Official translation Official translation GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No. 1063 ON PARTIAL AMEDMENTS TO RESOLUTION No. 1181 ON RETAIL TRADE IN TOBACCO PRODUCTS PASSED BY THE GOVERNMENT OF THE REPUBLIC OF LITHUANIA ON 2 OCTOBER 1998 27 September 1999 Vilnius In accordance with Articles 1, 8, 10 and 11 of the Law on Tobacco Control of the Republic of Lithuania, the Government of the Republic of Lithuania h a s r e s o l v e d: To partly amend Resolution No.1181 “On Retail Trade in Tobacco Products” passed by the Government of Lithuania on 2 October 1998 (Valstybės Žinios, No. 88–2440, 1998):
- To replace the words “within a period of 5 working days” in point 3.3 with the following words: “not later than by the 15th day of next month”.
- To amend the Regulations on Licensing Retail Trade in Tobacco Products approved by the said resolution in the following way: 2.
- to add the word “general” to point 7.2 by placing it after the words “memorandum of association”. 2.
- to set forth point 16.4 as follows: “16.
- the enterprise is indebted to the national budget of the Republic of Lithuania, municipal budgets or funds the income of which from taxes and contributions is administered by the State Tax Inspectorate under the Finance Ministry (hereinafter referred to as the “State Tax Inspectorate”), as well as to the budget of the State Social Insurance Fund or it has persistently evaded taxes as specified in Article 49 (except point 12) of the Law on Tax Administration of the Republic of Lithuania during the past 3 years prior to submitting an application for licence or between the issue (re-registration) of the licence and the application to re-register it provided that a decision passed by the State Tax Inspectorate on imposing a fine on the enterprise pursuant to Article 50
(3)of the said law has come into force”; 2.
- to set forth point 26.3 as follows: “26.
- licence holder does not make payments in due time to the national budget of the Republic of Lithuania, municipal budgets or funds the income of which from taxes and contributions is administered by the State Tax Inspectorate, or the budget of the State Social Insurance Fund”; 2.
- to set forth point 28.7 as follows: “28.
- there have been cases of persistent evasion of taxes referred to in Article 49 (except point 12) of the Law on Tax Administration of the Republic of Lithuania during the past 3 years prior to submitting an application for licence or between the issue (re-registration) of the licence and the application to re-register it provided that a decision passed by the State Tax Inspectorate on imposing a fine on the enterprise pursuant to Article 50
(3)of the said law has come into force; 2.
- to set forth point 28.9 as follows: “28.
- enterprises have been prohibited to conduct any commercial activity in accordance with the procedure prescribed by Article 71 of the Law on Commerce of the Republic of Lithuania”.
- To amend the Regulations on Retail Trade in Tobacco Products approved by the said resolution in the following way: 3.
- to set forth point 6 as follows: “
- It shall be prohibited to sell tobacco products: 6.
- in pharmacies, health care institutions, educational establishments (pre-school institutions, secondary, vocational and higher schools, supplementary educational establishments: art, sports, language, technical and other schools, as well as summer camps for children); 6.
- in retail businesses where goods for children account for 50 percent and more of the retail trade turnover; 6.
- by vending machines; 6.
- to individuals under 18 years of age”. 3.
- to set forth points 7.2, 7.3 and 7.8 as follows: “7.
- tobacco products without a copy of the manufacturing company’s certificate of quality for each consignment and brand of tobacco products; 7.
- tobacco products without wrappers that are valid in accordance with the procedure prescribed by legal acts; 7.
- contraband and falsified tobacco products”. 3.
- to add the following paragraphs to paragraph one of point 9: “Only the following information concerning tobacco products shall be presented in locations where tobacco products are sold: name and address of the manufacturer or commercial establishment and type of trade (wholesale or retail); name and brand of tobacco products; inscribed words: “We Trade In” or “We sell; levels of tar, nicotine and other harmful substances in tobacco products; prices of tobacco products; information that tobacco products present a hazard to health.
