Translation from Lithuanian Translation from Lithuanian GOVERNMENT OF THE REPUBLIC OF LITHUANIA R E S O L U T I O N No. 388 On More Stringent Regulations on Purchase and Sale of Waste and Scrap of Ferrous Metals Vilnius, 1994 May 23 Enacting Law No. I-432 "On Supplements to Law on Enterprise of the Republic of Lithuania" (Records, No.30-533, 1994) and striving to introduce more stringent regulations on purchase and sale of waste and scrap of the ferrous metals, to prevent their plunder and uncontrolled transfer, the Government of the Republic of Lithuania r e s o l v e s:

  1. To approve the appended: 1.
  2. The list of waste and scrap of the ferrous metals and metal articles (sold as scrap) prohibited from purchasing from natural persons; 1.
  3. The order of issuance of permits of purchase of waste and scrap of the ferrous metals in the Republic of Lithuania.
  4. To establish that: 2.
  5. Enterprises and their structural subdivisions registered in the Republic of Lithuania (hereinafter referred to as enterprises) may practice in the Republic of Lithuania business pertinent to purchase of waste and scrap of the ferrous metals (code 72.04 according to the combined goods nomenclature of the European Economic Community) and purchase of metal articles (sold as scrap) specified in the list approved by the present resolution (except cases when these articles are directly used in production) only upon the receipt of permits of the Ministry of Trade and Industry according to the decision of the Government of the Republic of Lithuania and after a public levy of the set amount is paid in for the issuance of the said permits. The Lithuanian Union of Customers Cooperatives receives one permit granting the right to all its subdivisions to undertake the said business; 2.
  6. Enterprises with smelteries may purchase waste and scrap of the ferrous metals and to practice this business without a permit, provided they purchase them only for re-melting from enterprises mentioned in paragraph 2.
  7. and from enterprises which in the process of production have the output of waste and scrap of the ferrous metals; 2.
  8. Enterprises that were in the business of purchase of waste and scrap of the ferrous metals prior to the adoption of this resolution have to obtain the permits mentioned in paragraph 2.
  9. or to stop their activities within two months from the date of the announcement of this resolution; 2.
  10. Enterprises mentioned in paragraph 2.
  11. may purchase waste and scrap of the ferrous metals and metal articles (sold as scrap), specified in the list approved by this resolution, from only those enterprises that are registered in the Republic of Lithuania and submitted stringent account documents proving their ownership rights on these goods; 2.
  12. Enterprises mentioned in paragraph 2.
  13. may purchase waste and scrap of the ferrous metals and metal articles (sold as scrap) that are not specified in the list approved by this resolution from natural persons provided they present their identification documents and the purchaser registers a purchasing deal; 2.
  14. Waste and scrap of the ferrous metals may be exported by : 2.6.
  15. enterprises specified in paragraph 2.1; 2.6.
  16. enterprises which in the process of production receive the output of waste and scrap of the ferrous metals, after the Ministry of Trade and Industry registers the contract; 2.
  17. Upon the receipt of permits mentioned in paragraph 2.
  18. of the present resolution, enterprises have no right to entitle in their name other enterprises to undertake this business; 2.
  19. Enterprises that violated regulations of purchase, account and storage of the waste and scrap of the ferrous metals and requirements of the present resolution are liable according to the order established by the law of the Republic of Lithuania. In some events, permits of some enterprises to purchase waste and scrap of the ferrous metals in the Republic of Lithuania may be nullified.
  20. Monthly information on export and import provided by the Customs Department under the Ministry of Finance to the Ministry of Trade and Industry, Ministry of Economy and to the Department of Statistics under the Government of the Republic of Lithuania shall separately specify in kind and in value the amount of export and import of waste and scrap of the ferrous metals (code 72.04 according to the combined goods nomenclature of the European Economic Communities). 4.To obligate the Ministry of the Interior, the Ministry of Finance, the Ministry of Trade and Industry, the Customs Department under the Ministry of Finance and to recommend to the State Control Department of the Republic of Lithuania to control the implementation of this resolution.   21. Railway facilities: rails, railway switches, cramps, stands, metal construction of bridges, parts of carriages and locomotives, rolling stock and their spare parts.
  22. Article of public utilities: covers of sewerage and water-supply, covers of thermal rout chambers and communication wells, water accumulation traps, sewerage pipes, steel pipes, dampers and pipes, cast iron litter boxes, articles of cast iron decorative fences, stationing signs of the underground engineering networks.
  23. Electric facilities: engines, transformatories, distribution facilities, metal piers and their elements.
  24. Gas facilities: liquid gas cylinders, steel framework (facets, dampers, pumps). APPROVED by Resolution No. 388 on 23 May 1994 of the Government of the Republic of Lithuania Order of Issuance of Permits of Purchase of Waste and Scrap of Ferrous Metals in the Republic of Lithuania
  25. Enterprises registered in the Republic of Lithuania (hereinafter referred to as enterprises) have the right to practice in the Republic of Lithuania business pertinent to purchase waste and scrap of the ferrous metals only upon the receipt of permits of the established form.
  26. Enterprises willing to obtain a permit to purchase waste and scrap of the ferrous metals in the Republic of Lithuania submit to the Ministry of Trade and Industry the following documents: 2.
  27. an application with the information on the expected amount of purchase and its sources, realization means and trends, network of purchasing places and terms of purchase; 2.
  28. a copy of enterprise registration certificate; 2.
  29. a copy of enterprise statute; 2.
  30. a copy of regulations within the enterprise on purchase and storage of waste and scrap of the ferrous metals.
  31. The committee comprised of the representatives from the Ministry of Trade ad Industry, Ministry of Economy and the Ministry of the Interior considers applications received from the enterprises. A composition of the committee is approved by the Ministry of Trade and Industry. Recommendations of the Committee on permit issuance are submitted to the Government of the Republic of Lithuania.
  32. The Ministry of Trade and Industry issues permits of the established form pursuant to the decision of the Government of the Republic of Lithuania and upon the receipt of a public levy bill the paid in by the enterprise. In the event of a negative decision, a motivated answer is sent to the applicant.
  33. Applications of the enterprises are to be considered within 30 days after their receipt.
