20 In the reply to the statement of grounds, the EUTM proprietor submitted a judgment rendered on 10 February 2022 by the Court of Justice, the Hague. The judgment concerned the same parties and the same conflicting marks. It dealt with the question of whether Article 5

(1)(b) EUTMR. 21 The judgment concluded that the requirements of Article 5

(1)(b) EUTMR. 23 On 6 July 2022, the invalidity applicant informed the Board that the abovementioned judgment is currently under appeal. 24 In addition, the EUTM proprietor informed the Board on 4 July 2022 that the abovementioned judgment was a precautionary decision and that the EUTM proprietor was about to file a lawsuit against the invalidity applicant in the Netherlands to get, as the EUTM proprietor put it, ‘a main decision in this case’. 25 The Board finds it appropriate under the circumstances of the case to suspend the current appeal proceedings. 26 It is true that the pending national proceedings are not a sufficient reason in themselves to suspend the proceedings. As follows from Article 71
(1)(b) EUTMDR and case-law, the Board of Appeal in exercising its discretion, must take into account not only the interests of the party whose EU trade mark is contested, but also those of the other parties. The decision whether or not to suspend proceedings must follow upon a weighing of the competing interests (13/05/2020, T-443/18, Vogue Peek & Cloppenburg / Peek & Cloppenburg, EU:T:2020:1847, par. 111 and the case-law cited therein). 27 However, in the current case, the question whether the invalidity applicant can successfully rely on the non-registered Dutch right is crucial to both the application of Article 60
(1)(c) EUTMR in conjunction with Article 8
(4)EUTMR, and Article 59
(1)(b) EUTMR. 28 In particular, if it were to be confirmed that the requirements of Article 5

:162 of the Dutch Civil Code are not fulfilled and therefore the invalidity applicant does not have any earlier Dutch right to rely on, the current invalidity action could not be successful under Article 60

(1)(c) EUTMR in conjunction with Article 8
(4)EUTMR. Such a conclusion would also be of a significant importance for the assessment of Article 59
(1)(b) EUTMR. 29 Taking into account that there is uncertainty as to the outcome of the parallel national proceedings calling into question the existence of the earlier right, rendering a decision in the present cancellation proceedings before the Office without awaiting the outcome of the parallel proceedings, could potentially be seriously disadvantageous to the interest of both parties. 30 The Board recalls that is has already been established by the EU judicature that uncertainty in parallel proceedings is of relevance in, inter alia, opposition proceedings before the Office (28/05/2020, T-84/19 & T-88/19- T-98/19, We Intelligence the World (fig.) / DEVICE OF TWO OVERLAPPING CIRCLES (fig.) et al., EU:T:2020:231, par. 52). 31 In view of the foregoing considerations, the Board decides, pursuant to Article 71
(1)(a) EUTMDR, to suspend the appeal proceedings (see, by analogy, 31/01/2022, R 646/201-1, 5 HOT DICE (fig.) / HOT DICE (fig.) et al.). Conclusion 32 Under the above circumstances and after balancing the interests of both parties, for reasons of legal certainty, procedural economy, and sound administration, the Board deems it appropriate to suspend the present appeal proceedings, pursuant to Article 71
(1)(a) EUTMDR, until the national proceedings are terminated and a final judgment is rendered. ” (onderstreping rechtbank) 3.

Uit de hiervoor deels weergegeven beslissing van het EUIPO volgt dat de kamer van beroep van het EUIPO het in de omstandigheden van de zaak passend heeft geacht om de door Morpara bij haar aanhangige beroepsprocedure (in de door Morpara tegen het Uniemerk van HizliPara ingestelde nietigheidsvordering) te schorsen totdat er een in kracht van gewijsde gegaan vonnis is van de Nederlandse rechter waarin definitief wordt beslist over de vraag of Morpara zich met succes kan beroepen (jegens HizliPara) op een ouder (handelsnaam)recht in Nederland dan wel of sprake is van een depot te kwader trouw. Die vraag ligt niet enkel voor in de hiervoor onder 2.12 genoemde kortgedingprocedure, waarvan het hoger beroep nog aanhangig is, maar kan ook in de onderhavige procedure aan de orde worden gesteld (door het instellen van een vordering in reconventie). Blijkens punt 24 van de hiervoor deels weergegeven beslissing, heeft de kamer van beroep daar ook rekening mee gehouden. 3.
  2. Het ligt, gelet op de hiervoor besproken beslissing van het EUIPO, geenszins in de rede dat de rechtbank onderhavige procedure schorst. In dat geval zouden zowel de beroepsprocedure bij het EUIPO als de nationale procedure stilliggen. Bovendien is de rechtbank, met het EUIPO, van oordeel dat de Nederlandse rechter beter in staat is om te beslissen op de vraag of sprake is van een ouder recht van plaatselijke betekenis in de zin van artikel 60 lid 1 onder c in verbinding met artikel 8 lid 4 UMVo dan wel aanvullende werking van artikel 6:162 BW , op basis waarvan een oudere handelsnaam bescherming biedt tegen een jonger overeenstemmend merk dat tot verwarring leidt, in dit geval een grondslag biedt voor Morpara om zich tegen de geldigheid van het Uniemerk te verzetten. (De beantwoording van) die vraag is in de woorden van het EUIPO “ crucial ” voor de beoordeling van de bij hem voorliggende nietigheidsvorderingen. De rechtbank zal genoemde beslissing van het EUIPO tot schorsing van de beroepsprocedure in afwachting van een definitieve uitspraak van de Nederlandse rechter, daarom aanmerken als een bijzondere reden als bedoeld in artikel 132 lid 1 UMVo die noopt tot voortzetting van onderhavige procedure. 3.
  3. Uit het voorgaande volgt dat de rechtbank het incidentele verzoek tot schorsing zal afwijzen. 3.
  4. Morpara zal als de in dit incident in het ongelijk gestelde partij, worden veroordeeld in de proceskosten. HizliPara vordert vergoeding van kosten in het incident op de voet van artikel 1019h Rv waartoe zijn een specificatie van haar kosten heeft overlegd tot een bedrag van € 1.925,-. De kosten zullen op dit bedrag worden begroot omdat dit bedrag lager is dan het bedrag dat in de Indicatietarieven maximaal is voorzien als redelijk en evenredig voor een ‘normaal’ incident in een bodemzaak (€ 2.500). Nu dit niet is gevorderd in het incident, zal de kostenveroordeling niet uitvoerbaar bij voorraad worden verklaard. Voortgang van de procedure 3.
  5. De hoofdzaak zal worden verwezen naar de rol over zes weken voor het nemen van een conclusie van antwoord door Morpara. 4 De beslissing De rechtbank in het incident 4.
  6. wijst het verzoek tot schorsing af; 4.
  7. veroordeelt Morpara in de proceskosten, tot op heden aan de zijde van HizliPara begroot op € 1.925; in de hoofdzaak 4.
  8. bepaalt dat de zaak weer op de rol zal komen van 29 maart 2023 voor het nemen van een conclusie van antwoord aan de zijde van Morpara; 4.
  9. houdt iedere beslissing aan. Dit vonnis is gewezen door mr. M.E. Kokke en in het openbaar uitgesproken op 15 februari
