Republic of Lithuania LAW ON THE WEAPONRY FUND UNDER the Government of the Republic of LithuaniA 11 July 1996 No I-1485 Vilnius (As last amended on 20 May 2008 – No X-1550) CHAPTER ONE GENERAL PROVISIONS Article
- Purpose of the Law This Law shall establish the status, legal basis of the activities, tasks, functions, structure and financing of the Weaponry Fund of the Republic of Lithuania under the Government of the Republic of Lithuania. Article
- The Weaponry Fund of the Republic of Lithuania under the Government of the Republic of Lithuania.
- The Weaponry Fund of the Republic of Lithuania under the Government of the Republic of Lithuania (hereinafter referred to as the "the Weaponry Fund") shall be a government institution established by the Government, which supplies state institutions, legal and natural persons with arms, ammunition, explosives, special devices, as well as carry out other functions laid down in this Law.
- The Weaponry Fund shall be a public legal person, which has accounts with a bank and the seal bearing the State Emblem of Lithuania and the legend "The Weaponry Fund of the Republic of Lithuania under the Government of the Republic of Lithuania". Article
- Legal Basis of the Activity of the Weaponry Fund
- The Weaponry Fund shall act in compliance with the Constitution of the Republic of Lithuania, this Law and other laws, international treaties of the Republic of Lithuania, the regulations of the Weaponry Fund, and other legal acts.
- The Government shall approve the regulations of the Weaponry Fund. CHAPTER TWO TASKS, FUNCTIONS AND DUTIES OF THE WEAPONRY FUND Article
- Tasks of the Weaponry Fund The tasks of the Weaponry Fund shall be to supply state institutions and legal persons with arms, ammunition, explosives or special devices, as well as natural persons with short firearms classified in categories B and C, and ammunition for these arms. Article
- Functions and Rights of the Weaponry Fund
- The Weaponry Fund shall perform the following functions: 1) to collect, analyse and store information about arms, ammunition, explosives, special devices, new types and models of arms, ammunition, explosives or special devices, their technical data and trends of their development; 2) to furnish to state institutions, legal persons the available information about the arms, ammunition, explosives or special devices needed by them; 3) to draw up each year annual purchase plans according to applications submitted by state institutions regarding the acquisition of arms, ammunition, explosives, special devices needed by them, and, pursuant to the approved purchase plans and the contracts concluded with the state institutions, to purchase and transfer to the state institutions or to sell to them the arms, ammunition, explosives and special devices; 4) to keep the State Register of Arms in accordance with the procedure laid down by the Government; 5) to purchase and sell short firearms classified in categories B, C, ammunition for such arms, explosives or special devices to legal persons, as well as short firearms classified in categories B, C and ammunition for such arms to natural persons; 6) to control within its competence the circulation of arms, ammunition, explosives, special devices in the territory of the Republic of Lithuania, and to issue certificates of the final user in the cases and according to the procedure laid down by legal acts; ) 7) to organize realisation or destruction of the arms and ammunition forfeited in accordance with the procedure laid down by legal acts; 8) to collect data on the circulation of firearms, ammunition, explosives in the Republic of Lithuania and to furnish such information to the interested institutions or international organizations; 9) in the cases established by laws and other legal acts of the Republic of Lithuania to issue licences to engage in appropriate economic and business activities, and to exercise the supervision of such activities; 10) to carry out other functions prescribed by laws and other legal acts of the Republic of Lithuania.
- The Weaponry Fund shall enjoy the following rights: 1) the exclusive right to supply the state institutions, except the Ministry of National Defence and the Army of Lithuania, with arms classified in category A, ammunition, their parts, short firearms classified in categories B, C, ammunition intended only for short firearms, their parts; 2) the exclusive right to trade in short firearms classified in categories B, C, ammunition intended only for short firearms, their parts within the territory of the Republic of Lithuania; 3) to import into the Republic of Lithuania, to export from it the arms classified in all categories, ammunition, parts of arms and ammunition, explosives, special devices; 4) other rights defined by laws and other legal acts of the Republic of Lithuania. - Duty to Provide Information On the written request of the Weaponry Fund, state or municipal institutions, registers or other legal persons must for free provide the Weaponry Fund with the data necessary to fulfil its tasks and functions. CHAPTER THREE THE STRUCTURE AND PERSONNEL OF THE WEAPONRY FUND Article
- Structure of the Weaponry Fund
- The Weaponry Fund shall be headed by the Director. He shall be appointed and dismissed by the Prime Minister in accordance with the procedure laid down by the Law on Civil Service. The Director shall be subordinate to the Prime Minister.
- The Director may have a deputy. He shall be appointed and dismissed by the Director in accordance with the procedure laid down by the Law on Civil Service.
- The Weaponry Fund shall consist of structural subdivisions necessary to carry out the functions of the Weaponry Fund.
- The structure and the list of positions shall be set and approved by the Director. Article
- Personnel of the Weaponry Fund
- The personnel of the Weaponry Fund shall comprise civil servants and the employees working under employment contracts.
- The status of civil servants of the Weaponry Fund, conditions of their remuneration and social guarantees shall be defined by the Law on Civil Service. The status of the employees working under employment contracts, conditions of their remuneration and social guarantees shall be defined by the Labour Code and other legal acts. CHAPTER FOUR FINANCING OF THE WEAPONRY FUND Article
- Financing of the Weaponry Fund
- The Weaponry Fund shall be a budgetary institution financed with the funds of the State budget.
- Purchase of arms, ammunition, explosives and special devices carried out by the Weaponry Fund according to applications of state institutions and on their assignment shall be financed from the allocations approved for appropriate state institutions in the State budget and the State investment programme for an appropriate year, when the said institutions transfer to the Weaponry Fund the funds designated for the purchase.
- Purchase according to applications of other legal persons shall be financed by transferring the funds designated for the purchase pursuant to the procedure laid down in sales and purchase agreements.
- Assignments of state institutions to the Weaponry Fund for purchase of arms, ammunition, explosives and special devices shall be executed in the form of agency agreements. I promulgate this Law passed by the Seimas of the Republic of Lithuania. PRESIDENT OF THE REPUBLIC ALGIRDAS BRAZAUSKAS
