Luxembourg, le 25 juillet 2019 À toutes les institutions de retraite professionnelle surveillées par la CSSF CIRCULAIRE CSSF 19/726 Concerne : Mise en œuvre d’un nouveau reporting annuel et trimestriel pour les institutions de retraite professionnelle (IRP) destiné à l’Autorité européenne des assurances et des pensions professionnelles (EIOPA), la Banque centrale européenne (BCE), la BCL et la CSSF Mesdames, Messieurs, La présente circulaire a pour objet de mettre en œuvre le nouveau reporting annuel et trimestriel dans le cadre réglementaire applicable aux institutions de retraite professionnelle établies au Luxembourg et soumises à la Loi du 13 juillet 2005, telle que modifiée (la « Loi de 2005 »). La décision du 10 avril 2018 du conseil des autorités de surveillance relative aux demandes d'informations habituelles de l'EIOPA auprès des autorités nationales compétentes (ANC) concernant la transmission d'informations sur les pensions professionnelles et le règlement BCE/2018/2 de la Banque centrale européenne du 26 janvier 2018 relatif aux obligations de déclaration statistique applicables aux fonds de pension ont introduit de nouvelles exigences de déclaration applicables aux IRP dans les États membres de l'UE (les « reporting »). Les reporting seront utilisés par l'EIOPA, la BCE, la BCL et la CSSF à des fins statistiques et de surveillance. Les reporting de l'EIOPA et de la BCE doivent techniquement être transmis à la CSSF avant d'être remis à l'EIOPA, respectivement à la BCL. La présente circulaire a pour objet de fournir aux IRP surveillées par la CSSF les principes clés, les instructions et les dispositions techniques pour l'établissement et l'envoi des reporting.
- IRP dans le champ d'application du reporting Toute IRP au sens des articles 5 et 25 de la Loi de 2005 doit se conformer au reporting tel que prévu par la présente circulaire de la CSSF. Afin d'utiliser les reporting de l'EIOPA également aux fins de sa propre surveillance statistique et prudentielle, la CSSF ne fait pas usage de l'option permise par la décision de l'EIOPA d'exempter, sous certaines conditions, les plus petites IRP de la soumission des reporting, de sorte que toutes les IRP figurant sur la liste officielle et surveillées par la CSSF doivent soumettre les reporting.

- Format, soumission et convention de dénomination des reporting à la CSSF La CSSF exige que les fichiers de reporting soient soumis par voie électronique en utilisant exclusivement l'un des canaux de transmission acceptés par la CSSF. - Date de référence La date de référence pour l'établissement des reporting à communiquer par les IRP est le dernier jour calendaire de chaque fin de trimestre ou de chaque fin d'année.

- Délai de remise des reporting à la CSSF Afin de respecter les délais prescrits par l'EIOPA et la BCE, les reporting sont soumis à la CSSF dix
(10)jours ouvrables avant les dates limites indiquées ci-dessus.
- Niveau de reporting Les reporting annuels et trimestriels destinés respectivement à l'EIOPA et à la BCE sont à établir au niveau de l'IRP, c'est-à-dire qu'ils regroupent les informations de tous les compartiments autorisés d'une IRP. Pour les besoins spécifiques de sa surveillance prudentielle des IRP, la CSSF demande, en plus des reporting trimestriels et annuels agrégés de l'EIOPA mentionnés ci-dessus, les mêmes reporting au niveau de chaque compartiment autorisé d'une IRP.
- Devise du reporting Les reporting doivent indiquer la devise dans laquelle les chiffres monétaires sont exprimés et doivent être conformes au rapport financier annuel audité de l'IRP. Circulaire CSSF 19/726 3
- Période La période de référence couvre un trimestre ou un an à compter du dernier rapport trimestriel ou annuel soumis à la date de référence. Par souci de clarté, le reporting CSSF actuel pour les IRP en vigueur conformément à l'article 61 de la Loi de 2005 n'est pas affecté à ce stade par la mise en œuvre du reporting implémenté par la présente circulaire et doit continuer à être soumis comme d'habitude. COMMISSION de SURVEILLANCE du SECTEUR FINANCIER Claude WAMPACH Marco ZWICK Jean-Pierre FABER Françoise KAUTHEN Directeur Directeur Directeur Directeur Circulaire CSSF 19/726 4 Luxembourg, 25th July 2019 To all institutions for occupational retirement provision supervised by the CSSF CIRCULAR CSSF 19/726 Re: Implementation of new annual and quarterly reporting for Institutions for Occupational Retirement Provision (the “IORP”) intended to the European Insurance and Occupational Pensions Authority (“EIOPA”), the European Central Bank (“ECB”), the BCL and the CSSF Ladies and Gentlemen, The purpose of the present circular is to implement new annual and quarterly reporting in the regulatory framework applicable to Luxembourg domiciled institutions for occupational retirement provision subject to the law of 13 July 2005, as amended (the “Law of 2005”). The Decision dated 10 April 2018 of the Board of Supervisors on EIOPA's regular information requests towards National Competent Authorities (NCAs) regarding provision of occupational pensions information and the Regulation ECB/2018/2 of the European Central Bank of 26 January 2018 on statistical reporting requirements for pension funds introduced new reporting requirements applicable to IORPs in the Member states of the EU (the “Reports”). The reports will be used by EIOPA, ECB, BCL and the CSSF for statistical and supervisory purposes. EIOPA as well as ECB reports must technically be transmitted to the CSSF before delivery to EIOPA, respectively BCL. The aim of the present circular is to provide the IORPs supervised by the CSSF with the key principles, instructions and technical provisions for drawing up and submitting the Reports.
- IORPs in scope of the reporting Every IORP within the meaning of Articles 5 and 25 of Law of 2005 must comply with the reporting as laid down by this CSSF circular. In order to use the EIOPA reports also for the purpose of its own statistical and prudential supervision, the CSSF does not make use of the option permitted by the EIOPA Decision to exempt under certain conditions the smallest IORPs from submitting the reports, thus every IORP on the official list and supervised by the CSSF must submit the reports.

- Format, Submission and Naming Convention of the Reports to the CSSF The CSSF requires that the reporting files are submitted electronically using exclusively one of the channels of transmission accepted by the CSSF. - Reference date The reference date for drawing up the Reports to be communicated by IORPs is the last calendar day of every end of quarter respectively end of year.

- Delivery deadline of the Reports to the CSSF In order to comply with the timeliness prescribed by EIOPA and ECB, the Reports shall be submitted to the CSSF ten
(10)working days prior to the outlined deadlines above.
- Level of reporting The annual and quarterly reporting intended to EIOPA and ECB respectively are expected to be drawn up at the level of the IORP i.e. aggregation of information of every authorized compartments of an IORP. For the purpose of specific needs of its prudential supervision of the IORPs, the CSSF requests, additionally to the aggregated quarterly and annual EIOPA reports above, the same reports also at the level of every authorized compartment of an IORP.
- Reporting currency The Reports shall state the currency in which the monetary figures are expressed and shall be in line with the annual audited financial report of the IORP reported.
- Period covered The reporting period covers one quarter respectively one year from the last quarterly respectively annual reporting submitted at the reference date. For sake of clarity, the current CSSF reporting for IORPs in force pursuant to Article 61 of the Law of 2005 is not affected at this stage by the implementation of the reporting implemented by this circular and must continue to be submitted as usual. This circular enters into force with immediate effect.
