1997 m Working document GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No. 1052 On the Combined Customs Tariffs and Foreign Trade Statistical Nomenclature of the Republic of Lithuania Vilnius, 11 September 1996 Pursuant to article 8 of the Law on Customs Tariffs of the Republic of Lithuania (Records, 1998, No.28-727), the Government of the Republic of Lithuania r e s o l v e s: (Preamble in the edition of Resolution No.424 of 15 April 1999 of the Government of the Republic of Lithuania (as of 22 April 1999) (Records, 1999, No.35-1041) 1.To establish that: 1.
- The Combined Customs Tariffs and Foreign Trade Statistical Nomenclature of the Republic of Lithuania (hereinafter called the ‘Combined Nomenclature of Goods’) shall be introduced and utilised for the classification of goods on the basis of the Combined Nomenclature of Goods of the European Economic Community (hereinafter called the ‘EEC Nomenclature’). The abbreviations ‘The Combined Nomenclature of Goods’ and ‘CNG’ might be used in all legal acts of the Government public and subordinate authorities of the Republic of Lithuania. The classification of the Combined Nomenclature of Goods shall be effected by including all headings and subheadings as well as any relative chapter, section, subheading notes or additional notes of the Nomenclature of EEC. In case of inaccuracies of the translation of headings and subheadings as well as any relative chapters, section, subheading notes and additional notes into Lithuanian, references shall be made to the English text of the Nomenclature of EEC published in the Official Journal of the European Communities; 1.
- A subheading of the Combined Nomenclature of Goods shall be specified by a nine-digit number, of which the first eight digits correspond to the relevant subheading code of the EEC Nomenclature; 1.
- For the purposes of the Combined Customs Tariffs and Foreign Trade Statistical Nomenclature of the Republic of Lithuania, national subheadings, being absent from the EEC Nomenclature, might be additionally included in the Combined Nomenclature of Goods. National subheadings might be determined by breaking the subheadings of EEC Nomenclature into parts. The codes of national subheadings determined by breaking the same subheading of EEC Nomenclature into parts shall differ only in a ninth digital number, which might vary from 1 to
- If subheading of the EEC Nomenclature is not broken into parts, then the determinative ninth digit of the code is
- The criteria governing the classification of goods into national subheadings might be determined by including additional national notes of the Combined Nomenclature of Goods; 1.
- The Combined Nomenclature of Goods might additionally include headings and subheadings of chapters 98 and 99 in which reduced customs duties or taxes or special customs clearance procedure shall be applicable to goods classified therein. The procedure for use of the headings and subheadings of chapters 98 and 99shall include a reference to additional notes of chapters 98 and 99 and subheading notes. 1.
- The Combined Nomenclature of Goods shall be managed by the Customs Department under the Ministry of Finance (hereinafter called the ‘Customs Department); 1.
- Edition of Resolution No.424 of 15 April 1999 of the Government of the Republic of Lithuania (as of 22 April 1999) (Records, 1999, No.35-1041) The Combined Nomenclature of Goods as amended shall be approved by the Inter-ministerial Commission on the Use of Combined Customs Tariffs and Foreign Trade Statistical Nomenclature formed by the Customs Department. A representative of the Customs Department shall be appointed Chairman of the Commission and representatives of the Ministry of Economy, Ministry of Finance, Ministry of Transport, Ministry of Environment, Ministry of Foreign Affairs, Ministry of Agriculture, Ministry of Health Care, Customs Department and Department of Statistics under the Government of the Republic of Lithuania shall be appointed members of the above Commission. The provisions of the Commission in co-ordination with the Department of Statistics under the Government of the Republic of Lithuania shall be approved and its draft documents shall be drawn up by the Customs Department. 1.
- Edition of Resolution No.424 of 15 April 1999 of the Government of the Republic of Lithuania (as of 22 April 1999) (Records, 1999, No.35-1041). The Combined Nomenclature of Goods must be approved not later than 20 December of each year. The Commission document specified under 1.6 paragraph whereby the Combined Nomenclature of Goods is approved should include a reference to the regulation of the European Commission whereby the EEC Nomenclature, serving as a basis for the Combined Nomenclature of Goods, and an edition number of the Official Journal of the European Communities where the English text of the indicated EEC Nomenclature was published. The Combined Nomenclature of Goods shall enter into force on 1 January of the following year and shall be valid until 31 December. During the established period of validity, following the approval of the Ministry of Finance, only national subheadings, national additional notes, notes of chapters 98 and 99 and subheading notes may be changed; 1.
- Inter-ministerial Commission on the Use of Combined Customs Tariffs and Foreign Trade Statistical Nomenclature of Foreign Trade shall also: 1.8.
- Deliberate proposals of public authorities, legal and natural persons on the amendments and supplements to the Combined Nomenclature of Goods; 1.8.
- By its acts approve documents which determine the classification of goods in the Combined Nomenclature of Goods; 1.8.
- Upon the instructions of the Government of the Republic of Lithuania approve lists of goods or nomenclatures of other goods drawn up according to the Combined Nomenclature of Goods; 1.8.
- Deliberate disputes relating to the classification of goods if a person does not agree to a decision of the Customs Department; 1.8.
- (Edition of Resolution No.1476 of 19 December 1996 of the Government of the Republic of Lithuania (as of 22 April 1999) (Records, 1996, No.125-2921) Without any other instructions approves code correlation tables if there is non conformity between the approved Combined Nomenclature of Goods and codes of goods specified in the legislation of the Government of the Republic of Lithuania and international treaties concluded on behalf of the Government of the Republic of Lithuania; 1.8.
- (Edition of Resolution No.1476 of 19 December 1996 of the Government of the Republic of Lithuania (as of 22 April 1999) (Records, 1996, No.125-2921) submit to the Government of the Republic of Lithuania and other public authorities proposals on the application of the Combined Nomenclature of Goods; 1.
- Edition of Resolution No.424 of 15 April 1999 of the Government of the Republic of Lithuania (as of 22 April 1999) (Records, 1999, No.35-1041) The approval procedure in the Combined Nomenclature of Goods of the classification of the samples (exhibits) of goods submitted by the legal and natural persons and the classification procedure of samples (specimens) taken by the Customs officers shall be established by the Customs Department. When laboratory tests are found necessary for the classification and expertise of samples (specimens), the expert findings of the Customs laboratory tests shall be taken as the basis for decision. Disputes relating to the classification of goods shall be settled as prescribed by the procedure of the Customs Department. Appeals against the decisions of the Customs Department might be lodged with the Inter-ministerial Commission on the Use of Combined Customs Tariffs and Foreign Trade Statistical Nomenclature; 1.
- (Edition of Resolution No.424 of 15 April 1999 of the Government of the Republic of Lithuania (as of 22 April 1999) (Records, 1999, No.35-1041) Lists of goods or nomenclature restrictions or special regimes, according to which import or export duties and (or) taxes as well as import or export prohibitions are determined, shall be made on the basis of the Combined Nomenclature of Goods. If a part of classified goods is specified under the heading and subheading Combined Nomenclature of Goods, the code of goods shall be marked with a prefix ‘ex’. The part of classified goods specified under the heading and subheading of Combined Nomenclature of Goods shall be defined in the description of the part of goods placed next to the code; 1.

The Combined Nomenclature of Goods shall be applicable in compliance with the Customs Code of the Republic of Lithuania, other legislation of the Republic of Lithuania regulating its applications, general rules governing the interpretation of the Harmonized Commodity Description and Coding System, explanatory notes of the Harmonized Commodity Description and Coding System and advisory opinions on the classification of goods published in the editions of the World Customs Organisation, explications of the EEC Combined Nomenclature approved by the EEC Commission, recommendations of the Harmonised System Committee and Science Sub-committee of the World Customs Organisation, regulations and decisions of the EEC Commission on the classification of goods.
- To instruct the Customs Department to set up the Inter-ministerial Commission on the Use of Combined Customs Tariffs and Foreign Trade Statistical Nomenclature by 23 September 1996 and approve its general provisions in conjunction with the Statistics Department under the Government of the Republic of Lithuania.
- To authorise the Ministry of Foreign Affairs to forward the nomenclature text in the English language to the Customs Department within two weeks from the date of the publication of the EEC Nomenclature in the Official Journal of the European Communities.

- From the said day the title “The Combined Nomenclature of Goods of European Economic Communities” shall be replaced with ‘the Combined Customs Tariffs and Foreign Trade Statistical Nomenclature of the Republic of Lithuania” in all legislative acts of the public and subordinate authorities of the Government of the Republic of Lithuania. The Lithuanian version of the Combined Nomenclature of Goods of the European Economic Communities shall apply by 31 March 1997 in compliance with Resolution No. 30 ‘On the Use of Combined Nomenclature of Goods of the European Economic Communities’ of 27 January 1993 of the Government of the Republic of Lithuania, and from 1 October 1996 shall be deemed the Combined Customs Tariffs and Statistical Nomenclature of Foreign Trade of the Republic of Lithuania.
