REPUBLIC OF LITHUANIA LAW ON THE PROHIBITION OF CHEMICAL WEAPONS 24 September 1998 No. VIII-864 Vilnius Article

1. Purpose of the Law The Law establishes measures and procedure for making effective the prohibition of the development, production, stockpiling and use of chemical weapons, the rights and duties of legal and natural persons in acquiring, selling or transferring, producing, processing, using, retaining, importing and exporting controlled chemicals. Article
2. Definitions As used in this Law,
3. “Chemical weapons” means the following: 1) toxic chemicals and their precursors, except where intended for purposes not prohibited under this Law, as long as their types and quantities are consistent with such purposes; 2) munitions and devices, as a result of employment whereof toxic chemicals specified in subparagraph 1 would be released; 3) any equipment specifically designed for use directly in connection with the employment of munitions and devices specified in subparagraph 2 hereof.
4. “Toxic chemical” means any chemical which through its chemical action on life processes can cause death, temporary incapacitation or permanent harm to humans or animals. This includes all such chemicals, regardless of their origin or of their method of production, and regardless of whether they are produced in facilities, in munitions or elsewhere.
5. “Precursor” means any chemical reactant which takes part at any stage in the production by whatever method of toxic chemical.
6. “Controlled chemicals” means controlled toxic chemicals, discrete organic chemicals and riot control agents.
7. “Controlled toxic chemicals” means toxic chemicals and their precursors listed according to their toxicity in three schedules (first - Schedule 1, second - Schedule 2 and third - Schedule 3).
8. “Discrete organic chemical” means any chemical belonging to the class of chemical compounds consisting of all compounds of carbon except for its oxides, sulphides and metal carbonates.
9. “Riot control agent” means any chemical not listed in paragraph 5 hereof, which can produce rapidly in humans sensory irritation or disabling physical effects which disappear within a short time following termination of exposure.
10. “Facility” means territory, production, administrative or other premises, except for residential quarters.
11. “International inspection” means a person or a group of persons issued a mandate under international agreements to inspect the implementation measures of chemical weapons prohibition. Article
12. Prohibited Activity
13. It shall be prohibited in the Republic of Lithuania: 1) to develop, produce, otherwise acquire, stockpile, retain or carry chemical weapons, sell or transfer them to any other person; 2) to use chemical weapons; 3) to engage in any military preparations to use chemical weapons; 4) to assist, encourage or induce anyone to engage in any activity prohibited under this Law; 5) to use riot control agents for military purposes.
14. Legal and natural persons must provide access, in compliance with the procedure established by legal acts, to facilities under their control and furnish international inspection teams and the accompanying representatives assigned by the Ministry of Economy with information necessary for the implementation of the Law. 15. Purposes not Prohibited under this Convention Toxic chemicals and their precursors, as long as the types and quantities are consistent with the purposes specified in paragraphs 1, 2 and 3 hereof, may be used for: 1) industrial, agricultural, research, medical, pharmaceutical or other peaceful purposes; 2) purposes directly related to protection against toxic chemicals and to protection against chemical weapons; 3) law enforcement including domestic riot control purposes. 16. Conditions of Controlled Toxic Chemicals and their Precursors Use for Purposes not Prohibited under Law

Without authorisation granted in accordance with the procedure established by the Government legal and natural persons shall have no right to: 1) acquire, sell or transfer, produce, process, use, retain, import into the territory of the Republic of Lithuania or export from it Schedule 1 toxic chemicals and their precursors; 2) import into the territory of the Republic of Lithuania and export from it Schedule 2 and Schedule 3 toxic chemicals and their precursors.
18. The lists of controlled toxic chemicals and their precursors shall be approved by the Government or the institution authorised by it.
19. Authorisation prescribed by paragraph 1 hereof shall be granted by the institution designated by the Government.
20. Conditions for granting authorisation: 1) Schedule 1 and Schedule 2 toxic chemicals and their precursors may be imported into the territory of the Republic of Lithuania from the states and exported from the territory of the Republic of Lithuania to the states included in the list approved by the Government of the Republic of Lithuania or the institution designated by it; 2) Schedule 3 toxic chemicals and their precursors may be exported to all states, however, their export to the states which are not on the list approved by the Government of the Republic of Lithuania or the institution designated by it shall only be permitted after the state makes a commitment not to use the listed toxic chemical as chemical weapons or for the purpose of developing or producing chemical weapons and not to transfer the chemical to other countries.
21. The procedure for granting authorisation shall be established by the Government. Article
22. Information
23. Every legal or natural person who acquires, sells or transfers, produces, processes, uses, retains, imports into or exports from the territory of the Republic of Lithuania controlled toxic chemicals, produces discrete organic chemicals or acquires riot control agents must provide information required for the implementation of the Law according to the procedure laid down by the Government.
24. The information relative to the implementation of the Law which has been obtained from legal and natural persons or provided by international organisations carrying out the supervision of chemical weapons prohibition shall be considered confidential when designated as such by the information supplier. Persons who are authorised to work with or have access to such information shall be prohibited from disseminating or from permitting others to disseminate the information without the consent of the legal or natural person who provided it, except in cases relating to: 1) the implementation of this Law; 2) the need to inform the public of the imminent danger in case of concealment of such information; 3) the necessity to ensure state security. 25. Liability for Non-compliance with the Law Violation of provisions of this Law shall make a person liable under law. Article
26. Instructions to the Government The Government or the institution designated by it shall by 1 February 1999: 1) compile the lists of Schedules 1, 2 and 3 toxic chemicals and their precursors and the lists of the states from which the chemicals may be imported into and to which they may be exported from the territory of the Republic of Lithuania; 2) establish the procedure for granting authorisation to acquire, sell or transfer, produce, process, use, retain, import into and export from the territory of the Republic of Lithuania of Schedule 1 toxic chemicals; 3) establish the procedure for granting authorisation to import into and export from the territory of the Republic of Lithuania Schedules 2 and 3 toxic chemicals and their precursors; 4) establish the procedure for furnishing information to be complied with by the legal and natural persons who acquire, sell or transfer, produce, process, use, retain, import into or export from the territory of the Republic of Lithuania controlled toxic chemicals, produce discreet organic chemicals and acquire riot control agents. 27. Coming into Force of the Law The Law shall come into force as of 1 October
