INTRODUCTION CONSIDERING that, in furtherance of the North Atlantic Treaty, the Signatories desire to unite their efforts for collective defence in even closer cooperation; NOTING that by the decision of the North Atlantic Council PO (2002) 140 dated 2nd September 2002, approved 10th September 2002, HQ ARRC/NRDC-UK retains its international status as an International Military Headquarters, which was originally granted in 1992 (reference to follow) and shall be relocated from Rheindahlen (Germany) to Innsworth (United Kingdom); NOTING the provisions of the Agreement of 19 June 1951 between the Parties to the North Atlantic Treaty regarding the Status of their Forces (NATO SOFA), the Protocol of 28 August 1952 on the Status of International Military Headquarters set up pursuant to the North Atlantic Treaty (the Paris Protocol); CONSIDERING the document MC-317/1, the NATO Force Structure, approved on 8 July 2002 by the NATO Military Committee; CONSIDERING that the NATO Military Committee (MC) concluded (MCM-079-03, 16 Apr 03) that High Readiness Force (Land) (HRF(L)) HQs provide NATO with more operational flexibility and add positively to the development of the NATO Response Force (NRF) and Transformation; NOTING that, in the same decision, the MC recommended that the North Atlantic Council (NAC) approve the selection of HQ ARRC, HQ EC (HQ EUROCORPS), HQ 1 (German-Netherlands) Corps, HQ NRDC-IT, HQ NRDC-SP and HQ NRDC-TU as NATO Deployable High Readiness Force (Land) Corps HQs; and that NRDC-FR also has since been selected according to MC decision MCM-066-2007. CONSIDERING the document MC 477, Military Decision on the NATO Response Force, approved by the NATO Military Committee on 10 April 2003; DESIRING to implement such multinational manning and funding arrangements as are necessary for the establishment and operation of HQ ARRC/NRDC-UK; THEREFORE the Signatories have reached the following understandings: SECTION ONE - DEFINITIONS 1.1 HQ-NATO Rapid Deployable Corps-UK (HQ NRDC-UK) is the Headquarters Allied Rapid Reaction Corps, relocated from Rheindahlen (DEU) to Innsworth (UK), officially designated as part of the NATO Force Structure, and whose organization is reflected in Annex A of this MOU. HQ NRDC-UK together with assigned Command and Information Systems (CIS) and Life Support elements as defined in Annex A to the Command and Control Technical Arrangement signed between SHAPE and the Framework Nation will be known as the HQ NRDC-UK Group. 1.2 PARTICIPANTS means those MODs and equivalents belonging to members of the North Atlantic Treaty Organization who will provide personnel and financial support to the HQ NRDC-UK in accordance with the provisions of this MOU. 1.3 SIGNATORIES means the Participants and SHAPE. 1.4 FRAMEWORK NATION means the United Kingdom, which is responsible for providing the command, communications, administration and logistical support of HQ NRDC-UK, as outlined in this MOU, and for the implementation of NAC decisions relating to the headquarters. 1.5 HQ NRDC-UK PLENARY means the executive policy committee composed of the representatives of the Signatories to this MOU. 1.6 National Support Element (NSE) means any national units/elements attached to the HQ NRDC-UK performing exclusively national administrative tasks in order to support national members of the HQ-NRDC-UK. NATO SOFA will apply to them. 1.7 Senior National Representative (SNR) is the senior officer of each Participant serving in the HQ NRDC-UK. He/she can delegate his/her authority to another officer among those belonging to his/her nation and serving in HQ NRDC-UK, in accordance with national laws and regulations. 1.8 Mainland Great Britain means the countries of England, Wales and Scotland; not including Northern Ireland, the Scottish Islands, the Channel Islands or the Isle of Man. SECTION TWO - PURPOSE AND SCOPE 2.1 The purpose of this MOU is to make provisions for the status of HQ NRDC-UK and that of the personnel assigned to it, and to establish arrangements for stationing, funding, manpower, administration, and logistical support of the HQ NRDC-UK and cost sharing amongst the Participants. 2.2 This MOU is not intended to conflict with national or international law and any existing applicable international agreements between the Signatories. In the event of such conflict, national or international law and existing international agreements between the Signatories will prevail. The Signatories will notify each other in writing in the event of any such conflict. SECTION THREE - STATUS AND TASK OF HQ ARRC/NRDC-UK 3.1 The provisions of the Paris Protocol and the provisions of the NATO SOFA, as applied by the Paris Protocol, apply to HQ ARRC/NRDC-UK, the Participants and the personnel assigned to the HQ. 3.2 HQ NRDC-UK may be deployed by NATO in peacetime or crisis on the authority of the appropriate NATO Military Authorities (NMA) by means of an exercise or operational tasking issued in accordance with standard NATO procedures. HQ NRDC-UK should not be employed or otherwise be made unavailable to NATO (eg for EU-led operations or for national purposes) without prior notification to SHAPE. 3.3 The command relations enabling HQ NRDC-UK to carry out its tasks in peacetime, crisis and operations are detailed in the Command and Control Technical Arrangement. 3.4 HQ NRDC-UK will be made available and sufficiently resourced by the Participants to support all training and exercise participation detailed: a. By the MC in the formal NATO Military Training and Exercise Program (MTEP) in which ACO defines the training required for the NATO Command and Force Structures including the NATO Response Force (NRF)1. b. By Commander NRDC-UK in order to ensure availability for NATO tasking in accordance with the appropriate readiness levels and lead times, as defined by the MC and SHAPE. 3.5 The Air Operations Coordination Centre (Land) (AOCC(L)) is an Air Force entity, functionally subordinate to the Commander of a Combined Air Operations Centre (CAOC), collocated with, as an integral part of HQ NRDC-UK, forming part of the Air Command and Control structure for the purpose of planning and coordinating air operations tasked in support of this HQ. The AOCC(L) and its personnel will have the command relationship of being under the Administrative Control (ADMINCON) of HQ NRDC-UK, whilst remaining functionally subordinate to the Commander of a CAOC. Operational command remains in accordance with ACO Directive 80-65 approved on 21 Nov 2006, the status of AOCC(L) personnel will continue to be determined in accordance with the Paris Protocol. The organisation and manning of the AOCC(L) is detailed in Annex A. SECTION FOUR - CHANGE OF PEACETIME LOCATION 4.1 The peacetime location of HQ-NRDC-UK will change from Rheindahlen (DEU) to Innsworth (UK) with effect from summer 2010. SECTION FIVE - PLENARY 5.1. The Plenary will meet at least once a year, to review the operation of this MoU. 5.2 The Framework Nation will be responsible for preparing and hosting the meetings of the Plenary, with the assistance of the Commander NRDC-UK as required. 5.3 Plenary will be composed of: a. The Chairman (belonging to the Framework Nation), who will chair the Plenary without having a vote; b. A representative for each Participant with right to vote; c. A representative from SHAPE, without right to vote, may attend; d. A secretary (belonging to the Framework Nation). 5.4 Plenary decisions will be made unanimously. 5.5 Each Signatory may provide any other required experts (without right to vote) to support its representative SECTION SIX- RESPONSIBILITIES 6.1 The responsibilities of the Framework Nation are set out at Annex B. 6.2 Each Participant will assign to HQ NRDC-UK appropriate personnel to fill the posts set out in Annex A. 6.3 Informal arrangements in writing between the Commander of HQ NRDC-UK and the Senior National Representative (SNR) of any concerned Participant may permit permanent changes other than those affecting manpower levels and allocation to specific nations, to be made to the approved post allocation set out in Annex A, up to and including OF-2 appointments. Similar arrangements may, in accordance with national rules and regulations, be applied on temporary basis up to and including OF-5 appointments. These temporary arrangements will be subject to the agreement of all SNRs and brought before the next Plenary session for approval in accordance with the principles laid down in paragraph 6.4 and Annex A. 6.4 Unless otherwise agreed by the Participants, any supplement to or reduction in the approved post allocation set out in Annex A, or any change in the approved post allocation in relation to appointments for OF-3 and above may only be effected by giving 12 (twelve) months notice in writing to the UK Ministry of Defence who will notify all other Participants of the relevant changes. All changes to post allocation will be discussed in Plenary. 6.5 Job descriptions for the staff of the HQ NRDC-UK and any changes thereto will be prepared by the HQ and approved by the Participants. Changes in job descriptions of level OF-2 and below will only require the approval of the Participants directly affected. HQ NRDC-­UK will employ personnel in accordance with the relevant job descriptions. Participants will provide personnel in accordance with the relevant job descriptions. SECTION SEVEN - DISCIPLINE AND NATIONAL DUTIES 7.1 With regards to discipline and national duties, the management of HQ-NRDC-UK personnel will follow the procedures in ACO Directive 45-1. 7.2 In matters of discipline and national duties, the SNRs or their delegates hold, with regard to the personnel of their own nationality, all powers or competences conferred on them by their national laws and regulations. They will ensure that within the limits imposed by the respective national laws and regulations, their personnel comply with the regulations issued by the Commander NRDC-UK. 7.3 In principle, all personnel are eligible for operational deployment. However, personnel of a Participant will not be deployed without prior permission of the Participant, which would be sought through the relevant SNR. If a Participant decides not to contribute to a specific operation, the other Participants will meet to decide which of them should provide the replacement, if considered necessary. 7.4 The Participants should not withdraw their permanently assigned personnel from HQ NRDC-UK until appropriate trained replacement/augmentation personnel are provided in order to ensure operational readiness and effectiveness. SECTION EIGHT - FINANCIAL PROCEDURES 8.1 Except as provided below, the Framework Nation will bear the cost of operating and maintaining HQ NRDC-UK on the basis of the responsibilities set out at Annex B. National Funding; 8.2 Each Participant will meet the cost of: a. Personnel assigned by it to HQ NRDC-UK in accordance with Annex A and expenditure related to those personnel, and any National Support Element (NSE) or other National Representation additional to that set out in the staff structure at Annex A, together with such allowances including per-diem expenses as are payable under national regulations. b. Any equipment or any personnel brought into HQ NRDC-UK in excess of that provided by the Framework Nation. c. CIS arising from national requirements. d. The additional cost of any special facility or equipment required to meet national needs and of any associated maintenance and utility costs where these can be separately identified by the Framework Nation. e. Travel costs of personnel on initial appointment to and end of tour re-assignment from the Headquarters. 8.3 The Framework Nation will not be responsible for any costs in respect of dependants of the personnel of other Participants. NATO Funding; 8.4 On a case-by-case basis, application for NATO common funding may be made via the appropriate Strategic Command (SC) to the NATO finance committees, for consideration in accordance with policies and regulations in force at the time of application. 8.5 Eligibility Criteria for NATO funding of deployment and in-theatre sustainment of the HQ during NAC-approved operations is detailed per MC 317/1 and PO(2000)16. When determined eligible, funding supporting specific deployments, and specific deployment related costs will be provided via the appropriate SC in the context of OPLAN budgets (or allocations thereof) approved by the appropriate finance committee. In the case of NAC directed deployments, costs considered could include the following: a. Those task-related incremental HQ operating and maintenance costs which arise from specific NMAs-directed deployment; b. The costs arising from contingency operations directed by higher NATO headquarters; c. Mission-related costs arising from liaison, planning, training and deployment associated with HQ NRDC-UK tasks for a specific Mission; d. Transportation costs associated with authorised temporary duty away from the HQ NRDC-UK where the duty is associated with the Mission-related tasks referred to at para. c (above). Shared Funding; 8.6 Any expenditure which: a. is not funded by the Framework Nation, by individual Participants or from NATO and which is agreed by the Participants under the procedures set out in Section 9.3; or b. is in respect of the costs of military exercises, not specified as a Framework Nation responsibility at Annex B; or c. arises out of settlement of a claim pursuant to Section 8.11, will be shared by the Participants in accordance with the cost sharing formula set out in Annex C. Personnel Support Arrangements; 8.7 The Framework Nation will provide, subject to availability and to the Framework Nation's requirements, laws and regulations, the logistical support/services set forth in this paragraph to members of the Participants, including NSE and their dependants. Individual charges, fines, and fees will be subject to reimbursement at rates to be published when necessary by the Framework Nation and will be the responsibility of the individual/ Participant actually using the services. a. Accommodation for single and married personnel; b. Access to the messing and officer and enlisted clubs on the same basis under which Framework Nation personnel are granted such access; c. Medical and dental services to a standard not exceeding that which is provided by the Framework Nation for its own personnel and their lawful dependants. On duty first aid at the point of injury will be provided for HQ NRDC-UK personnel and, upon request from Participants, pre and post-deployment standard medical checks and vaccination will be provided. d. State education for accompanying dependant children to a standard not less than that which is provided by the Framework Nation to the children of its own personnel. 8.8 Charges for these services and facilities will be calculated, in accordance with the principles at Annex D. Such charges will be expressed, and bills or receipts are to be settled, in the currency of the Framework Nation. Any change will be subject to timely written notice to the Participants and will be supported by an explanation of the reasons for the change. 8.9 Each Participant will take all reasonable steps to ensure that the bills raised against its personnel by the Framework Nation are settled promptly. 8.10 Neither the Framework Nation, nor other Participants will derive profit from the official activities of HQ-NRDC-UK. 8.11 Claims (other than contractual claims) against any Participant will be dealt with in accordance with article VI of the Paris Protocol and article VIII of the NATO SOFA. SECTION NINE - BUDGETARY AND ACCOUNTING PROVISIONS 9.1 The Funds provided by the Framework Nation will be controlled in accordance with its financial and accounting procedures. HQ NRDC-UK will provide for the information of Participants an annual summary under NATO Budget Chapter headings of the Framework Nation's direct contribution to its operating costs. 9.2 Funds made available from NATO sources will be requested and accounted for in accordance with standard NATO procedures defined in ACO Directives. 9.3 Estimates of the expenditure arising out of the implementation of article 8.6 which is not funded by the Framework Nation, by individual Participants or from NATO will be prepared by HQ NRDC-UK by 1 September of each year for the following calendar year and four subsequent years. Before being submitted formally to Participants the military requirements on which these estimates are based will be reviewed at a meeting comprising the SNR of each Participant serving in HQ NRDC-UK or his representative. Thereafter they will be considered by a committee to be known as the HQ NRDC-UK Senior Resources Committee (SRC) established for the purpose, on which all Participants will be represented. The SRC will scrutinise and approve the budget which will be shared between the Participants in accordance with the arrangements in Annex C. Funds made available from Shared Funds will be requested and accounted for in accordance with the Financial Administrative Procedures for Shared Funding approved by the SRC. The SRC will meet in accordance with its Terms of Reference at Annex E. 9.4 Funds made available from NATO sources and from Participants in accordance with Para 9.3 above will be subject to audit by the International Board of Auditors (IBAN). A copy of the Board's findings will be provided to each Participant. Funds provided from SC allocations will be subject to audit by the relevant SC. 9.5 Auditing functions for the shared funding will be as directed by the SRC. The designated agency is the IBAN. If not performed by the IBAN, audits will be performed as requested by the SRC. The audit results, together with the Headquarters Commander's report of necessary corrective action, will be provided to SRC members within 90 days of completion of the audit. Documents supporting multinationally funded transactions through shared funding budgets will be available for auditing purposes. 9.6 Funding of the shared element of the HQ NRDC-UK budget will be provided by Participants in a number of instalments as determined by the SRC. The administrative and financial management will be carried out in accordance with current NATO financial regulations and implementing procedures, and any other related documents, to the extent feasible as determined by the SRC. Subject to satisfactory scrutiny of the budget by the SRC, Participants will make available within sixty (60) days of receipt of the invoice and in the currency of the Framework Nation, the amount specified in the invoice being their share of the planned expenditure. Participants will be responsible for bank transfer charges. If in the view of HQ NRDC-UK expenditure is likely to vary significantly from that originally estimated, a revised estimate may be submitted for approval to the SRC. Thereafter an additional invoice will be raised by HQ NRDC-UK on the basis of the Participant's appropriate share of the revised budget. The commander will ensure: a. The designation of the bank or banks in which the funds are to be held. In selecting the bank or banks, the aim will be to obtain the most favourable conditions for the required services and adequate security for deposits; b. The establishment and overall management of all accounts; c. That the transfers and withdrawals from accounts are authorised by two signatures. Transfer authority and financial limits will be determined by the SRC. 9.7 HQ NRDC-UK will maintain a full and complete record of all expenditure incurred and an annual report detailing that expenditure will be submitted to the SRC. If at the end of an accounting period expenditure has been lower than forecast, subsequent invoices will be adjusted accordingly. At the end of the year, if a Participant has paid more than the appropriate share of actual expenditure, the excess will be retained and offset against the following year's contribution. SECTION TEN - WELFARE AND AMENITIES 10.1 Personnel of Participants and their dependants, including NSE and their dependants, will have access to the Framework Nation's officially provided welfare facilities including any deployment welfare package, subject to availability and to the Framework Nation's own national requirements and standards. These services will be subject to reimbursement at rates published by the Framework Nation. 10.2 In addition, personnel of Participants and their dependants, including NSE and their dependants, will have access to recreational amenities belonging to the Framework Nation, subject to availability. Any charges for these facilities will be the same as those for the Framework Nation's own personnel and will be the responsibility of the individual involved. SECTION ELEVEN - EQUIPMENT AND INFRASTRUCTURE 11.1 The equipment of the HQ NRDC-UK will comprise all materiel and equipment within the existing Headquarters organisation, excluding assets purchased by NATO or the Framework Nation for a regional crisis equipment pool and those temporarily located at the Headquarters. Upon closure of the Headquarters or termination of this MOU, the Participants and NATO will settle by negotiation in the Senior Resources Committee SRC the residual value of such property in accordance with existing NATO rules and procedures. Equipment procured by the Framework Nation will remain the property of the Framework Nation. Wherever practical, any equipment originally contributed without charge by a Participant will revert to the Participant which provided the equipment. All NATO-provided equipment will remain the property of NATO and be re-distributed in accordance with standard NATO procedures and the Paris Protocol. 11.2 Any equipment procured in the future through the Framework Nation budget will remain the property of HQ NRDC-UK. Upon closure of HQ NRDC-UK or termination of this MOU, residual value or remaining moveable property and equipment will remain with the Framework Nation. 11.3 NATO common funded property and equipment will not be utilised for non-NATO purposes without the specific prior permission of the appropriate SC. SECTION TWELVE - REVIEW, AMENDMENT AND DISPUTES 12.1 This MOU may be amended only with the unanimous written consent of the Signatories. Annexes and appendixes, with the exception of the cost sharing formula, may be amended in writing by the Plenary. Amendments will be attached to the MOU and registered as changes to the original document in accordance with NATO procedures. 12.2 Any dispute between any of the Signatories to this MOU relating to its interpretation or application will be settled by negotiations among the Signatories. Any such dispute, which cannot be settled by direct negotiation will be referred to the appropriate NATO authority whose decision will be final. 12.3 Any NATO member may join this MOU under the terms and conditions approved by the Plenary, through a Note Of Joining (NOJ) to be signed by the joining NATO member and all Signatories. SECTION THIRTEEN - COMMENCEMENT AND DURATION 13.1 This MOU supersedes the MOU concerning the operation, manning, funding, administration and support of Headquarters Allied Rapid Reaction Corps (HQ ARRC) - Headquarters NATO Rapid Deployable Corps (HQ NRDC-UK) dated 16 August 2005 ("the 2005 MOU"). The 2005 MOU will remain in effect, as detailed in the Interim Period Arrangements (Annex F), as long as is necessary for any activities or payments required under that MOU to be completed. 13.2 This MOU will come into effect on the date of the last signature thereto, and will continue in effect until it is terminated in accordance with section 13.4 below. 13.3 Any Participant may withdraw from this MOU giving 12 months prior notice in writing to UK Ministry of Defence, which will notify all other Signatories. In the event of a withdrawal, the SRC or Plenary (as appropriate) will discuss the future cost sharing, funding, residual value and Table of Positions and other implications. 13.4 This MOU may be terminated by unanimous consent of the Signatories at any time. Upon the termination of this MOU the financial consequences resulting there from, including the determination of the residual value of the infrastructure, facilities and equipment subject to shared funding, will be settled by negotiation between the Participants. ANNEX A HQ NRDC-UK MANNING ORGANISATION PRINCIPLES a. The HQ is open to the participation of all NATO members if they so choose, during peacetime, crisis and operations even if they do not have forces affiliated. b. The Plenary proposes, inter alia, degree of multinationality, joining of new members and changes in the Table of positions in accordance with this MOU. c. Changes in the organic structure are to be approved by the Plenary. d. The Manning Table shows the total number of posts authorised by the Participants on a permanent basis. The Essential Augmentee Nucleus (EAN) are posts common to both the Operational and Crises Establishments. The EAN enables the HQ NRDC-UK to provide full capability across all staff branches on a 24 hour / 7 day week basis without further augmentation for up to a 6 month period for the majority of Crisis Response Operations (CRO)3. EAN posts are flagged to nations to provide an assurance of sustainability on operations, which is not dependent on the SOR process. Whether a nation is requested to provide an EAN post holder for an operational deployment will depend on the nature of the mission. However, an operation which requires the full deployment of the HQ NRDC-UK is likely to require the majority of EAN post holders. EAN post holders should normally train with HQ NRDC-UK once per year. APPENDICES Appendix 1: HQ NRDC-UK Organisation. Appendix 2: Approved Manning Table (Permanent posts and EAN). 3 A high intensity combat operation involving HQ ARRC in the command of 4 divisions and up to 20 combat support and combat service support formations will require HQ ARRC to be augmented by its full OE. ANNEX B RESPONSIBILITIES OF THE FRAMEWORK NATION FRAMEWORK NATION 1. The Framework Nation will provide and bear the cost of the following services and functions to HQ NRDC-UK, in accordance with the Framework Nations' scale of supply and existing NATO standards where applicable, or as separately agreed by the HQ NRDC-UK Senior Resources Committee/Plenary (as appropriate): a. The infrastructure of buildings, their structural maintenance, cleaning, heating, lighting and physical security; b. The personnel and equipment within the Signal Brigade establishment administering HQ NRDC-UK; c. The office management, furnishings, fittings, office equipment and stationery for HQ NRDC-UK, together with office services and operational support services; on deployment and operations the Framework Nation will provide the scale of supply as prescribed by the NRDC-UK Sustainability Statement; d. Staff cars and other administrative vehicular transport for the personnel on duty of HQ NRDC-UK including the full cost of running the vehicles (50% of fuel costs will be shared by the Participants in accordance with the cost-sharing formula at Annex C), according to MOD Framework Nation regulations; e. External communications: A field tactical network; f. Command and information systems to support the structure of HQ ARRC/NRDC-UK in the peacetime location, on deployment and on operations subject to appropriate NATO reimbursement policy; g. Weapons and individual specific equipment (e.g. NBC), if requested by the Participants; h. Consumable combat supplies required for exercises in conditions defined in paragraph 2 below; i. Geographic support to HQ NRDC-UK, as follows: (1) Terrain analysis and graphics, provision of defined planning stocks and controlled access of a geographic map library; on deployment, direct geographic support and combat map distribution; base-plant facilities will augment other arrangements; (2) Coordination of the supply of geographic materials, either from existing NATO-designated materials (by nations meeting their existing responsibilities within current NATO Geographic Policy), or by arranging production and supply (with financial reimbursement through existing bilateral arrangements or on an invoice repayment basis). 2. The Framework Nation will provide and bear the costs of military exercises within Mainland Great Britain which involve the deployment of HQ NRDC-UK for a period not exceeding 7 days of active exercise time and which involve only personnel and equipment integral to HQ NRDC-UK. ANNEX C PARTICIPANT COST SHARING FORMULA 1. The Participants will fund between them the total operating costs of HQ NRDC-UK - i.e. the Framework Nation costs and the approved costs to be shared between the Participants - according to their share of the peacetime allocation of officers as reflected at Annex A. 2. Furthermore, the Framework Nation guarantees to meet the Framework Nation element of the HQ NRDC-UK budget in full, even if it is higher than its share of the total cost under paragraph 1 above. In that event, the Framework Nation will also contribute 5% of the remaining balance of the shared funding. The remainder of the operating costs of the HQ NRDC-UK will be shared between the other Participants on the basis of their share of the peacetime allocation of officers as reflected at Annex A. (Notes 1-3) Notes: 1. Unfilled posts will not affect the designated nation's liability. 2. Manpower adjustments will affect the shares of Nations affected. 3. Temporary augmentees will not affect national shares. ANNEX D CHARGES FOR ACCOMMODATION, MESSING, EDUCATION, MEDICAL AND OTHER FACILITIES 1. The following principles will apply in setting the rates of reimbursement for accommodation, education of school children and medical/dental services/facilities: a. Married Accommodation: The rates of reimbursement for service housing (including Substitute Services Families Accommodation (SSFA)) will be at the entitled rates for UK service personnel. These costs include the cost of rental from the private sector, the maintenance and repair of accommodation and the provision of local services and facilities. Participants' personnel will be required to engage with the local utility providers for gas, electricity and telephone but not for water or sewage charges (which are already included in the accommodation charge), and will be responsible for settling their own bills. However, if the Participant chooses not to use the Framework Nation provided accommodation the Framework Nation will at the request of the Participant, provide general advice and assistance on how to procure suitable accommodation from the private sector. In this case the Participant will meet the full cost of rental and any associated expenses. b. Single Accommodation and Messing: The rates of reimbursement for single accommodation (including Substitute Services Single Accommodation (SSSA)) will be at the entitled rates for UK service personnel. In addition the Mess Committee may set 'extra messing' charges and other subscription rates, to cover such items as entertainment and maintenance (napkins, newspapers etc). c. Messing: The rates for all personnel not resident in the Mess concerned will be at the standard rate applicable to personnel of the Framework Nation. The Mess Committee may set other subscriptions. d. National Support Elements: The charges will be based on the actual cost to the Framework Nation of providing, maintaining and operating the accommodation. e. Education. Dependant children of Participant nation personnel are entitled to admission to the UK maintained school appropriate to their age and domestic location at no charge. f. Medical and Dental Dependants of Participant nation personnel are permitted access to UK National Health Service (NHS) medical and dental care to a standard not less than UK civilians and service personnel. Dependants will be charged for prescription drugs and NHS dental care at the point of delivery. There will be no charge for primary health care. g. Welfare Facilities: Where charges are made for the use of officially provided welfare facilities they will reflect the actual cost to the Framework Nation of providing the service. ANNEX E TERMS OF REFERENCE OF HQ ARRC/NRDC-UK SENIOR RESOURCES COMMITTEE Definitions and Reference; 1. The Senior Resources Committee (SRC) is the committee responsible for considering resource issues arising from that part of the HQ NRDC-UK budget which falls to be shared between the Participants and for the resolution of issues arising out of the administration of that part of the HQ NRDC-UK budget. 2. A subordinate technical committee is any committee established by the SRC. Constitution; 3. Each Participant will nominate a representative to the SRC and to any subordinate technical committee the SRC may establish. The SCs may be represented in SRC as non voting members. 4. Each Participant's representative may be advised by national experts, who may participate in any discussions at SRC or subordinate technical committee meetings. 5. The Chairman and the Secretary of the SRC will be provided by the Framework Nation. 6. The SRC will determine its organisation and internal rules whilst abiding by the following general principles; a. The SRC will meet regularly at such intervals as shall enable it to carry out its responsibilities and as soon as possible in response to a specific request by any Participant or by HQ NRDC-UK. b. The SRC's decisions on resource implications and regarding funding policy shall be unanimous. c. Any disagreements that can not be resolved by the SRC will be submitted to the Plenary. Authority; 7. The SRC will be responsible for: a. Agreeing that part of the HQ NRDC-UK budget the funding of which falls to be shared by the Participants. b. Consideration and resolution of issues arising out of the administration of that budget. c. Approving any financial activities above any Established Financial Limits (EFLs) which the SRC may set. d. Retrospective examination of the executed HQ NRDC-UK budget against approved HQ NRDC-UK budget for funding, which falls to be shared between the Participants. 8. During a NATO contingency the provisions in Para 7 above will apply so far as practicable. If a meeting of the SRC cannot be convened, the authority of the SRC will be exercised in consultation with the Senior National Representatives (SNRs) of each Participant serving in HQ NRDC-UK. 9. No action will be taken by silence procedures. ANNEX F HQ NRDC - UK INTERIM PERIOD ARRANGEMENTS RESPONSIBILITIES 1. The Framework Nation will meet those costs associated with the physical move and establishment of the HQ from its present location at JHQ, DEU to INNSWORTH, UK over and above those which Participants would normally meet as part of their contribution to HQ NRDC-UK. 2. Movement of Personnel. Notwithstanding Paragraph 1 (above), the Framework Nation will defray the additional costs associated with the movement of personnel where those personnel move with HQ NRDC-UK from DEU to UK and have a period of 12 months or greater to serve in HQ NRDC-UK at the time of the move. In posting personnel to HQ ARRC during the Interim Period, Participants are encouraged to move their dependant families direct to INNSWORTH, UK. 3. Movement of NSE Equipment. Notwithstanding Paragraph 1 (above), the Framework Nation will defray the additional costs associated with the movement of Participants' NSE equipment from its current location in JHQ, DEU to INNSWORTH, UK where such movement does not include semi permanent structures such as porta-cabins etc which can easily be procured or rented within the UK. The Framework Nation will not be responsible for any insurance costs, nor be liable for any damage to NSE Equipment of Participants damaged as a result of the move. The responsibility for Insuring against any damage associated with the move will lie with Participants. Costs will only be defrayed if Participants utilise the removals contracts arranged by the Framework Nation. Should Participants choose to utilise their own contractual arrangements, or have security requirements additional to those of the Framework Nation, the resulting costs will not be met by the Framework Nation. 4. Expenditure incurred due to the dislocation of HQ ARRC from its CIS and administrative support is to be the responsibility of the Framework Nation, this notwithstanding the provisions of Annex B, Paragraph 2 of this MOU. EFFECT 5. During the Interim Period the MOU dated 16 August 2005 ("the 2005 MOU") will continue in effect only to the extent that the 2005 MOU will be the operative document addressing funding responsibilities for activities occurring within the British Forces Germany Administrative Area for those HQ NRDC-UK components based in DEU. Upon completion of the move of all HQ NRDC-UK components (see Paragraph 6 below) the 2005 MOU will cease to have effect. INTERIM PERIOD 6. Unless otherwise agreed by the Participants, these Interim Period Arrangements will apply upon the commencement of the move of HQ NRDC-UK (MAIN) and extend until such time as 1 (UK) Sig Bde is complete in its new UK location. IEVADS ŅEMOT VĒRĀ, ka Ziemeļatlantijas līguma pilnveidošanas nolūkā Parakstītāji vēlas apvienot centienus vēl ciešākai sadarbībai kolektīvās aizsardzības nodrošināšanā; IEVĒROJOT 2002. gada 2. septembra Ziemeļatlantijas Padomes Lēmumu PO (2002) 140, kas apstiprināts 2002. gada 10. septembrī, HQ ARRC/NRDC-UK saglabā savu starptautisko statusu kā Starptautiskais Militārais štābs, kas tika izveidots 1992. gadā (atsauce tekstā) un tiks pārvietots no Reindālenes (Vācijā) uz Insvortu (Apvienotajā Karalistē); IEVĒROJOT Ziemeļatlantijas līguma organizācijas dalībvalstu 1951. gada 19. jūnija līguma par to bruņotajiem spēkiem (NATO SOFA) noteikumus, 1952. gada 28. augusta Protokolu par Starptautiskā Militārā štāba statusu, kas ir sastādīts atbilstoši Ziemeļatlantijas līgumam (Parīzes protokols); ŅEMOT VĒRĀ dokumentu MC-317/1 par NATO spēku struktūru, ko 2002. gada 8. jūlijā apstiprinājusi NATO Militārā komiteja; ŅEMOT VĒRĀ, ka NATO Militārā komiteja (MC) vienojās (MCM-079-03, 2003. gada 16. aprīlis), ka Augstas gatavības spēku (sauszemes) (HRF(L)) štābs nodrošina NATO ar lielāku operāciju daudzpusību un labprāt iesaistās NATO Reaģēšanas spēku (NRF) uzlabošanā un pārveidē. IEVĒROJOT, ka šajā pašā lēmumā MC ieteica Ziemeļatlantijas Padomei (NAC) apstiprināt HQ ARRC, Eiropas korpusa virspavēlniecības štābu (HQ EUROCORPS), I korpusa štābu (vācu-nīderlandiešu), Itālijas NATO Ātrās izvietošanas spēku štābu, Spānijas NATO Ātrās izvietošanas spēku štābu un Turcijas NATO Ātrās izvietošanas spēku štābu kā NATO Augstas gatavības izvietošanas spēku (sauszemes) štābus, kā arī to, ka saskaņā ar MC lēmumu MCM-066-2007 ir izvēlēti arī Francijas NATO Ātrās izvietošanas spēki. ŅEMOT VĒRĀ dokumentu MC 477 - Militārais lēmums par NATO Reaģēšanas spēkiem - , ko 2003. gada 10. aprīlī pieņēmusi NATO Militārā komiteja; AR VĒLMI īstenot šādus starptautiskus komplektēšanas un finansēšanas pasākumus, kas ir nepieciešami HQ ARRC/NRDC-UK izveidei un darbībai; Parakstītāji ir panākuši šādu vienošanos: PIRMAIS PANTS - DEFINĪCIJAS 1.1. Apvienotās Karalistes NATO Ātrās izvietošanas spēku štābs (HQ NRDC-UK) ir Sabiedroto ātrās reaģēšanas spēku štābs, kas tiek pārcelts no Reindālenes (Vācijā) uz Insvortu (Apvienotajā Karalistē) un oficiāli nozīmēts kā daļa no NATO spēku struktūras, un kura organizatoriskā struktūra ir atspoguļota šī Saprašanās memoranda (MoU) A pielikumā. HQ NRDC-UK kopā ar piešķirto Komandvadības un informācijas sistēmu (CIS) un nodrošinājuma elementiem, kā norādīts Vadības un kontroles tehniskā plāna A pielikumā, ko parakstījusi SHAPE un Vadošā valsts, turpmāk tiek uzskatīta par HQ NRDC-UK grupu. 1.2. DALĪBNIEKI ir tās aizsardzības ministrijas (MoDs) un to ekvivalenti, kuri pieder pie tiem Ziemeļatlantijas līguma organizācijas dalībniekiem, kuri nodrošina HQ NRDC-UK personāla un finansiālo atbalstu saskaņā ar šī MoU nosacījumiem. 1.3. PARAKSTĪTĀJI ir Dalībnieki un SHAPE. 1.4. VADOŠĀ VALSTS ir Apvienotā Karaliste, kas ir atbildīga par HQ NRDC-UK komandvadības, sakaru, vadīšanas un loģistikas nodrošināšanas atbalstu saskaņā ar šo MoU un par NAC lēmumu īstenošanu attiecībā uz štābiem. 1.5. HQ NRDC-UK PLENĀRĀ KOMITEJA ir politikas izpildkomiteja, kuras sastāvā ir šī MoU Parakstītāju pārstāvji. 1.6. Nacionālais atbalsta elements (NSE) ir jebkura ar HQ NRDC-UK saistīta nacionāla vienība vai elements, kas pilda tikai nacionālās pārvaldes uzdevumus, lai palīdzētu HQ NRDC-UK nacionālajiem biedriem. Uz tiem attiecas NATO SOFA. 1.7. Vadošais nacionālais pārstāvis (SNR) ir katra Dalībnieka galvenā amatpersona, kas darbojas HQ NRDC-UK. Viņš vai viņa var deleģēt savus pienākumus citai amatpersonai no savas valsts, kas darbojas HQ NRDC-UK, saskaņā ar nacionālajiem likumiem un noteikumiem. 1.8. Lielbritānijas pamatteritorija ir Anglija, Velsa un Skotija, tajā neietilpst Ziemeļīrija, Skotijas salas, Normandijas salas un Menas sala. OTRAIS PANTS - MĒRĶIS UN DARBĪBAS JOMA 2.1. Šī MoU mērķis ir izveidot noteikumus HQ NRDC-UK statusam un tā ieceltajam personālam, kā arī izstrādāt kārtību HQ NRDC-UK izvietošanas, finansēšanas, spēku, vadības un loģistikas atbalstam un izmaksu sadalei Dalībnieku vidū. 2.2. Šī MoU mērķis nav būt pretrunā ar nacionālajiem vai starptautiskajiem tiesību aktiem un jebkādiem spēkā esošiem starptautiskiem Pušu nolīgumiem. Šādu konfliktu gadījumā dominējošs spēks ir nacionālajiem vai starptautiskajiem tiesību aktiem un starp Parakstītājiem noslēgtajiem starptautiskajiem nolīgumiem. Šādu konfliktu gadījumā Parakstītāji cits citu par tiem informē rakstveidā. TREŠAIS PANTS - SĀRSŠ/AKNĀISŠ STATUSS UN UZDEVUMS 3.1. Parīzes protokola noteikumi un NATO SOFA noteikumi saskaņā ar Parīzes protokolu attiecas uz HQ ARRC/NRDC-UK, Dalībniekiem un štāba personālu. 3.2. Miera vai krīzes laikā NATO var izvietot HQ NRDC-UK saskaņā ar attiecīgo NATO militāro institūciju (NMA) pilnvarām, izmantojot to mācību vai operāciju uzdevumu nolūkā saskaņā ar NATO standarta kārtību. HQ NRDC-UK nevajadzētu izmantot vai kā citādi padarīt to nepieejamu NATO (piemēram, ES vadītajām operācijām vai valsts vajadzībām), par to iepriekš neinformējot SHAPE. 3.3. Pavēlniecības attiecības, kas ļauj HQ NRDC-UK pildīt tā uzdevumus miera, krīzes vai operāciju laikā, ir detalizētāk aprakstītas Vadības un kontroles tehniskajā plānā. 3.4. Dalībnieki padara HQ NRDC-UK pieejamu un to atbilstoši nodrošina, lai atbalstītu dalību visās apmācībās un vingrinājumos, ko izstrādā: a. MC oficiālajā NATO Militāro apmācību un vingrinājumu programmā (MTEP), kurā Sabiedroto Operāciju Pavēlniecība (ACO) nosaka mācības, kas nepieciešamas NATO komandstruktūrai un spēku struktūrai, tostarp NATO Reaģēšanas spēkiem (NRF)1; b. NRDC-UK komandieris, lai nodrošinātu NATO spēku pieejamību saskaņā ar atbilstošiem sagatavotības līmeņiem un izpildes laikiem, kā to nosaka MC un SHAPE. 3.5. Gaisa operāciju koordinācijas centrs (sauszemes) (AOCC(L)) ir Gaisa spēku vienība, kas funkcionāli ir pakļauta Apvienotā gaisa operāciju centra (CAOC) komandierim, un šis centrs ir neatņemama HQ NRDC-UK sastāvdaļa, kas veido daļu no gaisa vadības un kontroles struktūras gaisa operāciju plānošanas un koordinēšanas nolūkā, lai atbalstītu šo štābu. AOCC(L) un tā personālam ir vadības funkcija, darbojoties HQ NRDC-UK vadības kontrolē (ADMINCON), vienlaikus paliekot CAOC komandiera funkcionālā pakļautībā. Operāciju vadība norit saskaņā ar ACO Direktīvu 80-65, kas apstiprināta 2006. gada 21. novembrī, AOCC(L) personāla statuss joprojām tiek noteikts saskaņā ar Parīzes protokolu. AOCC(L) organizatoriskā struktūra un komplektēšana ir izklāstīta A pielikumā. CETURTAIS PANTS - MIERA LAIKA VIETAS MAIŅA 4.1. HQ NRDC-UK miera laika vieta no 2010. gada vasaras tiek pārcelta no Reindālenes (Vācijā) uz Insvortu (Apvienotajā Karalistē). PIEKTAIS PANTS - PLENĀRĀ KOMITEJA 5.1. Lai pārskatītu šī MoU darbību, Plenārā komiteja satiekas vismaz vienu reizi gadā. 5.2. Vadošā valsts ir atbildīga par Plenārās komitejas sagatavošanu un uzņemšanu ar Apvienotās Karalistes NRDC-UK komandiera palīdzību, ja tā nepieciešama. 5.3. Plenārās komitejas sastāvā ir: a. Priekšsēdētājs (no Vadošās valsts), kurš vada Plenārās komitejas sanāksmi bez balsstiesībām; b. katra Dalībnieka pārstāvis ar balsstiesībām; c. SHAPE pārstāvis bez balsstiesībām, kurš drīkst piedalīties sēdē; d. Sekretārs (no Vadošās valsts). 5.4. Plenārās komitejas lēmumi tiek pieņemti vienbalsīgi. 5.5. Katrs Parakstītājs sava pārstāvja atbalstīšanai var nodrošināt jebkuru citu nepieciešamo ekspertu (bez balsstiesībām). SESTAIS PANTS - PIENĀKUMI 6.1.
