Translation from Lithuanian Translation from Lithuanian GOVERNMENT OF THE REPUBLIC OF LITHUANIA R E S O L U T I O N No. 98 On the Approval of Regulations of the Farmers Holding Register Vilnius, 23 January 1995 Enacting Resolution No. 701 on "Farmers Holding Register" (Records No. 62-1217, 1994) of 8 August 1995, the Government of the Republic of Lithuania r e s o l v e s:

  1. To approve the Regulations of Farmers Holding Register (attached).
  2. To establish that the data of Farmers Holding Register is stored in two phases: the first phase (1st half of 1995) - the data on holdings registration; the second phase (2nd half of 1995 - 1st half of 1996) - data on farming activities.
  3. To append the scheme of preparation of the state cadastres, classifiers and registers in the section "State National Cadastres, Classifiers, Registers" approved by Resolution No. 793 on "Preparation and Functioning of Cadastres, Classifiers, Registers" (Records, No. 33-1018, 1992) adopted by the Government of the Republic of Lithuania on 23 October 1992 with the following paragraph: "Farmers Resolution No. 701 The Department Holdings adopted by of Statistics Register the Government of the to the Government Republic of Lithuania of the Republic on 8 August

  5. These regulations govern the formation, administration and utilization of the data of the Farmers Holdings Register (hereinafter referred to as register). The register is a constituent part of the national information system. The register records all farmers holdings registered by the regional local authorities by the Ministry of Agriculture according to the procedure established in Decree No. 411 of 4 August
  6. The aim of the register is to collect and accumulate data on farmers holdings in the Republic of Lithuania, their number, acreage and the distribution of farming land, the area under crops, number of cattle, buildings, machinery and facilities, and to update, and generalize the data as provided by the present regulations.
  7. The object of the register is a holding (land user), which corresponds to the farmers holding definition given in the Law on Land of the Republic of Lithuania. The farmer is any person irrespective of the way he\she obtained the land - either after retaining, purchasing, leasing the land according to the Law on Farm Holdings of the Republic of Lithuania or having the right to cultivate land according to the mutual agreement with the co-owners of the land (but not less than for three years), or willing to restitute his\her property rights on land. The size of a farmer`s holding is established by adding up plots of land of different judicial status in his\her possession.
  8. According to Resolution No. 701 adopted by the Government of the Republic of Lithuania on 8 August 1994 the register is administered by the Department of Statistics under the Government of the Republic of Lithuania (further referred to as the Department of Statistics). Developing and utilizing the register, the Department of Statistics complies with the laws of the Republic of Lithuania, resolutions, directives and the present regulations of the Republic of Lithuania. The Department of Statistics prepares the methology of the formation and administration of the register and data collection.
  9. The register is used to meet information needs of the Ministry of Agriculture, the Department of Statistics, the Lithuanian Farmers Union, other institutions of public administration and educational establishments, and local authorities. It provides a possibility to collect aggregated data on farmers production and holding trends by each data item or data group.
  10. On register basis the Department of Statistics selects statistical survey methods (either sample or complete coverage surveys), sets up a network of the farmers-respondents who provide data on agricultural production, while the Agricultural Consulting Agency of Lithuania in cooperation with the Lithuanian Farmers Union sets up the network of farmers-respondents who deal with accountancy and provide information on financial results.
  11. The register is established and maintained by the Lithuanian State Budget and from funds of municipal budgets. An administrator of the register may earn some funds by charging a fee for information in compliance with the procedure established in the relevant regulations.   12. The register is administrated by the Department of Statistics. The Department of Statistics deals with the issues pertinent to data formation, preparation of aggregated information and its presentation after coordinating them with the Ministry of Agriculture and the Lithuanian Farmers Union. Formation of the register data covering regions (counties) is carried out by regional statistical offices and divisions of agriculture of the regional (county) boards upon the directive of the Department of Statistics.
  13. The register includes and updates: 9.
  14. the following registration data on farmers holdings: holding identification code; registration date of the holding; the date of data updating; the date of liquidation of the holding; full name of the farmer; personal identification code; farmer's domicile; residence address and telephone; the date of land acquisition for utilization purposes; the name of the institution that performed the judicial registration; the number in the register book; legal status of the land ownership ( owner, lessor, lessee); the cadastre number of the land plot; the acreage of the land plot; 9.
  15. the following data on the activities of farmers holdings: the land acreage by the farming land; area under crops by type of crops; the quantity of livestock by type and age group; animals by type; bee families; area of reservoirs for fish breeding; amount of agricultural equipment; buildings by the purpose and number of places for cattle therein. The registration data on farmers holdings is formed on the basis of information of the regional (counties) local authorities which is provided to the Ministry of Agriculture and the Department of Statistics (as to the register's administrator) according to the procedure established by the latter. Data on the activities of farmers holdings is formed on the basis of the filled-in register forms. The Department of Statistics determines the type of the form, indicators of the compiled information and the order of their presentation. Each farmer's holding is given an identification code in the register. The register's administrator establishes the structure of the code and the procedure of its provision. The aim of the code is to identify the holding, to accumulate data thereon with a view to be interlinked with the data banks and information systems.
  16. The register has to be interlinked with the information systems of enterprises, population, science, social security, tax, land cadastre, and other information systems and data banks in order to exchange data needed to carry out a complex social economic analysis. The Department of Statistics deals with issues of the above mentioned interlinks.
  17. Ministries, departments, other public institutions involved in the formation and utilization of data banks encompassing data on farmers activities, ensure harmonization of their own systems with the register. Utilization of information
  18. Only the aggregated data of the register about the activities of farmers holdings may be publicized. The administrator (the Department of Statistics) in compliance with the procedure and timeframe established thereby regularly free of charge provides the aggregated data on farmers holdings activities to public administration institutions, local authorities and the Lithuanian Farmers Union.
  19. International organizations, legal and natural persons of foreign countries receive only the aggregated data of the register.
  20. Institutions specified in Paragraph 5 of the present regulations receive the data on farmers holdings that is relevant to the field of their activities according to the procedure established by the administrator of the register.
  21. A person whose data is included in the register, enjoys the right to verify the data and to get free information about himself\herself as well as the aggregated data on the region (county) and the Republic of Lithuania.
  22. The aggregated information of the register for other legal and natural persons can be provided according to the procedure established by the administrator of the register, after the expenses of the preparation of the information are paid according to the contract.   23. The administrator of the register is prohibited to correct the data provided for the register or to demand it from the person providing the data. If the administrator has doubts about the data provided for the register, he\she requests the institution which presented information on the farmer's holding to specify it. Upon the receipt of the statement of the institution (or a farmer's statement) which (who) provided information, the misleading data is corrected specifying the reason of correction and the relevant document.
  24. The administrator of the register ensures the security of the data accumulated in the data bank from the external and internal influences. Requests for data and data provision are registered and stored by programming method.
  25. The data of the register is accumulated and stored in software discs. Information on farmers holdings not engaged in any activities is stored for six years and destroyed afterwards. Liquidation of the register
  26. The register is liquidated upon the decision of the Government of the Republic of Lithuania. ____________________________
