W imieniu Rzeczypospolitej Polskiej PREZYDENT RZECZYPOSPOLITEJ POLSKIEJ podaje do powszechnej wiadomości: W dniu 19 czerwca 1995 r. sporządzone zostały w Brukseli Umowa między Państwami - Stronami Traktatu Pół nocnoatlantyckiego a innymi państwami uczestniczącymi w Partnerstwie dla Pokoju , dotycząca statusu ich sił zbrojnych, oraz jej Protokół dodatkowy, w następującym brzmieniu: Przekfad UMOWA AGREEMENT między Państwami-Stronami Traktatu Północnoatlan tyckiego a innymi państwami uczestniczącymi w Partnerstwie dla Pokoju, dotycząca statusu ich sil zbrojnych among the States Parties to the North Atlantic Treaty and the other States participating in the Partnership for Peace regarding the status of their forces Państwa-Strony Traktatu Północnoatlantyckiego, Waszyngtonie dnia 4 kwietnia 1949 r., oraz państwa, które przyjmują zaproszenie do udziału w Partnerstwie dla Pokoju, wystosowane i podpisane przez głowy Państw i szefów Rządów Państw Członkowskich Organizacji Traktatu Północno atlantyckiego w Brukseli w dniu 10 stycznia 1994 r., i które podpisują się pod Dokumentem ramowym Partnerstwa dla Pokoju, The States Parties to the North Atlantic Treaty done in Washington on 4 April1949 and the States which accept the invitation to Partnership for Peace issued and signed by the heads of State and Government of the member States of the North Atlantic Treaty Orga nisation in Brussels on 10 January 1994 and which subscribe to the Partnership for Peace Framework Document; stanowiąc wspólnie państwa uczestniczące w Partnerstwie dla Pokoju; Constituting together the States participating in the Partnership for Peace; zważywszy, że siły zbrojne jednego z Państw-Stron niniejszej umowy mogą zostać wysłane i przyjęte, w drodze porozumień , na terytorium innego Państwa -Strony; Considering that the forces ot one State Party to the present Agreement may be sent and received, by arrangement, into the territory of another State Party; sporządzonego w mając na względzie , że decyzje o wysłaniu oraz dalszym ciągu przedmiotem odrębnych porozumień między zainteresowa nymi Państwami-Stronami; Bearing in mind that the decisions to send and to receive forces will continue to be the subject of separate arrangements between the States Parties concerned; pragnąc jednakże określić status sił zbrojnych podczas ich pobytu na terytorium innego Państwa - Strony; Desiring, however, to define the status of such forces while in the territory of another State Party; nawiązując do Umowy między Państwami-Strona mi Traktatu Północnoatlantyckiego dotyczącej statusu ich sił zbrojnych, sporządzonej w Londynie dnia 19 czerwca 1951 r. 1 ), Recalling the Agreement between the States Parties to the North Atlantic Treaty regarding the status of their forces, done at London on 19 June 1951; przyjęciu sił zbrojnych będą w 1) Zamieszczo nej na str. 3451 . Dziennik Ustaw Nr 97 - Poz. 605 3447 - uzgodniły, co następuje : Have agreed as follows: Artykuł I Article I Z wyjątkiem przypadków określonych w niniejszej umovyie oraz we wszelkich protokołach dodatkowych wiążących ich strony, wszystkie Państwa - Strony niniejszej umowy będą stosować postanowienia Umowy między Stronami Traktatu Północnoatlantyckiego dotyczącej statusu ich sił zbrojnych, sporządzonej w Londynie dnia 19 czerwca 1951 r., zwanej dalej NATO SOFA, tak jakby wszystkie Państwa-Strony niniejszej umowy były stronami NATO SOFA. Except as otherwise provided for in the present Agreement and any additional protocol in respect to its own parties, all States Parties to the present Agreement shall apply the provisions of the Agreement between Parties to the North Atlantic Treaty regarding the status of their forces, done at London on 19 June 1951, hereinafter referred to as the NATO SOFA, as if all States Parties to the present Agreement were parties to the NATO SOFA. (1)Oprócz obszaru, do którego stosuje się NATO SOFA, niniejsza umowa ma zastosowanie do terytorium wszystkich Państw-Stron niniejszej umowy nie będących stronami NATO SOFA.
(1)In addition to th e area to which the NATO SOFA applies the present Agreement shall apply to the territory of all States Parties to the present Agreement which are not parties to the NATO SOFA.
(2)Dla celów niniejszej umowy przyjmuje się, że odniesienia do obszaru Traktatu Północnoatlantyckie go w Umowie NATO SOFA dotyczą również terytoriów wymienionych w ust. 1 niniejszego artykułu, a odniesienia do Traktatu Północnoatlantyckiego dotyczą również Partnerstwa dla Pokoju.
(2)For the purposes of the present Agreement, references in the NATO SO FA to the North Atlantic Treaty area shall be deemed also to include the territories referred to in paragraph 1 ofthe present article, and references to the North Atlantic Treaty shall be deemed to include the Partnership for Peace. Artykuł III Article III Dla celów realizacji niniejszej umowy w kwestiach postanowienia NATO SOFA, które dotyczą przedsta wiania wniosków lub kwestii spornych Radzie Północ noatlantyckiej, Przewodniczącemu Rady Północno atlantyckiej lub jakiemukolwiek innemu arbitrowi, bę dą rozumiane jako wymagające od zainteresowanych stron prowadzenia negocjacji między sobą bez odwoływania się do jurysdykcji organów zewnętrznych. For purposes of implementing the present Agreement with respect to matters invo lving Parties that are not parties to the NATO SOFA, provisions ofthe NATO SOFA that provide for requests to be submitted, or differences to be referred to the North Atlantic Council, the chairman of the North Atlantic Council deputies or an arbitrator shall be construed to require the parties concerned to negotiate between or among themselves without recourse to any outside jurisdiction. (1)Niniejsza umowa jest otwarta do podpisu dla każdego państwa, które jest stroną NATO SOFA albo przyjmie zaproszenie do Partnerstwa dla Pokoju i podpisze Dokument ramowy Partnerstwa dla Pokoju.
(2)Niniejsza umowa podlega ratyfikacji, przyjęciu bądż zatwierdzeniu. Dokumenty ratyfikacji, przyjęcia bądź zatwierdzenia zostaną złożone Rządowi Stanów Zjednoczonych Ameryki, który każdorazowo powiado-

(2)The present Agreement shall be subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Government of the United States of America, which shall notify all signatory States of each such deposit.

Wypowiedzenie wejdzie w życie po upływie roku od otrzymania notyfikacji przez Rząd Stanów Zjednoczonych Ameryki. Po upływie tego okresu niniejsza umowa wygaśnie w odniesien iu do strony wypowiad a ją cej, co nie wpływa na uregulowanie zaległych roszczeń powstałych przed datą wejścia w życie wypowiedzenia, ale pozostanie ona w mocy w odniesieniu do pozostałych stron . T he present Agreement may be denounced by any party to t hi s A gree m ent by gi v ing written notification of de nun ciatio n t o the Gov ern m ent of th e United State s of Am eri ca, whic h wi ll notify all sig nato ry States of eac h such notification. The denunc iati on shall take effect one year after receipt ofthe notifi cat ion by the Govern ment of the United States of Ame ri ca. (2)The present Protocol shall be subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Government of the United States of America, which shall notify all signatory States of each such deposit.
(3)Niniejszy protokół wejdzie w życie po upływie 30 dni od złożenia dokumentu ratyfikacji, przyjęcia bądź zatwierdzenia przez trzy Państwa - Sygnatariuszy, z których przynajmniej jedno jest stroną NATO SOFA, a jedno - państwem, które przyjęło zaproszenie do uczestnictwa w Partnerstwie dla Pokoju i podpisało Dokument ramowy Partnerstwa dla Pokoju .
(3)The present protocol shall enter into force 30 days after the date of deposit of the instrument of rati fication, acceptance or approval by three signatory States, at least one of which is a party to the NATO SOFA and one of which is a state having accepted the invitation to join the Partnership for Peace and having subscribed to the Partnership for Peace Framework Document.
(4)Niniejszy protokół wejdzie w życie w stosunku do każdego innego Państwa-Sygnatariusza w dniu zło żenia dokumentu ratyfikacji, przyjęcia bądź zatwierdzenia Rządowi Stanów Zjednoczonych Ameryki.
(4)The present Protocol shall come into force in respect of each other signatory State on the date of the deposit of its instrument of ratification, acceptance or approval with the Government of the United States of America . Sporządzono w Brukseli dnia 19 czerwca 1995 r. w językach angielskim i francuskim, przy czym oba teksty są jednakowo autentyczne, w jednym egzempla rzu, który zostanie złożony w archiwach Rządu Stanów Zjednoczonych Ameryki. Rząd Stanów Zjednoczonych Ameryki przekaże uwierzytelnione kopie niniejszego protokołu wszystkim Państwom - Sygnatariuszom.
