Decree of the Government of the Republic of Lithuania (official translation) GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION Amending Government Resolution No 268 of 24 March 1997 On the Procedure of Export and Import Regulation in the Republic of Lithuania No 1245 20 October 1998 Vilnius Acting in pursuance of the Law on Customs Tariffs of the Republic of Lithuania, the Government of the Republic of Lithuania hereby h a s r e s o l v e d:
- To amend the Resolution of the Government of the Republic of Lithuania of 24 March 1997 No. 268 “On the Procedure of Export and Import Regulation in the Republic of Lithuania”: 1.
- subparagraphs 2.7.3 and 2.7.7 shall be set forth to read as follows: “2.7.
- imported consignments of charity and aid, also goods intended for disabled persons, disaster victims, participants in the resistance to occupations movements, and persons-victims of the occupations, when: 2.7.3.
- charity and aid consignments are imported according to the procedure laid down by the Government of the Republic of Lithuania or the institution authorised by it; 2.7.3.
- non-commercial goods intended for the disabled persons (children with disabilities, persons with group I, II and III disability, persons who have reached the age of 80), for their personal use, for employment, social, educational purposes, for the purposes of upbringing, scientific and cultural progress, which are imported by enterprises, institutions or organisations the activities whereof are related to the provision of aid to the disabled or by other organisations which represent the interests of the disabled, upon presenting to the customs the certificates issued by the enterprises, institutions or organisations the list whereof shall be drawn up by the Ministry of Social Security and Labour, together with the lists of goods being imported; 2.7.3.
- goods intended for disaster victims (victims of fire, flood, hurricane, epidemics, armed assault, explosion, train, aircraft, ship accident or any other calamity), except for alcoholic beverages, tobacco and tobacco products, that are imported by state or municipal institutions which take care of persons who are disaster victims, also for meeting the needs of rescue service carrying out rescue work. The customs must be presented with documents confirming the occurrence of the disaster (a decision or certificate of the state or municipal institution or a certificate testifying to the force majeur circumstances, issued according to the procedure established by the Government of the Republic of Lithuania); 2.7.3.
- non-commercial goods intended for personal use of participants in the resistance to occupations movements and persons-victims of the occupations, imported by the Genocide and Resistance of the Lithuanian Population Research Centre as well as public organisations whose members are participants in the resistance to the occupations movements and victims of the occupations. Considered as participants in the resistance to the occupations movement shall be persons specified in the Law of the Republic of Lithuania on the Legal Status of the Participants in the Resistance to the 1940-1990 Occupations, whereas persons-victims of the occupations shall be those specified in the Law of the Republic of Lithuania on the Legal Status of Persons-Victims of the 1939-1990 Occupations. The customs must be presented with the certificate issued by the Genocide and Resistance of the Lithuanian Population Research Centre together with the list of goods being imported; 2.7.
- goods supplied as reserve goods, according to the procedure laid down by the Government of the Republic of Lithuania, to vessels and aircraft registered in the Republic of Lithuania and foreign states which carry cargo and passengers on international routes as well as reserve goods supplied to international trains”; 1.
- the above Resolution shall be supplemented with the following subparagraphs 2.7.11 - 2.7.31: “2.7.
- imported low value consignments or small consignments the total customs value whereof does not exceed LTL
- If the total customs value of the consignment exceeds LTL 400, none of the goods in the consignment shall be exempt from customs duty; 2.7.
- means of production and other equipment imported upon the termination of the enterprise’s operations in a foreign state, which have been used in the enterprise before the termination of its operations for an at least one-year period and imported (in one or by several consignments) not later than within a year from the day of termination of the enterprise’s operations in the foreign state from which the means of production and other equipment are transported. The customs must be presented with a list of means of production and other equipment and documents proving the fact of termination of the enterprise’s operations in the foreign state and the ownership of the means of production and other equipment by the person in whose name the enterprise is registered in the Republic of Lithuania, certificate of the registration of the enterprise in the Republic of Lithuania and documents confirming the formation or increase of the enterprise’s authorised capital; 2.7.
- products of agriculture, animal husbandry, apiculture, horticulture and forestry imported by the agricultural producers of the Republic of Lithuania, produced (grown) on the land plots in their use, located in a foreign state and adjacent to the border of the Republic of Lithuania, provided the products are not processed (except for the usual treatment after bringing in the harvest or obtaining the product), also seeds, fertilisers and products for soil and harvest processing applied on the plots of land used by the persons, that are located in the Republic of Lithuania and border on the foreign state. In such cases the customs must be presented a permit of the Ministry of Agriculture with a year’s validity period. The permit shall be issued to the applicant agricultural producers according to the procedure established by the Ministry of Agriculture upon filing the title or lease documents concerning the land in the Republic of Lithuania (or foreign state), accompanied by an application specifying the amounts of agricultural products harvested or received on the land plots used by said persons, which are located in the foreign state and border on the Republic of Lithuania, or of the seeds, fertilisers and soil and harvest processing products, which they desire to be import. 2.7.
- educational, scientific and cultural material (books, newspapers, magazines, other printed matter, video and audio material), school supplies and scientific equipment imported for non-commercial purposes in the manner laid down by the Ministry of Education and Science and Ministry of Culture by non-profit organisations or institutions (educational institutions, institutions of science, libraries, museums and other educational, scientific and cultural institutions and organisations); 2.7.
- imported experimental animals prepared or intended for laboratory tests and biological and chemical substances intended for scientific research, used by enterprises, institutions and organisations whose primary field of activities is education and research, which are not grown or produced in the Republic of Lithuania. The customs must be presented the registration certificate of the enterprise, institution or organisation; 2.7.
- imported therapeutic materials of human origin (blood and its derivatives (constituents): plasma, albumins, plasma proteins solutions, immunoglobulins, fibrinogens, amounts of erythrocytes, platelets, leukocytes etc.; reagents of human, animal, biological or other origin for blood grouping, blood and tissue typing and for histocompatibility evaluation; tissues and organs of the dead person-donor, intended for transplantation, samples of blood and tissues or organs of the dead person-donor and the recipient intended for blood grouping, blood and tissue typing and histocompatibility evaluation; containers for the transportation of therapeutic substances of human origin, tissues and organs of the dead person-donor intended for transplantation, samples of blood and tissues or organs, samples of reagents, various solvents and additives needed for the use of reagents when tissues and organs of a dead person-donor or samples of blood, tissues or organs required for investigation are transported in them. Therapeutic substances of human origin, reagents for blood grouping and tissue typing, tissues and organs of the dead person-donor as well as other items specified herein must be addressed to the enterprises, institutions and organisations of the Republic of Lithuania, which use them in accordance with the type of their activities and which have been authorised (entitled) in the established manner to engage in health care or pharmaceutical activities, also to medical research institutions. The customs must be presented the enterprise, institution or organisation registration certificate and, when the tissues or organs of a dead person-donor intended for transplantation or blood, tissue or organ samples required for investigation are being imported - also the single use permit issued by the Ministry of Health Care; 2.7.
- imported articles intended for trade promotion: publications and printed non-commercial advertising material; articles of non-commercial value intended for advertising purposes; samples of goods suitable only for ordering the advertised goods; goods used and consumed at exhibitions, fairs or similar events (including low value materials for building, installing or decorating display stands); samples of goods, printed matter, catalogues, prospects, price tariffs, advertising posters, calendars, unframed photographs and other free articles supplied for the purpose of advertising the goods of foreign make which are demonstrated at exhibitions, fairs and other similar events. The customs must be presented a list of said goods drawn up by the organiser of the event and co-ordinated with the Ministry of Finance; 2.7.
- individual goods brought in for investigation, analysis or trial, if the goods are qualified under the customs procedure of temporary import into the Republic of Lithuania of goods for processing or the goods are destroyed under the customs’ supervision during the investigation, analysis and trial thereof; 2.7.
- imported (or sent for expert examination for author identification) trade marks, designs and related documents, applications for the issue of invention patent and other documents, intended for copyright and industrial and commercial patent rights protection organisations; computer tapes and disks with the data concerning the distribution of authors’ remuneration; CDs, audio and video cassettes with information on the world authors’ repertoire, also various documents, publications on legal matters, methodological material relating to the authors’ rights; 2.7.
- information material for tourists imported for free distribution (leaflets, booklets, pamphlets, books, magazines, travel guides, posters, unframed and enlarged photographs, maps, window slides, illustrated calendars, etc.), intended to promote foreign travel among the population, provided that commercial advertising constitutes not more than 25% of the material, also information material intended not for distribution but for business activities of official national tourism agencies (representative offices) (reference books, chronicles, telephone directories, hotel lists, fair catalogues, publications on museums, universities, resorts and other places of interest); 2.7.
- various. imported documents (documents sent to the institutions of the Republic of Lithuania; publications of foreign state governments and publications of official international organisations imported for free distribution; ballot papers for elections held in other states; documents and other objects to be presented as evidence or for similar purposes to the courts of law and law enforcement institutions of the Republic of Lithuania; files, archives, printed forms and other documents intended for international meetings, conferences and congresses, also reports on the meetings; plans, drawings, lists, printed forms, labels, tickets; photographs, slides, stereoscopic photographic graticule with captions or without, sent to press agencies and newspaper and magazine publishers; other documents and recording media used for information transmission (punch cards, audio and video records, microfilms, etc.); 2.7.
- imported materials (ropes, textiles, straw, paper, cardboard, timber, plastic, etc.) required for the protection of goods (including protection from heat) during their warehousing and transportation from abroad to the Republic of Lithuania; 2.7.
- imported and exported litter and fodder needed for scattering and feeding the animals during their transportation from abroad to the Republic of Lithuania and from the Republic of Lithuania to a foreign country. The required amount of litter and fodder shall be established according to norms approved by the Ministry of Agriculture; 2.7.
- imported fuels and lubricants contained in stationary fuel and lubricant containers provided for in the manufacturer’s technical documentation, also fuel transported in portable containers without violating the requirements for keeping fuel and lubricants established in the Republic of Lithuania, but not in excess of 20 l per vehicle; 2.7.
- imported material intended for the building, maintenance and decoration of monuments, memorials and cemeteries of war, genocide and occupanionist regimes victims, upon presenting to the customs the permit issued by the Ministry of Culture and the list of materials; 2.7.
- imported instruments and equipment (including spare parts and fixtures, also tools used for the maintenance, checking, repair and control of instruments and equipment), intended for medical examination, diagnostics and treatment, donated by charity or sponsorship organisations or individuals to health care system bodies authorised in the established manner (having the right) to engage in health care or pharmaceutical activities, medicines control laboratories, medical research, education and science institutions or purchased by said bodies or institutions with donated money. The customs must be presented the enterprise, institution or organisation registration certificate and documents confirming donation of the instruments, equipment or funds; 2.7.
- comparable substances, imported for the enterprises, institutions and organisations of the Republic of Lithuania authorised in the established manner to (entitled) to engage in health care or pharmaceutical activities, for medicines control laboratories, medical research and development, education and scientific institutions, intended for product quality control. The customs must be presented the certificate of registration of the enterprise, institution or organisation; 2.2.
- exported low-value consignments the customs value whereof is not in excess of LTL 400; 2.2.
- exported domestic animals, when the agricultural producers of the Republic of Lithuania terminate their activities in the Republic of Lithuania and transfer their business to another state. The customs must be presented documents, confirming the termination of business in the Republic of Lithuania as well as the size of the formerly held land area and the type of business conducted thereon; 2.7.
- Seeds exported by the agricultural producers of the Republic of Lithuania intended for the land plots used by said persons, which are located in a foreign state and are adjacent to the Republic of Lithuania as well as unprocessed agricultural products (except for the regular treatment of harvested or obtained products) exported by agricultural producers whose principal business is in a foreign state, which have been produced (grown) on the land plots used by the persons in the Republic of Lithuania, provided the land plots are adjacent to the foreign state. In such cases the customs must be presented a permit issue by the Ministry of Agriculture valid for one year. Agricultural producers who wish to be issued such a permit must present documents testifying to their title to or lease of land in the Republic of Lithuania (or the foreign state) and an application specifying the amount they want to export per year of agricultural produce received on the land plots used by them, which are located in the Republic of Lithuania and adjacent to on the foreign state, or of seeds, fertilisers and products intended for soil and harvest treatment; 2.7.
- Goods imported into the Republic of Lithuania and exported from it in other cases specified by the Customs Code of the Republic of Lithuania and other laws, also by resolutions of the Government of the Republic of Lithuania”; 1.
- the Resolution shall be supplemented with the following subparagraph 2.11: 2.
- meat of bovine animals (codes according to the Combined Nomenclature - 02.01 -02.02), meat of swine (codes according to the Combined Nomenclature - 02.03.), edible meat offal (codes according to the Combined Nomenclature - 02.06, 02.10), meat of poultry (code according to the Combined Nomenclature - 02.07), fish (code according to the Combined Nomenclature - 03.02 - 03.03), wheat (codes according to the Combined Nomenclature - 1001 - 90 - 1004.00.00), buckwheat (code according to the Combined Nomenclature 1008.10.00), flour, starches, inulin, wheat gluten (codes according to the Combined Nomenclature 1101.00 -11.06, 00.08, 1109.00.00), rape, colza and mustard oil (code according to the Combined Nomenclature - 15.14), margarine (code according to the Combined Nomenclature 15.17), prepared or preserved meat (code according to the Combined Nomenclature 16.02), prepared or preserved fish (code according to the Combined Nomenclature 16.04), sugar and other sugars (codes according to the Combined Nomenclature 17.01 - 17.02) shall be imported under the automatic licensing system according to licenses issued by the Ministry of Agriculture”, 1.
- the above Resolution shall be supplemented with the following subparagraph 2.21 (the former subparagraph 2.21 shall be accordingly considered as subparagraph 2.22): “2.
- when goods are sent in and sent out by postal packages, tax exemptions specified in subparagraph 2.7 shall be applied”; 1.

- The institutions listed below shall be given the following assignments by 1 January 1999: 2.
- The Ministry of Social Security and Labour, the Genocide and Resistance Research Centre, the Ministry of Communications, the Ministry of the Environment, the Ministry of Agriculture, the Ministry of Health Care, the Ministry of Education and Science and the Ministry of Culture shall be charged to prepare and, after consultation with the Customs Department under the Ministry of Finance, approve the procedure for issuing the permits, certificates or other documents specified in subparagraph 1 of this Resolution, required in order to be granted import duty reliefs for shipments and individual products, also the samples of said documents, dividing the assignment as follows: 2.1.
- the Ministry of Social Security and Labour shall be charged to prepare and approve the procedure for issuing relevant permits, certificates and other documents necessary for being granted import duty reliefs for charity and sponsorship shipments as well as goods intended for persons with disabilities and disaster victims; 2.1.
- the Genocide and Resistance Research Centre shall be charged to prepare and approve the procedure for issuing relevant permits, certificates and other documents necessary for being granted import duty reliefs for non-commercial products intended for personal use of the participants in the resistance to occupations movement and occupation victims, imported by the Genocide and Resistance Research Centre and public organisations of the resistance members and occupation victims; 2.1.
- the Ministry of the Environment shall be charged to prepare and approve the procedure for issuing relevant permits, certificates and other documents necessary for being granted import duty reliefs for materials, intended for erecting monuments, memorials to and keeping and decorating the cemeteries of victims of war, genocide and occupationist regimes repression; 2.1.
- the Ministry of Agriculture shall be charged to prepare and approve the procedure for issuing relevant permits, certificates and other documents necessary for being granted import duty reliefs for products of agriculture, animal husbandry, apiculture, horticulture and forestry harvested (grown) by the agricultural producers of the Republic of Lithuania on the land plots in their use, located in a foreign state and adjacent to the Republic of Lithuania, also the seeds, fertilisers and articles required for the working of the soil or processing of the harvested products of the agricultural producers whose principal business is conducted abroad, provided said articles are intended for application on the land plots used by the above persons, that are located in the Republic of Lithuania and are adjacent to the foreign state; 2.1.
- the Ministry of Health Care shall be charged to prepare and approve the procedure for issuing relevant permits, certificates and other documents necessary for being granted import duty reliefs for tissues and organs of the dead persons-donors, intended for transplantation, samples of blood and tissues or organs required for research purposes; 2.1.
- the Ministry of Education and Science and the Ministry of Culture shall be charged to prepare and approve the procedure for issuing relevant permits, certificates and other documents necessary for being granted import duty reliefs for educational, scientific and cultural material (books, newspapers, magazines, other printed matter, video and audio material), school supplies and scientific equipment imported pursuant to the UNESCO Agreement on the Importation of Educational. Scientific and Cultural Materials and the 1976 Protocol thereto (with reservations applicable in respect of the Republic of Lithuania) ratified by the Seimas; 2.
- the Ministry of Agriculture shall be charged to prepare and approve the standard norms of litter and fodder needed for scattering and feeding the animals during their transportation from abroad to the Republic of Lithuania and from the Republic of Lithuania to a foreign country; 2.
- the Ministry of Education and Science together with the Ministry of the Environment shall be charged to draw up lists of experimental animals required for laboratory tests as well as lists of biological and chemical substances intended for scientific research purposes, which are not grown or produced in the Republic of Lithuania; 2.
- the Ministry of Communications shall be charged to work out the procedure for supplying international trains with reserves and the norms of said reserves; 2.
- the Customs Department under the Ministry of Finance shall be charged to get ready and commence, as of 1 January 1999, to collect information on the importation of goods in respect whereof exemption from customs duty is applied and to furnish, from time to time, the Ministry of Economy with related information in the form agreed with the Ministry.
- Subparagraphs 1.3 and 1.
- shall be applicable as of 1 November
