Translation from Lithuanian Translation from Lithuanian GOVERNMENT OF THE REPUBLIC OF LITHUANIA R E S O L U T I O N No 1206 On Partial Amendments to Resolution No. 510 "On Approving Provisional Regulations of Government Procurement", adopted by the Government of the Republic of Lithuania on 12 April 1995 Vilnius, 8 September 1995 The Government of the Republic of Lithuania r e s o l v e s :

1. Partly amending Resolution No. 510 " "On Approving Provisional Regulations of Government Procurement", adopted by the Government of the Republic of Lithuania on 12 April 1995 (Records, 1995, No. 33-778): 1.
2. to append paragraph 4 with the following passage: "The purchasing organization can require that bidders shall submit the application guarantees. This requirement shall be applied to every supplier in the purchase. The form of an application guarantee must be specified by the purchasing organization in the tender documents. The application guarantees for tender shall not exceed 3 percent of the value of purchased goods or services. The guarantees shall be returned to the winner of the tender when the implementation guarantee of the purchasing agreement comes into force; to the rest of bidders it shall be returned within 5 working days since the announcement of the tender results”; 1.
3. to append paragraph 17 with the following passage: “When the value of purchased goods and services exceeds 5 mln.Lt., the participating suppliers shall submit the copies of tender applications to the Government of the Republic of Lithuania in a sealed envelope under the title “State Purchase Tender". The envelopes containing applications are kept by the Government of the Republic of Lithuania and opened only in cases of special emergency (provided the complaints about the forgery of tender results or other violations were lodged ), and for auditing purposes according to the procedure established by the Government Secretary of the Republic of Lithuania"; 1.
4. to append paragraph 23 with the following passage: " If necessary, head or his/her deputy of founding institution of the purchasing organization is appointed chairperson to assess applications of the Commission"; 1.
5. to append paragraph 30 with the following sentence: "When the value of purchased goods or services exceeds 5 mln. Lt., the protocol of purchase tender results drawn up by the Commission shall be approved by the resolution of the Government of the Republic of Lithuania"; 1.
6. to append paragraph 32 with the following sentence: "The winner of the purchase tender who refuses to sign the purchase agreement shall be prevented from participating in other goods or service purchase tenders upon the decision of the founder of the purchasing organization".
7. To establish that Provisional Regulations of Government Procurement defined in the above resolution shall be also applied to tenders organized to select contractors of constructions financed from the State budget of the Republic of Lithuania, municipal budgets, soft loans, and assistance funds.
