Translation from Lithuanian Translation from Lithuanian Government of the Republic of Lithuania R E S O L U T I O N No. 604 On the partial Amendments to the Resolution No. 169 of 16 March 1992 of the Government of the Republic of Lithuania of 16 March 1992 Vilnius, 4 August 1993 Government of the Republic of Lithuania r e s o l v e s: Partly amending Resolution No. 169 ON THE ACCELERATION OF OIL PRODUCTION AND PROCESSING of the Government of the Republic of Lithuania of March 16, 1992 (News, 1992, No. 16-434):

  1. In the Statute of Oil Works Licence Committee approved by the said Resolution: 1.1 to define 3.1 article as follows: "3.1 the participation of the most technically, financially and environmentally advanced Lithuanian and foreign legal and natural entities in oil works"; 1.2 to delete 4.1 article; 1.3 to define 4.2 and 4.3 articles as follows: "4.2 submit recommendations to the Government on the issuance of licences for oil prospecting, exploration and extraction; 4.3 submit recommendations to the Government of the Republic of Lithuania on the normative acts regulating oil works"; 1.4 to define article 5 as follows: "
  2. The Committee shall consist of one official each from the following institutions: the Department of the Environmental Protection of the Republic of Lithuania, Ministry of Energy, Ministry of Economics, Ministry of Trade and Industry, and State Geology Service under the Ministry of Construction and Urban Development".
  3. In the Provisional Regulations of Oil Prospecting, Exploration, and Production in the Republic of Lithuania approved by the said resolution: 2.1 to define article 2 as follows: "
  4. licences on oil prospecting, exploration and exploitation shall be issued to Lithuanian and foreign legal and physical entities by separate decisions of the Government of the Republic of lithuania upon the recommendation of Oil Works licence Committee (henceforth, the Committee) in coordination with the Department of the Environmental Protection of the Republic of Lithuania"; 2.2 to delete article 4; 2.3 to define article 5 as follows: "
  5. Gargþdai State Oil geology enterprise shall be entitled to carry out oil works not by way of competition"; 2.4 to define article 12 as follows: "
  6. The enterprise which participated in finding oil deposit in line with the established procedure may participate in the exploration of oil deposits and oil recovery"; 2.5 to supplement article 14 as follows: Territories (preserves, reserves and so on) may be designated within the sites of oil works prohibited from seismic exploration (explosion) and drilling works unless special stipulations are provided for these works"; 2.6 to supplement article 15 with the following paragraph: "Sites designated for oil prospecting may be expanded upon decision of the Committee'; 2.7 to define article 19 as follows: "19 The licence for one oil field shall be issued to only one licencee". A licencee may have licences for several oil fields, however, each licence shall be issued by way of separate competition"; 2.8 to define 22 -26 articles 22 - 26 as follows: '
  7. The licence provides the licencee with the right to prospect oil fields as well as to explore and exploit the found oil fields.
  8. Works in the licenced site are divided into three stages: prospecting, exploration and recovery. Each stage of works is defined by a time limit and a separate program of works, after accomplishing of which, a report in the appropriate form and geologic data are submitted to the Government of the Republic of Lithuania or to the authorised institutions.
  9. The expiry of licence is pertain to the stages of works specified above in article
  10. Prospecting may be carried out within tree years after the licence is issued. Upon the request of a licencee the Committee may prolong this period for the next 3 years provided the request is reasonably grounded. The discovered oil field is to be explored and prepared for recovery within 3 years after the day of approval of the program of works by the Government of the Republic of Lithuania. This timeframe may be prolonged for 1 year. The timeframe of oil recovery depends on the regime of oil recovery and economic feasibility. The timeframe of this stage is indicated in the programme and may be changed according to the procedure established in the program and in the contract.
  11. Provided the licencee fully carries out his/her commitments established in the program defining the earlier stages and submits the request to prolong the licence until the completion of the current stage, the licencee obtains the right to proceed with the works of the next stage.
  12. With regard to the results of the submitted report and the requests of the licencee while prolonging the licence to carry out separate stages of works the Committee may reduce the site designated for prospecting of oil fields or to allot an additional site to further carry out works."; 2.9 in articles 27.1, 27.2, 35 and 36 substitute words "State geology service" for the "State geology Service under the Ministry of Construction and Urban development"; 2.10 in articles 27.3, 33, 34 and 47 to substitute words "bodies, State agencies" for the "institutions, State institutions". 2.11 to define the first sentence of article 30 as follows: "The licencee may refuse to carry out oil works in the order established by the contract provided he submits written notification thereon to the Committee within the 6 months; 2.12 to define articles 43 and 44 as follows: "

The legal and physical entities of the Republic of Lithuania or other states whose applications have been endorsed by the Committee shall, within the time limit set by the Committee (according to the established timetable of the competition) submit to the said Committee feasibility studies of the prospective oil works, program of works and the version of the licence according to the typical licence form.
  14. The Committee within the period of 6 months, selects the candidate for licence to oil works and submit it to the Government of the Republic of Lithuania for approval"; 2.
  15. to delete article 46; 2.
  16. to define article 54 as follows: "
  17. Oil prospecting, exploration and extraction equipment shall be put to exploration and use of the State Labour Inspection and State Technical Survey Service according to the established procedure. 2.
  18. to define article 59 as follows: "
