W imieniu Rzeczypospolitej Polskiej PREZYDENT RZECZYPOSPOLITEJ POLSKIEJ podaje do powszechnej wiadomości: W dniu 4 grudnia 1991 r. w Londynie zostało podpisane Porozumienie o ochronie nietoperzy w Europie w następującym brzmieniu: Przekład: POROZUMIENIE AGREEMENT o ochronie nietoperzy w Europie on the conservation of bats in Europe Układające się Strony, The Contracting Parties nawiązując do Konwencji o ochronie wędrownych gatunków dzikich zwierząt, otwartej do podpisu w Bonn dnia 23 czerwca 1979 r., Recalling the Convention on the Conservation of Migratory Species of Wild Animals opened for sig nature in Bonn on 23 June 1979; uznając obecny stan zachowania nietoperzy w Europie oraz w pozaeuropejskich Państwach Strefy za niepomyślny - w szczególności poważne ich zagroże­ nie ze względu na: degradację ich środowisk naturalnych, niepokojenie ich w schronieniach oraz niektóre pestycydy, Recognising the unfavourable conservation status of bats in Europe and non-European Range States and in particular the serious threat to them from habitat degradation, disturbance of roosting sites and certain pesticides; świadome, że zagrożenia nietoperzy w Europie i w pozaeuropejskich Państwach Stefy wspólne są dla gatunków wędrownych i osiadłych oraz, że obie te grupy mogą zajmować jednocześnie te same schronienia, Conscious that the threats facing bats in Europe and non-European Range States are com mon to both migratory and non-migratory species and that roosts are often shared by migratory and non-migratory species; przypominając, że na pierwszej Konferencji Stron Konwencji o ochronie wędrownych gatunków dzikich zwierząt (Bonn, październik 1985 r.) uzgodniono, aby dodać do załącznika II konwencji europejskie gatunki Chiroptera (Rhinolophidae i Vespertilionidae) oraz że zobowiązano Sekretariat Konwencji, aby przedsię­ wziął odpowiednie kroki w celu opracowania porozumienia dotyczącego tych gatunków, Recalling that the first meeting of the Conference of the Parties to the Convention on the Conservation of Migratory Species of Wild Animals held in Bonn in October 1985 agreed to add European species of CHIROPTERA (Rhinolophidae and Vespertilionidae) to Appendix II of the Convention and instructed the Secretariat of the Convention to take appropriate measures to develop an Agreement for these species; przekonane, że zawarcie porozumienia dotyczące ­ go tych gatunków znacznie przyczyni się do polepszenia ochrony nietoperzy w Europie, Convinced that the conclusion of an Agreement for these species would greatly benefit the conservation of bats in Europe; uzgodniły, co następuje: Have agreed as follows: Artykuł I Article I Zakres i definicje Scope and Interpretation W rozumieniu niniejszego porozumienia: (

1. a)"Konwencja" oznacza Konwencję o ochronie wę­ drownych gatunków dzikich zwierząt (Bonn 1979); For the purposes of this Agreement: (
2. a)"Convention" means the Convention on the Conservation of Migratory Species of Wild Animals (Bonn 1979); - Dziennik Ustaw Nr 96 5185- Poz. 1112 (bl wyraz "nietoperze" oznacza europejską populację Chiroptera (Rhinolophidae i Vespertilionidae) występującą w Europie i w pozaeuropejskich Pań­ stwach Strefy; (
3. b)"Bats" means European populations of CHIROPTERA (Rhinolophidae and Vespertilionidae) occurring in Europe and non-European Range States; (
4. c)"Państwo Strefy" oznacza każde państwo (niezależnie od tego, czy jest ono stroną konwencji), które posiada jurysdykcję nad jakąkolwiek częścią strefy występowania któregokolwiek z gatunków objętych niniejszym porozumieniem; (
5. c)"Range State" means any State (whether or not it is a party to the Convention) that exercises jurisdiction over any part of the range of a species covered by this Agreement; (dl "Organizacja regionalnej integracji gospodarczej" oznacza organizację utworzoną przez suwerenne Państwa, do której stosuje się niniejsze Porozumienie, posiadającą uprawnienia w kwestiach w nim zawartych oraz odpowiednio upoważnioną, zgodnie z jej przepisami wewnętrznymi, do podpisania, ratyfikowania, przyjęcia lub zatwierdzenia niniejszego porozumienia albo przystąpienia do niego; (
6. d)"Regional Economic Integration Organisation" means an organisation constituted by sovereign States to which this Agreement applies and which has competence in respect of matters covered by this Agreement and has been duly authorised, in accordance with its internal procedures, to sign, ratify, accept, approve or accede to it; (
7. e)wyraz "Strony", jeśli z kontekstu nie wynika inaczej, oznacza Strony niniejszego porozumienia; (
8. e)"Parties" means, unless the context otherwise indicates, Parties to this Agreement; (
9. f)wyrazy"w Europie" oznaczają kontynent europejski. (
10. f)"In Europe" means the continent of Europe. Artykuł II Article II Postanowienia ogólne General Provisions 1. Niniejsze porozumienie jest porozumieniem w rozumieniu artykułu IV ust. 3 Konwencji. 1. This Agreement is an AGREEMENT within the meaning of paragraph 3 of Article IV of the Convention. 2. Przepisy niniejszego porozumienia nie zwalniają Stron z ich zobowiązań nałożonych przez jakiekolwiek inne istniejące traktaty, konwencje lub porozumienia. 2. The provisions of this Agreement shall not relieve Parties of their obligations under any existing treaty, convention or agreement. 3. Każda ze Stron niniejszego porozumienia wyznaczy jeden (lub więcej) właściwych organów, którym powierzy odpowiedzialność za wykonanie niniejszego porozumienia; Strony przekażą sobie nazwy oraz adresy tych organów. 3. Each Party to this Agreement shall designate one or more com petent authorities to whom it shall assig n responsibility for the implementation of this Agreement. It shall communicate the name and address of its authority or authorities to the other Parties to this Agreement. 4. Strony, w porozumieniu ze Stronami Konwencji, 4. Appropriate administrative and financial support for this Agreement shall be determined by its Parties in consultation wit h the Parties to the Convention. określą zasady administracyjnego i finansowego funk- cjonowania porozumienia. Artykuł III Article III Podstawowe zobowiązania Fundamental Obligations 1. Każda ze Stron zabroni celowego odłowu, przetrzymywania lub zabijania nietoperzy, chyba że właści­ wy organ wyda na to zgodę. 1. Each Party shall prohibit the deliberate capture, keeping or killing of bats except under permit from its competent authority. 2. Każda ze Stron wskaże te stanowiska na obszarze jej jurysdykcji, które są ważne dla utrzymania stanu zachowania i ochrony nietoperzy, w tym ich schronienia. Biorąc pod uwagę czynniki ekonomiczne i społeczne Strony będą chronić te miejsca przed zniszczeniem lub zakłócaniem w nich spokoju. Ponadto Strony 2. Each Party shall identify those sites within its own area of jurisdiction which are important for the conservation status, including for the shelter and protection, of bats. It shall, taking into account as necessary economic and social considerations, protect such sites from damage or disturbance. Przy określaniu, jakie obszary powinny podlegać ogólnemu programowi ochrony, każda ze Stron nada 3. When deciding which habitats to protect for general conservation purposes each Party shall give due weight to habitats that are important for bats. następnie odpowiednią rangę środowiskom ważnym dla nietoperzy. 4. Each Party shall take appropriate measures to promote the conservation of bats and shall promote public awareness of the importance of bat conservation. 5. Każda ze Stron wyznaczy właściwą i nstytucję odpowiedzialną za dostarczanie informacji na temat ochrony i kontroli nietoperzy na jej terytorium, zwłasz­ cza odnośnie do nietoperzy zamieszkujących budynki. Strony będą wymieniać doświadczenia w tym zakre- 5. Each Party shall assign to an appropriate body responsibilities for the provision of advice on bat conservation and management within its territory particularly wit h regard to bats in buildings. Parties shall exchange information on their experiences in this matter. sie. 6. Każda ze Stron podejmie dodatkowe działania, które uzna za konieczne, w celu zabezpieczenia tych populacji nietoperzy, które uzna za zagrożone, a następnie, zgodnie z artykułem VI, złoży sprawozdanie o podjętych działaniach. 6. Each Party shall take such additional action as it considers necessary to safeguard populations of bats which it identifies as being subject to threat and shall report under Article VI on the action taken. 7. Each Party shall, as appropriate, promote research programmes relating to the conservation and management of bats. Parties shall consult each other on such research program mes, and shall endeavour to co-ordinate such research and conservation programmes. 8. Each Party shall, wherever appropriate, consider the potential effects of pesticides on bats, when assessing pesticides for use, and shall endeavour to replace timber treatment chemicals which are highly toxic to bats with safer alternatives. chemiczne, stosowane w konserwacji drewna, innymi bezpieczniejszymi substancjami. Artykuł IV Article IV Wykonanie porozumienia na szczeblu krajowym Nationallmplementation 1. · Każda ze Stron przyjmuje i wprowadza takie prawne i administracyjne, które są konieczne dla wykonania niniejszego porozumienia. 1. Each Party shall adopt and enforce such legislative and administrative measures as may be necessary for the purpose of giving effect to this Agreement. 2. Postanowienia ninIejszego porozumienia w żaden sposób nie ograniczają prawa Stron do ustanawiania bardziej surowych zasad ochrony nietoperzy. 2. The provisions of this Agreement shall in no way affect the right of Parties to adopt stricter measures concerning the conservation of bats. Artykuł V Article V Spotkania Stron Meetings ot the Parties 1. Strony niniejszego porozumienia będą odbywały cykliczne spotkania. Nie później niż trzy lata po dacie wejścia w życie porozumienia Rząd Zjednoczonego Królestwa zwoła pierwsze spotkanie Stron. Strony 1. There shall be periodic meetings of the Parties to this Agreement. The Government of the United Kingdom shall cali the first meeting of the Parties to the Agreement not later than 3 years after the date of środki Dziennik Ustaw Nr 96 - 5187 - Poz. 1112 przyjmą regulamin spotkania oraz zasady finansowe, w tym budżet oraz skalę wpłat na przyszły okres finansowy. Dokumenty te przyjmuje się większością dwóch trzecich głosów Stron obecnych i głosujących. Decyzje dotyczące zasad finansowych wymagają większości trzech czwartych głosów Stron obecnych i głosują­ cych. entry into force of the Agreement. The Parties to the Agreement shall adopt rules of procedure for their meetings and financial rules, including the provisions on the budget and the scale of contributions for the next financial period. Such rules shall be adopted by a two-thirds majority of the Parties present and voting. Decisions taken under the financial rules shall require a three-quarters majority ofthe Parties present and voting. 2. Na sesjach Strony mogą utworzyć zespoły naukowe lub grupy robocze, jakie uznają za właściwe. 2. At their meetings the Parties may establish such scientific and other working groups as they see fit. 3. Państwa Strefy i organizacje regionalnej integracji gospodarczej nie będące Stronami porozumienia, a także Sekretariat Konwencji oraz Rada Europy jako Sekretariat Konwencji o ochronie dzikiej flory i fauny europejskiej oraz ich siedlisk naturalnych, a także inne podobne organizacje międzyrządowe, mogą być reprezentowane na sesjach Stron porozumienia przez obserwatorów. Każda instytucja lub organizacja posiadająca kwalifikacje techniczne w dziedzinie ochrony i kontroli nietoperzy, może być reprezentowana przez obserwatorów na sesjach Stron, chyba że sprzeciwi się temu co najmniej jedna trzecia obecnych Stron . Jedynie Stronom przysługuje prawo głosowania na sesjach Stron. 3. Any Range State or Regional Economic Integration Organisation not a Party to this Agreement, the Secretariat ofthe Convention, the Council of Europe in its capacity as the Secretariat ofthe Conventionon the Conservation of European Wildlife and Natural Habitats and similar intergovernmental organisations may be represented by observers at meetings of the Parties. Any agency or body technically qualified in the conservation and management of bats may be represented by observers at meetings of the Parties unless at least one-third of the Parties present object. Only Parties may vote at meetings of the Parties. 4. Z wyjątkiem sytuacji, o których mowa w ustę­ pie 5, każdej ze Stron porozumienia przysługuje jeden 4. Except as provided for in paragraph 5 below, each Party to this Agreement shall have one vote. głos. 5. Regional Economic Integration Organisations which are Parties to this Agreement shall, in matters within their competence, exercise their right to vote wit h a number of votes equal to the number of their Member States which are Parties to the Agreement and present at the time of the vote. A Regional Economic Integration Organisation shall not exercise its right to vote if its Member States exercise theirs, and vice versa. Artykuł VI Article VI Sprawozdania z wykonania porozumienia Reports on Implementation Na każdym spotkaniu Stron każda ze Stron przedstawi aktualne sprawozdanie z wykonania postanowień porozumienia. Sprawozdanie powinno być dostarczone pozostałym Stronom co najmniej na 90 dni przed rozpoczęciem spotkania. Each Party shall present to each meeting of the Parties an up-to-date report on its implementation of this Agreement. It shall circulate the report to the Parties not less than 90 days before the opening ofthe ordinary meeting . Artykuł VII Article VII Poprawki do porozumienia Amendment of the Agreement 1. Do porozumienia mogą być wprowadzane poprawki na każdej sesji Stron. 1. This Agreement may be amended at any meeting of the Parties. 2. Każda Strona może przedstawić projekt poprawki. 2. Proposais for amendment may be made by any Party. 3. Tekst jakiejkolwiek proponowanej poprawki wraz z uzasadnieniem powinien być zakomunikowany 3. The text of any proposed amendment and the reasons for it shall be communicated to the Depositary - Dziennik Ustaw Nr 96 Poz. 1112 5188- depozytariuszowi co najmniej na 90 dni przed rozpoczęciem sesji. Depozytariusz natychmiast przekaże kopie tekstu pozostałym Stronom. at least 90 days before the opening ofthe meeting. The Depositary shall transmit copies forthwith to the Parties. 4. Poprawki przyjmowane są większością dwóch trzecich głosów Stron obecnych i głosujących. W stosunku do tych Stron, które przyjęły poprawkę, wchodzi ona w życie po upływie 60 dni od złożenia depozytariuszowi piątego dokumentu przyjęcia poprawki. Po tym terminie poprawka wejdzie w życie w stosunku do Strony po upływie 30 dni od daty złożenia depozytariuszowi jej dokumentu przyjęcia poprawki. 4. Amendments shall be adopted by a two-thirds majority of the Parties present and voting and shall enter into force for those Parties which have accepted them 60 days after the deposit of the fifth instrument of acceptance of the amendment wit h the Depositary. Thereafter, they shall enter into force for a Party 30 days after the date of deposit of its instrument of acceptance of the amendment with the Depositary. Artykuł VIII Article VIII Zastrzeżenia Reservations Zgłaszanie ogólnych zastrzeżeń do przepisów niniejszego porozumienia nie jest dopuszczalne. Jednak jakiekolwiek Państwo Strefy lub organizacja regionalnej integracji gospodarczej, stając się Stroną, zgodnie z artykułami X lub XI, może złożyć szczegółowe zastrzeżenie dotyczące określonych gatunków nietoperzy. The provisions of this Agreement shal not be subject to general reservations. However, a Range State or Regional Economic Integration Organisation may, on becoming a Party in accordance wit h Articles X or XI, enter a specific reservation with regard to any particular species of bat. Artykuł IX Article IX Rozstrzyganie sporów Settlement of Disputes Jakiekolwiek spory, które mogą powstać między Stronami, dotyczące interpretacji lub stosowania postanowień niniejszego porozumienia, będą przedmiotem negocjacji pomiędzy Stronami biorącymi udział w sporze. Any dispute which may arise between Parties with respect to the interpretation or application of the provisions of this Agreement shall be subject to negotiation between the Parties involved in the dispute. Artykuł X Article X Podpisanie, ratyfikacja, przyjęcie i zatwierdzenie Signature, Ratification, Acceptance and Approval Niniejsze porozumienie jest otwarte do podpisu dla Państwa Strefy oraz dla organizacji regionalnej integracji gospodarczej, które mogą stać się Stroną poprzez: This Agreement shall be open to signature by Range States or Regional Economic Integration Organisations who may become Parties either by: (
11. a)podpisanie bez zastrzeżenia ratyfikacji, przyjęcia lub zatwierdzenia albo (
12. a)signature without reservation in respect of ratification, acceptance or approval; or (
13. b)ratyfikację, przyjęcie lub zatwierdzenie w przypadku podpisania z zastrzeżeniem ratyfikacji, przyję­ cia lub zatwierdzenia. (
14. b)signature with reservation in respect of ratification, acceptance or approval, folIowed by ratification, acceptance or approval. Dokumenty ratyfikacji, przyjęcia lub zatwierdzenia składane są depozytariuszowi. Instruments of ratification, acceptance or approval shall be deposited with the Depositary. Niniejsze porozumienie pozostaje otwarte do podpisu do dnia jego wejścia w życie. This Agreement shall remain open for signature until the date of entry into force of the Agreement. Artykuł XI Article XI Przystąpienie Accession Niniejsze porozumienie otwarte jest do przystą­ pienia dla Państw Strefy oraz organizacji regionalnej integracji gospodarczej po dacie jego wejścia w życie. This Agreement shall be open for accession by Range States or Regional Economic Integration Organisations after the date of entry into force of the Agre- - Dziennik Ustaw Nr 96 5189 - Poz. 1112 Dokumenty przystąpienia składa się depozytariuszowi. ement. Instruments of accession shall be deposited with the Depositary. Artykuł XII Article XII Wejście w życie Entry into Force Niniejsze porozumienie wejdzie w życie w dziedniu od daty, w której pięć Państw Strefy stanie się Stronami zgodnie z artykułem X. Następnie, dla państwa podpisującego je lub do niego przystępującego, porozumienie wejdzie w życie po upływie trzydziestu dni od złożenia jego dokumentu ratyfikacji, przyjęcia, zatwierdzenia lub przystąpienia. This Agreement shall enter into force on the ninetieth day following the date on which five Range States have become Parties in accordance wit h Article X. Thereafter it shall enter into force for asignatory or acceding State on the thirtieth day after the deposit of its instrument of ratification, acceptance, approval or accession . Artykuł XIII Article XIII Wypowiedzenie i wygaśnięcie Denunciation and Termination Każda ze Stron może wypowiedzieć niniejsze porozumienie składając depozytariuszowi pisemną notyfikację w dowolnym czasie. Wypowiedzenie wywoła skutek po upływie dwunastu miesięcy od daty otrzymania notyfikacji przez depozytariusza. Porozumienie pozostanie w mocy co najmniej przez dziesięć lat, a następnie wygaśnie w dniu, w którym pozostanie mniej niż pięć Stron porozumienia. Any Party may denounce this Agreement by written notification to the Depositary at any time. The denunciation shall take effect twelve months after the date on which the Depositary has received the notification. The Agreement shall remain in force for at least ten years, and thereafter shall terminate on the date on which there cease to be at least five Parties thereto. Artykuł XIV Article XIV Depozytariusz Depositary Oryginał porozumienia, sporządzony w językach angielskim, francuskim i niemieckim, którego każdy tekst jest jednakowo autentyczny, zostanie złożony Rządowi Zjednoczonego Królestwa, który będzie depozytariuszem i przekaże uwierzytelnione kopie niniejszego porozumienia wszystkim państwom i organizacjom regionalnej integracji gospodarczej, które podpisały porozumienie lub złożyły dokumenty ratyfikacji, przyjęcia, zatwierdzenia lub przystąpienia. The original of the Agreement, in English, French and German, each version being equally authentic, shall be deposited with the Government of the United Kingdom, which shall be the Depositary and shall transmit certified copies thereot to all States and any Regional Economic Integration Organisations that have signed the Agreement or deposited instruments ot ratification, acceptance, approval or accession. Depozytariusz poinformuje wszystkie Państwa Strefy oraz organizacje regionalnej integracji gospodarczej o podpisaniu porozumienia oraz o złożeniu dokumentów ratyfikacji, przyjęcia, zatwierdzenia lub przystąpienia, o wejściu w życie porozumienia i poprawek, a także o zastrzeżeniach i notyfikacjach wypowiedzenia. The Depositary shall inform all Range States and Regional Economic Integration Organisations ot signatures, deposit of instruments of ratification, acceptance, approval or accession, entry into torce ot this Agreement, amendments thereto, reservations and notifications of denunciation. więćdziesiątym Po zaznajomieniu się z powyższym porozumieniem, w imieniu Rzeczypospolitej Polskiej oświadczam, że: - porozumienie zostało uznane za słuszne w całości, jak i każde z postanowień w nim zawartych, - Rzeczpospolita Polska postanawia przystąpić do powyższego porozumienia, - porozumienie będzie niezmiennie zachowywane.
