Translation from Lithuanian Translation from Lithuanian GOVERNMENT OF THE REPUBLIC OF LITHUANIA R E S O L U T I O N No. 1390 On Licensing Veterinary Practice and Pharmaceutical Activities in Veterinary Medicine Vilnius, 26 October 1995 The Government of the Republic of Lithuania r e s o l v e s:

1. To approve Regulations on Licensing Veterinary Practice and Pharmaceutical Activities in Veterinary Medicine (attached).
2. To instruct the State Veterinary Service to issue licences for engagement in veterinary practice and pharmaceutical activities in veterinary medicine, to supervise compliance with the conditions of licensed activities, and suspend or cancel said licences. 3. These regulations shall regulate the procedure of licensing engagement in veterinary practice and veterinary pharmaceutical activities.
4. Veterinary practice and veterinary pharmaceutical activities shall only be allowed if there is a licence issued by the State Veterinary Service.
5. The State Veterinary Service shall issue licences for: 3.
6. engagement in veterinary practice (veterinary preventive measures, treatment of animal diseases); 3.
7. engagement in pharmaceutical activities in veterinary medicine (production of medicines and medicinal substances, provision of medicines and medicinal substances, retail trade in medicines and medicinal substances); 3.
8. treatment of especially dangerous animal diseases that are specified on the list approved by the State Veterinary Service, diagnosing these diseases and arranging for the elimination thereof. The State Veterinary Service shall issue licences for engagement in the activities defined in this paragraph on the basis of the laws of the Republic of Lithuania - Law on Enterprises, Law on Veterinary Activities and Law on Pharmaceutical Activities.
9. Licences for veterinary practice shall be issued to veterinary surgeons engaged in private practice.
10. Licences for engagement in pharmaceutical activities in veterinary medicine shall be issued: 5.
11. to veterinary and pharmaceutical specialists with a specialised secondary or higher pharmaceutical education; 5.
12. to companies that employ a specialist (specialists) holding a licence issued by the State Veterinary Service.
13. Owners of individual enterprises engaged in veterinary practice shall be veterinary surgeons, and those engaged in pharmaceutical activities in veterinary medicine shall be veterinary or pharmaceutical specialists.
14. Veterinary surgeons engaged in private practice, as well as veterinary and pharmaceutical specialists employed in veterinary pharmacies and other companies producing or supplying veterinary medicines must hold a licence for veterinary practice.
15. Licences for treatment of especially dangerous animal diseases, diagnosing these diseases and arranging for their elimination shall only be issued to state veterinary establishments and specialised public corporations and close corporations the entire stock of which is owned by the state.
16. One legal or natural person may be issued one licence or several types of licences.
17. An application shall be submitted to the State Veterinary Service. The application shall indicate: 10.
18. data about the applicant: name, surname and address of the natural person; code, name and address of the enterprise (if the licence is sought by a registered enterprise); 10.
19. the sphere of commercial-economic activities for which the licence is sought; 10.
20. the date of submission of the application.
21. The following documents shall be attached to an application for licence: 11.
22. a letter of recommendation to issue a licence. The letter of recommendation shall be written by the chief town, region or county veterinary surgeon or a town, region or county branch of the Veterinary Surgeons' Association; 11.
23. a copy of the registration card of the enterprise, if the enterprise has not yet been registered - an agreement on the establishment of the enterprise and draft statute thereof; 11.
24. a copy of the diploma testifying to specialised secondary or higher veterinary or pharmaceutical education of the specialist, the number of the previously issued licence and the date of issuance.
25. Applications for licence shall be considered by the State Veterinary Service.
26. Veterinary or pharmaceutical specialists applying for a licence shall sit for a qualification exam according to the programme approved by the State Veterinary Service. Veterinary surgeons who graduated from a school of higher education in the same year shall be exempted from the qualification exam. Qualification exam shall not be necessary in the cases whereby during the last two years a specialist finished a qualification improvement course according to the programme approved by the State Veterinary Service and holds a course graduation certificate.
27. A licence shall be issued for a period of up to five years. A licence shall be renewed following the same procedure as during the issuance of the initial licence.
28. A stamp tax shall be collected for the issuance of a licence in a procedure established by the Law of the Republic of Lithuania on Stamp Tax and resolutions of the Government of the Republic of Lithuania. A licence shall be issued upon producing a payment order with a bank stamp or an original receipt certifying the payment of the stamp tax.
29. A licence shall not be issued if: 16.
30. not all required documents were submitted; 16.
31. the submitted documents do not meet the requirements or were drawn up in an inappropriate manner; 16.
32. the applicant breached the laws of the Republic of Lithuania - Law on Veterinary Activities and Law on Pharmaceutical Activities, and after a repeated warning did not stop the violation.
33. In the event the licence is refused, the applicant shall be notified thereof and provided with the reasons of refusal. The licence or the refusal to issue the licence shall be issued to the applicant within thirty days from the date of receipt of the documents needed for the issuance of the licence.
34. The licence shall indicate: 18.1 the institution issuing the licence; 18.
35. the licence number; 18.
36. the holder of the licence (name, surname and address of the natural person; code, name and address of the enterprise. If the licence is issued to an enterprise being established, its code shall be written down upon its recording with the Register of Enterprises of the Republic of Lithuania; 18.
37. the nature of commercial-economic activities for which the licence is issued; 18.
38. the term of licence; 18.
39. the date of issuance of the licence.
40. The issued licence shall be recorded in the Licence Register indicating: 19.
41. the number of the licence; 19.
42. the holder of the licence (name, surname and address of the natural person; code, name and address of the enterprise); 19.
43. the nature of commercial-economic activities for which the licence is issued; 19.
44. the date of issuance of the licence; 19.
45. the date of suspension of the licence; 19.
46. the date of revocation of suspension of the licence; 19.
47. the date of cancellation of the licence; 19.
48. the date of payment of stamp tax, the number of receipt, the amount of the stamp tax paid.
49. A licence holder shall be entitled to engage in the licensed activities upon recording the enterprise in the Register of Enterprises of the Republic of Lithuania. In the event that a licence is issued to an enterprise being established, the licence holder shall within thirty days notify the State Veterinary Service, issuer of the licence, about the recording of the enterprise with the Register of Enterprises of the Republic of Lithuania, indicating the code of the enterprise.
50. A licence holder shall not have the right to pass the licence or the competence granted thereby over to another legal or natural person.
51. A licence holder shall observe the laws of the Republic of Lithuania, resolutions of the Government of the Republic of Lithuania, these Regulations and other legal acts.
52. The licensed activities in the sphere of veterinary medicine shall be controlled by the State Veterinary Service.
53. The State Veterinary Service shall have the right to suspend the licence if: 24.
54. the laws of the Republic of Lithuania - the Law on Veterinary Activities, Law of Pharmaceutical Activities and other legal acts regulating the licensed activities - were repeatedly violated after a warning was issued. 24.
55. by a specified date shortfalls of the licensed activities established earlier on were not eliminated and the term for the elimination was not extended.
56. In the event that the licence was suspended, suspension shall be revoked when the shortfalls of the licensed activities are eliminated.
57. The State Veterinary Service may cancel the licence if: 26.
58. a licence holder decided to cease the licensed commercial-economic activities and requested that the licence be cancelled; 26.
59. following the suspension of the licence, the enterprise did not eliminate the violations and other established shortfalls within a set period. 26.
60. in the licensed activities violations were established of the laws of the Republic of Lithuania - Law on Veterinary Activities, Law of Pharmaceutical Activities and other legal acts. 26.
61. there is a notification of the liquidation or reorganisation of the enterprise and the enterprise terminates its activities as an independent economic subject.
62. Suspension or cancellation of a licence shall be considered within fifteen days upon the receipt of the recommendation of the chief town, regional or county veterinary surgeon to suspend or cancel the licence.
63. Upon the issuance of a licence, suspension of a licence, cancellation of the suspension of a licence or cancellation of a licence, the State Veterinary Service, the licence issuer, shall announce the above in "Valstybës þinios" (Records). The announcement shall indicate: 28.
64. the code, name and address of the enterprise; 28.
65. the activities for which the licence was issued; 28.
66. the number of the licence; 28.
67. the date of issuance of the licence; 28.
