1. These Regulations shall establish the types of visas required for crossing the State border of the Republic of Lithuania (hereinafter referred to as the border), the procedure for the issuing, extension and cancellation thereof, as well as the scope of powers of the State institutions which enforce these Regulations.
2. Foreign nationals and stateless persons (hereinafter referred to as foreigners), when entering the Republic of Lithuania, are required to have a visa of the Republic of Lithuania (hereinafter referred to as a visa), unless another procedure is provided for in the international agreements or resolutions of the Government of the Republic of Lithuania. A visa shall be the endorsement (inset) in a person's foreign passport or any other travel document recognised by the Republic of Lithuania (hereinafter referred to as a passport) which permits its holder to enter into, stay in, depart from, or travel through, the Republic of Lithuania.
3. Visas shall be issued at the diplomatic missions and consular institutions of the Republic of Lithuania abroad, the Consular Department of the Ministry of Foreign Affairs, and the Migration Department under the Ministry of Internal Affairs. By way of exception, visas may be issued at border crossing posts. Types of Visas
4. There shall be diplomatic, business, visitor, special, transit, and group visas. Diplomatic and Business Visas
5. Diplomatic and official visas shall be issued to persons who, pursuant to international agreements and laws of the Republic of Lithuania, as well as the universally recognised practice, are entitled to diplomatic and consular privileges and immunities as well as other privileges and immunities equated to them, and who enter the Republic of Lithuania officially or travel through it from third states.
6. Diplomatic visas shall be issued to the following persons: 6.
7. heads of foreign states (and their accompanying family members) as well as members of delegations headed by them; 6.
8. heads of governments of foreign states (and their accompanying family members), members of delegations headed by them, and members of parliaments and governments of foreign states; 6.
9. foreign affairs ministers of foreign states (and their accompanying family members) as well as members of the delegations headed by them; 6.
10. members of official delegations of foreign states (special missions) who are visiting the Republic of Lithuania or who are travelling through the Republic of Lithuania to third states as well as their accompanying family members; 6.
11. diplomatic agents and consular officers of foreign states who are travelling to the place of their appointment or returning therefrom as well as their accompanying family members. Spouses, sons under 18 years of age, and unmarried daughters of diplomatic agents or consular officers shall be recognised as their family members; 6.
12. representatives of international organisations and their family members (with the exception of service staff), if the visit and the composition of the delegation has been coordinated with the Ministry of Foreign Affairs; 6.
13. diplomatic and consular couriers of foreign states; and 6.
14. other persons pursuant to international agreements concluded by the Republic of Lithuania.
15. Business visas shall be issued to the following persons: 7.
16. members of administrative, technical and service staffs accredited to the diplomatic missions and consular institutions functioning in the Republic of Lithuania or travelling through the Republic of Lithuania to third states, as well as representatives of foreign mass media who are permanently employed in the Republic of Lithuania, and their accompanying family members. Spouses, sons under 18 years of age, and unmarried daughters of members of administrative, technical, or service staffs shall be recognised as their family members; 7.
17. members of parliamentary and governmental delegations of foreign states who are not entitled to a diplomatic visa; 7.
18. staff members of trade missions of foreign states in the Republic of Lithuania who are not entitled to a diplomatic visa; 7.
19. other persons pursuant to international agreements concluded by the Republic of Lithuania; and 7.
20. in cases not provided for in these Regulations - upon obtaining a permit from the Consular Department of the Ministry of Foreign Affairs.
21. Diplomatic and business visas shall be issued at the diplomatic missions or consular institutions of the Republic of Lithuania abroad as well as at the Consular Department of the Ministry of Foreign Affairs.
22. Diplomatic and business visas shall be issued upon receipt through diplomatic channels of a written application from the Ministry of Foreign Affairs of the respective state or from the diplomatic mission or consular institution of said state in the Republic of Lithuania, or upon receipt of a written application from an appropriate international organisation confirming that the person is entering Lithuania or travelling in transit through Lithuania in order to carry out business functions.
23. Diplomatic and business visas shall be issued for the requested time period, but they shall be valid for no longer than one year. Diplomatic and business visas shall be issued to employees of diplomatic and trade missions and consular institutions of foreign states as well as representative offices of international organisations in the Republic of Lithuania for the entire period of their accreditation or employment in the Republic of Lithuania. Business visas shall also be issued to foreign mass media representatives for the entire period of their employment in the Republic of Lithuania.
24. The registration and recording of diplomatic and business visas shall be carried out by the Ministry of Foreign Affairs.
25. Consular fees shall not be charged for the issue of diplomatic and business visas. Visitor Visas
26. Visitor visas shall be issued to foreigners who enter the Republic of Lithuania for a short stay for personal, tourism, commercial, medical, and other purposes.
27. Visitor visas shall be issued for the period specified in the visa application form, but for no longer than one year.
28. Visitor visas shall be issued by the diplomatic missions or consular institutions of the Republic of Lithuania abroad, as well as by the Migration Department under the Ministry of Internal Affairs. Special Visas
29. Special visas shall be issued to foreigners who enter the Republic of Lithuania to work or study.
30. Special visas shall be issued by the diplomatic missions or consular institutions of the Republic of Lithuania abroad upon receipt of a permit from the Migration Department under the Ministry of Internal Affairs. The Migration Department under the Ministry of Internal Affairs shall issue said visas for the period of employment or study. Transit Visas
31. Foreigners possessing a transit visa may travel in transit through the territory of the Republic of Lithuania (to and fro). With this visa, it shall be permitted to be in Lithuania for no longer than 48 hours each time. Transit visas shall be valid for up to one year.
32. Transit visas shall be issued to foreigners who possess visas of the state to which they are travelling through the Republic of Lithuania. In the event that entry to the third state is permitted without a visa, transit visas shall be issued to foreigners provided that they adhere to the rules of entry of the third state.
33. Transit visas shall be issued by the diplomatic missions or consular institutions of the Republic of Lithuania abroad as well as by the Migration Department under the Ministry of Internal Affairs. Group Visas
34. A group visa is a visitor or a transit visa issued to a group of persons.
35. Group visas may be issued if: 22.
36. a leader of the group has been appointed; 22.
37. the group is united by one common purpose (tourism, sports, art, etc.); and 22.
38. the date of entry and departure, the period and place of stay, and the itinerary is the same.
39. A group visa shall be a list of the persons of the group, at the end of which an appropriate mark concerning the number of persons travelling shall be put.
40. Group visas shall be issued by the diplomatic missions or consular institutions of the Republic of Lithuania abroad as well as by the Migration Department under the Ministry of Internal Affairs. Single Entry and Multiple Visas
41. A foreigner possessing a single entry visa is entitled to single entry into the Republic of Lithuania where he or she may stay for the period indicated in the visa; a person possessing said visa is also entitled to depart from the Republic of Lithuania.
42. A foreigner possessing a multiple visa is entitled to multiple visits to, stay in, and departure from, the Republic of Lithuania during the period for which the visa is valid.
43. Single visit and multiple diplomatic, business, visitor and transit visas shall be issued for no longer than one year. The entire period of stay in the Republic of Lithuania (including visa extension) may not exceed 90 days (this provision shall not be valid in the case of a transit visa). The above requirements shall not apply to persons specified in Pars. 6.3 and 7.
45. Special visas shall be multiple visas and shall be issued for the entire period of work or study in the Republic of Lithuania, but not more than 2 years. In the event that the period of work or study is longer than 2 years, a new special visa may be issued upon expiration of the initial 2 years.
46. Multiple visas shall be issued by the diplomatic missions or consular institutions of the Republic of Lithuania abroad as well as by the Migration Department under the Ministry of Internal Affairs. Submitting Visa Applications
47. The procedure for submitting applications for visas and the extension thereof shall be established by the Ministry of Internal Affairs in conjunction with the Ministry of Foreign Affairs.
48. Upon receipt of an application, diplomatic missions or consular institutions of the Republic of Lithuania abroad shall adopt the decision concerning the issue of a visa within 10 days. In the event that the conclusion of the Migration Department under the Ministry of Internal Affairs is required for adopting said decision, the time period may be extended to one month.
49. A visa which has not been used by a foreigner and whose period of validity has expired shall not be extended, with the exception of cases when the foreigner presents documents confirming that he or she could not use the visa for valid reasons (illness, etc.). The above requirement shall not apply to diplomatic and business visas.
50. Fees in the amount fixed by the Government of the Republic of Lithuania shall be charged for the issue or extension of visas and for the provision of services related thereto.
51. The time period specified in the visa (together with the extension thereof) for which a person is permitted to stay in the Republic of Lithuania may not exceed 90 days. The above provision shall not apply to diplomatic, business and special visas.
52. Visas shall not be issued to foreigners who: 35.
53. present a passport or any other travel document which is not recognised by, or is invalid in, the Republic of Lithuania; 35.
54. were deported from the Republic of Lithuania within the last 5 years; 35.
55. are unable to present documentation confirming that they possess the funds necessary for residing in the Republic of Lithuania and returning to the state of their residence or departing to another state whereto they have the right to depart; 35.
56. suffer from an illness or any other health disorder which may pose a threat to public health and safety and which is included in the list approved by the Ministry of Health; 35.
57. belong to a totalitarian or terrorist organisation or any other organisation which uses violence and poses a threat to the safety and public order in the Republic of Lithuania, or if they are members of a secret anti-state or criminal organisation; 35.
58. have committed crimes against the world and humanity, are war criminals or have participated in mass repressions; 35.
59. have assisted another foreigner in the illegal crossing of the state border of the Republic of Lithuania; 35.
60. when applying for a visa, deliberately presented faulty documents; 35.
61. have been declared "persona non grata"; and 35.
62. are ineligible due to other cases provided for in the laws of the Republic of Lithuania.
63. Upon refusal to issue a visa, a stamp shall be put in the document presented by the foreigner.
64. The decision to issue a visa or to deny a person a visa shall be adopted by an authorised officer of an appropriate State agency. In the case of any questionable issues or doubts concerning the issue of visas, the decision shall be adopted by the Migration Department under the Ministry of Internal Affairs, and abroad - by the Consular Department of the Ministry of Foreign Affairs Visa Issue Control and Cancellation of Visas
65. The procedure for the issue, registration, recording and cancellation of visas (with the exception of cases specified in Par. 11) shall be established by the Ministry of Internal Affairs.
66. The Migration Department under the Ministry of Internal Affairs shall compile a list of foreigners who are prohibited from entering the Republic of Lithuania. A foreigner may be prohibited from entering the Republic of Lithuania for a specified or indefinite period of time.
67. Visas may be cancelled on grounds established by the laws of the Republic of Lithuania.
68. Decisions concerning the cancellation of a visa shall be adopted: 41.
69. prior to the foreigner's entry into the Republic of Lithuania - by the Migration Department under the Ministry of Internal Affairs or by a diplomatic mission or consular institution of the Republic of Lithuania abroad which shall notify the Migration Department under the Ministry of Internal Affairs of the adopted decision; 41.
70. After the foreigner's entry into the Republic of Lithuania or arrival at a border point thereof - by the Migration Department under the Ministry of Internal Affairs. Decisions concerning the cancellation of diplomatic and business visas shall be adopted by the Ministry of Foreign Affairs. _____________________
