  1. To approve the appended: 1.
  2. Rules of the entry of foreign naval and other state-owned noncommercial vessels into the Klaipëda State Sea Port and rules regulating their presence in it; 1.
  3. The procedure of issuing permissions to foreign vessels subject to the right to hold permission.
  4. Partly amending Resolution No. 676 "On Legal Status of the Klaipëda Sea Port" adopted by the Government of the Republic of Lithuania on 16 September 1992 (Records, 1992, No. 29

(2)-891, No. 36-1129), to outline paragraph 4.1 as follows: "4.
  1. foreign naval and other state-owned noncommercial vessels may enter the port only after obtaining the permission issued by the Ministry of Foreign Affairs".   2. The present rules are prepared in line with the Law on State Borders of the Republic of Lithuania and they establish the procedure of foreign naval and other state-owned noncommercial vessels entry into the Klaipëda State Port (further referred to as port) and the procedure of their presence in it.
  3. The terms used in the present rules shall have the following meaning: 2.
  4. "foreign naval vessels" - ships that are the property of military forces of a certain state and have national outer identification marks of a naval vessel. The vessels are commanded by officers officially appointed by competent authorities of a particular state, and crews keep to the rules of military order; 2.
  5. "other state-owned noncommercial vessels" - ships that belong to a certain state or used by that state and ships engaged in a noncommercial civil service; 2.
  6. "head of the Klaipëda garrison" - official representative of the Ministry of Defence in Klaipëda; 2.
  7. "obliged entry" - foreign naval or other state-owned noncommercial vessel entry into the port subject to exceptional circumstances, namely accidents, natural disasters or storm endangering ships, as well as rendering of urgent medical aid to a crew member or in other similar circumstances; 2.
  8. "visit" - entry of foreign naval vessels into the port. Visits are categorised as official, non-official and business (ordinary).
  9. Upon the entry into the port or during their presence in it, foreign naval and other state-owned noncommercial vessels are obliged to observe laws and other legal acts of the Republic of Lithuania.
  10. In the event when a foreign naval vessel or a state-owned noncommercial vessel violates laws and other legal acts of the Republic of Lithuania, the head of the Klaipëda garrison shall warn the captain of the vessel and demand to cease illegal activities, and if the requirements are disregarded, upon the decision of the Government of the Republic of Lithuania, the vessel shall be suggested leaving the port within a set period or immediately. The country which assumes the property of the vessel, shall be informed through the diplomatic channels.
  11. If an international agreement of the Republic of Lithuania sets norms and provisions different form the present ones, in that case the norms and provisions of this international agreement of the Republic of Lithuania shall be applied. Entry and presence in the port
  12. Foreign naval vessels and other state-owned noncommercial vessels may enter the port only with a permission of the Ministry of Foreign Affairs of the Republic of Lithuania.
  13. The request to issue a permission is presented through the diplomatic channels, but not later than 30 days in advance before the planned date of the vessel entry into the port.
  14. The request should include: 8.
  15. data on naval vessels: 8.1.
  16. number of vessels, class (type), names (side numbers), most important data (tonnage, length, width, draught), type of power reactor, armament; 8.1.
  17. aim and the type of the visit (official, unofficial, business); 8.1.
  18. date of arrival and departure; 8.1.
  19. rank and name of the officer in charge of each vessel, the rank and the name of the officer in charge of the vessel formation; 8.1.
  20. the number of officers, noncommissioned officers and private sailors of each vessel individually; 8.1.
  21. the power and frequencies of the vessel radio station requested for use during the stay in the port; 8.1.
  22. the necessary service (work of a tugboat, supply in fuel, water, telecommunications and etc.); 8.
  23. on other state-owned non-commercial vessels: 8.2.
  24. types of vessels, names, most important data (tonnage, length, width, draught); 8.2.
  25. purpose of the entry; 8.2.
  26. date of arrival and departure; 8.2.
  27. captain’s name, a number of the crew members; 8.2.
  28. the necessary service.
  29. Requirements as laid down in paragraph 6 and 7 of these provisions are not applicable for foreign naval and non-commercial state vessels which carry heads of foreign states (governments). Arrival like this should be informed about by the diplomatic channels not later than 7 days in advance and vessel data as specified in paragraph 8 of these provisions should be submitted.
  30. In case of the forced entry, the officer in charge (captain) of a foreign naval or other non-commercial state-owned vessel is obliged to inform by radio the head of the Klaipëda garrison and the administration of the port about the reasons of the entry, and, upon the entry into the port, submit the head of the Klaipëda garrison the concrete data on the entry reasons, indicate the required service. Upon the expiry of circumstances of the forced entry, the captain of the vessel before leaving the port shall inform about that the head of the Klaipëda garrison.
  31. An authorized representative of the interested ministry agrees with the port director and the specific quay user about the parking location of foreign naval and other state-owned non-commercial vessels in the port, and organizes the reception and servicing of these vessels.
  32. Customs clearance procedures of foreign naval vessels are not carried out except the goods unloaded from those vessels or loaded into them. Customs clearance procedures are applied to other state-owned non-commercial vessels according to the procedure established by laws and other legal acts of the Republic of Lithuania.
  33. Disembarkment conditions shall be applied for crew members of foreign naval vessels as laid down in paragraphs No. 23 and 24 of the present rules, while the customs control procedure shall be applied to the crew members of other state-owned non-commercial vessels for disembarkment or embankment of these vessels. This procedure shall be also applied to persons who are not crew members of foreign naval or other non-commercial state vessels.
  34. The duration of the presence of foreign naval and other state-owned non-commercial vessels in the port shall not exceed 5 days, unless it is otherwise specified in the issued permission.
  35. Foreign naval vessels and other state-owned non-commercial vessels are exempt from the port taxes: for tonnage, channel, lighthouse and mooring. They shall be charged for certain services only.
  36. While foreign naval and other state-owned non-commercial vessels are in the port they are prohibited from: 16.
  37. carrying out scientific research; 16.
  38. organizing armed maneuvers and training, if this is not provided in specific agreements; 16.
  39. using radiolocation and other radiotechnics, and hidroacoustics, if this is not necessary for the safety of the vessel; 16.
  40. descending divers into water and carrying out activities under it.
  41. In case a specific part of the vessel under water needs an immediate inspection or repair, an approval from the head of the Klaipëda garrison and the administration of the port should be obtained. Visits of foreign naval vessels
  42. An official visit shall be an entry of foreign naval vessels to the port upon an official invitation of the Government of the Republic of Lithuania on an occasions of important national holidays, or when a head of foreign state or government travels by ship, or when a foreign state applies with a request to be granted a status of an official visit to a naval vessel. grand ceremonies and the appropriate protocol procedure shall be carried out during the official visit. The artillery fires salute according to the international practice and local regulations.
  43. An unofficial visit shall be an entry of foreign naval vessels to the port with an aim of establishing or fostering friendly relations between the military forces, or when the state, whose vessels are due to arrive, applies with an appropriate request. Grand ceremonies are not planned on the occasion of a visit like that. The artillery may fire salutes if this is arranged with the head of the Klaipëda garrison.
  44. The business (ordinary) visit is considered to be an entry of foreign naval vessels to the port when they participate in joint maneuvers or training together with the naval vessels of the Republic of Lithuania, or when crews of vessels need to rest or vessels need to renew their material technical supplies. Only basic protocol procedures are planned for the business (ordinary) visit. The artillery shall not fire salutes.
  45. The head of the Klaipëda garrison informs the city municipality, the police unit of border posts control, the transport police and the city police headquarters about the forthcoming visit and arranges events scheduled in the visit programme according to the established procedure.
  46. In order to maintain relations with the head of a foreign naval vessel, the head of the Klaipëda garrison appoints an officer in charge of communication, who upon boarding the foreign naval vessel, must inform the head of the vessel about current regulations of the port.
  47. The procedure of permitting the crew of the vessel to disembark (the number of people, their leave and return time, etc.) must be agreed on with the head of the Klaipëda garrison by heads of vessels. Residents of the Republic of Lithuania are permitted to visit foreign naval vessels at the hours scheduled in the programme only
  48. Armed troops, authorized to participate in grand ceremonies or processions, shall obtain the permission of the head of the Klaipëda garrison to disembark. __________________________ APPROVED by Resolution No. 1301 of 4 October 1995 of the Government of the Republic of Lithuania Procedure of Issuing Licences to Foreign Naval Vessels Subject to the Right to Hold a Licence
  49. These regulations shall establish the procedure of issuing licences to foreign naval vessels subject to the right to hold a licence to enter the Klaipëda State Sea Port (further referred to as port) through the territorial sea of the Republic of Lithuania in compliance with laws and other legal acts of the Republic of Lithuania.
  50. The Ministry of Foreign Affairs of the Republic of Lithuania (further referred to as Ministry of Foreign Affairs) after receiving a request to be granted through diplomatic channels a licence from a foreign state, passes this request to a Ministry competent to deal with the issues directly connected with the functional purpose of a specific vessel. The latter coordinates this request with the Ministry of Defence, the Ministry of Transport and the Ministry of the Interior of the Republic of Lithuania and, if necessary, with other governmental institutions and presents its final conclusion to the Ministry of Foreign Affairs.
  51. The main motives to be observed on adopting a decision on whether to issue the licence are as follows: 3.
  52. purposes of entering the port through the territorial sea of the Republic of Lithuania; 3.
  53. interstate relations with the country, which submits the request; 3.
  54. political situation in the Republic of Lithuania; 3.
  55. the state’s defence and other interests.
  56. The Ministry of Foreign Affairs, following the conclusion presented and the motives laid down in passage
  57. of the present Procedure, adopts a decision whether to issue the licence.
  58. A foreign state, which has applied with the request, and the governmental institutions, with which the request of a foreign state has been coordinated, are informed about the decision made.
  59. The reply to a foreign country must be forwarded not later than within 10 days after the receipt date of the request. ____________________________
