Translation from Lithuanian Translation from Lithuanian GOVERNMENT OF THE REPUBLIC OF LITHUANIA R E S O L U T I O N No. 431 On the Amendment to Customs Regime for Natural Persons Vilnius, 2 June 1993 The Government of the Republic of Lithuania r e s o l v e s:
- Partly amending Resolution No. 518 "On the establishment of customs regime for natural persons" of 9 July 1993 adopted by the Government of the Republic of Lithuania (Records, 1993, No. 28-661, No. 43-879, No 56-1): 1.1 to outline Paragraph 2.
- as follows: "2.
- natural persons are prohibited from exporting from the Republic of Lithuania commodities (goods) falling under decisions of the Government of the Republic of Lithuania or those on which the customs tariffs are imposed"; 1.
- to outline Paragraphs 2.3.7 and 2.3.8 as follows: "2.3.
- commodities ( goods ) intended as gifts, and commodities (goods) on which no customs tariffs are imposed; 2.3.
- contemporary cultural and art values aging not more than 40 years"; 1.
- to outline Paragraph 2.5.2 as follows: "2.5.
- commodities ( goods ) intended as gifts, and commodities ( goods ) included in the list of commodities ( goods ) limited for import ( delivery by mail) by natural persons to the Republic of Lithuania - for the total value not exceeding 1000 litai; Natural persons are prohibited to import (deliver by mail) more commodities (goods) included in the list of commodities limited for import (delivery by mail) to the Republic of Lithuania. Natural persons can import tobacco products and alcoholic drinks without stamps glued on tobacco products and on alcoholic drinks not exceeding the quantity of their import (delivery by mail) as set in the above list"; 1.
- to outline Paragraph 2.6.1 as follows: "2.6.
- in case the quantity of commodities (goods) imported (delivered by mail) exceeds the norm established by Article 2.5.2., the customs duty is imposed on the quantity of commodities (goods) exceeding the norm established for these commodities (goods), but not less than 10% of their total value. For other commodities (goods) on which the customs duty is not established, the customs duty levied on the exceeding part of the established norm comprises 10% of their total value (the above mentioned 10% is not levied for the imported cars, if the customs duty is not established for them)"; 1.
- to append the above mentioned resolution with Paragraph 2.6.4 as follows: "2.6.
- in case the quantity of commodities (goods) imported (delivered by mail) exceeds the norm established by Article 2.5.
- and the value added tax and excise are levied on these commodities (goods), this tax and excise shall also be calculated on the share exceeding the norm for natural persons"; 1.
- to insert the words "value added tax, excise" after the word "customs duty" in Paragraph 2.8; 1.
- to outline Paragraph 2.9 and 2.10 as follows: "2.
- on paying the customs duty, the customs registration procedure for commodities (goods) shall be conducted in accordance with the customs registration procedure applied for economic entities; 2.10 The Customs Department under the Ministry of Finance shall provide information for all the customs houses within the Territory of the Republic of Lithuania on the regulations of customs procedure that shall apply for natural persons in the neighboring states and the import norms for commodities (goods) in the respective states." 1.
- to recognize as invalid Paragraphs 2.3.9 and 2.4; 1.
- to supplement the list of commodities (goods) limited for import (delivery by mail) to the Republic of Lithuania of the said resolution with the Paragraph as follows: "Chocolate and other food preparations, 3 kg not containing cocoa Coffee 2 kg Jewellery of precious metals 50 g and precious stones, natural pearls Motor cars 1 unit" 1.
- To outline paragraph 6 of the list of commodities (goods) which shall be prohibited for export from the Republic of Lithuania for all economic entities and natural persons in the said resolution as follows: "
- Non-ferrous metals, their alloys and scrap, scrap of ferrous metals and their waste (prohibitions applies to natural persons only)"; 1.
- To supplement the list of commodities (goods) which shall be prohibited for import into the Republic of Lithuania for all economic entities and natural persons in the said resolution with paragraph 7 (with paragraph 7 as paragraph 8) as follows : "
- Electric fishing equipment shall be imported with the permit of the Department of the Environmental Protection of the Republic of Lithuania only"; 1.
- to make the following amendments in the list of articles of personal use approved by the said resolution: 1.12.
- to outline paragraph 5 as follows: "
- Private articles of jewellery and parts thereof, of precious metals and precious stones and natural pearls, but not more than 1 unit. The total weight of these articles shall not exceed 50 grams"; 1.12.
- to supplement the list with paragraphs 6-8: "6.Orthopaedic appliances for private use to compensate for a disability and the medical equipment, necessary during the journey.
- Private orders, decorations, prises received at the exhibitions, competitions and sport events.
- Other articles clearly designed for private use"; 1.
- To outline Paragraph 1 of the list of commodities (goods) which shall be prohibited for delivery by mail from and into the Republic of Lithuania and approved in the said resolution as follows: "
- Domestic and foreign currency, not including the currency necessary for change of banknotes and coin samples received and sent by the Bank of Lithuania and its institutions. Collection and anniversary coins can be sent by all banks of the Republic of Lithuania.
- To recognize as invalid Resolution No. 794 "On the partial amendment to the Resolution No. 518, of 9 July 1993 adopted by the Government of the Republic of Lithuania'" of 20 October 1993 and adopted by the Government of the Republic of Lithuania" (Records, 1993, No. 56-1105).
- This Resolution enters into force from 20 June
