Zmiany do wymienionej konwencji zosta∏y ratyfikowane na podstawie artyku∏u 89 ust´p 2 Konstytucji Rzeczypospolitej Polskiej. Zgodnie z artyku∏em 59 ust´p 3 i artyku∏em 60 ust´p 1 wymienionej konwencji, niniejsze Zmiany wesz∏y w ˝ycie w stosunku do Rzeczypospolitej Polskiej i pozosta∏ych stron konwencji dnia 17 lutego 1999 r. JednoczeÊnie podaje si´ do wiadomoÊci, ˝e Rzàd Rzeczypospolitej Polskiej wycofa∏ dnia 16 paêdziernika 1997 r. nast´pujàce zastrze˝enie, z∏o˝one wraz z dokumentem przystàpienia do niniejszej konwencji dnia 23 grudnia 1980 r. (Dz. U. z 1984 r. Nr 17, poz. 77): „Polska Rzeczpospolita Ludowa nie uwa˝a si´ za zwiàzanà postanowieniami ust´pów 2 do 6 artyku∏u 57 tej konwencji”. Informacje o paƒstwach, które sà lub stanà si´ stronami wymienionej konwencji w terminie póêniejszym, mo˝na uzyskaç w Departamencie Traktatowym Ministerstwa Spraw Zagranicznych. A European Molecular Biology Conference, hereinafter referred to as ”the Conference”, is hereby established. Il est institué une Conférence européenne de biologie moléculaire, appelée ci-apr¯s „la Conférence”. Hiermit wird eine Europäische Konferenz für Molekularbiologie gegründet (im folgenden als „Konferenz” bezeichnet). Artyku∏ II Article II Article II Artikel II Cele Purposes Buts Ziele 1. Konferencja b´dzie zapewniaç wspó∏prac´ mi´dzy Paƒstwami Europy w zakresie badaƒ podstawowych w dziedzinie biologii molekularnej, jak równie˝ w innych dziedzinach badaƒ ÊciÊle z nià zwiàzanych. 1. The Conference shall provide for co-operation among European States for fundamental research in molecular biology as well as in other areas of research closely related thereto. 1. La Conférence assure la coopération entre Etats européens pour les recherches en biologie moléculaire de caract¯re fondamental ainsi que pour d’autres domaines de recherche qui leur sont étroitement liés. 1. Die Konferenz sorgt für die Zusammenarbeit europäischer Staaten auf dem Gebiete der Grundlagenforschung in der Molekularbiologie und in anderen hiermit eng zusammenhängenden Forschungsbereichen. 2.   4. a)die Vergabe von Ausbildungs-, Lehr- und Forschungsstipendien;
  5. b)pomoc uniwersytetom i innym instytucjom szkolnictwa wy˝szego pragnàcym korzystaç z us∏ug wyk∏adowców;
  6. b)assistance to universities and other institutions of higher learning that wish to receive visiting professors;
  7. b)l’aide aux universités et autres institutions nationales d’enseignement supérieur et de recherche désireuses d’accueillir des professeurs invités;
  8. b)die Unterstützung von Universitäten und sonstigen nationalen Hochschul- und Forschungseinrichtungen, welche Gastprofessoren aufzunehmen wünschen;
  9. c)ustalenia dotyczàce programu kursów oraz organizowanie spotkaƒ naukowych, skoordynowanych z programami uniwersytetów i innych instytucji szkolnictwa wy˝szego oraz instytucji badawczych.
  10. c)the establishment of programmes of courses and the organization of study meetings, coordinated with the programmes of universities and other institutions of higher learning and research.
  11. c)l’établissement de programmes de cours et l’organisation de réunions d’étude coordonnés avec les programmes des universités et d’autres institutions d’enseignement supérieur et de recherche.
  12. c)die Aufstellung von Vorlesungsplänen und Veranstaltung von Studientagungen, die mit den Lehrplänen von Universitäten sowie sonstigen Hochschul- und Forschungseinrichtungen abgestimmt werden. Wykonanie Programu ogólnego Konferencja powierza EMBO. The execution of the General Programme is entrusted by the Conference to EMBO. La réalisation du Programme Général est confiée par la Conférence ∫ l’OEBM. Die Durchführung dieses Allgemeinen Programms überträgt die Konferenz der EMBO. Program ogólny lub sposoby jego realizacji mogà byç zmienione decyzjà Konferencji powzi´tà jednog∏oÊnie przez cz∏onków obecnych i g∏osujàcych. The General Programme, or the means of its execution, may be modified by decision of the Conference taken unanimously by the Members present and voting. Le Programme Général ou les conditions de sa mise en oeuvre pourront ˘tre modifiés par la Conférence ∫ l’unanimité des Membres présents et votants. Das Allgemeine Programm sowie die Modalitäten seiner Durchführung können durch Konferenzbeschlüsse geändert werden, die der Einstimmigkeit der anwesenden und abstimmenden Mitgliedstaaten bedürfen. 3. Projekty rozpatrywane przez Konferencj´, które b´dà wykonywane tylko przez niektórych cz∏onków, b´dà okreÊlane jako Projekty specjalne. Ka˝dy Projekt specjalny musi byç zatwierdzony przez Konferencj´ wi´kszoÊcià 2/3 g∏osów cz∏onków obecnych i g∏osujàcych. Wykonanie Projektu specjalnego b´dzie przedmiotem oddzielnego porozumienia mi´dzy paƒstwami w nim uczestniczàcymi. Ka˝dy z cz∏onków jest uprawniony do przystàpienia w póêniejszym terminie do ka˝dego Projektu specjalnego, który zosta∏ wczeÊniej zatwierdzony. 3. Projects studied by the Conference which only some Members are disposed to execute shall be termed Special Projects. Any Special Project shall be approved by the Conference by a two-thirds majority of the Members present and voting. The execution of a Special Project shall be the subject of a special agreement between the States participating in it. Any Member is entitled to participate at any later time in a Special Project which has already been approved. 3. Les projets étudiés par la Conférence et que seuls certains Membres sont disposés ∫ réaliser sont qualifiés de Projets Spéciaux. Tout Projet Spécial doit ˘tre approuvé par la Conférence ∫ la majorité des deux tiers des Membres présents et votants. La mise en oeuvre d’un Projet Spécial fait l’objet d’un accord entre les Membres qui y participent. Tout Membre a la faculté de participer ultérieurement ∫ un Projet Spécial déj∫ approuvé. 3. Bestimmte von der Konferenz geprüfte Vorhaben, zu deren Durchführung nur einige Mitgliedstaaten bereit sind, werden als Sondervorhaben bezeichnet. Jedes Sondervorhaben bedarf der mit Zweidrittelmehrheit der anwesenden und abstimmenden Mitgliedstaaten erteilten Genehmigung der Konferenz. Seine Durchführung ist Gegenstand einer Sonderübereinkunft der daran teilnehmenden Staaten. Jeder Mitgliedstaat ist berechtigt, an einem Sondervorhaben auch nach dessen Genehmigung teilzunehmen. Cz∏onkami Konferencji sà Paƒstwa-Strony niniejszej umowy. 1. The Members of the Conference are the States parties to this Agreement. 1. Les Membres de la Conférence sont les Etats parties au présent Accord. 1. Mitglieder der Konferenz sind die Vertragsstaaten dieses Übereinkommens. 2. Po wejÊciu w ˝ycie niniejszej umowy Konferencja mo˝e, decyzjà podj´tà jednog∏oÊnie przez cz∏onków obecnych i g∏osujàcych, zezwoliç innym paƒstwom europejskim, jak równie˝ paƒstwom, które od momentu jej utworzenia wnosi∏y istotny wk∏ad w prace EMBO, na cz∏onkostwo przez przystàpienie do niniejszej umowy po jej wejÊciu w ˝ycie. 2. The Conference may, by decision taken by unanimous vote of the Members present and voting, permit other European States, as well as States which have made an important contribution to the work of EMBO from its foundation, to become Members by acceding to this Agreement after it has come into force. 2. La Conférence peut, par une décision prise ∫ l’unanimité des Membres présents et votants, permettre ∫ d’autres Etats européens, ainsi qu’aux Etats ayant apporté une contribution importante aux travaux de l’OEBM d¯s sa fondation, de devenir Membres en adhérant au présent Accord apr¯s son entrée en vigueur. 2. Anderen europäischen Staaten sowie solchen Staaten, die seit Gründung der EMBO einen wichtigen Beitrag zu deren Arbeiten geleistet haben, kann die Konferenz durch einstimmigen Beschluss der anwesenden und abstimmenden Mitgliedstaaten gestatten, durch Beitritt zu diesem Übereinkommen nach dessen Inkrafttreten Mitgliedstaaten zu werden. 3. Konferencja mo˝e, jednog∏oÊnym postanowieniem cz∏onków obecnych i g∏osujàcych, nawiàzaç wspó∏prac´ z paƒstwami, które nie sà cz∏onkami Konferencji, z instytucjami krajowymi oraz z mi´dzynarodowymi organizacjami rzàdowymi lub pozarzàdowymi. Warunki i zasady takiej wspó∏pracy, w ka˝dym przypadku i stosownie do okolicznoÊci, zostanà przez Konferencj´ ustalone jednomyÊlnà decyzjà cz∏onków obecnych i g∏osujàcych. 3. The Conference may, by unanimous vote of the Members present and voting, establish co-operation with non-Member States, national bodies or international governmental or non-governmental organizations. The conditions and terms of such co-operation shall be defined by the Conference, by unanimous vote of the Members present and voting, in each case according to the circumstances. 3. La Conférence peut, par une décision prise ∫ l’unanimité des Membres présents et votants, établir une coopération avec des Etats non Membres, des organisations nationales ou des organisations internationales gouvernementales ou non gouvernementales. Les conditions et les modalités d’une telle coopération sont définies par la Conférence, ∫ l’unanimité des Membres présents et votants, dans chaque cas selon les circonstances. 3. Die Konferenz kann durch einstimmigen Beschluss der anwesenden und abstimmenden Mitgliedstaaten mit Nichtmitgliedstaaten, nationalen Einrichtungen, zwischenstaatlichen oder internationalen nichtstaatlichen Organisationen eine Zusammenarbeit aufnehmen.Die Voraussetzungen und die Art und Weise dieser Zusammenarbeit legt die Konferenz im Einzelfall entsprechend den Umständen durch einstimmigen Beschluss der anwesenden und abstimmenden Mitgliedstaaten fest. Artyku∏ IV Article IV Article IV Artikel IV Tryb post´powania i funkcje Konferencji Procedure and Functions of the Conference Fonctionnement et compétences de la Conférence Verfahren und Aufgaben der Konferenz 1. Zwyczajne sesje Konferencji odbywajà si´ raz do roku. Na wniosek 2/3 wszystkich cz∏onków Konferencja mo˝e zbieraç si´ równie˝ na sesjach nadzwyczajnych. 1. The Conference shall meet once a year in ordinary session. It may also meet in extraordinary session at the request of two-thirds of all the Members. 1. La Conférence se réunit une fois par année en session ordinaire. Elle peut en outre se réunir en session extraordinaire ∫ la demande des deux tiers de tous les Membres. 1. Die Konferenz tritt einmal im Jahr zu einer ordentlichen Tagung zusammen. Auf Antrag von zwei Dritteln aller Mitgliedstaaten kann sie ferner zu einer ausserordentlichen Tagung zusammentreten. 2.   16. a)fasst die erforderlichen Beschlüsse, um die in Artikel II bezeichneten Ziele zu erreichen;
  17. b)decyduje o miejscu jej posiedzeƒ;
  18. b)decide upon its place of meeting;
  19. b)décide du lieu de ses réunions;
  20. b)beschliesst über ihren Tagungsort;
  21. c)jest upowa˝niona do zarzàdzania funduszami i zawierania umów;
  22. c)be empowered to hold funds and to conclude contracts;
  23. c)peut détenir des fonds et conclure des contrats;
  24. c)kann finanzielle Mittel besitzen und Verträge schliessen;
  25. d)uchwala swoje przepisy proceduralne;
  26. d)adopt its Rules of Procedure;
  27. d)adopte son R¯glement intérieur;
  28. d)gibt sich eine Geschäftsordnung;
  29. e)powo∏uje, decyzjà podj´tà wi´kszoÊcià 2/3 g∏osów cz∏onków obecnych i g∏osujàcych, niezb´dne organy pomocnicze;
  30. e)establish by a two-thirds majority of the Members present and voting such subordinate bodies as may prove necessary;
  31. e)peut, par une décision prise ∫ la majorité des deux tiers des Membres présents et votants, créer les organes subsidiaires qui se révéleraient nécessaires;
  32. e)setzt mit Zweidrittelmehrheit der anwesenden und abstimmenden Mitgliedstaaten die gegebenenfalls erforderlichen nachgeordneten Organe ein;
  33. f)zatwierdza kierunkowy plan wykonania Programu ogólnego, o którym mowa w artykule II ust´p 2, i ustala czas jego trwania. Zatwierdzajàc plan, Konferencja ustala, jednog∏oÊnà decyzjà cz∏onków obecnych i g∏osujàcych, górny pu∏ap Êrodków, które w czasie jego trwania mogà byç u˝yte. WysokoÊç ta nie mo˝e byç póêniej zmieniona inaczej, jak jednomyÊlnà decyzjà cz∏onków obecnych i g∏osujàcych;
  34. f)approve an indicative scheme for the realisation of the General Programme mentioned in Article II, paragraph 2 and specify its duration. In approving this scheme, the Conference shall determine, by unanimous vote of the Members present and voting, the maximum credits that may be committed during that period. This amount may not be varied thereafter, unless the Conference by unanimous vote of the Members present and voting so decides;
  35. f)approuve un plan indicatif d’exécution du Programme Général mentionné ∫ l’article II, 2., et en fixe la durée. En approuvant ce plan, la Conférence détermine, par un vote unanime des Membres présents et votants, le montant maximum des engagements pour la période précitée. Ce montant ne peut ˘tre modifié par la suite sans une décision de la Conférence prise ∫ l’unanimité des Membres présents et votants;
  36. f)genehmigt zur Durchführung des in Artikel II Absatz 2 erwähnten Allgemeinen Programms einen Rahmenplan und bestimmt dessen Geltungsdauer. Bei der Genehmigung dieses Planes setzt die Konferenz durch einstimmigen Beschluss der anwesenden und abstimmenden Mitgliedstaaten den Höchstbetrag der Mittel fest, bis zu dem während dieser Zeit Verpflichtungen eingegangen werden dürfen. Dieser Betrag darf später nicht mehr geändert werden, es sei denn, dass die Konferenz ihn durch einstimmigen Beschluss der anwesenden und abstimmenden Mitgliedstaaten ändert; Dziennik Ustaw Nr 43 — 2773 — Poz. 496
  37. g)przyjmuje, wi´kszoÊcià 2/3 g∏osów cz∏onków obecnych i g∏osujàcych, zwyczajny roczny bud˝et oraz zawiera niezb´dne porozumienia finansowe;
  38. g)adopt the ordinary annual budget by a two-thirds majority of the Members present and voting and make the necessary financial arrangements;
  39. g)adopte le budget annuel ordinaire et prend, ∫ la majorité des deux tiers des Membres présents et votants, les dispositions financi¯res nécessaires;
  40. g)verabschiedet mit Zweidrittelmehrheit der anwesenden und abstimmenden Mitgliedstaaten das ordentliche Jahresbudget (den ordentlichen Jahreshaushaltsplan) und trifft die erforderlichen finanziellen Regelungen;
  41. h)zatwierdza wst´pny preliminarz wydatków na dwa kolejne lata;
  42. h)approve the provisional estimate of expenditures for the two following years;
  43. h)approuve l’estimation provisoire des dépenses pour les deux années suivantes;
  44. h)genehmigt den vorläufigen Ausgabenvoranschlag für die folgenden zwei Jahre;
  45. i)zapoznaje si´ z poszczególnymi postanowieniami finansowymi dotyczàcymi wszystkich Projektów specjalnych uchwalonych wczeÊniej przez cz∏onków uczestniczàcych w danym projekcie;
  46. i)take note of the particular financial provisions relating to any Special Project previously adopted by those Members participating in that Project;
  47. i)prend connaissance des dispositions financi¯res particuli¯res relatives ∫ chaque Projet Spécial préalablement adopté par les Membres qui participent ∫ ce Projet;
  48. i)nimmt in bezug auf jedes Sondervorhaben die diesem eigenen Finanzbestimmungen zur Kenntnis, nachdem es von den an dem Sondervorhaben teilnehmenden Mitgliedstaaten genehmigt worden ist;
  49. j)zatwierdza, wi´kszoÊcià 2/3 g∏osów cz∏onków obecnych i g∏osujàcych, przepisy finansowe;
  50. j)adopt Financial Regulations by a two-thirds majority of Members present and voting;
  51. j)adopte son R¯glement financier ∫ la majorité des deux tiers des Membres présents et votants;
  52. j)beschliesst mit Zweidrittelmehrheit der anwesenden und abstimmenden Mitgliedstaaten eine Finanzordnung;
  53. k)zatwierdza i publikuje zrewidowane roczne sprawozdanie finansowe;
  54. k)approve and publish its audited annual accounts;
  55. k)approuve et publie ses comptes annuels vérifiés;
  56. k)genehmigt und veröffentlicht ihre geprüften Jahresabrechnungen;
  57. l)zatwierdza roczny raport przedstawiony przez Sekretarza Generalnego.
  58. l)approve the annual report presented by the Secretary-General.

The Conference shall appoint, by a two-thirds majority of all Members, a Secretary-General for a defined period of time. He shall remain in office until the appointment of his successor. Any dispute between two or more Members concerning the interpretation or application of this Agreement which is not settled through the good offices of the Conference shall be submitted, at the request of any party to the dispute, to the International Court of Justice, unless the Members concerned agree within a reasonable lapse of time on another mode of settlement. JeÊli Konferencja nie zdecyduje inaczej, nadwy˝ka aktywów b´dzie rozdzielona mi´dzy cz∏onków proporcjonalnie do wk∏adów wniesionych przez nich od dnia, w którym stali si´ stronami niniejszej umowy. W przypadku deficytu b´dzie on pokryty przez cz∏onków proporcjonalnie do ich wk∏adów ustalonych na bie˝àcy rok finansowy. Subject to any agreement which may be made between Members with regard to the winding-up of the Conference, the Secretary-General shall be entrusted with all questions arising from the winding-up of the Conference. Except where otherwise provided by the Conference, the surplus shall be distributed among the Members in proportion to the contributions paid by them since the dates of their becoming parties to this Agreement. In the event of a deficit, this shall be met by the Members in the same proportions as those in which their contributions have been assessed for the current financial year. If a Member fails to fulfil its obligations under this Agreement, it may be deprived of its membership by decision of the Conference taken by a majority of two-thirds of all the Members. Such decision shall be notified to signatory and acceding States by the Secretary-General. 6. Any excess payment by a State, over and above its definitive share as thus established, shall be placed to its credit. 3.
