(10)of the Republic of Lithuania Law on the Profit Tax of Legal Persons (Official Gazette No 34-813, 1995), the Government of the Republic of Lithuania h a s r e s o l v e d: 1.To approve the Regulations of the Decommissioning Fund of the SE “Ignalina Nuclear Power Plant “ (attached thereto).

- SE “Ignalina Nuclear Power Plant “ shall include in the electricity cost the expenditures connected with: 2.1.
- the formation of its decommissioning fund; 2.1.
- handling of spent nuclear fuel (acquisition of containers, design, installation and maintenance of storage site, loading, transportation and maintenance of containers); 2.2 As of 25 07 1996, version of Government Resolution No181 of 2 February 1996 (Official Gazette, 960120320), Resolution No 852 of 18 July 1996 (Official Gazette, 1996, No. 69-1673), as of 13 02 1996 version of Government Resolution No 103 of 7 February 1997 The funds accumulated prior to the entry into force of this Resolution for the financing of decommissioning works of the SE “Ignalina Nuclear Power Plant” must be transferred to the special account of the State Treasury of Lithuania by 1 July

- Prime Minister Adolfas Đleţevičius Minister of Energy Arvydas Leđčinskas Approved by Government of the Republic of Lithuania Resolution No 1403 Regulations of the SE”Ignalina Nuclear Power Plant Decommissioning Fund General Provisions 1.The purpose of the SE “Ignalina Nuclear Power Plant” Decommissioning Fund ((hereinafter referred to as –the Fund) is to accumulate resources necessary for the financing of decommissioning works, including preliminary research and design works. 2.The resources of the SE “Ignalina Nuclear Power Plant” Decommissioning Fund shall be kept in a special account of the State Treasury of Lithuania. 3.The issues concerning the use of accumulated resources shall be decided upon by the Board of the Fund, appointed by the Minister of Economy on the basis of the mutual agreement of interested Lithuanian institutions. 4.The resources shall be transferred to the special account of the State Treasury of Lithuania within 45 days after the date on which the calculations of profit tax of legal persons must be submitted. 5.The resources transferred to the special account of the State Treasury of Lithuania in accordance with the procedure set forth in paragraph 4 of these Regulations will be included in the electricity production cost of the SE “Ignalina Nuclear Power Plant”. If these resources are not transferred to the special account when due, it shall be deemed that the taxable profit, generated in that period in which these funds were included in the electricity production cost, was reduced wrongfully. Resources of the Fund
- The resources of the Fund shall be accumulated from the deductions from revenues generated by the SE “Ignalina Nuclear Power Plant” from electricity sold and the interest. Use of Fund Resources
- The resources of the Fund shall be used by the SE “Ignalina Nuclear Power Plant” for the financing of decommissioning works, including preliminary research and design works. With the prior consent of the Government of the Republic of Lithuania, the resources of the Fund may be used for the acquisition of government securities (bonds). Liquidation of the Fund
- The Fund shall be liquidated upon the completion of the decommissioning works.
- The Fund shall be liquidated and the balance of the resources will be used following the decision of the Government of the Republic of Lithuania.
