Translation from Lithuanian GOVERNMENT OF THE REPUBLIC OF LITHUANIA R E S O L U T I O N No. 623 On the Approval of Regulations on Transfer of Information Classified as State Secret of the Republic of Lithuania to other States or International Organizations, Regulations on Issuance of Permits Allowing Citizens of Other States to Work or Have Access to Information Classified as State Secret of the Republic of Lithuania, and Regulations of Protection of Secrets of Other States and International Organizations Vilnius, 27 May 1996 Pursuant to Article 1 and Paragraph 7 of Article 5 of the Law on State Secrets and their Protection of the Republic of Lithuania (Records, 1995, No. 96-2146), the Government of the Republic of Lithuania r e s o l v e s: To approve Regulations on Transfer of Information Classified as State Secret of the Republic of Lithuania to other States or International Organizations, Regulations on Issuance of Permits Allowing Citizens of Other States to Work or Have Access to Information Classified as State Secret of the Republic of Lithuania, and Regulations of Protection of Secrets of Other States and International Organizations (attached). 1. The present regulations lay down the general requirements which shall be observed in the process of transfer of information classified as state secret of the Republic of Lithuania to other states or international organizations, and issuance of permits allowing citizens of other states to work or have access to information classified as states secret of the Republic of Lithuania, and protection of secrets of other states and international organizations transferred to the Republic of Lithuania. Transfer of Information Classified as State Secret of the Republic of Lithuania to other States or International Organizations
2. Information, specified in Article 2 of the Law on State Secrets and their Protection, can be transfers to only those states or international organizations with which the Republic of Lithuania concluded international Agreements on Protection of Secret Information, provisions of which shall guarantee that: 2.
3. information transferred shall be identified by classification markings which would be equivalent to classification markings used in the Republic of Lithuania; 2.
4. information transferred shall be protected according to the classified information protection standards adopted by this state; 2.
5. information transferred shall not be further transferred or disclosed to anyone, either to the government of the third party, or a person, and no other entity shall have access thereto without the approval of the Republic of Lithuania; 2.
6. information transferred shall be used only for the designated purpose, and will be available to persons who need it for official use; 2.
7. every person, who shall be granted the right to work or to have access to the information transferred, shall have a special permit to work and have access to the classified information, or such a person shall be checked according to the standards of a person’s credibility established in the state whereto information is transferred, which will testify to the right to work or to have access to the classified information.
8. The right to transfer information containing a state secret shall be vested with the subjects of state secrets after they coordinate their activities with the Permanent Steering Committee on Preparation and Implementation of Agreements on State Secrets issues under the Ministry of Foreign Affairs.
9. Information under the marking "Top Secret" shall be dispatched with a messenger only.
10. Information under the marking "Secret" shall be dispatched either with a messenger or by the diplomatic mail.
11. Information not considered as state secret, however falling under with the NATO's classification "NATO RESTRICTED", may be dispatched by the registered mail, however, the documents containing information like this shall be packed according to the stipulations of the present regulations.
12. A messenger dispatching information under the marking "Top Secret" and "Secret" shall be obliged to have a Security Certificate issued by the Permanent Steering Committee on Preparation and Implementation of Agreements on State Secrets under the Ministry of Foreign Affairs.
13. Uncodified confidential and strictly confidential information shall be prohibited from transferring via computer application systems of information transfer.
14. Information under the marking "Top Secret" and "Secret" transferred to other countries or international organizations shall be registered according to the regulations of Classified Information Records Keeping approved by the Department of Archives of Lithuania and the Department of State Security of the Republic of Lithuania.
15. Documents subject to dispatching and containing information considered as state secret, shall be packed in double opaque hard packages. An inside package or envelope shall contain a marking specifying the degree of confidentiality, addresses of the addresser and the addressee, and a document number. A package shall be glued, stitched up with a thread or fastened with wire so that all its flaps are fastened in places glued. If a package (enclosing schemes, photos, drawings) may not be pierced, it shall be tied crosswise in the centre of the package (as measured from all its sides) so that the strained thread holds the content of the package firmly and is tied up in the centre on the other side of the package. The point, where the package is tied, is glued with silicate adhesive whereon a paper tag with the name of the subject of a state secret is glued. The tag shall be glued so that it covers the centre of the package flaps, leaving ends of the thread visible, and covering the knot. Five sealed paper tags shall be attached on flap corners and in the centre of packages containing documents with the marking "Top Secret". Tags shall be produced from non flaky paper. Tags, which are sealed, may be round or quadrangular, and shall be larger by 3 - 4 mm than the attached seal. The address of both the addressee and the addresser only shall be written down on the outside package. The package shall not specify whether the documents enclosed contain classified information considered as state secret.
16. Alongside top secret and secret information the register of receipt shall be dispatched as well, the recipient of which shall have to sign and send it without any delay to the addresser. The register of the receipt shall indicate only the number of the document, the date and the number of pages. Protection of Secrets of other States and International Organizations
17. Packages with classified information from other states or international organizations may be opened only by officials who belong to the department of classified information of the institutions, to which the package is addressed, and who have the right to work with information like this, and these officials are exclusively empowered to sign registers of receipts, if there are any .
18. All secret documents received from other states or international organizations shall be stamped with classification markings established according to the laws of the Republic of Lithuania. Marking stamps shall be affixed on the top and the bottom of each page.
19. Persons, holding the Security Certificate issued by the Permanent Steering Committee on Preparation and Implementation of Agreements on State Secrets under the Ministry of Foreign Affairs, shall be allowed, insofar it is pertinent to the duties they carry out, to work with or have access to classified information of other states and organizations.
20. Persons enjoying the right to work with the documents containing information considered as secret of other states or international organizations or any other classified information, shall be warned of the liability for the disclosure or loss of the information of this type, as is required by the procedure of protection of information considered as state secret of the Republic of Lithuania approved by the Government of the Republic of Lithuania.
21. Secret documents received from other states or international organizations shall be registered, handled and deposited in compliance with the provisions of regulations of record keeping of classified information approved by the Department of Archives and the Department of State Security of the Republic of Lithuania.
22. Documents containing information secrets of other states or international organizations shall be stored only in the departments of classified information. Top secret documents of the NATO and other states must be deposited in "A" class safes with coded locks of the NATO's standards, secret and confidential in "B" class safes with coded locks of the NATO's standards, while documents for the restricted use shall be deposited in "C" class safes of the NATO's standards or metal cabinets with coded locks.
23. Premises of the department of classified information shall be equipped according to the NATO's standards. It must be ensured that outsiders will be prevented from access to the premises, and safety of the documents containing secret information stored in the premises must be guaranteed.
24. The security of the premises, designated for storage and access to the classified information of other states or international organizations, shall be implemented according to the procedure of protection of information considered as state secret of the Republic of Lithuania and approved by the Government of the Republic of Lithuania
25. Documents containing classified information of other states or international organizations may be translated into other languages only by persons holding a Security Certificate issued by the Permanent Steering Committee on Preparation and Implementation of Agreements of State Secrets under the Ministry of Foreign Affairs. A translation shall be marked with the same classification marking as the original and shall be stored together with the document. The other side of the document shall specify by whom and when the translation was done.
26. The text of documents shall be translated according to the provisions of record keeping of classified information outlined in the regulations approved by the Archives Department of Lithuania and the Department of State Security of the Republic of Lithuania.
27. Documents of other states or international organizations containing classified information shall be allowed for copying only on the permission of the competent institution of a particular state or international organization. It shall be allowed to make only one copy of translation of these documents.
28. Documents of other states or international organizations containing classified information under the marking "secret" or classified as less secret shall be allowed for copying only by the subject of the state secret to whom the document is addressed. All reproduced copies shall be registered and entered into registration list according to the regulations of classified information record-keeping approved by the Department of Archives of Lithuania and the Department of State Security of the Republic of Lithuania.
29. Documents of other states or international organizations containing secret information shall be destroyed according to the regulations of classified information record keeping approved by the Lithuanian Department of Archives and the Department of Sate Security of the Republic of Lithuania with the participation of representatives of the Permanent Steering Committee on Preparation and Implementation of Agreements on State Secrets under the Ministry of Foreign Affairs. The NATO's top secret documents shall not be destroyed - they shall be returned to the sender after they are recognized as no longer necessary or upon the expiry of their validity. In the event of crisis confidential documents of other states or international organizations shall be destroyed according to the procedure established by the Permanent Steering Committee on Preparation and Implementation of Agreements on State Secrets under the Ministry of Foreign Affairs. 30. Upon coordination with the Permanent Steering Committee on Preparation and Implementation of Agreements on State Secrets under the Ministry of Foreign Affairs, the authority of a subject holding state secrets issues permits allowing citizens and officials of other states and international organizations, with which the Republic of Lithuania concluded International Agreements on Protection of Classified Information, to work with or have access to information classified as state secret of the Republic of Lithuania.
31. A permit is issued if a citizen of the other state or official of an international organization presents a request (specifying a category and scope of information requested to work with or to have access to) motivated by a competent institution and supplemented by a person’s Security Certificate issued by respective authorities of his/her state or international organization. ____________________________
