. Article
  61. Co-ordination and Approval of Compulsory and Supplementary Technological Security Features
  62. Upon the decision of the approving institution, supplementary technological security features may be used in addition to the compulsory technological security features. The supplementary technological security features shall be approved by the Service, having co-ordinated them with the approving institution.
  63. The rules for co-ordination and approval of compulsory and supplementary technological security features of security documents and security document forms shall be approved by the Service.
  64. Where the Service possesses data on the forgery of security documents or security document forms, it may, having co-ordinated it with the approving institution, adopt a decision to replace and/or supplement the approved technological security features or submit to the Commission the following proposals: 1) to assign a security document or security document form to a higher level or sub-level of technological security; 2) to change the number of technological security features assigned to a particular level and sub-level of technological security; Article
  65. Descriptions of Technological Security Features
  66. Within 15 working days of receiving specimens of security documents or security document forms, the Service must prepare and approve by an order of the director the descriptions of technological security features to be presented to the public, specialists and experts.
  67. The Service must: 1) publish the description of technological security features intended for the public in the supplement Informaciniai pranešimai to the official gazette Valstybės žinios and the official website of the Service; 2) present the description of technological security features intended for specialists to the bodies supervising the circulation of security documents or security document forms following a written request from these bodies addressed to the Service; 3) present the description of technological security features intended for experts to the bodies carrying out forensic document examination following a written request from these bodies addressed to the Service.
  68. The procedure for preparing the descriptions of technological security features shall be approved by the Service. CHAPTER III ISSUANCE AND PRODUCTION OF SECURITY DOCUMENTS OR SECURITY DOCUMENT FORMS Article
  69. Preparation and Approval of the Mandatory Form of Government Securities, Tax Stamps, Public Transport Tickets, Official Marking Signs and Document Forms
  70. The preparation and approval of the mandatory form of government securities, tax stamps, public transport tickets, official marking signs and document forms shall be carried out by the approving institution. When being prepared, the mandatory form shall have the series marked with the letter (letters) “X” and the number marked with the digit (digits) “0”.
  71. The text and particulars of government securities, tax stamps, public transport tickets, official marking signs and document forms must comply with the norms of the standard Lithuanian language and the requirements of the official record keeping.
  72. The text and particulars of government securities, tax stamps, public transport tickets, official marking signs and document forms must be co-ordinated with the Lithuanian Archives Department under the Government of the Republic of Lithuania.
  73. The approving institution shall be held responsible for the text written in the mandatory form of government securities, tax stamps, public transport tickets, official marking signs and document forms.
  74. Upon the approval of the mandatory form of government securities, tax stamps, public transport tickets, official marking signs and document forms, following the publication of the legal act approving the mandatory form, where the publication of the respective legal act is required under the law, the approving institution must, within 30 days, request the Commission to evaluate the government securities, tax stamps, public transport tickets, official marking signs and document forms and assign them to a level or sub-level of technological security. Where the publication of the legal act approving the mandatory form of the government securities, tax stamps, public transport tickets, official marking signs and document forms is not provided for by the law, the approving institution must, within 30 days of approving the mandatory form, apply to the Commission. The Commission must, within one month of the day of receiving a request from the approving institution addressed to the Commission, evaluate the government securities, tax stamps, public transport tickets, official marking signs and document forms and assign them to a level or sub-level of technological security.
  75. Where the mandatory form of government securities, tax stamps, public transport tickets, official marking signs and document forms is approved by the Government of the Republic of Lithuania, a request to the Commission must be submitted by the Ministry of the respective sphere of management.
  76. The approving institution must, by order of the director, appoint a person responsible for applying to the Commission in accordance with the procedure laid down by this Law. Article
  77. Application to Register a Security Document or Security Document Form in the Register of Security Documents or Security Document Forms and to Prepare the Sketch and Graphic Design of a Security Document or Security Document Form
  78. The approving institution shall, following the assignment of government securities, tax stamps, public transport tickets, official marking signs and document forms to a level or sub-level of technological security and the publication of the decision of the Commission in the supplement Informaciniai pranešimai to the official gazette Valstybės žinios, within 30 days submit an application to the Service to register a security document or security document form in the Register of Security Documents or Security Document Forms and to prepare the sketch and graphic design of the security document or security document form (hereinafter referred to as an “application”). A separate application shall be submitted for each security document or security document form.
  79. The following must be indicated in the application: 1) the title of a security document or security document form; 2) the number of symbols in a security document or security document form numbers or series and numbers; 3) the issue of security documents or security document forms to be produced; 4) the sources of the official publication of the legal act approving the mandatory form of government securities, tax stamps, public transport tickets, official marking signs and document forms, where such publication is provided for by the law; 5) the level and sub-level of technological security of a security document or security document form; 6) other additional information.
  80. The head of the approving institution that is to submit an application to the Service must appoint by his order a person responsible for submitting the application in accordance with the procedure laid down by this Law.
  81. The form and instructions for completion of the application shall be approved by the Service. Article
  82. Preparation and Approval of the Sketch of a Security Document or Security Document Form
  83. The Service shall, within 30 working days of the approval of compulsory or supplementary technological security features, prepare a draft of the sketch of a security document or security document form (hereinafter referred to as a “draft of the sketch ”).
  84. When preparing a draft of the sketch of a security document or security document form, the Service shall co-ordinate the draft with the Lithuanian Heraldry Commission under the President of the Republic of Lithuania (where the heraldry of the Republic of Lithuania is used in the draft of the sketch), State Commission for Cultural Heritage (where images of monuments of architecture are used in the draft of the sketch), Ministry of Culture of the Republic of Lithuania (where elements of culture (music, art and other arts), characters or personalities are used in the draft of the sketch), approving institution or other bodies, if such co-ordination is specified by the legal acts currently in force. The Lithuanian Heraldry Commission under the President of the Republic of Lithuania, State Commission for Cultural Heritage, Ministry of Culture of the Republic of Lithuania, approving institution or other bodies shall agree to the draft of the sketch of the security document or security document form or shall submit their reasoned suggestions within 10 working days of the day of receiving the draft of the sketch. The Service shall submit the co-ordinated draft of the sketch of the security document or security document form to the approving institution for approval within 2 working days. Upon the approval of the draft of the sketch of the security document or security document form by the approving institution, the director of the Service shall approve it within 2 working days. The draft of the sketch of the security document or security document form shall be approved by an act the form of which shall be prescribed by the Service and which shall be signed by the head of the approving institution and director of the Service. Such act shall be approved using the stamps of the approving institution and the Service and specifying the date of the approval of the draft of the sketch of the security document or security document form. Article
  85. Preparation and Approval of the Graphic Design of a Security Document or Security Document Form
  86. Upon approving the draft of the sketch of a security document or security document form and after the contracting authority notifies the Service in writing of the selected producer of the security document or security document form and the date of submitting the order for the production of the security document or security document form, the Service shall, within 30 working days, prepare the graphic design of the security document or security document form. If the approving institution does not agree to the graphic design of the security document or security document form, it shall, within 5 working days, submit to the Service its reasoned suggestions. If there are no suggestions, the approving institution shall approve the graphic design of the security document or security document form and shall submit it to the Service. The director of the Service shall approve this graphic design of the security document or security document form within 2 working days.
  87. The graphic design of a security document or security document form shall be approved with the signatures and stamps of the head of the approving institution and director of the Service, specifying the date of approval of the graphic design of the security document or security document form. The graphic design of the security document or security document form shall be approved by an act the form of which shall be prescribed by the Service.
  88. After the contracting authority notifies the Service in writing of the producer and the date of submitting the order for the production of a security document or security document form, the Service shall, within 10 working days, forward to the producer the approved graphic design of the security document or security document form recorded on a digital (electronic) medium. Article
  89. Selection of the Producer
  90. The producer shall be selected by the contracting authority in accordance with the procedure laid down by laws and other legal acts.
  91. When arranging the purchase of the production services of security documents or security document forms and the purchase of security documents or security document forms, the contracting authority must indicate in the purchasing documentation that the security documents security document forms shall be produced in accordance with the requirements established in this Law and other legal acts regulating the production of security documents or security document forms. Article
  92. Preparation, Approval and Storage of the Standard Form of a Security Document or Security Document Form
  93. The producer shall produce the standard form of a security document or security document form in accordance with the approved form of government securities, a tax stamp, public transport ticket, official marking sign and document form as well as the graphic design and approved compulsory or compulsory and supplementary technological security features of the security document or security document form.
  94. A representative of the Service shall be present during the course of production of the standard form of a security document or security document form. The producer may apply for the approval of the standard form of the security document or security document form after the representative of the Service confirms that the draft of the standard form of the security document or security document form contains all the approved technological security features and the draft of the standard form of the security document or security document form has been produced in accordance with the approved mandatory form of government securities, a tax stamp, public transport ticket, official marking sign and document form as well as the graphic design of the security document or security document form. The rules for approval of the standard form of the security document or security document form shall be prescribed by the Service.
  95. The standard form of a security document or security document form must have the metrics of the security document or security document form and zero numbering or the metrics of the security document or security document form and the series marked with the letter (letters) “X” and zero numbering or the metrics of the security document or security document form and the series marked with the digit (digits) “0” and the letter (letters) “X” and zero numbering.
  96. The standard form of a security document or security document form shall be approved by writing an act approving the standard form of the security document or security document form with the form of the act prescribed by the Service. The standard form of the security document or security document form shall be approved with the signatures and stamps of the representatives of the approving institution that submitted the application, Service and producer, specifying the date of approval of the standard of the security document or security document form.
  97. A new standard form of a security document or security document form shall not be approved if the year of submitting the order to the producer is changed in the metrics of the security document or security document form or if the contracting authority arranges with the producer for the security document or security document form to be filled in typographically without changing the mandatory form of government securities, a tax stamp, public transport ticket, official marking sign and document form. Where it is necessary to change the metrics of the security document or security document form, the contracting authority must inform the Service in writing, providing information on the year of submission of the order to the producer.
  98. The approving institution, Service and producer shall each store one copy of the standard form of a security document or security document form. Article
  99. Specimens of a Security Document or Security Document Form
  100. Upon the approval of the standard form of a security document or security document form, the producer must, within 15 working days, submit to the Service and contracting authority the number of specimens of the security document or security document form specified by the Service.
  101. The producer must register the specimens of a security document or security document form in accordance with the Rules of Work in Restricted Access Area. These shall be approved by the Government of the Republic of Lithuania or an institution authorised thereof.
  102. The producer may keep specimens of security documents or security document forms for own use, however they must have a registration number and must be entered into the registration documents. Article
  103. Production of an Issue of Security Documents or Security Document Forms
  104. The production of an issue of security documents or security document forms shall commence after the standard form of the security document or security document form is approved by the act approving the standard form of the security document or security document form.
  105. Only the number (issue) of security documents or security document forms specified in the order shall be produced.
  106. Upon receiving the order, the producer must, within 3 working days, notify the Service in writing of each order for the production of security documents or security document forms received, specifying the contracting authority, order number, title of the ordered security document or security document form, identification number or code, ordered issue and date of receiving the order.
  107. Upon executing the order, the producer must, within 5 working days, notify the Service of it in writing, specifying the order number of the produced security document or security document form, contracting authority, issue produced, title of the security document or security document form, identification number or code, series and numbers and date of executing the order. Article
  108. Quality Control of Security Documents or Security Document Forms
  109. Quality control of security documents or security document forms shall be carried out by way of selection by representatives of the contracting authority and Service during the course of production of the security documents or security document forms after the produced issue or order is delivered onto the premises of the producer where ready production is stored. The Service may partake in the process of carrying out quality control of the security documents or security document forms upon delivering them to the contracting authority if the contracting authority submits a written request thereof.
  110. If security documents or security document forms have not been produced by a company registered in the Republic of Lithuania or foreign company branch, quality control of the produced security documents or the security document forms shall be carried out by way of selection, where this is provided for in the contract for the production of the security documents or security document forms concluded between the contracting authority and the producer.
  111. The rules for quality control of security documents or security document forms by way of selection shall be approved by the Government of the Republic of Lithuania or an institution authorized thereof. CHAPTER FOUR REQUIREMENTS FOR THE PRODUCTION OF SECURITY DOCUMENTS AND SECURITY DOCUMENT FORMS Article
  112. Licensing of Security Document and Security Document Form Production
  113. Security documents or security document forms shall be produced in a company or foreign company branch that possess licenses to produce the security documents or security document forms (hereinafter referred to as a “license”) or, where the company is registered in a Member State of the European Union or other state that is member of the European Economic Area, documents issued by the Government of the respective state or an institution authorized thereof, permitting to produce the security documents or security document forms. Companies of third states shall be granted the right to produce the security documents or security document forms on the basis of reciprocity, where companies of the Republic of Lithuania are granted no lesser rights in the third state.
  114. The requirements for licensing of the production of security documents and security document forms shall be approved by the Government of the Republic of Lithuania. Article
  115. Realisation and Destruction of Unused Remains of Special Materials Used for the Production of Security Documents or Security Document Forms Upon Losing the Right to Produce the Security Documents and Security Document Forms
  116. Upon losing the right to produce security documents and security document forms, a company or foreign company branch must, within 6 months, realise unused remains of special materials used for the production of the security documents or security document forms. The unused remains of the special materials used for the production of the security documents or security document forms may only be realised by the company or foreign company branch upon receiving a written consent of the Service.
  117. If a company or foreign company branch that lost the right to produce security documents and security document forms do not realise unused remains of special materials used for the production of the security documents or security document forms within the specified period of time, the unused remains must be destroyed. The unused remains of the special materials used for the production of the security documents or security document forms shall be burnt or affected mechanically in such a way that their use for the direct purpose would be impossible. When destroying the special materials used for the production of the security documents or security document forms, an act documenting destruction of the special materials used for the production of the security documents or security document forms shall be written. It shall include the following: date of writing the act, title or code of the special materials used for the production of the security documents or security document forms, quantity (kg, m, m², units) and positions, names, surnames and signatures of the persons writing the act. The remains of the special materials used for the production of the security documents or security document forms shall be destroyed by the company or foreign company branch with participation of a representative of the Service. Article
  118. Production of Security Documents and Security Document Forms
  119. The producer shall produce security documents and security document forms in accordance with the Rules of Work in Restricted Access Area. If the producer is registered in a foreign state, he must present to the contracting authority documents issued by the Government of the respective state or an institution authorized thereof, which would confirm that the producer is able to produce security documents and security document forms in accordance with the Rules of Work in Restricted Access Area.
  120. The premises used for the production and storage of security documents and security document forms as well as tools and materials related to the production must comply with the Security Requirements for Premises Used for the Production of Security Documents and Security Document Forms approved by the Government of the Republic of Lithuania or an institution authorized thereof. The producer registered in a foreign state must present to the contracting authority documents issued by the Government of the respective state or an institution authorized thereof, which would confirm that the security of the premises used by the producer for production of the security documents and security document forms complies with the requirements for the security of premises used for the production of the security documents and the security document forms set out in the respective state.
  121. Where the production of security documents and security document forms involves classified information marked with classification marks “Confidential”, “Secret” or “Top Secret”, the producer must, in accordance with the procedure laid down by legal acts, obtain a certificate of reliability of the company. The producer registered in a foreign state must present to the contracting authority documents issued in accordance with the procedure laid down by legal acts of the respective state that would confirm the reliability of the respective producer to protect classified information when producing the security documents and security document forms.
  122. The documents specified in paragraphs 1-3 of this Article must be obtained from the producer registered in a foreign state by the contracting authority.
  123. The producer must ensure that the production of security documents and security document forms complies with the production requirements, the produced security documents and security document forms are in compliance with the approved standard form of the security documents and security document forms and that the rejects of the security document or security document form production do not get into circulation.
  124. After the producer concludes a contract with the contracting authority on the production of security documents or security document forms, he must, within 3 working days, notify the Service of the contract concluded, specifying the day of concluding the contract, the contracting authority, titles of the security documents or security document forms and number of the security documents or security document forms to be produced. The producer also must, within 3 working days, notify the Service of any changes in or extensions of the contract, where this is due to the change in the number of the produced security documents or security document forms.
  125. Upon the production of the number of security documents or security document forms specified in the contract or the order, the rejects of the production must be destroyed in the presence of authorized representatives of the producer and Service. The contracting authority shall be informed of the place and time of destroying the rejects. A representative thereof shall have the right to take part in the process of destroying the rejects. CHAPTER FIVE FINAL PROVISIONS Article
  126. Liability for Infringement of this Law The legal and natural persons in breach of the provisions of this Law shall be held liable under the laws of the Republic of Lithuania. I promulgate this Law passed by the Seimas of the Republic of Lithuania PRESIDENT OF THE REPUBLIC Rolandas paksas
