RESOLUTION official translation GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No. 1002 CONCERNING THE IMPLEMENTATION OF THE LAW OF THE REPUBLIC OF LITHUANIA ON PUBLIC PROCUREMENT 16 September 1999 Vilnius Acting pursuant to the Law of the Republic of Lithuania on Public Procurement (Official Gazette, 1996, No 84-2000; 1999, No 56-1809), the Government of the Republic of Lithuania has resolved:

  1. To approve the list of legal acts necessary for the implementation of the Law of the Republic of Lithuania on Public Procurement and of the institutions responsible for the drafting thereof (appended).
  2. To charge: 2.
  3. the organisations included in the above-specified list to prepare drafts of legal acts for the preparation whereof they are responsible and to submit the said acts to the Government of the Republic of Lithuania according to the established procedure and by the date fixed in the above list; 2.
  4. the Public Procurement Office under the Government of the Republic of Lithuania: 2.2.
  5. to draw up and approve, by 20 September 1999, the list of legal acts necessary for the implementation of the Law of the Republic of Lithuania on Public Procurement, which are assigned within the sphere of competence of the Public Procurement Office, and to set the time limits for the drafting of the above legal acts; 2.2.
  6. to draw up, by 15 December 1999, the list of members of the Independent Commission for the Examination of Complaints Relating to Public Procurement (hereinafter referred to as the Commission); 2.2.
  7. to provide the Commission with adequate working conditions by 31 December 1999; 2.
  8. the Ministry of Economy - to draw up and approve by 1 October the list of contracting authorities which may execute procurement contracts the value whereof is not below the threshold specified in Article 12

(3)of the Law of the Republic of Lithuania on Public Procurement; 2.
  1. the Ministry of Administrative Reforms and Municipality Affairs together with the State-owned enterprise State Property Fund - to draft proposals regarding the allotment of additional premises to the Public Procurement Office for providing working places for the Commission; 2.
  2. ministries and other institutions of public administration - to harmonise by 1 October 1999 the legal acts adopted by them with the Law of the Republic of Lithuania on Public Procurement. Drafts of the Resolutions of the Government of the Republic of Lithuania or documents confirmed by them, which are to be amended shall be submitted according to the established procedure to the Government of the Republic of Lithuania by 1 October
  4. To establish that: 3.
  5. public procurement procedures commenced prior to 1 October 1999 shall be completed in accordance with the Law of the Republic of Lithuania on Public Procurement enacted on 13 August 1996 (Official Gazette, 1996, No 84-2000; 1997, No 117-3000); 3.
  6. the complaints of suppliers/contractors received by the Public Procurement Office prior to 1 January 2000 shall be examined in accordance with the Law of the Republic of Lithuania on Public Procurement of 13 August 1996 (Official Gazette , 1996, No 84-2000; 1997, No 117-3000), and the Regulations for the Examination of the Suppliers’/Contractors’ Complaints about the Violations of the Law of the Republic of Lithuania on Public Procurement, confirmed by the Resolution of the Government of the Republic of Lithuania of 22 December 1998 No. 1475 “Concerning the Approval of the Regulations of the Examination of Complaints by Suppliers/Contractors about the Violations of the Law of the Republic of Lithuania on Public Procurement” (Official Gazette, 1998, No 113-3155) Prime Minister Rolandas Paksas Minister of the Economy Eduardas Maldeikis Confirmed by the Resolution of the Government of the Republic of Lithuania of 16 September 1999 No. 1002 LEGAL ACTS NECESSARY FOR THE IMPLEMENTATION OF THE LAW OF THE REPUBLIC OF LITHUANIA ON PUBLIC PROCUREMENT AND THE INSTITUTIONS RESPONSIBLE FOR THE DRAFTING OF SAID ACTS Title of the legal act Responsible institution Date of submission to the Government of the Republic of Lithuania
