(10)of the Regulation, the officials of foreign states are also entitled to receive data from the database in accordance with international conventions, international agreements or co-operation agreements between the state agencies.

(3)of the Regulation, the national contact points of the Contracting Parties of the abovementioned Convention may conduct automated searches or comparisons from the database in compliance with the Convention. Also,

(3)of the Regulation, it is allowed to send data to other states to fulfil the obligations rising from EU law and in compliance with international conventions, international agreements or co-operation agreements between the state agencies.

In accordance with Article 2, paragraph 3 of the Treaty: 1. Romania declares that, on its territory, the National System of Judicial Genetic Data, hereinafter referred to as N.S.J.G.D., contains genetic profiles corresponding to the following categories:

  1. a)suspects – individuals regarding whom there are data and information in the sense that they could be perpetrators, instigators, accomplices of offences for which biological evidence can be collected in order for the genetic profiles to be introduced in the national data basis, in conformity with the legislation in force;
  2. b)individuals finally convicted to imprisonment for committing offences for which biological evidence can be collected in order for the genetic profiles to be introduced in the national data basis, in conformity with the legislation in force;
  3. c)biological traces collected when performing crime scene investigation;
  4. d)unidentified corpses, missing or deceased persons following natural catastrophes, mass accidents, murders or terrorism acts/terrorist acts; 2. Romania declares that genetic profiles are verified and compared within N.S.J.G.D. in order to:
  5. a)exclude individuals from a circle of suspects and identify perpetrators of crimes for which biological evidence can be collected in order for the genetic profiles to be introduced in the national data basis, in conformity with the legislation in force;
  6. b)determine the identity of individuals who are victims of natural disasters, mass accidents or terrorism acts;
  7. c)exchange information with other states and combat cross-border criminality;
  8. d)identify the participants in committing offences for which biological evidence can be collected in order for the genetic profiles to be introduced in the national data basis, in conformity with the legislation in force; B. In accordance with Article 28, paragraph 2 of the Treaty, Romania declares that it is prohibited on its territory for the civil servants of the sending state to carry and use arms, ammunition and equipment, others than those carried for the purpose of their duty, in conformity with the national legislations in force; C. In accordance with Article 42 of the Treaty, Romania designates as competent authorities for the implementation of this Treaty the specialized departments of:
  9. a)the Ministry of Interior and Administrative Reform, for the contact points mentioned in Article 42, paragraph 1, points 1 - 4, and points 7 - 9 of the Treaty, respectively,
