GOVERNMENT OF THE REPUBLIC OF LITHUANIA Official translation GOVERNMENT OF THE REPUBLIC OF LITHUANIA R E S O L U T I O N No. 119 Amending Resolution No. 199 of 6 March 1997 and Resolution No. 268 of 24 March 1997 adopted by the Government of the Republic of Lithuania Vilnius, 4 February 1999 The Government of the Republic of Lithuania r e s o l v e s: 1.To amend Resolution No. 199 “ On the Establishment of Customs Regime Applicable to Travellers crossing the State Border of the Republic of Lithuania” adopted on 6 March 1997 by the Government of the Republic of Lithuania (Žin., 1997, No. 21-511; 1998, No. 28-739, No. 42-1147, No. 65-1894, No. 84-2358): 1.

  1. to set paragraph 2 to read as follows as follows: “
  2. To establish that: 2.
  3. persons arriving in the Republic of Lithuania for a period not exceeding three days must have at least 300 Litas in cash or a corresponding amount in foreign currency according to the official exchange rate of that day of Litas against that foreign currency set by the Bank of Lithuania, and travellers arriving for a period exceeding 3 days must have at least 100 Litas for each day or a corresponding amount in foreign currency according to the official exchange rate of that day of Litas against that foreign currency set by the Bank of Lithuania. This requirement shall not be applied to Lithuanian travellers; travellers in transit via the territory of the Republic of Lithuania; operatives of motor vehicles fulfilling international transportation; and, upon presentation of a certificate issued pursuant to the procedure set by the Ministry of the Interior, to non-Lithuanian travellers temporarily arriving in the Republic of Lithuania for the purposes of studying, medical treatment, on business, as well as for the persons residing, working or studying in the frontier zone, going to and fro from work, school every day, also in other cases set by the Ministry of the Interior; 2.
  4. the present Resolution is applicable unless otherwise provided for in the Laws of the Republic of Lithuania and International agreements (conventions)”; 1.
  5. in the Customs Regime Applicable to Travellers Crossing the State Border of the Republic of Lithuania approved by the said Resolution: 1.2.
  6. to outline the paragraphs 5.5.1 and 5.
  7. as follows: “5.5.
  8. in case a traveller changing his permanent residence and moving to the Republic of Lithuania from another state has been granted a permit to settle permanently in the Republic of Lithuania (upon presentation to the Customs of documents certifying the fact of a person’s residence abroad and the documents issued by the Ministry of the Interior certifying the right to reside in the Republic of Lithuania permanently), or in case a permit to settle permanently in the Republic of Lithuania is not required (upon presentation of documents certifying the fact of a person’s residence abroad for a period of not less than twelve months). Within twelve months from the day of receipt of a permit to settle permanently in the Republic of Lithuania, or, in case such permit is not required, from the first day of the release into free circulation of the first consignment of property brought in (taking into account particular circumstances, the above indicated period of twelve months can be extended to fifteen months pursuant to the decision of the Customs) a traveller has the right to bring into the Republic of Lithuania (in one or several individual consignments) articles for personal use that belong to him/her or members of his/her family, as well as personal articles for non-commercial and non-productive purposes that he/she used abroad (according to the list presented to the Customs and not exceeding the rates indicated in Annex 2): 5.5.1.
  9. furniture and other domestic requisites; 5.5.1.
  10. domestic appliances and other everyday (including electronic) equipment; 5.5.1.
  11. articles for personal use; 5.5.1.
  12. means of transport for private use which have been registered abroad in the name of a traveller or his/her family member; 5.5.1.
  13. working instruments and tools used in professional activity; 5.5.1.
  14. leisure items; 5.5.1.
  15. collector’s items; 5.
  16. engine fuel and lubricants contained in a traveller’s private means’ of transport fitted fuel and lubricants tanks (described in the manufacturer’s technical documentation) from which the fuel and lubricants directly reach the fuel supply and lubricating systems of the means of transport, with the exception of cases indicated in this paragraph and paragraph 6.
  17. If the state border is crossed for the second time or more prior to the expiry of three days after the first entry by the same private cars including passenger-cargo automobiles (universal) and racing cars (code according to the Combined Nomenclature of Goods - 87.03), the amount of engine fuel allowed to be brought in the said fuel tanks can not exceed 1/4 of the volume of the car tank subject to the data shown by the fuel indicator (if necessary, other means of inspection may be applied). While going by the automotive vehicles intended for transporting cargo or ten or more persons, including the driver, or by special motor vehicles, tractors or prime movers (codes according to the Combined Nomenclature of Goods - appropriately, 87.04, 87.02, 87.05, 87.01), the amount of engine fuel allowed to be brought in the said fuel tanks can not exceed 1/4 of the volume of the tank of the vehicle when the total volume of the said tanks is 400 and more litres, and not more than 100 litres when the total volume of the said tanks is less than 400 litres (the amount of the fuel is established from the data shown by the fuel indicator; if necessary, other means of inspection may be applied). If the amount of engine fuel carried exceeds the allowed norm, or if it is established that the data shown by the fuel indicator does not correspond to the amount of fuel contained in the fuel tank, the driver will be subject to the sanctions laid down in the Administrative Law of the Republic of Lithuania and other legal acts. The amount of engine fuel and lubricants contained in a traveller’s private means’ of transport fitted fuel and lubricants tanks (described in the manufacturer’s technical documentation) from which the fuel and lubricants directly reach the fuel supply and lubricating systems of the means of transport is not restricted for the following means of transport: those carrying travellers and consignments by international routes; going by transit through the territory of the Republic of Lithuania; going through the border control points where the state frontier borders the state in which the engine fuel prices are higher than those in the Republic of Lithuania or slightly differ from them; carrying persons residing, working or studying in the frontier zone and every day going to work, school and back upon presentation by them of the certificate issued by the Ministry of the Interior in the prescribed order. The periodicity of crossing the state border of the Republic of Lithuania by the travellers and means of transport is registered by putting stamps in the passport of the traveller or by any other method established by the Ministry of the Interior. The analysis of the prices of engine fuel in the Republic of Lithuania and neighbouring states is carried out by the Ministry of Economy, and conclusions are presented periodically to the Customs Department under the Ministry of Finance and the Border Police Department under the Ministry of the Interior”; 1.2.
  18. to supplement the said regime by paragraphs 6.7 - 6.9: “6.
  19. importing meat and meat offal, dairy products, eggs, sausages and similar products of meat, (codes according to the Combined Nomenclature of Goods - 02.01-02.10, 04.01-04.08, 16.01); 6.
  20. importing engine fuel and lubricants: 6.8.
  21. exceeding the rates indicated in paragraph 5.7; 6.8.
  22. not contained in a private traveller’s means’ of transport fitted fuel and lubricants tanks (described in the manufacturer’s technical documentation) from which the fuel and lubricants directly reach the fuel supply and lubricating systems of the means of transport; 6.8.
  23. contained in non-self propelled means of transport; 6.
  24. importing goods, including those indicated in Annexes 2 and 3, via the border control points without Customs posts”; 1.2.
  25. to outline paragraph 15.2 as follows: “15.
  26. articles (goods) arriving and listed under paragraphs 5.3, 5.4, 5.5 and 5.9, irrespective of their quantity, as well as articles (goods) which are not covered by paragraph 5, or motor vehicles purchased abroad by a Lithuanian traveller and not registered in the Republic of Lithuania as well as other means of transport and their units carrying number plates. A single administrative document shall be presented (except in cases when railway travellers, on importation of these articles (goods), present a traveller’s declaration, if they agree that the duties and taxes can be computed for the whole consignment, treating it as goods subject to the highest total rate of the established duties and taxes, but not less than 10%, also in cases otherwise indicated by the Procedure of Temporary Admission of Goods into the Republic of Lithuania established by the Government of the Republic of Lithuania)”; 1.2.
  27. to outline paragraph 7 of Annex 1 as follows: “Weapon (civilian (hunting, sporting gun, gun for self-defence), service weapon and weapon registered on a certain name) with ammunition. For persons taking part in sports contests or hunting and returning from them, more than one hunting or sporting gun shall be treated as their articles for personal use, upon presentation to the Customs of a permit to bring in (take out) these hunting or sporting guns issued pursuant to the procedure set by the Ministry of the Interior”; 1.2.
  28. to outline Annex 2 as new version (enclosed); 1.2.
  29. in Annex 3: 1.2.6.
  30. to outline first, third, fifth and sixth passages as follows: “Preserved meat and meat offal (code according to the Combined Nomenclature of Goods - 16.02) 1 kg Vegetable foodstuffs (codes according to the Combined Nomenclature of Goods - 07.01 -12.12, 15.07 - 15.15, 1516.20, 15.17, 1521.10, 17.01 - 21.06, 2209.00) 1 kg The quantity of foodstuffs may not exceed the norms, if established, indicated in Annex 2 of Customs Regime Applicable to Travellers Crossing the State Border of the Republic of Lithuania Gas spraying mechanical appliances or aerosol spray cans (code according to the Combined Nomenclature of Goods - 9304.00.00.0) 1 unit Valid also on importation Gas pistols (revolvers) (code according to the Combined Nomenclature of Goods - 9304.00.00.0) 1 unit Valid also on importation Cartridges for gas pistols (revolvers) (code according to the Combined Nomenclature of Goods - 9306.30.98.0)”; 2 sets “ 1.2.6.
  31. to supplement the said Annex by eighth passage: “Pneumatic guns and pistols not exceeding 4,5 mm calibre (code according to the Combined Nomenclature of Goods - 9304.00.00.0)”; 1 units “ 1.2.6.
  32. to outline the note as follows: “Note. The indicated quantities of articles (goods) may be imported into the Republic of Lithuania by non-Lithuanian travellers who are arriving and Lithuanian travellers who are returning back only through the border control points with customs posts and only once in three days (this requirement shall not be applied to travellers going by air or sea transport)”.
  33. Partly amending Resolution No. 268 “ On the Procedure of Export and Import Regulation in the Republic of Lithuania” adopted on 24 March 1997 by the Government of the Republic of Lithuania (Žin., 1997, No. 27-645; 1998, No. 93-2578), to outline paragraph 2.7.24 as follows: “2.7.
  34. imported engine fuel and lubricants contained in a driven motor vehicles’ fitted fuel and lubricants tanks (described in the manufacturer’s technical documentation) from which the fuel and lubricants directly reach the fuel supply and lubricating systems of the means of transport, with the exception of below indicated cases. If the state border is crossed for the second time or more prior to the expiry of three days after the first entry by the same private cars including passenger-cargo automobiles (universal) and racing cars (code according to the Combined Nomenclature of Goods - 87.03), the amount of engine fuel allowed to be brought in the said fuel tanks can not exceed 1/4 of the volume of the car tank subject to the data shown by the fuel indicator (if necessary, other means of inspection may be applied). If the amount of engine fuel carried exceeds the allowed norm, or if it is established that the data shown by the fuel indicator does not correspond to the amount of fuel contained in the fuel tank, the driver will be subject to the sanctions laid down in the Administrative Law of the Republic of Lithuania and other legal acts. The amount of engine fuel and lubricants contained in a private means’ of transport fitted fuel and lubricants tanks (described in the manufacturer’s technical documentation) from which the fuel and lubricants directly reach the fuel supply and lubricating systems of the means of transport is not restricted for the following means of transport: those carrying travellers and consignments by international routes; going by transit through the territory of the Republic of Lithuania; going through the border control points where the state frontier borders the state in which the engine fuel prices are higher than those in the Republic of Lithuania or slightly differ from them; carrying persons residing, working or studying in the frontier zone and every day going to work, school and back upon presentation by them of the certificate issued by the Ministry of the Interior in the prescribed order. The periodicity of crossing the state border of the Republic of Lithuania by the travellers and means of transport is registered by putting stamps in the passport of the traveller or by any other method established by the Ministry of the Interior.
