LAW LAW ON THE TRANSFER OF STATE-OWNED PROPERTY TO MUNICIPALITIES 2 December 1997 No. VIII-546 Vilnius Chapter I GENERAL PROVISIONS Article 1. Purpose of the Law The Law determines the share of state-

(2)of this Law shall be transferred by deeds of conveyance, specifying the name and address (location) of the municipal institution supported from the budget or the public institution, also the property’s balance-sheet value and balance-sheet data for the last accounting period; 4) property identified in of Article 3, paragraph 3 (1, 2, 3, 4) shall be transferred by deeds of conveyance which specify the name of the facility, its address (location), immovable property technical inventory date, also its balance-sheet and residual value; 5)

(5)shall be transferred by deeds of conveyance comprising, among other documents, completion of works certificates; 6)
Article 3(4) shall be transferred by deeds of conveyance.
- In the cases specified in paragraph 2 hereof the balance-sheets of enterprises and institutions drawn up for the last accounting period shall be appended to the deeds of conveyance.
- The deeds of conveyance shall be signed by the person authorised by the Government and the municipality mayor.

(1), shall be transferred subject to its prior inventorying. 6. The facilities and other
this Law, Article 3, paragraph 3 (2, 3, 4), shall be transferred irrespective of the date of technical inventorying thereof. Technical inventorying data shall be revised following the transfer of property. Where no technical inventory has been taken, the property shall be inventoried prior to its transfer to municipalities.
- The deed of conveyance shall be legal basis for the registration of transferred property in the property register. Where the property that is transferred is not subject to registration, ownership rights thereto shall be created from the moment of property transfer. Article
- Conditions of Property Transfer
- State-owned property shall be transferred to municipalities without consideration and irrespective of which municipality administers the territory where the property is located.
- The property assigned but not transferred to municipalities under the Law on the Assignment and Transfer of Part of State-owned Property to Municipalities shall not be transferred to municipalities if it is not assignable thereto under this Law. The property assigned but not transferred to municipalities under the Law on the Assignment and Transfer of Part of State-owned Property to Municipalities shall be transferred in the manner prescribed by this Law provided it is assignable to municipal ownership thereunder. - Property Transfer Dates State-owned property shall be transferred to municipalities in the manner and within the time period prescribed by the Government, however, municipalities may be transferred only those shares, buildings and premises specified information whereon has been submitted by the municipality to the Government or the institution authorised by it. The Government or the institution authorised by it shall have the right to suspend or discontinue the transfer of state-owned shares or other property, should it transpire that municipalities have submitted incorrect information or falsified the data relating to the property which is transferred to them. Chapter IV FINAL PROVISIONS Article
- Dispute Settlement Procedure Disputes between the persons authorised by the Government and municipalities concerning the transfer of a certain portion of state-owned property assignable under this Law to the ownership of municipalities shall be settled by court. Article
- Final Provisions
- Every year municipal councils shall earmark funds in their respective budgets, required for taking a technical inventory of the property assigned to municipal ownership and subject to transfer to municipalities or for making revisions of the inventory.
- The coming into force of this Law shall invalidate: 1) the Law of the Republic of Lithuania on the Assignment and Transfer of Part of State-owned Property into Municipal Ownership; and 2) the Law of the Republic of Lithuania on the Implementation of the Law on the Assignment and Transfer of Part of State-owned Property into Municipal Ownership.
