In connection with the publication of Circular CSSF 22/812, the CSSF would like to draw the attention of all issuers of specific payment instruments that can be used only in a limited way on their obligation to notify the use of the limited network exclusion pursuant to the Law of 10 November 2009 on payment services. In this context, “specific payment instrument that can be used only in a limited way” shall mean an instrument that allows (

  1. i)acquiring goods or services only in the premises of the issuer or within a limited network of merchants or (
  2. ii)acquiring only a very limited range of goods or services. This includes, for example, store cards, gift cards, fuel cards, shopping centre cards, meal vouchers, public transport cards, membership cards with a payment functionality, or other similar instruments. The notification obligation to the CSSF applies to instruments that are usable from and in Luxembourg for which the total value of the payment transactions executed over the last 12 months exceeds the amount of EUR 1 million. This obligation applies to all issuers of such instruments that fulfil the requirements, regardless of whether or not the entity is under the supervision of the CSSF or whether it is part of the financial sector or not. Within one month from the moment the conditions are met, a notification must be submitted to the CSSF’s Innovation, Payments, Market Infrastructures and Governance (IPIG) department via the form available on our website.   4. k)de • les critères et facteurs à prendre en compte par les autorités compétentes la Directive 2015/2366 (« PSD2 »); dans leurs évaluations de l’application de ladite exclusion; • les dispositions particulières applicables aux prestataires de services de paiement listés à l’article 1 de la PSD2 et aux émetteurs de monnaie électronique autorisés souhaitant bénéficier de l’exclusion ; • la procédure de notification de l’utilisation de cette exclusion, telle que prévue à l’article 37

(2)de la PSD2, y compris le calcul du seuil et les informations devant être contenues dans la notification; et • la description des activités rendue publiquement disponible dans les registres nationaux et dans le registre central de l’EBA en vertu de l’article 37
(5)de la PSD2. Les orientations sont d’application à partir du 1er juin 2022. Champ d’application La présente circulaire s’applique à toutes personnes prestant au Luxembourg des services reposant sur des instruments de paiement spécifiques qui ne peuvent être utilisés que de manière limitée en vertu de l’article 3(
  1. k)de la loi du 10 novembre 2009 relative aux services de paiement (la « Loi »). Les orientations s’appliquent à ces personnes quel que soit leur secteur d’activité (i.e. secteur financier ou non) et leur statut (i.e. réglementé ou non). 3. Notification d’exclusion Il est demandé à toute personne prestant au Luxembourg des services basés sur des instruments de paiement spécifiques en vertu de l’article 3(k)(
  2. i)ou (
  3. ii)de la Loi, et pour lesquels la valeur totale des opérations de paiement exécutées au cours des 12 mois précédents dépasse le montant de 1.000.000 euros, d’adresser à la CSSF une notification en vertu de l’article 3-1
(1)de la Loi. A partir de l’entrée en vigueur de cette circulaire, la notification susmentionnée devra tenir compte des nouvelles dispositions prévues par les orientations et devra être soumise en utilisant le nouveau formulaire disponible sur le site web de la CSSF. La CSSF demande aux entités bénéficiant d’une exclusion au titre de l’article 3(k)(i) ou (ii) de la Loi et lui ayant déjà soumis une notification en vertu de l’article 3-1
(1)de la Loi, de lui soumettre une nouvelle notification prenant en compte les nouvelles dispositions des orientations, et ce au plus tard pour le 1er septembre

As a consequence, the CSSF integrates these Guidelines into its administrative practice and regulatory approach with a view to promote supervisory convergence in this field at European level.
  4. Guidelines The Guidelines aim at clarifying: • the scope and limits of the limited network exclusion under article 3(k) of • the criteria and indicators to be taken into account by competent authorities Directive 2015/2366 (“PSD2”); in the assessment of whether the activities should fall or not under the said exclusion; • the specific provisions applicable to the authorised payment services providers listed in article 1 of PSD2 and electronic money issuers that would like to benefit from the exclusion; • the notification process as per article 37
(2)of PSD2, including the calculation of the threshold and information to be included in the notification; and • the description of the activities to be made publicly available on the national registers and central register of the EBA as per article 37
(5)of PSD2. These Guidelines apply from 1 June 2022. These Guidelines are annexed to the present circular and available on the EBA website: https://www.eba.europa.eu/regulation-and-policy/payment-services- and-electronic-money/guidelines-limited-network-exclusion-under-psd2 2. Scope The present circular applies to all persons providing in Luxembourg services based on specific instruments that can be used only in a limited way as per article 3(
  1. k)of the law of 10 November 2009 on payment services (the “Law”). CIRCULAR CSSF 22/812 2/4 The Guidelines apply to these persons regardless of the sector (i.e. financial sector or not) and their regulatory status (i.e. regulated or not). 3. Notification of the exclusion It is required for all persons providing in Luxembourg services based on specific payment instrument as per article 3(k)(
  2. i)or (
  3. ii)of the Law, and for which the total value of payment transactions executed over the preceding 12 months exceeds the amount of EUR 1 million, to address to the CSSF a notification as per article 3-1
(1)of the Law. As of the entry into force of this circular, the above-mentioned notification shall take into account all the provisions foreseen in the Guidelines et shall be submitted using the new form available on the CSSF website. Entities benefiting from an exclusion under article 3(k)(i) or (ii) of the Law and that already submitted a notification to the CSSF as per article 3-1
(1)of the Law shall as soon as possible and at latest by 1 September 2022 submit a new notification taking into account the provisions of the Guidelines.
