General Provisions
- This procedure shall establish the rates, payment and use of the charges for servicing aircraft in airspace and airports.
- For the purpose of this Resolution: “MTOW” shall mean the maximum take-off weight of an aircraft indicated in its airworthiness certificate and expressed in tons rounded to the nearest number after the decimal point in the usual manner; “airspace” (airspace management area) shall mean the airspace where air traffic services are rendered by the relevant institutions of the Republic of Lithuania; “airport” shall mean an enterprise that services passengers, baggage, cargo, mail, aircraft flights and crew, and operates an airport, buildings and other ground-based facilities as well as personnel to this end; “great circle distance” shall mean the shortest distance in kilometers: - in the event of transit flight, measured from the point of entry into the airspace management area of the Republic of Lithuania to the point of exit from the airspace management area of the Republic of Lithuania; - in the event of aircraft landing, as measured from the point of entry into the airspace management area to the small airport circle (the diameter of this circle is 40 kilometres, i. e. 20 kilometre radius around the airport reference point); - in the event of a flight between two airports of the Republic of Lithuania, as measured by the distance between small airport circles; “ultralight aircraft” shall mean any aircraft with MTOW less than or equal to 0.5 tons. II. TYPES OF CHARGES
- The following charges shall be collected for the aircraft services rendered in the airspace and airports: 3.
- air navigation charge; 3.
- airport navigation charge; 3.
- aircraft landing charge; 3.
- aircraft escort charge; 3.
- departing passenger’s charge; 3.
- aircraft parking charge; 3.
- aviation security charge. III AIR NAVIGATION CHARGE
- The air navigation charge shall be collected for the use of air navigation equipment during an aircraft’s flight in the airspace management area.
- The rate of the air navigation charge shall be calculated according to the following formula as proposed by the International Civil Aviation Organization (ICAO): R = W x P x D, where R is the rate of air navigation charge; W is the weight factor (); P is the price of the air navigation charge (P = 220 litas); D is the great circle distance divided by
- The rate of the air navigation charge for training, demonstrative, aircraft equipment adjustment and test flights, also flights for taking photos or shooting films, or ground-based air navigation equipment test flights shall be determined as follows: MTOW (tons) Rate of charge (litas per minute) 0.5–2 1.4 2–5 1.84 5–10 2.08 10–20 2.2 20–35 4.04 35–50 5 50–100 6.2 100–200 8 more than 200 10.4
- For the flights referred to in paragraph 6 over an airport at night (from sunset till sunrise), the air navigation charge shall be increased by 40 per cent. IV. AIRPORT NAVIGATION CHARGE
- The airport navigation charge shall be collected for the use of navigation landing equipment by the aircraft that land at airports.
- For the aircraft with MTOW less than or equal to 2 tons, the rate of the airport navigation charge shall be determined as follows: - 40 litas for international flights; - 20 litas for domestic flights.
- The rate of the airport navigation charge for the aircraft with MTOW exceeding 2 tons shall be calculated according to the following formula: T = I x W, where T is the rate of the airport navigation charge; I is the price of the air navigation charge (I = 540 litas for international flights, I = 200 litas for domestic flights); W is the weight factor (). V. AIRCRAFT LANDING CHARGE
- The aircraft landing charge shall be collected for the use of runways and taxiways by the aircraft landing at airports.
- For the aircraft with MTOW less than 2 tons, the rate of the landing charge shall be determined as follows: Airport Rate of charge (in litas) for aircraft on international routes for aircraft on domestic routes Vilnius 80 40 Karmėlava (Kaunas) 72 36 Palanga 72 36 Zokniai (Šiauliai) 60 32
- For the aircraft with MTOW equal to or exceeding 2 tons, the rate of the landing charge shall be determined as follows ( for each ton of aircraft): Airport Rate of charge for each ton of aircraft (in litas) for aircraft on international routes for aircraft on domestic routes Vilnius 52 28 Karmėlava (Kaunas) 52 26 Palanga 52 24 Zokniai (Šiauliai) 52 24 VI. AIRCRAFT ESCORT CHARGE
- The aircraft escort charge shall be collected for the services of a follow-me car that escorts an aircraft from its parking place to the runway or from the runway to its parking place. It shall not depend on the weight of the aircraft and the location of the aircraft parking place. The charge shall be set at 60 litas. VII. DEPARTING PASSENGER’S CHARGE
- The departing passenger’s charge shall be collected for the services rendered to a passenger departing from an airport of the Republic of Lithuania.
- The rate of the departing passenger’s charge shall be determined as follows: Airport Rate of charge (in litas) for passengers on international routes for passengers on domestic routes Vilnius 40 20 Karmėlava (Kaunas) 28 14 Palanga 28 14 Zokniai (Šiauliai) 20 10 VIII. AIRCRAFT PARKING CHARGE
- The aircraft parking charge shall be collected for the use of parking grounds by aircraft at airports.
- The rate of the parking charge shall be 10 percent of the aircraft landing charge (it shall be calculated for each 24 hours and the sum shall be rounded to the nearest whole number in the usual manner).
- If the aircraft parking time at the airport does not exceed 3 hours, no parking charge shall be collected. If the aircraft stays at the airport for more than 3 hours, a 24-hour charge shall be collected. IX. AVIATION SECURITY CHARGE
- The aviation security charge shall be collected for ensuring safety in the areas and on the grounds located by the passenger terminal and controlled by the airport. The rate of aviation security charge shall be 10 per cent of the landing charge (it shall be calculated for each 24 hours and the sum shall be rounded to the nearest whole number in the usual manner). X. PAYMENT OF CHARGES
- Charges shall be paid by: 21.
- users of the aircraft that cross the airspace management area shall pay the air navigation charge to the operators of respective navigation equipment or their authorized international agencies in cash or by transfer according to the procedure prescribed by laws and other legal acts; 21.
- users of the aircraft that lands in airports shall pay the airport navigation charge and the aircraft escort charge to the operators of respective navigation equipment or their authorized international agencies in cash or by transfer according to the procedure prescribed by laws and other legal acts; 22.
- users of the aircraft that land in airports shall pay landing, aircraft parking, aviation security and departing passenger’s charges to airports in cash or by transfer according to the procedure prescribed by laws and other legal acts;
- A zero air navigation, airport navigation, aircraft landing, aircraft escort, aircraft parking, aviation security and departing passenger’s tariff shall be imposed on the users of aircraft in the following cases: 22.
- an aircraft conducts search and rescue operations of people and aircraft involved in an accident; 22.
- the flight of an aircraft starts and ends at the same airport without an intermediate landing (forced return); 22.
- flights are carried out by aircraft registered in the State Aircraft Register of the Republic of Lithuania (police, customs, air force aircraft); 22.
- flights are carried out by ultralight aircraft; 22.
- special Government flights are carried out by foreign aircraft that have been authorized through diplomatic channels in conformity with international agreements valid in the Republic of Lithuania or that are afforded the same treatment as Lithuania by a respective foreign state; 22.
- flights are carried out by the aircraft of foreign military units that have been authorized to come to international exercises on the territory of the Republic of Lithuania according to the procedure prescribed by the law; 22.
- training flights are carried out by the aircraft of the Aviation Institute of Vilnius Gediminas University.
- Aircraft that carry charity, humanitarian aid and special aid supplies shall be exempt from air navigation, airport navigation, aircraft landing, aircraft escort, aircraft parking, aviation security and departing passenger’s charges according to the procedure established by the Ministry of Transport.
- Users of aircraft shall not pay the air navigation charge if the aircraft crosses the “G” class (uncontrolled) airspace of the Republic of Lithuania.
- Users of aircraft shall not pay the departing passenger’s charge for the following persons: 25.
- passengers travelling on direct transit flights; 25.
- passengers travelling free of charge; 25.
- children under the age of 2; 25.
- official delegations of the Government of the Republic of Lithuania and persons travelling on special flights.
- Users the of aircraft that land in emergency airports shall pay a 50 percent tariff for airport navigation, landing and aircraft parking services.
- Users of the aircraft of the Republic of Lithuania that carry out international flights from Lithuanian airports with intermediate landings on Lithuanian territory shall pay rates set for domestic routes in paragraphs 9, 10, 12 and 13 for services rendered in the international section of the route between Lithuanian airports.
- The approved rates of air navigation, airport navigation and landing charges shall be reduced for the users of aircraft of the Republic of Lithuania that carry out regular flights at airports indicated in the aircraft registration certificate subject to the flight frequency of the said user: Number of flights per month 1999 (in percent) 2000 (in percent) 2001 (in percent) 0–50 — — — 51–70 5 — — 71–90 10 — — 91–150 20 5 — 151–200 30 15 — more than 200 35 20 —
- Aircraft parking and aviation security charges calculated pursuant to paragraphs 18 and 20 shall be reduced for users of the aircraft that carry out regular air flights at airports indicated in the aircraft registration certificate as follows: Charge 1999 (in percent) 2000 (in percent) 2001 (in percent) Aircraft parking 25 10 — Aviation security 35 20 —
- Tariffs may be reduced for aircraft users that are not referred to in paragraphs 28 and 29 according to the procedure prescribed therein if such reductions are provided for by the agreement between the user of aircraft and the establishment that collects charges.
- All charges indicated in this Resolution shall be paid in litas.
- For the users of airspace and airports, which have failed to pay charges within 25 days, a fine for late payment amounting to 0.2 percent of the total sum for each day delayed shall be levied. XI. USE OF CHARGES
- The funds collected for the aircraft services rendered in airspace and airports shall be included into the gross income of the establishment that collects such charges. These funds shall be used to cover the costs relating to services referred to in the present resolution, also to finance the management and development of civil aviation. The detailed use of such income shall be provided for in the annual estimate of charge income and expenditure drawn up by establishments that collect such charges and approved by the Ministry of Communications.
