Official Translation Official Translation REPUBLIC OF LITHUANIA LAW ON THE WORK CONDITIONS OF THE MEMBERS OF SEIMAS July 11,

  1. No I - 1473 Vilnius FIRST CHAPTER GENERAL PROVISIONS ARTICLE
  2. Purpose of the Law
  3. This Law shall establish for each member of Seimas such conditions, while working at the Seimas, its departments, the electoral area and individually, as to enable him to properly perform the duties and implement the rights established for him by laws.
  4. This Law shall apply to the members of Seimas who have taken an oath of loyalty to the Republic of Lithuania, pursuant to Article 59 of the Constitution of the Republic of Lithuania and the requirements of Article 5 of the Seimas Statute. ARTICLE
  5. The Member of Seimas Identification Document and Diplomatic Passport The Central Electoral Committee shall issue to the members of Seimas the identification document of a member of Seimas. During his term of office a diplomatic passport shall be issued to the Seimas member. ARTICLE
  6. Attendance of the Members of Seimas at Sessions A member of Seimas must attend the sessions of the Seimas during voting which had been officially planned at least one day in advance and also, must attend the meetings of the Seimas committees and subcommittees, which he is a member of. The work hours of a Seimas member shall not be defined. ARTICLE
  7. Insurance of the Members of Seimas
  8. Following the implementation by a member of Seimas of the requirements of Article 2 of the Seimas Statute, the following notation shall be entered on his social insurance document: “Member of the Seimas of the Republic of Lithuania.”
  9. The members of Seimas shall be insured by State Social Insurance.
  10. The health and life of a member of Seimas shall be insured from State funds. The procedure and conditions of insurance shall be established by law. SECOND CHAPTER WORK CONDITIONS OF THE MEMBERS OF SEIMAS ARTICLE
  11. The Provision of Premises for Work
  12. Suitably appointed work premises shall be set up for the members of Seimas, committees, commissions and parliamentary groups of Seimas. A member of Seimas shall be provided an individual work area within Seimas premises.
  13. The members of Seimas shall be provided free of cost premises by local governments: 1) to hold meetings; 2) to meet with voters, for a member of Seimas who has been elected in a multi-candidate electoral area.
  14. A member of Seimas elected in a single candidate electoral area having indicated at his own request, the owner (manager) and the address of the premises he wishes to rent, and following concurrence by the Seimas Administrative Commission (further - Administrative Commission), the Seimas office shall draw up a rental agreement of the premises designated for the work (the member of Seimas shall pay for the use of the telephone) of the Seimas member.
  15. If the members of Seimas so desires, a telephone may be installed at their residence on a priority basis. ARTICLE
  16. The Right to Obtain Health Care Services A member of Seimas shall have the right, in accordance with the procedure established by laws, to avail himself of free health care services within the Republic of Lithuania, regardless of his place of residence. ARTICLE
  17. The Use of Official Automobiles
  18. The Speaker of Seimas, his deputies and the Chancellor of Seimas shall be entitled, by virtue of their position, to the use of an official automobile and driver.
  19. Each member of Seimas shall have the right, during his term of office, to obtain an official automobile without a driver.
  20. The Administrative Commission shall establish the procedure of the use of the official automobiles, at the disposal of Seimas. THIRD CHAPTER ATTENDANCE BY THE MEMBERS OF SEIMAS AT SEIMAS SESSIONS, ITS COMMITTEE, COMMISSION AND SUBCOMMITTEE MEETINGS ARTICLE
  21. Informing About Inability to Attend Session If a member of Seimas is unable to attend the session of Seimas during voting which had been planned in advance, and the Seimas committee, commission or subcommittee meeting, he shall appropriately inform, the secretariat of the Seimas sessions, committee, commission, subcommittee chairman, indicating the reasons for his absence. If the Seimas member fails to provide information, as to why he shall not attend the session, it shall be construed that the session was missed without due cause. ARTICLE
  22. The Reasons for Absence The following shall be considered important reasons for absence at a Seimas session during voting which had been planned in advance and also, at a committee, commission or subcommittee meeting: the temporary inability of a Seimas member to work, a journey in connection with being dispatched by the Seimas Board or with its approval, accidents or other circumstances, whose justification shall be determined by the Seimas Commission on Ethics and Procedure (further - Commission on Ethics and Procedure), and appropriate committee, commission and subcommittee chairmen. ARTICLE
  23. Information on Attendance at Sessions The Secretariat of Seimas Sessions shall submit the summarised information concerning attendance by the members of Seimas at Seimas sessions, and also about attendance at the Seimas session during voting which had been planned in advance while the committee, commission and subcommittee chairmen on the first work day of every month shall submit in writing, to the Chairman of the Seimas Commission on Ethics and Procedure, information regarding attendance at committee, commission and subcommittee meetings during the preceding month. ARTICLE
  24. Attendance at Meetings of the Commission on Ethics and Procedure The members of Seimas, invited to a meeting of the Ethics and Procedure Commission, shall arrive at the time appointed by this commission. If a member of Seimas is unable to attend such a meeting, he must inform the chairman of that commission and indicate the reasons for this. ARTICLE
  25. Estimation of the Reasons for Failure to Attend Meetings During the first half of every month, the chairman of the Commission on Ethics and Procedure shall inform the Seimas and submit to the Finance Section of the Seimas office the information on the absences of the members of Seimas at Seimas sessions during voting which had been planned in advance, and absences at committee, commission and subcommittee meetings. The names of the members of Seimas, who in the absence of serious causes, failed to attend such meetings may, upon the decision of the Commission on Ethics and Procedure be published in “Valstybės Žinios” (“Official Gazette”). FOURTH CHAPTER THE SALARY OF THE MEMBERS OF SEIMAS ARTICLE
  26. The Size of Salary and Its Reduction
  27. Every month, the members of Seimas shall receive a salary based upon the tripled amount of the preceding month’s average monthly wage (AMW) of the Lithuanian economy, published by the Statistics Department at the Government of the Republic of Lithuania, whereas the member of Seimas, who has been appointed Prime Minister or Minister, shall receive a salary equivalent to one AMW.
  28. A one-third reduction in salary shall be made for a member of Seimas who, in the course of the month has, without serious cause, missed more than one-fourth of the Seimas sessions with advance-planned voting when legal acts were being enacted, or has missed more than one-fourth of Seimas committee, commission or subcommittee meetings, whose work he was to have participated in. ARTICLE
  29. The Salary of the Officers of Seimas
  30. Seimas officers shall have a supplementary salary allotted to them: 1) the Speaker of Seimas of a triple equivalent of an AMW amount; 2) the Deputy to the Speaker of Seimas, Chancellor of Seimas of a double equivalent of an AMW amount; 3) chairman of a Seimas committee, a permanent commission, of a one equivalent of an AMW amount; 4) deputy chairman of a Seimas committee, a permanent commission, chairman of a subcommittee, of a 0.5 equivalent to an AMW amount.
  31. The spokesman of a parliamentary group and his deputies shall receive additional pay commensurate with the size of the parliamentary group. The sum paid for parliamentary group administration, commensurate with the size of membership shall be as follows: when fewer than 5 members of Seimas are included in the parliamentary group, an amount equivalent to 0.25 AMW, from 6 to 10 members - 0.5 AMW, from 11 to 20 members, 1 AMW, from 21 to 30 members - 1.5 AMW, from 31 to 40 members - 2 AMW, over 40 members - 2.5 AMW.
  32. A member of Seimas may only receive one salary slated for a Seimas officer, if it exceeds 1 AMW. ARTICLE
  33. The Fund of the Speaker of Seimas The Fund of the Speaker of Seimas, to which a sum in the amount of 12 AMW’s, shall be allotted every month, shall be instituted to fund representational expenses within the country and abroad, as well as other expenses. Half of the money in the Fund of the Seimas Speaker shall be used without accounting. ARTICLE
  34. The Funds to Cover Other Expenses
  35. A member of Seimas shall have an additional sum equivalent to 1 AMW amount allotted to him to cover office, post, telephone, telegraph and other expenses incurred in connection with parliamentary activity.
  36. A member of Seimas who is being sent on official business to areas within the Republic of Lithuania, shall have his passenger travel expenses reimbursed. The Seimas Board shall establish the procedure for reimbursement of such expenses.
  37. The parliamentary group shall have a annual sum of 1 AMW and 0.2 AMW allotted per each parliamentary group member to cover its annual activities. These funds may be utilised to cover the legislative and expert examination, representational, postal, telephone and other necessity expenses. ARTICLE
  38. The Right of Members of Seimas to Return To a Previously Held Position
  39. Upon the expiration of the term of powers of a member of Seimas in the instances stipulated, in items 1 and 3 of Article 8 of the Seimas Statute, he must be offered the position held by him prior to his election or a position at a state enterprise, institution or organisation, with the exception of that of a member of the Government and elective office within a governing institution. If the former position has been abolished or the enterprise, institution or organisation has been liquidated, he must be provided an equivalent job or position at that same enterprise, institution and organisation or, if the member of Seimas agrees, at another state enterprise, institution and organisation. The member of Seimas also shall have the right to approach the Ministry of Public Administration Reform and Local Government Affairs which shall inform the former member of Seimas about official position vacancies in his permanent place of residence area, and shall employ him if he concurs.
  40. The parliamentary activity time of the member of Seimas shall be included in the work record of all types of work.
  41. Following the termination of the powers of a member of Seimas involving the circumstances stipulated in items 1,2,3, and 4 of Article 63 of the Constitution, a severance pay shall be paid him. This pay shall be issued in a sum to equal as many average position salaries, as the number of years he spent without interrupting his term of office, in Seimas or in the Seimas and the Supreme Council of the Republic of Lithuania, but in an amount to equal a minimum equivalent to 2 average position salaries. FIFTH CHAPTER THE ASSISTANTS-SECRETARIES OF THE MEMBERS OF SEIMAS AND PARLIAMENTARY GROUP STAFF MEMBERS ARTICLE
  42. The Salaries of Assistants-Secretaries of the Members of Seimas
  43. A member of Seimas shall have the right to retain assistants-secretaries. A general sum to equal 2 average AMW’s shall be allotted on a monthly basis to cover their salaries.
  44. Upon the recommendation of a member of Seimas, the chancellor of Seimas shall draw up a term employment contract with the member of Seimas assistant-secretary. Following the interruption of the powers of a member of Seimas prior to term expiration, the term employment contract with the assistant-secretary shall also be cancelled. If the term employment contract has been interrupted due to the expiration of the powers of the member of Seimas, the assistant-secretary shall be paid a severance pay sum to equal 2 AMW’s.
  45. The assistant-secretary of a member of Seimas shall be given an annual holiday equivalent to 28 calendar days .
  46. A member of Seimas may have assistants working on a volunteer basis. ARTICLE
  47. Parliamentary Group Staff Members
  48. The Seimas Board shall establish the number of parliamentary group staff members and the salary conditions thereof. The parliamentary group shall be allotted a minimum of one advisory position.
  49. Upon the recommendation of the parliamentary group spokesman, the chancellor of Seimas shall draw up a term employment contract with the staff members of parliamentary groups, not to exceed the Seimas powers term. SIXTH CHAPTER LIVING CONDITIONS OF MEMBERS OF SEIMAS ARTICLE
  50. The Provision of Living Quarters for Seimas Members
  51. A member of Seimas who does not have a residence in Vilnius or else has the right to state support in securing a residence in Vilnius, shall be provided free a place of residence to share with his family in Vilnius, reserving him the right to use his rented residence in his permanent area of residence. The Seimas office shall form a contract with the member of Seimas on the use of a residence.
  52. A member of Seimas who does not have a residence in Vilnius, may rent a residence in Vilnius, on his own. In this instance, the Seimas Board shall determine the size and procedure of reimbursement for rent. The sum of reimbursement may not exceed the sum allotted without cost, to cover the rental expenses of the member of Seimas for the upkeep of an analogous residence.
  53. The members of Seimas, who have free residential facilities allotted to them, shall enjoy free use of the furniture and other inventory located in the premises allotted to them, and utilities (heating of the premises, electricity, gas, cold and hot water, plumbing, rubbish removal, care of the rubbish disposal, elevator, television antenna, wired radio apparatus, cleaning of communal premises, care and cleaning of the residential building area), telephone (except out of town phone calls), and television.
  54. Following termination of the member of Seimas powers, the former member of Seimas must vacate within 30 days, the premises provided for him for the duration of his powers. SEVENTH CHAPTER FINAL PROVISIONS ARTICLE
  55. Implementation of the Law on the Work Conditions of the Members of Seimas
  56. Guided by this Law the Seimas office and the local governments shall create the necessary work and living conditions for the members of Seimas.
  57. The diplomatic missions of the Republic of Lithuania abroad must render assistance to members of Seimas for the duration of their work assignments in a foreign state.
  58. Special departments of the Seimas office shall administer the social insurance and other personal documents of the members of Seimas. ARTICLE
  59. Control The board the Administrative Commission and the Commission for Ethics and Procedure shall control implementation of this Law. I promulgate this law passed by the Seimas of the Republic of Lithuania. PRESIDENT OF THE REPUBLIC ALGIRDAS BRAZAUSKAS
