(1)Celem niniejszej konwencji jest okreÊlenie zakresu odpowiedzialnoÊci Umawiajàcych si´ Stron, zasad organizacji i wspó∏pracy w ramach Korpusu oraz statusu jego Kwatery G∏ównej.
(1)The purpose of this Convention is to define the responsibilities of the Contracting Parties, the principles of organisation and co-operation in the Corps, and the status of its Headquarters.
(2)Porozumienia wykonawcze do niniejszej konwencji zostanà zawarte przez ministerstwa obrony.
(2)Implementing arrangements will be concluded by Ministries of Defence. - a)Corps. All elements as mentioned in Article 4 of this Convention including personnel, material and goods provided by the Contracting Parties due to the co-operation for common purposes.

- b)oraz ust´pach 2 i 3 niniejszej konwencji, ∏àcznie z personelem, sprz´tem i towarami dostarczonymi przez Umawiajàce si´ Strony w celu wspó∏pracy w ramach wspólnie wytyczonych celów;
- b)Headquarters. All elements as mentioned in Article 4 paragraph 1 lit.

- c)Agreement. The Agreement concerning Operation of the Multinational Corps Northeast. Artyku∏ 3 Article 3 Zadania i misje Tasks and Missions
(1)Zgodnie z konstytucjami narodowymi oraz z postanowieniami Karty Narodów Zjednoczonych, jak równie˝ decyzjami podj´tymi przez w∏aÊciwe organy Paƒstw uczestniczàcych, do zadaƒ Korpusu b´dzie nale˝eç:
(1)Within the limits of national constitutions and in accordance with the provisions of the Charter of the United Nations, pursuant to the decisions taken by the competent organs of the participating States, the Corps will be tasked:
- a)planowanie i dzia∏anie na rzecz wspólnych celów obronnych zgodnie z artyku∏em 5 Traktatu Pó∏nocnoatlantyckiego;
- a)to plan and operate for collective defence purposes under Article 5 of the North Atlantic Treaty;
- b)wnoszenie wk∏adu przez swojà Kwater´ G∏ównà w wielonarodowe operacje majàce na celu rozwiàzywanie sytuacji kryzysowych, ∏àcznie z misjami pokojowymi prowadzonymi w ramach Organizacji Narodów Zjednoczonych, Organizacji Traktatu Pó∏nocnoatlantyckiego bàdê innych regionalnych porozumieƒ na podstawie rozdzia∏u VIII Karty Narodów Zjednoczonych, jak np. Dowództwo Si∏ Làdowych w Po∏àczonych Si∏ach do Zadaƒ Specjalnych (CJTF) lub jak Dowództwo Wojsk; operacje te mogà byç przeprowadzane wraz z wojskami podleg∏ymi lub oddelegowanymi do Korpusu do tych celów;
- b)to contribute with its Headquarters within the framework of the United Nations, the North Atlantic Treaty Organisation, or regional arrangements pursuant to Chapter VIII of the Charter of the United Nations, to multinational crisis management operations including peace support operations, e.g. as a Land Component Command in a Combined Joint Task Force (CJTF) context or as a Force Command; these missions may be conducted with forces subordinated or added to the Corps for those purposes;
- c)planowanie i przygotowywanie przez swà Kwater´ G∏ównà, a na wezwanie — równie˝ prowadzenie misji humanitarnych i ratowniczych, ∏àcznie z misjami realizowanymi w czasie kl´sk ˝ywio∏owych.
- c)with its Headquarters to plan, prepare and on request to conduct humanitarian and rescue missions including natural disaster relief missions.
(2)Korpus zostanie podporzàdkowany NATO i jako taki zostanie w pierwszej kolejnoÊci wcielony do Sojuszniczych Si∏ Obszaru CieÊnin Ba∏tyku (BALTAP)/ Po∏àczonego Dowództwa Pó∏nocno-Wschodniego (JHQ NE) celem wspólnego szkolenia i çwiczeƒ. Korpus mo˝e byç wykorzystywany przez inne odpowiednie organizacje po ka˝dorazowym uprzednim uzgodnieniu przez w∏aÊciwe organy paƒstwowe.
(2)The Corps will be assigned to NATO and in this respect primarily affiliated to the Baltic Approaches (BALTAP)/Joint Headquarters Northeast (JHQ Northeast) for common training and exercise purposes. It may be made available to other relevant organisations on a case-by-case basis as decided by competent national authorities.
(3)Narodowe wk∏ady do Korpusu b´dà równie˝ dost´pne dla celów narodowych.
(3)National contributions to the Corps shall also be available for national purposes. Artyku∏ 4 Article 4 Struktura organizacyjna Korpusu Organisational Structure of the Corps
(1)Korpus b´dzie si´ sk∏adaç z: a) wielonarodowej Kwatery G∏ównej, tzn. Sztabu Korpusu, w tym wielonarodowego Plutonu Centrum
(1)The Corps will consist of;
- a)a multinational Headquarters, i.e. the Corps Staff, including a multinational Communications and In- Dziennik Ustaw Nr 21 — 1286 — Poz. 259 Systemów ¸àcznoÊci i Informacji (CISC) oraz Kompanii przy Kwaterze G∏ównej, zapewnionych przez Polsk´; formation Systems Centre (CISC) Platoon and the Headquarters Company provided by Poland;
- b)wielonarodowej Brygady Wspomagania Dowodzenia przy Kwaterze G∏ównej, zintegrowanej w czasie pokoju z g∏ównym zespo∏em Sztabu Korpusu (G6); oraz
- b)the multinational Command Support Brigade Headquarters, in the peacetime establishment integrated with a nucleus in the Corps Staff (G 6); and
- c)innych wk∏adów narodowych wyznaczonych do Korpusu zgodnie z Porozumieniem lub udost´pnianych Korpusowi przez Umawiajàce si´ Strony w poszczególnych przypadkach.
- c)national contributions assigned to the Corps as laid down in the Agreement or made available to it by the Contracting Parties on a case-by-case basis.
(2)Korpus b´dzie wspomagany przez wspólnie z nim stacjonujàce Centrum Koordynacji Dzia∏aƒ Powietrznych (AOCC) i Morskà Komórk´ ¸àcznikowà (MLC).
(2)The Corps will be supported by a collocated Air Operations Co-ordination Centre (AOCC) and a Maritime Liaison Cell (MLC).
(3)Wk∏ady narodowe do Kwatery G∏ównej b´dà wspierane przez narodowe komponenty wspomagajàce (NSE).
(3)The national contributions to the Headquarters will be supported by national support elements (NSE). Artyku∏ 5 Article 5 J´zyk Language J´zyk angielski b´dzie oficjalnym j´zykiem roboczym Korpusu. English shall be the official working language of the Corps. Artyku∏ 6 Article 6 Status prawny Legal Status
(1)Postanowienia Umowy NATO SOFA b´dà mieç zastosowanie do Kwatery G∏ównej oraz do jej personelu wojskowego i cywilnego, a tak˝e do cz∏onków ich rodzin. W odniesieniu do personelu oraz sprz´tu Korpusu postanowienia Umowy NATO SOFA, a tak˝e innych obowiàzujàcych umów dotyczàcych wizytujàcych si∏ zbrojnych stosuje si´ uzupe∏niajàco do postanowieƒ niniejszej konwencji; w innych sytuacjach postanowienia te stosowaç si´ b´dzie bez zmian.
(1)The provisions of the NATO SOFA shall apply to the Headquarters and to its military and civilian personnel and their dependents. As far as personnel and materiel of the Corps are concerned, the NATO SOFA and other existing visiting forces agreements are supplemented by this Convention but remain otherwise unaffected.
(2)W celu zastosowania postanowieƒ Umowy NATO SOFA do Kwatery G∏ównej poj´cia: „si∏y zbrojne”, „personel cywilny” oraz „cz∏onek rodziny”, ilekroç wyst´pujà w Umowie NATO SOFA, b´dà oznaczaç:
(2)For the purpose of applying the provisions of the NATO SOFA to the Headquarters the expressions ”force”, ”civilian component” and ”dependent”, wherever they occur in the NATO SOFA shall have the meanings set out below:
- a)„si∏y zbrojne” — przydzielony Kwaterze G∏ównej personel, który wchodzi w sk∏ad wojsk làdowych, morskich lub powietrznych którejkolwiek z Umawiajàcych si´ Stron;
- a)”force” means the personnel attached to the Headquarters who belong to the land, sea or air armed services of any Contracting Party;
- b)„personel cywilny” — pracowników cywilnych nie b´dàcych bezpaƒstwowcami ani obywatelami jakiegokolwiek Paƒstwa, które nie jest Umawiajàcà si´ Stronà niniejszej konwencji, ani te˝ obywatelami bàdê osobami zamieszka∏ymi na sta∏e w Paƒstwie przyjmujàcym, przydzielonych do Kwatery G∏ównej i zatrudnionych w s∏u˝bach si∏ zbrojnych Paƒstwa uczestniczàcego.
- b)”civilian component” means civilian personnel who are not stateless persons, nor nationals of any State which is not a Contracting Party, nor nationals of, nor ordinarily resident in the Receiving State and who are attached to the Headquarters and in the employ of an armed service of a participating State;
- c)„cz∏onek rodziny” — wspó∏ma∏˝onka lub wspó∏ma∏˝onk´ cz∏onka si∏ zbrojnych lub personelu cywilnego, o którym mowa w literach
- a)i
- b)niniejszego ust´pu, albo dziecko b´dàce na jego lub jej utrzymaniu.
- c)”dependent” means the spouse of a member of a force or civilian component, as defined in sub-paragraphs
- a)and

(3)Kwatera G∏ówna oznacza si∏y zbrojne dla celów artyku∏u II, artyku∏u V ust´p 2, artyku∏u VII ust´p 10, artyku∏u VIII ust´p 5, artyku∏u IX ust´py 2, 3, 4, 7 i 8 oraz artyku∏u XIII Umowy NATO SOFA.
(3)The Headquarters shall be considered to be a force for the purposes of Article II, paragraph 2 of Article V, paragraph 10 of Article VII, paragraph 5 of Article VIII, paragraphs 2, 3, 4, 7 and 8 of Article IX, and Article XIII of NATO SOFA. - a)(z wy∏àczeniem cz´Êci Kompanii przy Kwaterze G∏ównej odpowiedzialnych za administracj´, ochron´ oraz zarzàdzanie koszarami), ust´p 1 litera
- b)oraz ust´p 2, podczas pe∏nienia obowiàzków s∏u˝bowych lub s∏u˝bowego korzystania z dowolnego sprz´tu przez wy˝ej wymienione osoby, powodujàcych szkody, b´dà ponoszone w równych cz´Êciach przez Umawiajàce si´ Strony oraz wyp∏acane ca∏kowicie z Wielonarodowego Bud˝etu, okreÊlonego w artykule 10. Claims of third parties, other than contractual claims, arising out of acts or omissions of members of the elements of the Corps mentioned in Article 4 paragraph 1 lit.
- a)(excluding the elements of the Headquarter Company which are responsible for the administration, guarding and management of the barracks), paragraph 1 lit.
- b)and paragraph 2, done in performance of official duty or arising out of the official use of any materiel used by these elements and causing damage, shall be equally shared by the Contracting Parties and paid entirely from the Multinational Budget, as defined in Article 10. Artyku∏ 8 Article 8 Zwolnienia podatkowe Exemption from Taxation
(1)Postanowienia artyku∏u X Umowy NATO SOFA w sprawie zwolnieƒ z podatków od wynagrodzeƒ oraz uposa˝eƒ cz∏onków si∏ zbrojnych i personelu cywilnego majà zastosowanie do personelu Kwatery G∏ównej otrzymujàcego uposa˝enie lub wynagrodzenie od si∏ zbrojnych, w których pe∏nià s∏u˝b´ lub w których sà zatrudnieni, z zastrze˝eniem ˝e ust´p powy˝szy nie zwalnia wymienionych wy˝ej cz∏onków si∏ zbrojnych lub personelu cywilnego od podatków na∏o˝onych przez Paƒstwo wysy∏ajàce.
(1)The exemption from taxation accorded under Article X of NATO SOFA to members of a force or civilian component in respect of their salaries and emoluments shall apply, as regards personnel of the Headquarters to salaries and emoluments paid to them as such personnel by the armed service to which they belong or by which they are employed, except that this paragraph shall not exempt any such member or employee from taxation imposed by the sending State.
(2)W celu u∏atwienia ustanowienia, zbudowania, utrzymania oraz dzia∏alnoÊci Kwatery G∏ównej obcià˝enia z tytu∏u ce∏ i podatków od towarów i us∏ug wykorzystywanych do tych celów zostanà zawieszone tak dalece, jak to mo˝liwe. Szczegó∏y zostanà uregulowane w drodze porozumienia mi´dzy Kwaterà G∏ównà a w∏aÊciwymi organami polskimi.
(2)For the purpose of facilitating the establishment, construction, maintenance and operation of the Headquarters duties and taxes for goods and services related thereto shall be waived as far as practicable. Details shall be regulated in an arrangement between the Headquarters and the competent Polish authorities.
(3)Towary i us∏ugi wwiezione przez personel Kwatery G∏ównej oraz cz∏onków rodzin na w∏asne potrzeby b´dà zwolnione z ce∏ i podatków. Rodzaje i iloÊci tych towarów oraz us∏ug zostanà okreÊlone w porozumieniu mi´dzy Kwaterà G∏ównà a w∏aÊciwymi organami polskimi.
(3)Goods and services imported by the personnel of the Headquarters or their dependents for their own private consumption or use shall be exempted from any duties and taxes. Types and quantities of these goods and services shall be specified in an arrangement between the Headquarters and the competent Polish authorities.
(4)Towary i us∏ugi wwiezione przez Kwater´ G∏ównà na jej potrzeby oraz sprzedawane w mesach, kantynach i barach Kwatery G∏ównej b´dà zwolnione z wszelkich ce∏ i podatków. Rodzaje i iloÊci tych towarów oraz us∏ug zostanà okreÊlone w porozumieniu mi´dzy Kwaterà G∏ównà a w∏aÊciwymi organami polskimi.
(4)Goods and services imported by the Headquarters for the use of the Headquarters or to be sold in messes, canteens and bars operating in the Headquarters shall be exempted from any duties and taxes. Types and quantities of these goods and services shall be specified in an arrangement between the Headquarters and the competent Polish authorities.
(5)Nadwy˝ka oraz zu˝yty sprz´t wwieziony lub dostarczany do Kwatery G∏ównej zwolniony z ce∏ i podatków mo˝e zostaç sprzedany lub przekazany innym
(5)Surplus and used equipment imported or procured by the Headquarters free of taxes or duties may be sold or otherwise made available to other users on- Dziennik Ustaw Nr 21 — 1288 — Poz. 259 u˝ytkownikom zgodnie z obowiàzujàcymi przepisami Paƒstwa przyjmujàcego. ly in accordance with applicable provisions of the Receiving State.
(6)Postanowienia zawarte w artykule XI ust´py 5 i 6 Umowy NATO SOFA nie majà zastosowania do obywateli Paƒstwa przyjmujàcego, chyba ˝e obywatele ci nale˝à do si∏ zbrojnych Paƒstwa uczestniczàcego innego ni˝ Paƒstwo przyjmujàce.
(6)The provisions in paragraphs 5 and 6 of Article XI of NATO SOFA shall not apply to nationals of the Receiving State, unless such nationals belong to the armed services of a participating State other than the Receiving State.
(7)Poj´cie „c∏a i podatki” nie obejmuje op∏at za wyÊwiadczone us∏ugi.
(7)The expression ”duties and taxes” does not include charges for services rendered. Artyku∏ 9 Article 9 Rachunki bankowe Accounts
(1)W celu u∏atwienia wykonywania Wielonarodowego Bud˝etu Kwatera G∏ówna mo˝e posiadaç dowolne waluty, a tak˝e prowadziç rachunki w dowolnej walucie.
(1)To enable it to operate the Multinational Budget, the Headquarters may hold currency of any kind and operate accounts in any currency.
(2)Umawiajàce si´ Strony u∏atwià przelew Êrodków Kwatery G∏ównej z jednego kraju do drugiego oraz wymian´ dowolnej waluty, b´dàcej w posiadaniu Kwatery G∏ównej, na dowolnà innà walut´, ilekroç zajdzie potrzeba zaspokojenia potrzeb Kwatery G∏ównej w tym zakresie.
(2)The Contracting Parties shall facilitate transfers of the funds of the Headquarters from one country to another and the conversion of any currency held by the Headquarters into any other currency, when necessary to meet the requirements of the Headquarters.
(3)Konta bankowe Kwatery G∏ównej mogà byç zwolnione z wewn´trznych przepisów dewizowych oraz z wszelkich krajowych Êrodków bezpieczeƒstwa dotyczàcych kont bankowych zgodnie z porozumieniem zawartym mi´dzy bankiem a Kwaterà G∏ównà.
(3)The bank accounts of the Headquarters can be exempted from national currency regulations, and from any emergency measures against bank accounts according to an agreement concluded between the bank and the Headquarters. Artyku∏ 10 Article 10 Wielonarodowy Bud˝et Multinational Budget
(1)Dla elementów sk∏adowych Korpusu wymienionych w ust´pie 2 niniejszego artyku∏u zostanie utworzony Wielonarodowy Bud˝et o równych udzia∏ach. Zakres i finansowanie Wielonarodowego Bud˝etu b´dzie uzgadniane corocznie przez Ministerstwa Obrony zgodnie z przepisami wewn´trznymi.
(1)There shall be an equally shared Multinational Budget for the elements of the Corps mentioned in paragraph 2. The scope and funding of the Multinational Budget shall be agreed upon annually by the Ministries of Defence in accordance with national provisions.

- a)(z wy∏àczeniem cz´Êci Kompanii przy Kwaterze G∏ównej odpowiedzialnych za administracj´, ochron´ i zarzàdzanie koszarami), ust´p 1 litera
- b)oraz ust´p 2.
(2)The elements of the Corps which are to be funded equally by the Contracting Parties are those defined in Article 4 paragraph 1 lit.
- a)(excluding the elements of the Headquarters Company which are responsible for the administration, guarding, and management of the Barracks), paragraph 1 lit.
- b)and paragraph 2.
(3)Do administracji i gospodarki finansowej Korpusu b´dà mieç zastosowanie przepisy obowiàzujàce w NATO, chyba ˝e Umawiajàce si´ Strony postanowià inaczej.
(3)The principles established in current NATO rules and regulations for administration and financial management shall apply, as far as not otherwise agreed.
(4)Wykonanie Wielonarodowego Bud˝etu i wielonarodowych rozliczeƒ b´dzie corocznie kontrolowane przez w∏aÊciwe krajowe instytucje kontrolne na zasadzie rotacji. CzynnoÊci te b´dà obejmowaç aspekty finansowe i wykonawcze i oparte b´dà na wzajemnie przyj´tych procedurach.
(4)The execution of the Multinational Budget and the multinational accounts shall be audited annually by the competent national audit institutions on a rotational basis. The audit includes financial and performance aspects. The auditing shall be based on mutually accepted auditing standards and procedures.

(1)W imieniu Paƒstw uczestniczàcych Kwatera G∏ówna b´dzie posiada∏a zdolnoÊç do:
(1)The Headquarters shall have the capacity on behalf of the participating States:
- a)zawierania umów;
- a)to enter into contracts;
- b)nabywania i sprzedawania rzeczy ruchomych oraz
- b)to acquire and dispose of movable property; and
- c)wnoszenia, rozwa˝ania i rozpatrywania lub rozstrzygania roszczeƒ.
- c)to file, consider and settle or adjudicate claims in this respect.
(2)Umowy dotyczàce wspólnych celów obcià˝ajàce Wielonarodowy Bud˝et b´dà zawierane, wraz z wynikajàcymi z nich skutkami prawnymi, w imieniu Paƒstw uczestniczàcych. W oparciu o potrzeby przedstawione przez Dowódc´ Korpusu uprawnione organy narodowe b´dà wspó∏pracowaç w tym zakresie za wspólnà zgodà.
(2)Contracts for combined purposes debited to the Multinational Budget shall be concluded, with ensuing legal effect, for the participating States. Based on the requirements submitted by the Commander of the Corps the competent national authorities shall co-operate by common consent.
(3)Wszelkie aktywa finansowane z Wielonarodowego Bud˝etu stanà si´ wspólnà w∏asnoÊcià Paƒstw uczestniczàcych. Przepisy i procedury, regulujàce zbywanie wspólnej w∏asnoÊci, zostanà ustanowione w drodze oddzielnych porozumieƒ.
(3)All assets financed from the Multinational Budget shall become joint property of the participating States. The provisions and procedures which govern the disposal of joint property shall be laid down in separate arrangements.
(4)W przypadku wszcz´cia procedur prawnych w zwiàzku z umowami, o których mowa w ust´pie 1 niniejszego artyku∏u, Paƒstwo przyjmujàce b´dzie odpowiedzialne za reprezentacj´ prawnà. W paƒstwach trzecich Paƒstwo, którego obywatelem jest osoba upowa˝niona do zawierania umów, przyjmie na siebie powy˝szà odpowiedzialnoÊç. Koszty post´powania b´dà pokrywane z Wielonarodowego Bud˝etu.
(4)If legal proceedings are initiated as a result of the contracts identified in paragraph 1 above, the Receiving State shall assume responsibility for legal representation. In third countries the State of which the person authorised to conclude contracts is a national shall assume this responsibility. Costs of legal proceedings shall be borne by the Multinational Budget.
(5)Wszelkie koszty wynikajàce z lub powsta∏e w zwiàzku z umowami wymienionymi w ust´pie 1 niniejszego artyku∏u b´dà pokrywane z Wielonarodowego Bud˝etu.
(5)All costs resulting from or relating to the contracts as mentioned in paragraph 1 shall be borne by the Multinational Budget. The archives and other official documents of the Headquarters kept in premises used by the Headquarters or in the possession of any properly authorised member of the Headquarters shall be inviolable, unless the Headquarters has waived this immunity. The Headquarters shall, at the request of the Receiving State and in the presence of a representative of that State, verify the nature of any documents to confirm that they are entitled to immunity under this Article. - a)urz´dnicy, w tym celnicy i inspektorzy urz´dów pracy, którzy zgodnie z prawem Paƒstwa przyjmujàcego sà uprawnieni do wchodzenia na teren siedziby w celu wykonania swoich czynnoÊci s∏u˝bowych, mogà skorzystaç z tego prawa po uprzednim uzyskaniu upowa˝nienia od Dowódcy bàdê jego przedstawiciela;
- a)Officials, including customs officers and labour inspectors, entitled under the law of the Receiving State to enter the premises for the purposes of performing their official functions shall do so only if duly authorised by the Commander or his representative;
- b)w nag∏ych przypadkach lub na podstawie decyzji wydanej przez w∏aÊciwy organ prowadzàcy dochodzenie upowa˝nienie takie mo˝e byç wydane osobom, które majà prawo do wejÊcia na teren pomieszczeƒ lub instalacji w takich przypadkach.
- b)In cases of emergency, or by virtue of an order issued by an investigating magistrate, such authorisation shall be given to such persons as are entitled to enter premises or installations in such cases.
(3)Kwatera G∏ówna podejmie wszelkie mo˝liwe dzia∏ania, aby chroniç swojà siedzib´ przed u˝yciem jej jako miejsca schronienia osób unikajàcych aresztowania zgodnie z prawem Paƒstwa przyjmujàcego, w stosunku do których Paƒstwo przyjmujàce wyda∏o nakaz ekstradycji bàdê wydalenia do innego kraju lub które uchylajà si´ od wyroku sàdowego.
(3)The Headquarters will take all feasible measures to prevent its premises from being used as a refuge by persons who are avoiding arrest under any law of the Receiving State, who are requested by the Receiving State for extradition or expulsion to another country or who are endeavouring to avoid service of legal process. (1)W porozumieniu z w∏aÊciwymi organami Paƒstwa przyjmujàcego w odniesieniu do lokalizacji i parametrów technicznych sprz´tu Kwatera G∏ówna ma prawo wwoziç, tworzyç, mieç dost´p do, eksploatowaç oraz utrzymywaç, tymczasowo bàdê na sta∏e, na terenie lub poza terenem swojej siedziby, wszelkie obiekty telekomunikacyjne oraz wojskowe stacje radiowe niezb´dne do pe∏nienia funkcji operacyjnych, prowadzenia çwiczeƒ wojskowych, manewrów lub potrzebne w sytuacjach wyjàtkowych.
(1)In agreement with the appropriate authorities of the Receiving State regarding locations and technical details of equipment, the Headquarters may import, establish, access, operate and maintain, on either a temporary or permanent basis, inside or outside the premises occupied by it, such telecommunications facilities and military radio stations as may be required for its operational functions, military exercises, manoeuvres or emergencies.
(2)U˝ywane pasma cz´stotliwoÊci zostanà uzgodnione z organami Paƒstwa przyjmujàcego. Organy Paƒstwa przyjmujàcego oraz Kwatera G∏ówna podejmà dzia∏ania w celu unikni´cia lub wyeliminowania interferencji z urzàdzeniami ∏àcznoÊci wojskowej i cywilnej oraz elektrycznymi.
(2)The frequencies to be used will be agreed with the authorities of the Receiving State. The authorities of the Receiving State and the Headquarters will take measures to avoid or eliminate interference with military and civilian telecommunication services and electrical facilities.
(3)Wojskowe stacje radiowe oraz telekomunikacyjne nale˝àce do Kwatery G∏ównej mogà byç u˝ywane wy∏àcznie w celach s∏u˝bowych.
(3)Military radio and telecommunications stations of the Headquarters will be used exclusively for official purposes.
(4)Kryteria, przepisy i stawki wynagrodzenia za prac´ oraz us∏ugi operatorów telekomunikacyjnych nie powinny byç mniej korzystne ni˝ stosowane do Si∏ Zbrojnych Paƒstwa przyjmujàcego.
(4)The criteria, regulations and rates for work and services of the telecommunications operators shall not be less favourable than those applied to the Armed Services of the Receiving State.
(5)Przy tworzeniu i eksploatacji obiektów telekomunikacyjnych Kwatera G∏ówna powinna przestrzegaç postanowieƒ Mi´dzynarodowej Konstytucji Telekomunikacyjnej oraz Konwencji z dnia 22 grudnia 1992 r., jak równie˝ wszelkich innych mi´dzynarodowych przepisów dotyczàcych telekomunikacji obowià-
(5)In establishing and operating telecommunications facilities, the Headquarters shall observe the provisions of the International Telecommunications Constitution and Convention, of 22 December 1992, and of any other international provision in the field of telecommunications binding in the Receiving State. Headquarters shall be exempt from this provision to the extent that such exemption is granted to the Armed Forces of the Receiving State.

(6)The Headquarters shall be entitled to send and receive messages in cipher. Artyku∏ 15 Article 15 Us∏ugi pocztowe Postal Services
(1)Korespondencja s∏u˝bowa Kwatery G∏ównej mo˝e byç wysy∏ana za poÊrednictwem placówek pocztowych lub us∏ug kurierskich bàdê te˝ przy u˝yciu wewn´trznych kana∏ów wojskowych. O ile jest to konieczne, korespondencja ta powinna byç zwolniona z op∏aty pocztowej na tej samej zasadzie co korespondencja Si∏ Zbrojnych Paƒstwa przyjmujàcego.
(1)The Headquarters official mail may be sent through the postal or courier services of the Receiving State or through national military channels. Where appropriate, it shall be exempt from prepaid postage in the same way as mail sent by the Armed Forces of the Receiving State.
(2)Wszelka korespondencja wysy∏ana pocztà oraz przesy∏ki kurierskie oznaczone jako s∏u˝bowe, zarówno otrzymywane, jak i wysy∏ane przez Kwater´ G∏ównà, powinny byç zwolnione z kontroli celnej oraz cenzury. Tego typu korespondencja lub materia∏y muszà byç oznakowane w nast´pujàcy sposób: „Korespondencja s∏u˝bowa Kwatery G∏ównej Wielonarodowego Korpusu Pó∏nocno-Wschodniego”. Przesy∏ki kurierskie nie b´dà wysy∏ane za poÊrednictwem cywilnych urz´dów pocztowych Paƒstwa przyjmujàcego.
(2)All mail and courier material which is certified as being official and which is addressed to or sent by the Headquarters shall be exempt from customs examinations and censorship. Such mail or material will be marked with the term ”Headquarters, Multinational Corps Northeast Official Mail”. Courier mail will not be sent through civilian postal services of the Receiving State. (1)Przepisy dotyczàce ruchu drogowego Paƒstwa przyjmujàcego b´dà mieç zastosowanie do s∏u˝bowych pojazdów i przyczep nale˝àcych do Kwatery G∏ównej oraz do prywatnych pojazdów i przyczep si∏ zbrojnych, personelu cywilnego oraz cz∏onków rodzin, z zastrze˝eniem poni˝szych postanowieƒ.
(1)The traffic regulations of the Receiving State shall apply to the official vehicles and trailers of the Headquarters and to private vehicles and trailers of members of the force, civilian component and dependents, subject to the following provisions.
(2)Tablice rejestracyjne na pojazdach i przyczepach s∏u˝bowych nale˝àcych do Kwatery G∏ównej powinny byç wystawiane przez Kwater´ G∏ównà. Powy˝sze pojazdy i przyczepy s∏u˝bowe nie podlegajà przepisom Paƒstwa przyjmujàcego odnoÊnie do obowiàzkowego ubezpieczenia pojazdów samochodowych przez ich w∏aÊcicieli.
(2)The licence plates for official vehicles and trailers of the Headquarters shall be issued by the Headquarters. These official vehicles and trailers shall not be subject to regulations of the Receiving State concerning compulsory insurance of holders of motor vehicles.
(3)Pojazdy i przyczepy s∏u˝bowe nale˝àce do Kwatery G∏ównej b´dà traktowane tak samo jak pojazdy Polskich Si∏ Zbrojnych pod wzgl´dem op∏at za korzystanie z dróg.
(3)Official vehicles and trailers of the Headquarters shall receive the same treatment as service vehicles of the Polish Armed Forces with regard to fees and tolls for road use.
(4)W∏aÊciwe organy paƒstwa przyjmujàcego powinny zwolniç pojazdy samochodowe i przyczepy nale˝àce do Kwatery G∏ównej z obowiàzku przestrzegania przepisów obowiàzujàcych w Paƒstwie przyjmujàcym w sprawie konstrukcji, projektowania i wyposa˝enia pojazdów samochodowych i przyczep, z odpowiednim poszanowaniem bezpieczeƒstwa i porzàdku publicznego, jeÊli takie zwolnienie jest niezb´dne do pe∏nienia funkcji przez Kwaterà G∏ównà.
(4)The competent authorities of the Receiving State shall, in respect of motor vehicles and trailers of the Headquarters, grant exemptions from regulations of the Receiving State concerning the construction, design and equipment of motor vehicles and trailers, with due regard to public safety and order, if such exemption is necessary for the fulfilment of the functions of the Headquarters.

(1)Tajne dokumenty NATO b´dàce w posiadaniu Korpusu powinny byç traktowane i chronione zgodnie z odpowiednimi przepisami NATO w sprawie bezpieczeƒstwa danych.
(1)NATO classified material within the Corps shall be treated and protected in accordance with applicable NATO security provisions.
(2)Kwatera G∏ówna opracuje wspólne przepisy wykonawcze w zakresie bezpieczeƒstwa, w tym bezpieczeƒstwa informatycznego (IT Security), które b´dà podlegaç zatwierdzeniu przez w∏aÊciwe organy paƒstwowe.
(2)The Headquarters will develop common implementing regulations in the field of security including security of information technology (IT Security) for approval by competent national authorities.
(3)Umawiajàce si´ Strony b´dà wspó∏pracowaç przy wprowadzaniu w ˝ycie postanowieƒ niniejszego artyku∏u oraz wspomagaç si´ nawzajem w przestrzeganiu ich stosowania.
(3)The Contracting Parties shall co-operate in the implementation of this Article and support each other in assuring its application. Artyku∏ 18 Article 18 Ochrona danych osobowych Personal Data Protection
(1)Dane osobowe b´dà przekazywane i przetwarzane wy∏àcznie w celach przewidzianych w Umowie NATO SOFA oraz w niniejszej konwencji. Nale˝y przestrzegaç ograniczeƒ obowiàzujàcych w prawodawstwie Umawiajàcej si´ Strony dostarczajàcej informacji. Umawiajàce si´ Strony uzgodnià wspólne przepisy w sprawie zbierania, przetwarzania i u˝ywania danych osobowych.
(1)Personal data shall be passed and processed solely for the purposes envisaged in the NATO SOFA and in this Convention. Restrictions in possible applications based on the legislation of the Contracting Party supplying the information shall be observed. The Contracting Parties shall agree on common regulations on collection, processing and use of personal data.
(2)Niniejszy artyku∏ nie b´dzie stanowiç zobowiàzania dla którejkolwiek z Umawiajàcych si´ Stron, polegajàcego na podj´ciu dzia∏aƒ b´dàcych w sprzecznoÊci z jej prawem lub jej ˝ywotnymi interesami w sferze bezpieczeƒstwa paƒstwa lub bezpieczeƒstwa publicznego.
(2)This Article shall not impose an obligation on the Contracting Parties to carry out measures which would contravene its laws or conflict with its predominant interests with regard to the protection of the security of the State or of public safety. Artyku∏ 19 Article 19 Rozstrzyganie sporów Settlement of Disputes Wszelkie spory dotyczàce interpretacji lub stosowania postanowieƒ niniejszej konwencji powinny byç rozstrzygane w drodze negocjacji mi´dzy Umawiajàcymi si´ Stronami bez odwo∏ywania si´ do stron trzecich. Wspólne doÊwiadczenia i praktyka wynikajàce ze stosowania postanowieƒ Protoko∏u w sprawie statusu mi´dzynarodowych dowództw wojskowych, ustanowionych na podstawie Traktatu Pó∏nocnoatlantyckiego z dnia 28 sierpnia 1952 r., b´dà odpowiednio stosowane do interpretacji niniejszej konwencji. Any dispute concerning the interpretation or application of this Convention shall be settled through negotiations between the Contracting Parties without recourse to third parties. As far as relevant, experiences and common practice deriving from the application of the Protocol on the Status of International Military Headquarters set up pursuant to the North Atlantic Treaty of the 28 August 1952 shall be used for interpretation. Other States Party to the North Atlantic Treaty may, at the invitation of the Contracting Parties to this Convention, join this Convention under conditions to be agreed in detail. (1)Niniejsza konwencja wejdzie w ˝ycie po up∏ywie trzydziestu dni od dnia otrzymania ostatniej noty stwierdzajàcej, i˝ zosta∏y spe∏nione niezb´dne do tego wymogi wewn´trzne.
(1)This Convention shall enter into force thirty days after the date of receipt of the last notification that the national requirements for entry into force have been fulfilled.
(2)Po wejÊciu w ˝ycie niniejsza konwencja zostanie zarejestrowana przez Rzàd Rzeczypospolitej Polskiej w Sekretariacie Organizacji Narodów Zjednoczonych zgodnie z artyku∏em 102 Karty Narodów Zjednoczonych. Rzàd Rzeczypospolitej Polskiej poinformuje Rzàd Królestwa Danii oraz Rzàd Republiki Federalnej Niemiec o fakcie rejestracji oraz o numerze rejestracyjnym, gdy tylko zostanie o tym powiadomiony przez Sekretariat.
(2)As soon as this Convention enters into force, it shall be registered by the Government of the Republic of Poland with the Secretariat of the United Nations in accordance with Article 102 of the Charter of the United Nations. The Government of the Republic of Poland shall inform the Government of the Kingdom of Denmark and the Government of the Federal Republic of Germany of the registration and the registration number as soon as it is notified by the Secretariat.
(3)Niniejsza konwencja mo˝e byç zmieniana lub uzupe∏niana w ka˝dym czasie za wspólnà pisemnà zgodà Umawiajàcych si´ Stron oraz zgodnie z wymogami procedur wewn´trznych.
(3)This Convention may be amended or supplemented by mutual written consent of the Contracting Parties and due to required national procedures.
(4)Niniejsza konwencja mo˝e byç poddana przeglàdowi na wniosek ka˝dej z Umawiajàcych si´ Stron.
(4)This Convention shall be reviewed upon request of one of the Contracting Parties.
(5)Niniejsza konwencja mo˝e byç wypowiedziana przez ka˝dà z Umawiajàcych si´ Stron, z zachowaniem pisemnego terminu wypowiedzenia wynoszàcego dwanaÊcie miesi´cy, o czym powinny byç powiadomione pozosta∏e Strony. Umawiajàce si´ Strony powinny si´ skonsultowaç ze sobà w celu uzgodnienia warunków wypowiedzenia, które by∏yby do przyj´cia dla wszystkich Stron.
(5)This Convention may be terminated by each of the Contracting Parties giving twelve months notice in writing to the others. The Contracting Parties shall consult each other to agree on mutually acceptable conditions of termination.
