Projet de loi approuvant la participation du Grand-Duché de Luxembourg à la dixneuvième reconstitution des ressources de l'Association internationale de développement TEXTE DU PROJET DE LOI Article unique. Le Gouvernement est autorisé à participer à concurrence de 61 070 000 euros à la dixneuvième reconstitution des ressources financières de l'Association internationale de développement, conformément à la résolution n° 244 adoptée le 31 mars 2020 par le Conseil des gouverneurs de l'Association internationale de développement. EXPOSE DES MOTIFS Régulièrement le Gouvernement soumet à la Chambre des Députés des projets de lois destinés à faire face aux obligations résultant de l'appartenance du Luxembourg à diverses institutions financières internationales. Le présent projet a pour objet d'actualiser les engagements du Luxembourg auprès de l'Association internationale de développement (AID). COMMENTAIRE DES ARTICLES Article unique. Dix-neuvième reconstitution des ressources financières de l'Association internationale de développement (AID) L'Association internationale de développement est l'institution de la Banque mondiale qui aide les 76 pays les plus pauvres de la planète dont 39 se trouvent en Afrique. Fondée en 1960, l'AID vise à réduire la pauvreté en accordant des prêts (appelés « crédits ») et des dons destinés à des programmes de nature à stimuler la croissance économique, à réduire les inégalités et à améliorer la vie des plus démunis. L'AID représente la plus importante source de contributions des donateurs aux services sociaux de base dans ces pays. L'AID prête des fonds à des conditions concessionnelles. Cela signifie que les crédits de l'AID portent un intérêt très faible ou nul. Les bénéficiaires ayant un risque élevé de surendettement reçoivent 100 % de leur assistance financière sous la forme de dons, tandis que ceux ayant un risque moyen de surendettement n'en reçoivent que 50 % sous cette forme. D'autres bénéficiaires reçoivent des crédits aux conditions habituelles ou à des conditions mixtes, assortis d'une échéance de 38 ans et de 30 ans respectivement. Outre les prêts concessionnels et les dons, l'AID apporte des allégements de dette substantiels dans le cadre de l'Initiative en faveur des pays pauvres très endettés (Initiative PPTE) et de l'initiative pour l'allégement de la dette multilatérale (IADM). Depuis 1960, l'AID a ainsi fourni 375 milliards de dollars pour des investissements dans 113 pays. Le volume annuel de ses engagements ne cesse de croître et a atteint 22 milliards de dollars par an en moyenne au cours des trois dernières années. L'AID soutient toutes sortes d'activités de développement, comme l'enseignement primaire, les services de santé de base, l'approvisionnement en eau potable et l'assainissement, la protection de l'environnement, l'agriculture, l'amélioration du climat des affaires, l'infrastructure et les réformes 1 institutionnelles. Ces projets ouvrent la voie vers l'égalité, la croissance économique, la création d'emplois, le relèvement des revenus et l'amélioration des conditions de vie. Pour les partenaires bailleurs de fonds, l'AID constitue un instrument efficace pour canaliser l'aide au développement vers les pays les plus pauvres. Les contributions des donateurs étant mises en commun avec les remboursements des bénéficiaires actuels ou passés des crédits de l'AID, l'Association constitue une source de financement substantielle et stable sur laquelle les pays AID peuvent compter pour financer leurs priorités de développement. Les activités opérationnelles de l'AID sont complétées par des études analytiques qui informent la conception des politiques de réduction de la pauvreté. L'AID conseille les gouvernements sur les moyens à mettre en œuvre pour diversifier la croissance économique et protéger les plus démunis des chocs économiques. L'AID coordonne l'aide des bailleurs de fonds pour alléger le fardeau des pays pauvres qui ne sont pas en mesure d'assurer le service de leur dette. Elle a mis au point une formule d'allocation de dons aux pays menacés de surendettement, conçue pour aider ces derniers à revenir à un niveau d'endettement tolérable. L'impact de son action sur le développement constitue une priorité pour l'AID, considérée comme une plateforme qui permet d'obtenir des résultats dans la transparence et d'une manière efficace par rapport au coût. Par exemple, durant la période couverte par les exercices 2011-19, les financements de l'AID ont permis de vacciner 330 millions d'enfants, de fournir à 96,5 millions de personnes un accès à des services d'approvisionnement en eau de meilleure qualité, et de recruter et/ou de former 14 millions d'enseignants. L'AID joue par ailleurs un rôle essentiel en cas de crise ou de situation d'urgence en intervenant par le biais de mécanismes tels que le Guichet spécial de fmancement de riposte aux crises (CRW). Le CRW apporte une aide aux pays confrontés à des crises graves comrne la famine en Afrique de l'Est et au Yémen, le tremblement de terre de 2010 en Haïti, l'épidémie d'Ébola en Afrique de l'Ouest, et le séisme de 2015 au Népal. Depuis sa création dans le cadre d'AID-16, le CRW a fourni 3 milliards de dollars pour faire face à des crises et à des situations d'urgence dans 26 pays AID répartis dans cinq régions. Les fonds du CRW sont fournis en sus de l'allocation ordinairement versée aux pays AID. Les pays les plus pauvres du monde — les clients de l'AID — sont particulièrement touchés par la crise sanitaire et économique déclenchée par la pandémie du COVID-19. L'AID est bien placée pour répondre rapidement et de manière flexible aux besoins changeants des pays AID alors qu'ils font face aux impacts sanitaires, sociaux et économiques de la pandémie. Ainsi l'AID a déjà fait un effort substantiel, après consultation des représentants des emprunteurs et des bailleurs de fonds, pour répondre aux urgences liées au secteur de la santé grâce à la mise en place de la Fast Track COVID-19 Facility. Compte tenu de la nature évolutive de la crise, les ajustements qui s'imposent (par exemple une redéfmition des priorités, une restructuration du portefeuille, une flexibilisation de l'allocation des ressources) seront faits pour permettre des soutiens supplémentaires et accélérés à la réponse économique et sociale à la pandémie COVID-19. Une attention particulière sera accordée aux pays et populations (par exemple les réfugiés) confrontés à des vulnérabilités uniques. *** 2 Pour la période comprise entre le l er juillet 2020 et le 30 juin 2023 (AID-19), les représentants des emprunteurs et des bailleurs de fonds de l'AID ont choisi comme thème central « 2030 dans dix ans : croissance, populations, résilience ». La croissance permet de réduire la pauvreté, mais doit être à la fois solidaire et durable pour être largement répartie et avoir des effets de longue durée. Dans de nombreux pays AID, le revenu augmente plus lentement parmi les 40 % les plus pauvres de la population que la moyenne nationale, ce qui menace la cohésion sociale et la stabilité, et pourrait semer les germes de la fragilité, du conflit et de la violence (FCV). La population est une thématique tout aussi importante, car le capital humain est essentiel à une croissance économique solidaire, au bien-être, à la résilience et à la réduction de la pauvreté. Les pays AID doivent donc impérativement accélérer la formation du capital humain pour pouvoir soutenir la concurrence dans l'économie du futur. Par ailleurs, la réduction de la pauvreté et des vulnérabilités exige d'aider les pays IDA à renforcer leur résilience. En effet, les pays se développent plus rapidement lorsqu'ils peuvent éviter les chocs et/ou être préparés à y faire face, le cas échéant. S'attaquer aux causes de FCV, renforcer les institutions en vue d'améliorer la prestation de services, assurer l'inclusion et promouvoir la responsabilité sont des actions fondamentales pour des économies résilientes. AID-19 exploitera les résultats robustes et porteurs de transformation d'AID-18, notamment les progrès accomplis sous les cinq thèmes particuliers qui sont: emploi et transformation économique (JET); fragilité, conflit et violence; changement climatique; parité hommes-femmes et développement; et gouvernance et institutions. Tout au long d'AID-19, l'Association poursuivra son travail dans les domaines déjà ciblés pendant AID-18 tout en intégant les enseignements tirés de la mise en œuvre d'AID-18 pour améliorer ses résultats. Le train de mesures adopté pour AID-19 comprend un ensemble d'engagements stratégiques qui aideront les pays à accélérer les progrès accomplis sur ces thèmes particuliers essentiels. Le train de mesures d'AID-19 va davantage élargir le champ d'action de l'Association en intégrant quatre questions transversales: la dette, la technologie, l'investissement dans les ressources humaines et l'inclusion des personnes handicapées. En l'absence d'une action décisive, l'aggravation de la vulnérabilité à la dette risque de compromettre les perspectives de développement futures et les ambitions de nombreux pays AID, d'où la nécessité d'y porter une attention particulière. La technologie transforme la nature du travail, bouleverse les modes de fonctionnement traditionnels et génère de nouveaux défis et de nouvelles opportunités. C'est la raison pour laquelle pendant AID-19, l'Association va aider les pays à se créer des opportunités et à adopter des technologies porteuses de transformations. L'investissement dans les ressources humaines — y compris dans les personnes handicapées qui sont souvent touchées de manière disproportionnée par la pauvreté, les catastrophes naturelles, les conflits et la violence — est essentiel pour assurer une prospérité partagée et au centre de l'action de l'AID. Pendant AID-19, l'Association redoublera d'efforts pour élargir les possibilités de manière équitable aux personnes vivant avec un handicap. *** 3 AID-19 propose un train de mesures complet et sans précédent pour soutenir les actions de développement dans les pays les plus pauvres et les plus vulnérables de la planète. Entre autres éléments clefs de ce train de mesures, on peut citer : Un ambitieux programme pour l'emploi. Dans le cadre d'AID-19, l'IDA va aider les pays à poursuivre une approche globale et équilibrée de transformation économique durable et solidaire. Elle va faciliter des investissements privés créateurs d'emplois, notamment dans des infrastructures accessibles et de qualité, qui sont essentiels à la réduction de la pauvreté et la promotion d'une croissance solidaire. Elle va aussi contribuer à offrir un plus grand nombre de possibilités aux travailleurs et aux entrepreneurs, à renforcer leurs capacités et à faciliter l'accès à l'emploi. Par ailleurs, AID-19 sera l'occasion de contribuer à atténuer les facteurs qui motivent les migrations économiques en donnant une plus grande place aux questions de migration dans les programmes d'aide de l'AID aux pays. À travers le Guichet de promotion du secteur privé (PSW), IFC et la MIGA vont intensifier leurs opérations et mobiliser davantage d'investissements privés dans les pays AID. Une approche équitable et fondée sur des incitations pour aider les pays à renforcer la viabilité de leur dette. La future Politique de financement durable du développement (SDFP) devrait accroître la capacité des pays AID à remédier aux facteurs de vulnérabilité liés à leur dette et les aider à financer leurs efforts de développement à l'aide de solutions durables. À cet égard, il sera particulièrement important de permettre à ces pays de renforcer leur communication sur la dette afin d'en améliorer la transparence et de rendre les autorités publiques plus responsables. Durant AID-19, l'Association consacrera davantage de moyens aux questions de la gestion de la dette, de la transparence en matière de dette et de la sensibilisation des créanciers, en travaillant avec le Fonds monétaire international (FMI) et d'autres banques multilatérales de développement. Un appui accru et plus ciblé aux pays en situation de fragilité et de conflit (FM. A l'aide de la nouvelle Enveloppe FCV, des ressources plus importantes —et plus ciblées —seront allouées à des pays confrontés à un éventail de risques FCV, et assorties de fortes incitations et de conditions d'imputabilité strictes pour les aider à s'attaquer aux causes de FCV. Cette enveloppe permettra à l'AID de mieux différencier son approche face aux risques de fragilité, en portant une plus grande attention à des facteurs tels que l'augmentation des inégalités, l'absènce d'opportunités, l'exclusion et les perceptions d'injustice. S'agissant de l'objectif de réorientation des interventions vers la prévention, AID-19 va aussi permettre de déployer davantage d'efforts pour faire face aux facteurs régionaux de fragilité dans le cadre des programmes régionaux, notamment dans le Sahel, la région du lac Tchad et la Corne de l'Afrique. La promotion de l'intégration régionale. À travers son Guichet régional, l'AID va appuyer des investissements stratégiques et des réformes qui favorisent l'intégration régionale, notamment dans les domaines des infrastructures en vue d'améliorer la connectivité, de l'électricité, du commerce et de l'économie numérique. Le cadre d'AID-19 prévoit aussi d'aborder des questions qui touchent aux biens publics mondiaux, comme la réduction de la pollution de l'air et de l'eau — y compris les déchets marins — et la création d'opportunités de développement pour les réfugiés et leurs communautés d'accueil. Une attention plus grande portée à la préparation aux crises et à une intervention précoce dans des situations à évolution lente. Les engagements stratégiques pris dans le cadre d'AID-19 favoriseront le renforcement des actions à l'appui de résilience, notamment la préparation aux pandémies et la réduction 4 des risques que présentent les chocs climatiques pour la réduction de la pauvreté et le développement du capital humain. C'est ainsi que le Mécanisme de réponse aux crises (CRW) va fmancer les interventions précoces face aux crises à évolution lente. Compte tenu des problèmes de développement singulier auxquels sont confrontées les économies de plus petite taille, l'AID continuera à aider les petits États à réaliser leurs objectifs de développement durant AID-19. S'appuyant sur l'augmentation substantielle des ressources allouées aux petits États au titre d'AID-18, l'Association continuera à soutenir fortement ces États et à mettre l'accent sur la réalisation des économies d'échelle, l'harmonisation des politiques, le renforcement des moyens de préparation aux crises et de la résilience, et l'adaptation aux effets du changement climatique pendant AID-19. En outre, les petits États bénéficieront grandement de l'augmentation des ressources du Guichet régional destinées au financement des efforts d'intégration régionale, ce qui peut contribuer à élargir les marchés et à réaliser des économies d'échelle. *** L'AID est supervisée par ses 173 pays actionnaires, qui composent le Conseil des Gouverneurs. Les activités quotidiennes de développement de l'AID sont administrées par le personnel opérationnel de la Banque mondiale, et par les États et les organes d'exécution dans les pays participant aux programmes. L'AID a toujours été principalement financée par les contributions des États membres. Les donateurs se réunissent tous les trois ans pour reconstituer les ressources de l'AID et examiner son cadre d'action. La procédure de reconstitution des ressources consiste habituellement en quatre conférences officielles qui se déroulent sur une année. Outre les représentants des États bailleurs de fonds, à présent plus d'une cinquantaine, des représentants des pays membres emprunteurs sont invités à y participer afin d'assurer que les cadres d'action et de financement de l'AID répondent bien aux besoins des pays. Les documents d'orientation examinés durant les négociations de reconstitution sont communiqués au public, et le projet d'accord de reconstitution est publié sur internet pour inviter le public à faire part de ses commentaires avant la dernière conférence. Le personnel de l'AID dialogue aussi en permanence avec des organisations de la société civile (OSC), des fondations et des groupes de réflexion du monde entier. La reconstitution la plus récente des ressources de l'AID (AID-19) a été conclue en mars 2020 et a permis de mobiliser un montant de 82 milliards de dollars (contre 75 milliards de dollars pour AID-18, ce qui représente une augmentation de 3% en valeur réelle des ressources que l'AID met à disposition de ses clients). Les emprunteurs de l'AID ont d'énormes besoins de financement concessionnel. Or le montant des fonds disponibles, qui est fixé après l'annonce par les États bailleurs de fonds du montant de leurs contributions, ne permet pas de couvrir la totalité de ces besoins. L'AID doit donc décider de la manière dont les ressources limitées dont elle dispose seront réparties entre les pays admissibles. Les décisions d'allocation sont fondées sur plusieurs critères, notamment les niveaux de revenu des pays et leurs antécédents dans la gestion de leur économie et des projets de l'AID en cours de réalisation. Pour être admissible aux ressources de l'IDA, un pays doit tout d'abord satisfaire aux conditions suivantes :

  1. a)afficher une pauvreté relative, à savoir un revenu national brut (RNB) par habitant inférieur à un seuil établi et actualisé chaque année, soit 1 175 dollars pour l'exercice 20,
  2. b)présenter une cote de crédit ne lui 5 permettant pas d'emprunter aux conditions du marché, et donc avoir besoin de ressources concessionnelles pour fmancer son programme de développement. Les pays sont ensuite évalués pour déterminer dans quelle mesure ils mettent en œuvre des politiques qui favorisent la croissance économique et la réduction de la pauvreté. Il s'agit de l'Évaluation de la politique et des institutions nationales (CPIA). Cette évaluation et les résultats du portefeuille de projets du pays constituent ensemble la notation AID de la performance du pays. Outre cette notation, la population et le revenu par habitant déterminent également le montant de l'allocation. Depuis 2002, l'AID mesure l'impact de son action sur la croissance économique et la réduction de la pauvreté des pays qui bénéficient de son aide, et elle tient les donateurs informés de l'efficacité de leurs contributions. Le système de mesure des résultats (RMS) est l'outil qui permet de présenter les résultats agrégés de l'ensemble des pays AID. Il montre également si l'AID gère efficacement ses interventions et ses services et fonctionne de manière efficiente. Le cadre du RMS regroupe les indicateurs en quatre sousensembles. Les deux preiniers sous-ensembles (progrès des pays AID et résultats de développement appuyés par l'AID) enregistrent les résultats globaux de développement du pays et la contribution de l'AID à ces résultats. Les deux autres (efficacité opérationnelle de l'AID et efficacité organisationnelle de l'AID) comparent les composantes des résultats avec les normes de résultats convenues. L'AID a obtenu une notation de crédit AAA, essentielle à la réussite durable de la mise en œuvre du programme de mobilisation de ressources et d'accès au marché, témoignant de la solidité exceptionnelle des fonds propres et de la position financière de l'AID, du soutien de ses pays membres. Depuis AID-18, le cadre de financement de l'AID a été transformé par l'introduction d'un accès au marché des capitaux, une des propositions les plus concrètes et les plus marquantes à ce jour du Programme d'action d'Addis-Abeba. Elle contribue à assurer le déroulement du programme de changement d'échelle des financements du « milliard au millier de milliards » nécessaire pour atteindre les objectifs de développement durable (ODD). Cette innovation permet aussi aux donateurs de considérablement optimiser leurs ressources, chaque euro contribué ayant pour contrepartie un montant de ressources internes et d'emprunts à peu près similaire, générant donc des financements à hauteur d'environ trois euros. *** Depuis sa création, l'AID s'est vue octroyer une contribution cumulative du Luxembourg de l'ordre de 405 millions dollars. Eu égard au rôle central de l'AID ainsi que de la reconstitution de ses ressources s'inscrivant dans un contexte d'ambitions mondiales accrues et d'intensification des risques, son importance cruciale en tant que plate-forme de l'aide au développement mondial est indéniable. C'est la raison pour laquelle le Luxembourg a annoncé qu'il contribuera 61,07 millions euros à la dix-neuvième reconstitution de l'AID, laquelle accroît sa part de 5 millions d'euros et la maintient à 0,21% de l'enveloppe globale de l'AID. Cette contribution traduit la confiance du Gouvernement dans la capacité de l'AID et du groupe Banque mondiale de fournir une aide efficace, rapide et adapté aux besoins des pays les plus pauvres. Elle confirme également la volonté du Luxembourg de continuer à soutenir de manière vigoureuse les programmes d'aide des institutions multilatérales de développement. Elle illustre la conviction du Gouvernement que l'aide multilatérale est un instrument efficace et efficient de l'aide au développement. 6 En effet, les organisations multilatérales exhibent souvent des connaissances plus approfondies et une expérience plus poussée que les pays donateurs pris individuellement. Elles permettent la réalisation d'économies d'échelle, offrent un vaste potentiel de synergies, évitent, par cela, le double emploi et poussent à la coordination. Il en résulte des processus moins onéreux et plus structurés. Finalement, le multilatéral est traditionnellement délié. Par conséquent il facilite aux pays en développement l'appropriation des stratégies et programmes de lutte contre la pauvreté. NOW THEREFORE THE BOARD OF GOVERNORS HEREBY ACCEPTS the Report as approved by the Executive Directors, NOTES its conclusions and recommendations AND RESOLVES THAT a general increase in subscriptions of the Association is authorized on the following terms and conditions: 1.   32. a)above, the Association is authorized to accept additional subscriptions and contributions from Contributing Members reflecting the grant element of a CPL in the amounts and currencies specified in Column 6 of Table I a-SDR attached to this Resolution. (
  33. b)The Association is authorized to accept additional resources from any member for which no contribution is specified in Table 2 and additional subscriptions and contributions from Contributing Members incremental to the amounts specified for each such member in Tables la and lb. (
  34. c)The Association is authorized to accept additional subscriptions from each Subscribing Member in the amount specified for each such member in Table 2. (
  35. d)The rights and obligations of the Association and the Contributing Members in respect of the authorized subscriptions and contributions in paragraphs (
  36. a)and (
  37. b)above will be the same (except as otherwise provided in this Resolution) as those applicable to the ninety percent portion of the initial subscriptions of original members payable under Article II, Section 2(

  39. a)When a Contributing Member agrees to pay its subscription and contribution, or a Subscribing Member agrees to pay its subscription, it will deposit with the Association an Instrument of Commitinent substantially in the form set out in Attachment I to this Resolution ("Instrument of Commitment") and with respect to: (
  40. i)its contribution for debt forgiveness under the HIPC Debt Initiative, a Contributing Member will either include such contribution in an Instrument of Commitment or make a Debt Relief Transfer Contribution, as defined and specified in paragraph 9(

  43. ii)a CPL, a Contributing Member will enter into written agreement(
  44. s)in such form as may be acceptable to the Association. When a Contributing Member agmes to pay a part of its subscription and contribution without qualification and the remainder is subject to enactment by its legislature of the necessary appropriation legislation, it will deposit (other than in respect of the grant element of a CPL) a qualified Instrument of Commitment in a form acceptable to the Association ("Qualified Instrument of Commitment") and such member: (
  45. i)undertakes to exercise its best efforts to obtain legislative approval for the full amount of its subscription and contribution by the payment dates set out in paragfaph 3(
  46. b)of this Resolution; and (
  47. ii)agrees that, upon obtaining such approvals, it will notify the Association that any parts of its Qualified Instrument of Commitment have become unqualified. 3. Pavment. (
  48. a)Each Subscribing Member will pay to the Association the amount of its subscription in full within 31 days after the date of deposit of its Instrument of Commitment; provided that if the Nineteenth Replenishment shall not have become effective by December 15, 2020, payment may be postponed by the member for not more than 31 days after the Effective Date as defined in paragraph 6(
  49. a)of this Resolution. (
  50. b)Each Contributing Member that deposits an Instrument of Commitment that is not a Qualified Instrument of Commitment will pay to the Association the amount of its subscription and contribution in three equal annual installments no later than 31 days after the Effective Date or as agreed with the Association, January 15, 2022, and January 15, 2023; provided that: (
  51. i)the Association and each Contributing Member may agree to earlier payment; (
  52. ii)if the Nineteenth Replenishment shall not have become effective by December 15, 2020, payment of the first such installment may be postponed by the member for not more than 31 days after the date on which the Nineteenth Replenishment becomes effective; (iii) the Association may agree to the postponement of any installment, or part thereof, if the amount paid, together with any unused balance of previous payments by the Contributing Member concerned, is at least equal to the amount estimated by the Association to be required from that member up to the due date of the next installment for purposes of disbursements for financing committed under the Nineteenth Replenishment; and (
  53. iv)if any Contributing Member deposits an Instrument of Commitment with the Association after the date when the first installment of the subscription and contribution is due, payment of any installment, or part thereof, will be made to the Association within 31 days after the date of such deposit. (
  54. c)If a Contributing Member has deposited a Qualified Instrument of Commitment and, upon enactment of appropriation legislation, notifies the Association that an installment, or part thereof, is unqualified after the date when it was due, then payment of such installment, or part thereof, will be made within 31 days after the date of such notification, (
  55. d)Each Contributing Member that makes a contribution through the grant element of a CPL will pay to the Association the amount of the Loan in three equal annual installments no later than 31 days after the Effective Date, January 15, 2022, and January 15, 2023 or as agreed with the Association. 4. Mode of Pavment. (
  56. a)Payments pursuant to this Resolution will be made, at the option of the member: (
  57. i)in cash, on terms agreed between the member and the Association; or (
  58. ii)by the deposit of notes or similar obligations issued by the government of the member or the depository designated by such member, which shall be nonnegotiable, non-interest bearing and payable at their par value on demand to the account of the Association. IDA Resolution No. 244 Page 4 of 18 (
  59. b)(
  60. c)The Association will encash notes or similar obligations of Contributing Members, on an approximately pro rata basis among Partners, in accordance with the encashment schedule set out in Attachment 11 to this Resolution, or as agreed between a Contributing Member and the Association. With respect to a Contributing Member that is unable to comply with one or more encashment requests, the Association may agree with the member on a revised encashment schedule that yields at least an equivalent value to the Association. The provisions of Article IV, Section 1(
  61. a)of the Articles will apply to the use of a Subscribing Member's currency paid to the Association pursuant to this Resolution. 5. Currencv of Denomination and Pavment. (
  62. a)Contributing Members will denominate the resources to be made available pursuant to this Resolution in SDRs, the currency of the member if freely convertible, or, with the agreement of the Association, in a freely convertible currency of another member, except that if a Contributing Member's economy experienced a rate of inflation in excess of ten percent per annum on average in the period 2016-2018, as detennined by the Association, its subscfiption and contribution will be denominated in SDRs or in any currency used for the valuation of the SDR and agreed with the Association. Subscribing Members will denominate the resources to be made available pursuant to this Resolution in the currency of the member or in a freely convertible currency with the agreement of the Association. (
  63. b)Contributing Members will make payments pursuant to this Resolution in SDRs, a currency used for the valuation of the SDR, or, with the agreement of the Association, in another freely convertible currency, and the Association may freely exchange the amounts received as required for its operations. Subscribing Members will make payments in the currency of the member or in a freely convertible currency with the agreement of the Association. (
  64. c)Each member will maintain, in respect of its currency paid by it under this Resolution, and the currency of such member derived therefrom as principal, interest or other charges, the same convertibility as existed on the effective date of this Resolution. (
  65. d)The provisions of Article IV, Section 2 of the Articles with respect to maintenance of value will not be applicable. (
  66. e)Notwithstanding the foregoing provisions of this paragraph, a Contributing Member that makes a contribution through the grant element of a CPL will denominate and make payment of such CPL in SDRs or any other currencies approved by the Executive Directors and as defined in their respective loan agreements. 6. Effective Date. (
  67. a)The Nineteenth Replenishment will become effective and the resources to be contributed pursuant to this Resolution will become payable to the Association on the date (the "Effective Date") when Contributing Members whose subscriptions and contributions aggregate not less than SDR 10,128 million shall have deposited with the Association Instruments of Commitment, Qualified Instruments of Commitment, Debt Relief Transfer Notifications (as defmed in paragraph 9(
  68. b)of this Resolution) or duly executed concessional loan agreements to provide the CPLs, provided that this date shall be not later than December 15, 2020, or such later date as the Executive Directors of the Association may determine. (
  69. b)If the Association determines that the availability of additional resources pursuant to this Resolution is likely to be unduly delayed, it shall convene promptly a meeting of the Contributing Members to review the situation and to consider the steps to be taken to prevent a suspension of financing to eligible recipients by the Association. (
  70. c)In order to avoid an interruption in the Association's ability to commit fmancing to eligible recipients pending the effectiveness of the Nineteenth Replenishment, the Association may deem, prior to the Effective Date, to use one third of the agreed Replenishment amount. IDA Resolution No. 244 Page 5 of 18 7. Advance Contributions. (
  71. a)In order to avoid an interruption in the Association's ability to commit financing to eligible recipients pending the effectiveness of the Nineteenth Replenishment, the Association may deem, prior to the Effective Date, one third of the total amount of each subscription and contribution for which (
  72. i)an Instrument of Commitment has been deposited with the Association; (
  73. ii)a Debt Relief Transfer Notification (as defined in paragraph 9(
  74. b)of this Resolution) has been received by the Association; or (iii) a duly executed concessional loan agreement for a CPL has been received by the Association; as an "Advance Contribution", unless the Contributing Member specifies otherwise in its Instrument of Commitment, Debt Relief Transfer Notification or concessional loan agreement for a CPL. (
  75. b)(

  77. d)The Association shall specify when Advance Contributions pursuant to paragraph 7(
  78. a)are to be paid to the Association. The terms and conditions applicable to contributions to the Nineteenth Replenishment shall apply also to Advance Contributions until the Effective Date, when such contributions shall be deemed to constitute payment toward the amount due from each Contributing Member for its subscription and contribution. In the event that the Nineteenth Replenishment shall not become effective pursuant to paragraph 6(
  79. a)of this Resolution, (
  80. i)voting rights will be allocated to each member for the Advance Contribution as if it had been made as a subscription and contribution under this Resolution, and (
  81. ii)each member not making an Advance Contribution will have the opportunity to exercise its preemptive rights under Article III, Section 1(
  82. c)of the Articles with respect to such subscription as the Association shall specify. 8. Authoritv to Use Subscription and Contributions. (
  83. a)Subscriptions and contributions will become available for use by the Association for fmancing to eligible recipients upon receive of the Instruments of Commitment and after the Effective Date, provided that Advance Contributions may become available earlier under paragraph 7(
  84. a)of this Resolution.

(1)) Any qualified part of a subscription and contribution notified under a Qualified Instrument of Commitment will become available for use by the Association for financing when the Association has been notified, pursuant to paragraph 2(
  1. b)(
  2. ii)of this Resolution, that such parts have become unqualified. (
  3. c)The Association may enter into financing commitments with eligible recipients conditional on such commitments becoming effective and binding on the Association when resources under the Nineteenth Replenishment become available for commitment by the Association. 9. HIPC and Arrears Clearance Contributions. (
  4. a)Contributing Members making an additional subscription and contribution to compensate the Association for forgiveness of debt under the H1PC Debt Relief Initiative or to fmance arrears clearance operations, will do so either: (
  5. i)through an additional subscription and contribution to the Association's regular resources (a "Debt Relief Additional Contribution") or (
  6. ii)through a creditor-specific contribution for the benefit of the Association to the HIPC window or arrears clearance window of the Debt Relief Trust Fund ("Debt Relief Transfer Contribution"). (
  7. b)Contributing Members making a Debt Relief Transfer Contribution will either (
  8. i)enter into a Contribution Agreement with the Association as administrator of the Debt Relief Trust Fund; or (
  9. ii)for Contributing Members that are already current contributors to the Debt Relief Trust Fund, IDA Resolution No. 244 Page 6 of 18 (
  10. c)send to the Association a notice of additional contribution or allocation to the appropriate window of the Debt Relief Trust Fund (each a "Debt Relief Transfer Notification"). Such Debt Relief Transfer Notification will provide for a contribution to be made to the appropriate window of the Debt Relief Trust Fund in the amount set forth in Columns 9 and 11 of Table 1 a-SDR to this Resolution, to be payable in three equal annual installments no later than 31 days after the Effective Date, January 15, 2022, and January 15, 2023; provided that the Association and each Contributing Member may agree to earlier payment. When any amount of a Debt Relief Transfer Contribution is paid to compensate the Association for forgiveness of debt under the HIPC Debt Initiative or to finance arrears clearance operations, such amount of the Debt Relief Transfer Contribution will be treated as a subscription and contribution under the Nineteenth Replenishment. 10. Authorization of Grants, Guarantees, Euuitv Investments and Risk Intermediation. The Association is hereby authorized to provide financing under the Nineteenth Replenishment in the form of grants and guarantees, equity investments and through the intermediation of risk management products. 11. Administration of IDA18 Funds under the Nineteenth Reulenishment. (
  11. a)On the Effective Date, any funds, receipts, assets and liabilities held by the Association under the Eighteenth Replenishment will be administered under the Nineteenth Replenishment, subject, as appropriate, to the terms and conditions applicable to the Eighteenth Replenishment. (
  12. b)Pursuant to Article V, Section 2(
  13. a)(
  14. i)of the Articles of Agreement of the Association, the Association is authorized to use the funds referred to in paragraph 11(
  15. a)above, and funds derived therefrom as principal, interest or other charges, to provide fmancing in the forms of grants, guarantees and equity investments under the terms, conditions and policies applicable under the Nineteenth Replenishment. 12. Allocation of Votin2 Mets under Nineteenth Reulenishment. Voting rights calculated on the basis of the current voting rights system will be allocated to members for subscriptions under the Nineteenth Replenishment as follows: (
  16. a)Each Subscribing Member that has deposited with the Association an Instrument of Commitment will be allocated the subscription votes specified for each such member in Table 2 on the effective payment date pursuant to paragraph 3(
  17. a)of this Resolution. Each Subscribing Member will be allocated the additional membership votes specified in Column c-3 of Table 2 on the date such member is allocated its subscription votes. (
  18. b)Each Contributing Member that has deposited with the Association an Instrument of Commitment (other than in respect of the grant element of a CPL) will be allocated one third of the subscription votes specified for each such member in Table 2 on each effective payment date pursuant to paragraph 3(
  19. b)of this Resolution. Each Contributing Member will be allocated the additional membership votes specified in Column b-3 of Table 2 for its subscription on the date such member is allocated the first one third of its subscription votes. (
  20. c)Each Contributing Member that has made a Debt Relief Transfer Contribution will be allocated a proportionate share of the subscription votes specified for such member in Column b-2 of Table 2 from time to time and at least semi-annually following payment of any amount of its Debt Relief Transfer Contribution to compensate the Association for forgiveness of debt under the HIPC Debt Initiative or to finance arrears clearance operations. (
  21. d)Each Contributing Member that has provided a CPL in the amount provided in Table lb will be notified by the Association of the grant element determined by the Association with respect to the CPL and will be allocated, in respect of such grant element, a proportionate share of the subscription votes specified for such member in Column b-2 of Table 2 from time to time following payment to the Association of the CPL. IDA Resolution No. 244 Page 7 of 18 Each member that has deposited with the Association a Qualified Instrument of Commitment will be allocated subscription votes at the time and to the extent of payments made in respect of its subscription and contribution. Any member that deposits its Instrument of Commitment alter any of these dates will be allocated, within 31 days of the date of such deposit, the subscription votes to which such member is entitled on account of such deposit. If a member fails to pay any amount of its subscription or subscription and contribution when due, or fails to pay when due any amount of (or due in connection with) a CPL, the number of subscription votes allocated from time to time to such member under this Resolution in respect of the Nineteenth Replenishment will be reduced in proportion to the shortfall in the net present value of such payments, but any such votes will be reallocated when the shortfall in the net present value of such payments causing such adjustment is subsequently made up.
