Translation from Lithuanian Translation from Lithuanian GOVERNMENT OF THE REPUBLIC OF LITHUANIA R E S O L U T I O N No. 599 On the approval of vegetable quarantine regulations for import and export of goods of vegetable origin to and from the Republic of Lithuania and their transit through the territory of the Republic of Lithuania Vilnius, 3 August 1993 Seeking to avoid the spreading of agricultural pests, vegetable diseases and weeds, the Government of the Republic of Lithuania r e s o l v e s :

1. To approve the vegetable quarantine regulations for import and export of goods of vegetable origin to and from the Republic of Lithuania and their transit through the territory of the Republic of Lithuania (attached).
2. To instruct the Ministry of Agriculture to approve the list of dangerous agricultural pests, vegetable diseases and weeds to which quarantine is applicable. Prime Minister Adolfas Ðleþevièius Minister of Agriculture Rimantas Karazija APPROVED by Resolution No. 599 of 3 August 1993 of the Government of the Republic of Lithuania Vegetable quarantine regulations for import and export of goods of vegetable origin to and from the Republic of Lithuania and their transit through the territory of the Republic of Lithuania
3. These regulations are applicable to goods of vegetable origin which are imported or exported to or from the Republic of Lithuania or in transit through the territory of the Republic of Lithuania (furtheron referred to as "goods of vegetable origin") and are submitted to quarantine checking (according to the appendix).
4. Quarantine and customs checking of goods of vegetable origin is performed jointly by the experts of State Border Vegetable Quarantine Points of the State Vegetable Quarantine Inspectorate of the Republic of Lithuania (furtheron referred to as "Vegetable Quarantine Points") and customs officials in line with the laws, other legal acts of the Republic of Lithuania and these regulations.
5. Goods of vegetable origin must be transported through the customs posts where vegetable quarantine points are operating. Goods of vegetable origin are not submitted to quarantine checking in case they are transferred across the state border of the Republic of Lithuania and the Republic of Latvia.
6. Vegetable Quarantine Service Points are operating inside the customs posts' zones. Acting officials of the Vegetable Quarantine Service Points and State Vegetable Quarantine Inspectorate of the Republic of Lithuania are allowed to enter the territory of border control points and customs control zone only upon the presentation of special official permits issued by the State Border Security Service of the Ministry of National Defence in accordance with the Customs Department under the Ministry of Finance.
7. While importing to the Republic of Lithuania the goods of vegetable origin included in the appendix, it is obligatory to present to the customs the phytosanitary certificate issued by the Vegetable Quarantine or Vegetable Protection Service of the exporting state. Certificate must bear a note "allowed for import" made by the Vegetable Quarantine Service Point. While importing the goods of vegetable origin marked in the appendix with a star one must additionally present to the customs the quarantine permit for import issued by the State Vegetable Quarantine Inspectorate of the Republic of Lithuania. This permit must contain the four figure codes of the imported goods according to the nomenclature of the Harmonized Commodity Description and Coding System.
8. Import of the following goods of vegetable origin to the Republic of Lithuania is allowed only with the presence of phytosanitary certificates issued by the Vegetable Quarantine or Vegetable Protection Service of the exporting country: 6.
9. samples of seeds and planting stock or seedlings for sort experimenting in botanical gardens, Botanical institute and institutes of education or scientific research; 6.
10. goods (products) of vegetable origin for consumption, charity purposes, humanitarian aid - to diplomatic missions, consulates, commercial representations and international governmental institutions as well as to persons enjoying privileges and immunities; 6.
11. samples of agricultural products and raw materials received by foreign trade institutions of the Republic of Lithuania; 6.
12. materials (to which quarantine is applicable) for non-commercial exhibitions. After the exhibition these materials are returned to the sending states.
13. While exporting the goods of vegetable origin from the territory of the Republic of Lithuania it is obligatory to submit to the customs a phytosanitary certificate issued by the State Vegetable Quarantine Inspectorate of the Republic of Lithuania. Certificate must contain the four figure codes of the exported goods according to the nomenclature of the Harmonized Commodity Description and Coding System.
14. Goods of vegetable origin in transit through the territory of the Republic of Lithuania must have a phytosanitary certificate issued by the State Vegetable Quarantine or Vegetable Protection Service of the exporting country. The Certificate must be submitted to the customs and must bear a note of a Vegetable Quarantine Service Point "permitted for transit through the territory of the Republic of Lithuania".
15. In the event the goods of vegetable origin are transferred across the state border of the Republic of Lithuania and the documents indicated in articles 5, 7 and 8 are not submitted to the customs, the customs checking is performed only in the presence of the officials of Vegetable Quarantine Service Point. In the event the quarantine checking is not performed, the goods of vegetable origin are not allowed to be taken out from the customs post zone.
16. Post deliveries containing goods of vegetable origin are submitted to customs checking only in the presence of the officials of Vegetable Quarantine Service Point. After the quarantine checking is carried out the post delivery is marked with a triangular stamp with the word "Lithuania" and symbols of corn ear and small serpent on it.
17. Only the following goods of vegetable origin for scientific and educational purposes are permitted to be delivered by post: live mushroom and bacteria cultures, viruses, nematodes, vegetable and soil pathogens, insects (live and inanimate), as well as collections of seeds, plant herbariums and samples of soil.
18. Post deliveries of vegetable and flower seeds (except seeds of leguminous plants) not exceeding 15 packages do not require quarantine permits and phytosanitary certificates.
19. Post deliveries of seeds, planting stock and seedlings, live insects or vegetable and soil pathogens are allowed to legal and natural persons having a phytosanitary certificate. Scientific research institutes, botanical gardens and other institutions of scientific research and education are allowed to exchange post deliveries of small samples of seeds, planting stock and seedlings without a phytosanitary certificate only with the presence of the stamp defined by article 10 on the package of the post delivery.
20. A person is allowed to transfer without quarantine permits and phytosanitary certificates not more than 3 bouquets of cut flowers or dried plants and non-infected goods of vegetable origin for consumption not exceeding 5 kilogrammes which have to undergo a phytosanitary checking in the Quarantine Service Point.
21. If suspected that goods of vegetable origin do not correspond to the requirements of phytosanitary regulations of the Republic of Lithuania, the officials of a Quarantine Service Point have the right according to the established procedure to take the samples of these goods for laboratory analysis.
22. Import of goods of vegetable origin to the Republic of Lithuania is prohibited in case these goods are infected by quarantine or dangerous vegetable pests, pathogens and weeds, which cannot be effectively fought.
