disciplinary offences and sanctions in respect of judges and court presidents are introduced by the Amendments; the Amendments transfer some competencies of the assemblies of judges to the colleges composed of the court presidents appointed by the Minister of Justice; the Amendments change the process of the election of the First President of the Supreme Court, lowering the quorum to 32 judges (out of approximately 120) in the third round of voting. Onder “C. Prohibition to question the lawfulness of the judge's appointment” is voorts overwogen: 31. Several provisions of the Amendments eliminate the competence of the Polish courts to examine whether another court decision was issued by a person appointed as a judge in compliance with the Constitution, European law and other international legal standards. These amendments are seemingly designed to have a nullifying effect on the CJEU ruling of 19 November 2019 and the Supreme Court judgment of 5 December 2019, and on other pending proceedings where the competence of the
ly appointed judges has been challenged. 32. In particular,
Article 55
§ 1 stipulates that a person who has been appointed as a judge by the President of the Republic and who has taken an oath should be regarded as a judge.
Article 42a
prohibits courts (except the Extraordinary Chamber) from questioning (
- a)the powers of courts, constitutional state bodies and law enforcement and control bodies, and (
- b)the jurisdiction of a judge dealing with a case. 33. In order to guarantee that no judge in Poland questions the validity of an appointment made by the
NCJ (rechtbank: National Council of the Judiciary), amended Article 107 § 1 of the Acts on the Common Courts (on disciplinary offences) prohibits “actions questioning … the effectiveness of the appointment of a judge or the constitutional mandate of an organ of the Republic of Poland”. This provision seems to cover statements made by the judge extrajudicially (on this see above, Section B). It also prohibits procedural actions which challenge the validity of appointment of other judges. 34. Finally,
Article 45b
introduced to the Act on the NCJ provides that once the President of the Republic appoints a person as a judge, on the basis of a proposal by the NCJ, any appeal proceedings which challenge the decision of the NCJ “shall be discontinued by operation of the law”. It appears that, by virtue of Article 12 of the Amendments, these
provisions will have a retroactive effect and invalidate any proceedings (and the resulting judgments) which might question the appointments which had already been made by the President. 35. All motions challenging the independence and impartiality of judges are henceforth to be decided by the Extraordinary Chamber (see
§§ 2– 4 of Article 26 of the Act on the Supreme Court).
That being said, motions based on the alleged illegality of appointment of a judge or his/her authority to perform judicial function should be “left unprocessed” (§ 3). The Extraordinary Chamber is given a special competence to quash decisions of other courts, including other chambers of the Supreme Court, if those decisions contest the legitimacy of other judges (§ 4).
- These provisions, taken together, significantly curtail the possibility to examine the question of institutional independence of Polish courts by those courts themselves. This approach raises issues under Article 6 § 1 of the ECtHR, since judicial review should involve examination of all relevant aspects of the independence of the tribunal, including institutional ones. Thus, as demonstrated by the ECtHR’s case-law, the composition of the body which appoints judges is relevant from the stand-point of the requirement of “independence”. There are other institutional elements which should be assessed – for example, the risk of an arbitrary removal of a judge by the Minister of Justice, or the risk of undue pressure by the president of the court in which the judge works. In the opinion of the Venice Commission, national judge should not be prevented from examining these aspects of the case, along with other elements which may affect the “independence and impartiality” requirement under Article 6 § 1 of the ECHR. This is certainly true when the normal chain of appeals is concerned; however, the Strasbourg Court did not have an occasion to examine situations when one national court contests the legitimacy of another judicial body (with the reference to the lack of independence or otherwise) outside of the normal chain of appeals, and what should be a proper procedural framework for resolving such disputes.
- Furthermore, the above provisions, taken together, aim at nullifying the effects of the CJEU ruling. This is a serious challenge to the principle of the primacy of EU law. In the preliminary ruling of 19 November 2019, the CJEU clearly held that it was a duty of the referring court to examine the question of independence of the Disciplinary Chamber, in particular by looking at the composition of the selecting body (the NCJ). Polish courts dealing with the consequences of the CJEU judgment of 19 November 2019 or confronted with an issue of judicial independence in a different context, will be put in an impossible position of choosing between following the requirements of the EU law as interpreted by the CJEU, or using legal avenues provided by the TFEU, and abiding by the
law. 41. In addition,
Article 55
§ 4 is contrary to the principle of a lawful judge (enshrined in to Article 6 § 1 of the ECHR and Article 47 of the Charter): it will be henceforth impossible to challenge a judge on the ground that the case has been allocated to him/her unlawfully and/or arbitrarily, or that the rules on territorial and substantive jurisdiction were breached. This provision may lead to abusive redistribution of cases to “loyal” judges. Such arbitrary allocation of cases is further facilitated by
provisions on the distribution of work-load in the courts which would increase the discretion of the court presidents (see, for example,
Article 22a
, and
Article 37e
§2), and the
rule de facto permitting allocation of cases to a judge from another district court (see
Article 77
§ 9a which permits to delegate a judge of the district court to another court “simultaneously with performing duties in his official place” of work, i.e. in the district where this judge normally works).
- The Amendments in this part are supposed to counter a situation which was created by the 2017 reform of the NCJ and of the Supreme Court. In the opinion of the Venice Commission, it is necessary to return to the question of composition of the NCJ, in order to bring the method of appointment of its judicial members in accordance with the European standards and best practices. That would remove the risk of legal chaos, although the question of validity of judicial appointments made in the meantime would have to be addressed by the Polish authorities.
- In the short-term perspective, the Venice Commission urges the Polish authorities to remove provisions (on disciplinary offences and other) which prevent the courts from examining the questions of independence and impartiality of other judges from the standpoint of the EU law and the ECHR. disciplinary offences and sanctions”: 44. As stressed above,
Article 107
affects the free speech of judges and may be problematic under the ECHR and EU law. However, it is very troubling in other respects too.
§ 1
contains overbroad and open-ended definitions and thus threatens the principle of legality. For instance, it prohibits “acts or omissions which may prevent or significantly impede the functioning of an organ of the judiciary” and “an infringement of the dignity of the office”. Both of these invite very subjective interpretations and could easily be abused to interfere improperly in judicial roles.

Het enkele vooruitzicht dat de betrokken nationale rechters in voorkomend geval tuchtrechtelijk kunnen worden vervolgd omdat zij een verzoek om een prejudiciële beslissing hebben ingediend of hebben besloten dat verzoek na indiening te handhaven, kan immers afbreuk doen aan de daadwerkelijke uitoefening door de betrokken nationale rechters van de in het voorgaande punt genoemde mogelijkheid en taak. 59 Het feit dat deze rechters niet worden blootgesteld aan tuchtrechtelijke procedures of sancties wegens het feit dat zij hebben gebruikgemaakt van deze mogelijkheid om zich tot het Hof te wenden, die onder hun exclusieve bevoegdheid valt, vormt voorts een waarborg die inherent is aan hun onafhankelijkheid (zie in die zin beschikking van 12 februari 2019, RH, C‑8/19 PPU, EU:C:2019:110, punt 47), welke onafhankelijkheid in het bijzonder essentieel is voor de goede werking van het stelsel van rechterlijke samenwerking die gestalte krijgt in het in artikel 267 VWEU neergelegde mechanisme van de prejudiciële verwijzing [zie in die zin arrest van 25 juli 2018, Minister for Justice and Equality (Gebreken in het gerechtelijk apparaat), C‑216/18 PPU, EU:C:2018:586, punt 54 en aldaar aangehaalde rechtspraak].
- de inbreukprocedure die door de Europese Commissie op 25 oktober 2019 is gestart - een “beroep wegens niet-nakoming” - die tot doel heeft vast te stellen dat Polen de verplichtingen niet is nagekomen die op haar rusten krachtens: - artikel 19, lid 1, tweede alinea, VEU, - door toe te staan dat de inhoud van rechterlijke beslissingen kan worden aangemerkt als een tuchtrechtelijk vergrijp wat betreft de rechters van de gewone rechterlijke instanties [artikel 107, § 1, van de ustawa – Prawo o ustroju sądów powszechnych (wet betreffende de organisatie van de gewone rechterlijke instanties) van 27 juli 2001 (Dz. U. nr. 98, volgnr. 1070), zoals gewijzigd (Dz. U. van 2019, volgnr. 1495) (hierna: „wet betreffende de organisatie van de gewone rechterlijke instanties”), en artikel 97, §§ 1 en 3, van de wet inzake de Sąd Najwyższy]; - door niet de onafhankelijkheid en onpartijdigheid te waarborgen van de tuchtkamer, die belast is met de toetsing van de beslissingen in tuchtprocedures tegen rechters [artikel 3, punt 5, artikel 27 en artikel 73, § 1, van de wet inzake de Sąd Najwyższy, gelezen in samenhang met artikel 9a van de ustawa o Krajowej Radzie Sądownictwa (wet inzake de nationale raad voor de rechterlijke macht) van 12 mei 2011 (Dz. U. nr. 126, volgnr. 714), zoals gewijzigd bij de ustawa o zmianie ustawy o Krajowej Radzie Sądownictwa oraz niektórych innych ustaw (wet tot wijziging van de wet inzake de nationale raad voor de rechterlijke macht en van sommige andere wetten) van 8 december 2017 (Dz. U. van 2018, volgnr. 3 (hierna: „wet inzake de KRS”)]; - door de president van de tuchtkamer de discretionaire bevoegdheid te verlenen om het tuchtgerecht aan te wijzen dat in eerste aanleg bevoegd is voor zaken betreffende de rechters van de gewone rechterlijke instanties (artikel 110, § 3, en artikel 114, § 7, van de wet betreffende de organisatie van de gewone rechterlijke instanties), en derhalve niet te waarborgen dat tuchtzaken worden onderzocht door een „bij wet ingesteld” gerecht, en - door aan de minister van Justitie de bevoegdheid te verlenen om een tuchtambtenaar van de minister van Justitie aan te stellen (artikel 112b van de wet betreffende de organisatie van de gewone rechterlijke instanties), en derhalve niet te waarborgen dat tuchtzaken tegen rechters van de gewone rechterlijke instanties binnen een redelijke termijn worden behandeld, alsmede door te bepalen dat de handelingen die betrekking hebben op de aanwijzing van een raadsman en het op zich nemen van de verdediging door deze laatste, geen schorsende werking hebben voor het verloop van de tuchtprocedure (artikel 113a van de wet betreffende de organisatie van de gewone rechterlijke instanties) en dat het tuchtgerecht de procedure voortzet zelfs indien de in kennis gestelde betrokken rechter of zijn raadsman met reden afwezig is (artikel 115a, § 3, van de wet betreffende de organisatie van de gewone rechterlijke instanties), waardoor de rechten van de verdediging van de betrokken rechters van de gewone rechterlijke instanties niet worden beschermd; - artikel 267, tweede en derde alinea, VWEU, door toe te staan dat het recht van rechterlijke instanties om het Hof te verzoeken om een prejudiciële beslissing wordt beperkt door de mogelijkheid om een tuchtprocedure te starten.
- de beschikking van het HvJ van 8 april 2020 in deze inbreukprocedure, waarin bij wijze van interim measure is geoordeeld Het Hof (Grote kamer) beschikt: De Republiek Polen moet, onmiddellijk en tot aan de uitspraak van het arrest waarmee zaak C-791/19 wordt beëindigd, - de toepassing opschorten van artikel 3, punt 5, artikel 27 en artikel 73, § 1, van de ustawa o Sądzie Najwyższym (wet die ziet op de hoogste rechter in burgerlijke en strafzaken) van 8 december 2017 (Dz. U. van 2018, volgnr. 5), zoals gewijzigd, die de grondslag vormen voor de bevoegdheid van de Izba Dyscyplinarna (tuchtkamer) van de Sąd Najwyższy (hoogste rechter in burgerlijke en strafzaken) om zowel in eerste aanleg als in hoger beroep uitspraak te doen in tuchtzaken betreffende rechters; - zich onthouden van het toewijzen van de bij de tuchtkamer van de Sąd Najwyższy aanhangige zaken aan een rechtsprekende formatie die niet voldoet aan de vereisten van onafhankelijkheid zoals met name uiteengezet in het arrest van 19 november 2019, A. K. e.a. (Onafhankelijkheid van de tuchtkamer van de Sąd Najwyższy) (C‑585/18, C‑624/18 en C‑625/18, EU:C:2019:982), en - de Europese Commissie uiterlijk een maand na de kennisgeving van de beschikking van het Hof waarbij de gevraagde voorlopige maatregelen worden gelast, op de hoogte stellen van alle maatregelen die zij heeft genomen om volledig aan deze beschikking te voldoen. en waaruit blijkt dat de inbreukprocedure die op 25 oktober 2019 door de Europese Commissie is gestart, niet al op voorhand geen kans van slagen heeft. Het is de rechtbank niet bekend of de Poolse autoriteiten voornoemde maatregelen hebben genomen en of zij de Europese Commissie hiervan binnen de termijn van een maand in kennis hebben gesteld.
- de omstandigheid dat de rechtbank ambtshalve uit berichten in de media heeft vernomen dat inmiddels op 9 juni 2020 voor de tuchtkamer van de Sąd Najwyższy een zitting heeft plaatsgevonden betreffende het (al dan niet) opheffen van de strafrechtelijke immuniteit van een Poolse rechter.
- de omstandigheid dat de Europese Commissie op 29 april 2020 een (vierde) inbreukprocedure tegen Polen is gestart met betrekking tot voornoemde law on the judiciary of 20 December 2019: The
law on the judiciary undermines the judicial independence of Polish judges and is incompatible with the primacy of EU law. Moreover, the
law prevents Polish courts from directly applying certain provisions of EU law protecting judicial independence, and from putting references for preliminary rulings on such questions to the Court of Justice. After carrying out an analysis of the legislation concerned, the Commission concluded that several elements of the
law violate EU law: First, the Commission notes that the
law broadens the notion of disciplinary offence and thereby increases the number of cases in which the content of judicial decisions can be qualified as a disciplinary offence. As a result, the disciplinary regime can be used as a system of political control of the content of judicial decisions. The
law violates Article 19
(1)of the Treaty on European Union read in connection with Article 47 of the Charter of Fundamental Rights of the European Union, which establish a right to an effective remedy before an independent and impartial court. It is incompatible with the requirements of judicial independence as established by the EU Court of Justice. Second, the Commission notes that the
law grants the
Chamber of Extraordinary Control and Public Affairs of the Supreme Court the sole competence to rule on issues regarding judicial independence. This prevents Polish courts from fulfilling their obligation to apply EU law or request preliminary rulings from the EU Court of Justice. The
law is incompatible with the principle of primacy of EU law, the functioning of the preliminary ruling mechanism as well as with requirements of judicial independence. Third, the Commission notes that the law prevents Polish courts from assessing, in the context of cases pending before them, the power to adjudicate cases by other judges. This impairs the effective application of EU law and is incompatible with the principle of primacy of EU law, the functioning of the preliminary ruling mechanism and requirements of judicial independence. Finally, the Commission notes that the
law introduces provisions requiring judges to disclose specific information about their non-professional activities. This is incompatible with the right to respect for private life and the right to the protection of personal data as guaranteed by the Charter of Fundamental Rights of the EU and the General Data Protection Regulation. 3.3.3 Nadere vragen Voor de rechtbank vormen de voornoemde ontwikkelingen, in samenhang bezien, aanleiding om af te wijken van de sinds de eerdergenoemde uitspraak van 16 januari 2020 gehanteerde lijn. Naar het oordeel van de rechtbank blijkt uit deze ontwikkelingen van een dusdanig toegenomen druk op de onafhankelijkheid van de rechterlijke instanties van Polen, dat dit gevolgen kan hebben voor de door de rechtbank te nemen beslissing over de overlevering. Anders dan de verdediging respectievelijk de officier van justitie hebben verzocht, zal de rechtbank op dit moment nog niet een beslissing nemen tot het weigeren of toestaan van de overlevering, danwel tot het stellen van prejudiciële vragen aan het HvJ. De rechtbank heeft, alvorens zij één van de mogelijke beslissingen als bedoeld kan nemen, nog eenmaal behoefte aan aanvullende gegevens. De rechtbank zal deze bij de uitvaardigende rechterlijke autoriteit opvragen, in het kader van de aan haar opgedragen dialoog zoals bedoeld in het arrest LM in paragraaf 76 tot en met
- De rechtbank zal derhalve het onderzoek ter zitting heropenen en de officier van justitie verzoeken de volgende vragen voor te leggen aan de uitvaardigende rechterlijke autoriteit: A. Ten aanzien van de tuchtkamer van de Sąd Najwyższy Zijn voor de tuchtkamer van de Sąd Najwyższy sinds de interim measure van het Hof van Justitie van de Europese Unie van 8 april 2020 nog tuchtzaken tegen rechters behandeld? Zo ja, betekent dit dat de toepassing van artikel 3, punt 5, artikel 27 en artikel 73, § 1, van de ustawa o Sądzie Najwyższym (wet die ziet op de hoogste rechter in burgerlijke en strafzaken) van 8 december 2017 (Dz. U. van 2018, volgnr. 5), zoals gewijzigd, die de grondslag vormen voor de bevoegdheid van de Izba Dyscyplinarna (tuchtkamer) van de Sąd Najwyższy (hoogste rechter in burgerlijke en strafzaken) om zowel in eerste aanleg als in hoger beroep uitspraak te doen in tuchtzaken betreffende rechters, niet is opgeschort? In hoeverre is overigens voldaan aan de beschikking van het Hof van Justitie van de Europese Unie van 8 april 2020? Is de toepasselijke wetgeving nog (onverkort) van toepassing? B. Welke rechterlijke instanties bevoegd? Welke rechterlijke instanties (in eerste aanleg en in hoger beroep) zijn concreet bevoegd voor de procedures waaraan deze opgeëiste persoon zal worden onderworpen? C. Tuchtzaken of andere (disciplinaire) maatregelen bij de onder B bedoelde instanties Voor ieder van de hiervoor bedoelde rechterlijke instanties:
- Zijn er sinds de inwerkingtreding van de wijziging van de wet inzake de organisatie van de gewone rechtbanken in 2017 en in 2020 tuchtzaken tegen rechters en/of (vice)voorzitters geweest? Zo ja, wat was hiervoor de aanleiding en wat was de uitkomst?
- Hebben er sinds de inwerkingtreding van voornoemde wijzigingen van de wet inzake de organisatie van de gewone rechtbanken wijzigingen plaatsgevonden in de bezoldiging van (vice)voorzitters en rechters? Zo ja, wat was hiervoor de reden?
- Zijn er andere maatregelen betreffende (vice)voorzitters genomen, zoals hetverstrekken van ‘written remarks’ door de Minister van Justitie? Zo ja, wat was hiervoor de aanleiding? D. Ten aanzien van de “ law on the judiciary of 20 December 2019 ” die op 14 februari 2020 in werking is getreden Voor zover nog niet beantwoord naar aanleiding van de vraag onder A: is deze wetgeving nog (onverkort) van toepassing? De rechtbank verzoekt de Poolse uitvaardigende justitiële autoriteit deze vragen ten spoedigste te beantwoorden, zo nodig na om de bijstand van de centrale autoriteit of een van de centrale autoriteiten van de uitvaardigende lidstaat in de zin van artikel 7 van het kaderbesluit te hebben verzocht (zie ook het arrest van het HvJ van 5 april 2016, [naam 3] en [naam 4] , C‑404/15 en C‑659/15 PPU, EU:C:2016:198, punt 97). Deze vragen dienen door tussenkomst van de officier van justitie aan de uitvaardigende justitiële autoriteit te worden voorgelegd en binnen 3 (drie) weken na de uitspraak te worden beantwoord. De vervolgzitting zal binnen 2 (twee) weken na de ontvangst van de antwoorden van de uitvaardigende justitiële autoriteit plaatsvinden. Gelet op hetgeen hiervoor is overwogen, komt de rechtbank tot de volgende beslissing. 4Beslissing HEROPENT en SCHORST het onderzoek voor onbepaalde tijd, teneinde de antwoorden op de gestelde vragen af te wachten; BEVEELT de oproeping van de opgeëiste persoon tegen een nader te bepalen datum en tijdstip, met tijdige kennisgeving daarvan aan zijn advocaten. BEVEELT de oproeping van een tolk Pools tegen voornoemd nader te bepalen datum en tijdstip. Aldus gedaan door mr. A.K. Glerum, voorzitter, mrs. C. Klomp en M.E.M.
