LIETUVOS RESPUBLIKOS REPUBLIC OF LITHUANIA PASSPORT LAW 8 November 2001 – No IX-590 (As last amended on 12 November 2009 – No XI-470) Vilnius Article
- Purpose of the Law
- This Law shall establish the purpose of the passport, the conditions of its issuance, replacement and validity as well as data recorded thereon.
- The provisions of this Law have been harmonised with the legal acts of the European Union referred to in the Annex to this Law. Article
- Passport and Its Purpose
- The passport is a personal document of a citizen of the Republic of Lithuania (hereinafter referred to as a “citizen”) confirming his identity and citizenship and intended for travelling to foreign states.
- The passport may also be used in the Republic of Lithuania.
- It shall not be obligatory to possess a passport; it shall be issued at the citizen’s request.
- The form of a passport shall be established by the Minister of the Interior. Article
- Period of Validity of Passport
- A passport issued to a citizen under 18 years of age shall be valid for not longer than 5 years.
- A passport issued to a citizen over 18 years of age shall be valid for a period of 10 years. Article
- Passport Records
- The following data about a citizen shall be recorded in a passport according to the data of the central database of the Residents’ Register of the Republic of Lithuania (hereinafter referred to as the “Residents’ Register”): 1) name (names); 2) surname; 3) sex; 4) date of birth; 5) place of birth (name of the State is entered); 6) personal number; 7) citizenship.
- A passport must contain the facial image of a citizen and his signature. The citizen who is unable to sign as a result of his physical disability or because he is legally incapable may be issued a passport without his signature.
- The data referred to in paragraph 1 of this Article as well as the facial image and fingerprints of a citizen shall be recorded in a passport electronically. Note. The provision of paragraph 3 regarding the data about a citizen and the electronic recording of the citizen’s facial image in a passport shall enter into force on 28 August 2006 and the provision of paragraph 3 on the recording of the citizen’s fingerprints in a passport shall enter into force not later than within 36 months after the establishment by the European Commission the technical specifications relating to the fingerprints. The provisions of paragraph 3 shall not apply to passports issued prior to the date of entry into force of the specified provisions.
- In addition to the data specified in paragraph 1 of this Article, the following shall also be recorded in the passport: 1) issue date; 2) name of the issuing institution; 3) expiry date. 4) passport number.
- Data in the passport shall be recorded in Lithuanian characters and the name (names) and surname of a citizen - in accordance with the procedure established by legal acts of the Republic of Lithuania regulating the writing of names and surnames in personal documents. Article
- Issuance and Replacement of Passport
- A passport shall, on the application of a citizen, be issued and replaced by institutions authorised by the Minister of the Interior (hereinafter referred to as an “authorised institution”), and where conditions laid down in the Consular Statute of the Republic of Lithuania are present – by diplomatic missions or consular posts of the Republic of Lithuania (hereinafter referred to as “consular posts of the Republic of Lithuania”) in accordance with the procedure established by the Minister of the Interior and the Minister of Foreign Affairs.
- A citizen residing in the Republic of Lithuania must appear in person for the issuance and replacement of a passport at an authorised institution which is the most convenient for him, except for the case specified in paragraph 4 of this Article. A legally incapable citizen shall apply for the issuance or replacement of a passport through his guardian or other legal representative and a citizen who cannot appear in person because of his physical disability – through an authorised person. If, due to his legal incapability or physical disability, the citizen cannot appear at an authorised institution to submit documents for the issuance and replacement of the passport, the authorised institution must be satisfied as to the identity of this citizen.
- A person residing in a foreign state must apply in person for the issuance or replacement of a passport to a consular post of the Republic of Lithuania or an authorised institution, except for the case specified in paragraph 4 of this Article. A legally incapable citizen shall apply for the issuance or replacement of a passport through his guardian or other legal representative and a citizen who cannot appear in person because of his physical disability – through an authorised person. If, due to his legal incapability or physical disability, the citizen cannot appear at the consular post of the Republic of Lithuania or the authorised institution to submit documents for the issuance and replacement of the passport, the consular post of the Republic of Lithuania or the authorised institution must be satisfied as to the identity of this citizen. The procedure for submitting documents pertaining to the issuance and replacement of a passport to consular posts of the Republic of Lithuania, forwarding such documents to an authorised institution and presenting the passport to a citizen shall be established by the Minister of the Interior and the Minister of Foreign Affairs.
- A passport for a citizen under 18 years of age shall be issued or replaced on the application of one of the parents (foster parents) or a guardian (curator) of the child. If the parents of the child are divorced, the passport shall be issued or replaced on the application of one of the parents (foster parents) with whom the child's residence is established. Taking into consideration the interests of the child, the passport may be issued or replaced without such application through the mediation of the State Children's Rights Protection Service. When submitting documents for the issuance and replacement of the passport of a citizen under the age of one, his appearance at the authorised institution or consular posts of the Republic of Lithuania shall not be obligatory.
- A passport shall be replaced if: 1) a citizen changes the data specified in subparagraphs 1-6 of paragraph 1 of Article 4 of this Law; 2) it is no longer fit for use; 3) passport pages designated for visas are full; 4) its period of validity has expired; 5) it contains inaccurate records; 6) the citizen so requests.
- When submitting documents for the replacement of a passport, a citizen must submit his current passport. Upon verification of the data, this passport shall be returned to him.
- A new passport shall be collected by the citizen or a person authorised by him or other legal representative. If the passport is collected by a person authorised by the citizen, he must present a document confirming his identity and an authorisation and if the passport is collected by a guardian or other legal representative of a legally incapable citizen, he must present documents confirming the mentioned circumstances and his identity. A new passport for a citizen residing abroad may be dispatched, at the citizen’s request and expense, by a consular post of the Republic of Lithuania by post or other safe method. Upon receipt of a new passport, such citizen must inform the consular post of the Republic of Lithuania. The procedure for the dispatch of the passport by post or other safe method and notification of the receipt thereof shall be established by the Minister of the Interior and the Minister of Foreign Affairs.
- When collecting a new passport, the current passport must be submitted. It shall be marked as invalid and returned to the citizen or a person authorised by him and if the citizen is legally incapable – to his guardian or other legal representative. If the invalid passport being returned is refused to be accepted, it shall be destroyed in accordance with the procedure established by the Minister of the Interior and the Minister of Foreign Affairs. In the cases provided for in paragraph 7 of this Article, where a new passport is dispatched by post or other safe method, the current passport shall not be submitted to the consular post of the Republic of Lithuania or an authorised institution upon receipt of the new passport.
- In the event of loss or theft of a passport, the citizen must report the loss or theft to the police, an authorised institution or a consular post of the Republic of Lithuania. The lost or stolen passport shall be declared invalid. A new passport shall be issued to the citizen at his request.
- If a passport is lost or stolen, it is no longer fit for use or its period of validity expires while a citizen is temporarily staying in a foreign state, a consular post of the Republic of Lithuania may issue a document permitting him to return to the Republic of Lithuania or a document permitting him to continue his journey, where the citizen is not in possession of any other valid travel document. The forms of such documents and the procedure for their issuance shall be established by the Minister of Foreign Affairs.
- Upon finding a passport of another citizen, a person must deliver it to the police or an authorised institution or consular post of the Republic of Lithuania.
- An authorised institution shall issue or replace a passport within one month from the date of receipt of the documents, and a consular post of the Republic of Lithuania – within two months from the date of receipt of the documents.
- State fees or consular fees for the performed consular acts as provided for in subparagraph 5 of paragraph 1 of Article 3 of the Republic of Lithuania Law on Consular Fees in the amount prescribed by the Government shall be charged for the issuance or replacement of a passport. Article
- Invalid Passport
- A passport shall become invalid upon expiry of the period of its validity, declaration of its invalidity or death of a citizen.
- A passport shall be declared invalid if: 1) it belongs to a person who has lost the citizenship of the Republic of Lithuania; 2) it has been lost or stolen; 3) it has been replaced on the grounds specified in subparagraphs 1, 2, 3, 5 and 6 of paragraph 5 of Article 5 of this Law; 4) it has not been collected by the citizen within one year from the day of its issue; 5) certain circumstances have transpired as a result of which it could not have been issued; 6) it has been forged. 7) a citizen has been issued an identity card with his personal data being altered;
- A person who has lost the citizenship of the Republic of Lithuania as well as a person, upon the issuance of the passport to whom certain circumstances have transpired as a result of which he could not have been issued a passport, must return the passport to an authorised institution or consular post of the Republic of Lithuania. The consular post of the Republic of Lithuania shall forward the returned passport to the authorised institution.
- The passport of a deceased person shall be returned to the Civil Registration Agency according to the place of residence or death or to a consular post of the Republic of Lithuania and these institutions shall forward the passport to the authorised institution.
- A passport shall be declared invalid by an authorised institution or, in the case provided for in the Consular Statute of the Republic of Lithuania – a consular post of the Republic of Lithuania. The procedure for declaring a passport invalid, forwarding an invalid passport to an authorised institution and destroying an invalid passport shall be established by the Minister of the Interior and the Minister of Foreign Affairs. - Seizure of Passport
- Upon establishing that a citizen uses the passport of another citizen or a passport declared invalid on the grounds specified in subparagraphs 1, 2, 5, 6 and 7 of paragraph 2 of Article 6 of this Law, the police or other law enforcement institution and, where the citizen is abroad, a consular post of the Republic of Lithuania must seize the passport and forward it to an authorised institution.
- The police or other law enforcement institution or the court shall seize the passport, if such passport has been issued, of a citizen under arrest, also a citizen sentenced to imprisonment or a citizen who is subject to an administrative arrest. The passport shall be returned to the citizen who has been released from arrest, paroled from the place of confinement, who has served his sentence or whose administrative arrest has terminated.
- It shall be prohibited to seize the passport of a citizen, except in cases specified by this or other laws of the Republic of Lithuania. Article
- Liability Persons who violate this Law shall be held liable in accordance with the procedure established by laws of the Republic of Lithuania. Article
- Entry into Force and Implementation of the Law
- This Law shall come into force on 1 January
- (Repealed on 1 January 2010). I promulgate this Law passed by the Seimas of the Republic of Lithuania.
