uznajàc, ˝e naruszenia przepisów celnych sà szkodliwe dla interesów ekonomicznych, skarbowych, spo∏ecznych i handlowych ich Paƒstw, considering that offences against customs legislation are prejudicial to the economic, fiscal, social and commercial interests of their countries; bioràc pod uwag´ znaczenie zapewnienia prawid∏owego wymierzania ce∏, podatków i innych op∏at recognizing the importance of assuring the accurate assessment of customs duties, taxes and any other Dziennik Ustaw Nr 202 — 12653 — Poz. 1710 przywozowych i wywozowych, prawid∏owego okreÊlania wartoÊci celnej, klasyfikacji i pochodzenia towarów, jak równie˝ w∏aÊciwego stosowania postanowieƒ dotyczàcych zakazów, ograniczeƒ i kontroli, charges on the importation or exportation of goods, the proper determination of the customs value, classification and origin of such goods, as well as the proper implementation of the provisions relating to prohibition, restriction and control; uznajàc, ˝e obrót Êrodkami odurzajàcymi i substancjami psychotropowymi stanowi zagro˝enie dla zdrowia spo∏ecznego i dla spo∏eczeƒstwa, considering that trafficking in narcotic drugs and psychotropic substances constitutes a danger to public health and to society; przekonane, ˝e zwalczanie naruszania przepisów celnych mo˝e byç bardziej skuteczne dzi´ki wspó∏pracy mi´dzy ich organami celnymi, convinced that action against customs offences can be made more effective by cooperation between their Customs Authorities; bioràc pod uwag´ istniejàce przyjazne stosunki mi´dzy Rzeczàpospolità Polskà i Paƒstwem Izraela, having regard to the friendly relations between the Republic of Poland and the State of Israel; majàc na uwadze Zalecenie Rady Wspó∏pracy Celnej z dnia 5 grudnia 1953 r. dotyczàce wzajemnej pomocy administracyjnej, having regard to the Recommendation of the Customs Co-operation Council on Mutual Administrative Assistance of 5 December 1953. uzgodni∏y, co nast´puje: have agreed as follows: Artyku∏ 1 Article 1 Definicje Definitions W rozumieniu niniejszej umowy: For the purposes of the present Agreement: 1. „Przepisy celne” — oznaczajà przepisy obowiàzujàce na terytoriach Rzeczypospolitej Polskiej i Paƒstwa Izraela dotyczàce przywozu, wywozu i tranzytu towarów, a tak˝e ce∏ i innych zwiàzanych z tym op∏at lub zakazów, ograniczeƒ i kontroli. 1. ”Customs legislation” — shall mean provisions in force in the territories of the Republic of Poland and the State of Israel concerning the importation, exportation and transit of goods, as well as customs duties and other charges related thereto, or to measures in respect of prohibition, restriction and control. 2. „Organy celne” — oznaczajà w Rzeczypospolitej Polskiej: Prezesa G∏ównego Urz´du Ce∏, a w Paƒstwie Izraela: Departament Ce∏ i Podatku VAT w Ministerstwie Finansów. 2. ”Customs Authorities” — shall mean in the Republic of Poland: the President of the Central Board of Customs and in the State of Israel: the Department of Customs and Value Added Tax of the Ministry of Finance. 3. „Nale˝noÊci celne” — oznaczajà wszelkie c∏a i inne op∏aty, wymierzane i pobierane zgodnie z przepisami celnymi. 3. ”Customs duties” — shall mean all duties and other charges which are levied and collected in accordance with the customs legislation. 4. „Organ wyst´pujàcy z wnioskiem” — oznacza w∏aÊciwy organ celny Umawiajàcej si´ Strony, który wyst´puje z wnioskiem o udzielenie pomocy w sprawach celnych lub otrzymuje takà pomoc. 4. ”Requesting Authority” — shall mean the competent Customs Authority of the Contracting Party which makes a request for assistance in customs matters or that receives such assistance. 5. „Organ proszony o pomoc” — oznacza w∏aÊciwy organ celny Umawiajàcej si´ Strony, do którego zwrócono si´ z wnioskiem o udzielenie pomocy w sprawach celnych lub który udziela takiej pomocy. 5. ”Requested Authority” — shall mean the competent Customs Authority of the Contracting Party which receives a request for assistance in customs matters or that renders such assistance. 6. „Naruszenie” — oznacza ka˝de naruszenie przepisów celnych, jak równie˝ ka˝de usi∏owanie naruszenia tych przepisów. 6. ”Offence” — shall mean any violation of customs legislation as well as any attempted violation thereof. 7. „Osoba” — oznacza zarówno osob´ fizycznà, jak i osob´ prawnà, a w Rzeczypospolitej Polskiej równie˝ inny organ nieposiadajàcy osobowoÊci prawnej. 7. ”Person” — shall mean either a physical human being or legal entity and in the Republic of Poland also entities having no legal personality. Dziennik Ustaw Nr 202 — 12654 — Poz. 1710 8. „Informacja” — b´dzie obejmowaç, mi´dzy innymi, raporty, rejestry, dokumenty i potwierdzone ich kopie, skomputeryzowane lub nie. 8. ”Information” — shall include, inter alia, reports, records, documents and certified copies thereof, whether computerized or not. Artyku∏ 2 Article 2 Zakres umowy Scope of agreement 1. Pomoc, w ramach niniejszej umowy, b´dzie udzielana zgodnie z wewn´trznymi przepisami Paƒstwa organu proszonego o pomoc. 1. Assistance, pursuant to this Agreement, shall be provided in accordance with the national law of the State of the requested Authority. 2. Umawiajàce si´ Strony, poprzez swoje organy celne, b´dà sobie pomagaç wzajemnie w zapobieganiu naruszeniom przepisów celnych, prowadzeniu dochodzeƒ, Êciganiu i zwalczaniu wszelkich naruszeƒ przepisów celnych. 2. The Contracting Parties shall assist each other through their Customs Authorities to prevent, investigate, prosecute and repress any offences against the customs legislation. 3. Pomoc, zgodnie z niniejszà umowà, b´dzie udzielana we wszelkiego rodzaju post´powaniach administracyjnych i sàdowych, ∏àcznie z post´powaniami wyjaÊniajàcymi zwiàzanymi z kwalifikacjà taryfowà, wartoÊcià celnà i pochodzeniem towarów oraz innymi problemami zwiàzanymi z przestrzeganiem przepisów celnych. 3. Assistance, pursuant to this Agreement, shall be provided for use in any administrative and judicial proceedings, including proceedings on tariff classification, customs value, origin and other characteristics relevant to the enforcement of the customs legislation. 4. Pomoc, w ramach niniejszej umowy, b´dzie obejmowaç, mi´dzy innymi, wymian´ informacji dotyczàcych wyposa˝enia technicznego, doÊwiadczeƒ w stosowaniu nowych Êrodków i metod wykorzystywanych w zwalczaniu naruszeƒ przepisów celnych, literatury fachowej przygotowanej przez organy celne, szkolenia funkcjonariuszy celnych oraz, na wniosek, informacji o przepisach celnych. 4. Assistance, pursuant to this Agreement, shall include, inter alia, the exchange of information concerning technical equipment, experience relating to new measures and methods used in combating customs offences, professional literature prepared by Customs Authorities, the training of customs officers and, upon request, information on the customs legislation. 5. Organy celne, zgodnie z niniejszà umowà, z w∏asnej inicjatywy lub na wniosek, przeka˝à sobie równie˝ informacje s∏u˝àce zapewnieniu prawid∏owego przestrzegania przepisów celnych, jak równie˝ w∏aÊciwego wymierzania ce∏. 5. The Customs Authorities, pursuant to this Agreement, on their own initiative or upon request, shall also supply to each other any information apt to ensure the proper enforcement of the customs legislation, as well as the correct assessment of customs duties. Artyku∏ 3 Article 3 Informacje Information 1. Organy celne b´dà, na wniosek lub z w∏asnej inicjatywy, udzielaç sobie wzajemnie wszelkich dost´pnych informacji dotyczàcych dzia∏aƒ, które mogà spowodowaç naruszenia przepisów celnych na terytorium Paƒstwa drugiej Umawiajàcej si´ Strony. 1. The Customs Authorities shall, upon request or on their own initiative, provide each other with any available information concerning activities that may result in the commission of offences against customs legislation in the territory of the State of the other Contracting Party. 2. Organy celne b´dà, na wniosek, informowaç si´ wzajemnie, czy towary wywiezione lub wwiezione na obszar celny Paƒstwa jednej Umawiajàcej si´ Strony zosta∏y wwiezione lub wywiezione z obszaru celnego Paƒstwa drugiej Umawiajàcej si´ Strony zgodnie z prawem, czy nielegalnie. Informacja ta, na wniosek, b´dzie zawieraç szczegó∏y na temat odprawy celnej lub czynnoÊci kontrolnych zastosowanych w odniesieniu do tych towarów oraz dane dotyczàce tych towarów. 2. Customs Authorities shall, upon request, inform each other whether goods exported from or imported into the customs territory of the State of one Contracting Party have been lawfully or illegally imported into or exported from the territory of the State of the other Contracting Party. Such information shall, upon request, include details concerning the customs clearance or control procedures applied to the goods and details and data concerning such goods. 3. Je˝eli organ proszony o pomoc nie posiada informacji, o które poproszono, podejmie dzia∏ania w celu uzyskania tych informacji, zgodnie z obowiàzujàcym prawem Paƒstwa Umawiajàcej si´ Strony. 3. If the requested Authority does not have the information asked for, it shall undertake measures in order to obtain that information, in accordance with the national law of the State of the requested Contracting Party. Pomoc, w ramach niniejszej umowy, udzielana b´dzie zgodnie z ustawodawstwem krajowym Paƒstw Umawiajàcych si´ Stron i w ramach kompetencji i mo˝liwoÊci organu proszonego o pomoc. W razie potrzeby organ ten mo˝e zapewniç udzielenie pomocy przez inny kompetentny organ, jakim w Rzeczypospolitej Polskiej, mi´dzy innymi, jest Generalny Inspektor Celny. 4. Assistance within the framework of this Agreement shall be rendered in accordance with the national legislation of the States of the Conctracting Parties and within the competence and resources of the requested Authority. If necessary, the requested Authority can arrange for assistance to be provided by another competent authority, which in the Republic of Poland, is among others, the General Customs Inspector. 5. Organ proszony o pomoc, na wniosek, b´dzie powiadamiaç zainteresowane osoby zamieszkujàce na terytorium jego Paƒstwa lub spowoduje powiadomienie ich przez w∏aÊciwe organy o wszelkich dzia∏aniach i decyzjach podj´tych przez organ wyst´pujàcy z wnioskiem, dotyczàcych wszelkich spraw obj´tych niniejszà umowà. 5. The requested Authority, upon request, shall deliver notifications to persons concerned, residing in the territory of its State or have them notified by the competent authorities, about any actions and decisions made by the requesting Authority concerning any matter within the framework of this Agreement. Artyku∏ 4 Article 4 Akta i dokumenty Files and documents 1. Organy celne Umawiajàcych si´ Stron b´dà, na wniosek, dostarczaç sobie wzajemnie informacji lub ich poÊwiadczonych kopii, zawierajàcych wszelkie dost´pne wiadomoÊci dotyczàce dzia∏aƒ, dokonanych lub planowanych, b´dàcych lub mogàcych byç naruszeniami przepisów celnych Paƒstwa organu wyst´pujàcego z wnioskiem. 1. The Customs Authorities of the Contracting Parties shall, upon request, supply each other information or certified copies thereof giving all available information on acts, completed or planned, which constitute or appear to constitute an offence against the customs legislation of the State of the requesting Authority. 2. W razie koniecznoÊci organ proszony o pomoc, wraz z informacjami, które przekazuje organowi wyst´pujàcemu z wnioskiem o pomoc, b´dzie dostarcza∏ wszelkich instrukcji koniecznych dla interpretacji lub wykorzystania tych informacji. 2. Where necessary, the requested Authority shall supply, along with the information which it provides to the requesting Authority, any necessary instructions for the interpretation or utilization of such information. 3. Organy celne b´dà, na wniosek, dostarczaç dokumentacj´ zwiàzanà z transportem i za∏adunkiem towarów, zawierajàcà informacj´ o wartoÊci celnej, pochodzeniu, dysponowaniu towarami i ich przeznaczeniu. 3. The Customs Authorities shall, upon request, provide documentation relating to transportation and loading of goods including information on the value, origin, disposition and destination of those goods. 4. Orygina∏y akt, dokumentów i innych materia∏ów b´dà wymagane tylko wtedy, gdy kopie b´dà niewystarczajàce. 4. Originals of files, documents or other materials shall be requested only when copies would be insufficient. 5. Orygina∏y akt, dokumentów i innych materia∏ów, które zosta∏y przes∏ane, b´dà zwrócone przy najbli˝szej okazji. Na wniosek, orygina∏y niezb´dne dla post´powaƒ sàdowych lub administracyjnych w Paƒstwie organu proszonego o pomoc b´dà zwracane natychmiast. 5. Originals of files, documents and other materials which have been sent shall be returned at the earliest opportunity. Upon request, originals necessary for judicial or administrative proceedings in the State of the requested Authority shall be returned immediately. Artyku∏ 5 Article 5 Nadzór nad osobami, towarami i Êrodkami transportu Surveillance of persons, goods and means of transport Organ celny jednej Umawiajàcej si´ Strony b´dzie, na wniosek i zgodnie z obowiàzujàcym prawem na terytorium jego Paƒstwa, sprawowaç nadzór nad: Upon request, the Customs Authority of one Contracting Party shall, in accordance with the legislation in force in the territory of its State, exercise surveillance over:
- a)poszczególnymi osobami, o których wiadomo lub które podejrzewa si´, ˝e biorà udzia∏ w naruszeniach przepisów celnych;
- a)particular persons known to be or suspected of being involved in committing offences against customs legislation;
- b)Êrodkami transportu, o których wiadomo lub co do których istnieje podejrzenie, ˝e sà wykorzystywane dla naruszenia przepisów celnych na terytorium Paƒstwa drugiej Umawiajàcej si´ Strony, i
- b)means of transport known to be or suspected of being used in committing offences against customs legislation in the territory of the State of the other Contracting Party; and Dziennik Ustaw Nr 202 — 12656 — Poz. 1710
- c)towarami wskazanymi, przez organ wyst´pujàcy z wnioskiem, jako przedmiot przemytu do lub z jego obszaru celnego.
- c)goods designated by the requesting Authority as being the object of smuggling into or from its customs territory. Artyku∏ 6 Article 6 Wykonanie wniosków Execution of requestes 1. Organ proszony o pomoc przedsi´weêmie wszelkie mo˝liwe Êrodki w celu zrealizowania wniosku, a w razie koniecznoÊci b´dzie staraç si´ poszukiwaç wszelkich urz´dowych lub sàdowych Êrodków koniecznych do jego wykonania. Je˝eli organ proszony o pomoc nie posiada informacji, o które zosta∏ poproszony, podejmie dzia∏ania w celu ich uzyskania, tak jakby czyni∏ to we w∏asnym imieniu i w imieniu organu wyst´pujàcego z wnioskiem. 1. The requested Authority shall take all reasonable measures to execute the request, and if required, will endeavour to seek any official or judicial measure necessary to carry out the request. 2. Organ celny ka˝dej z Umawiajàcych si´ Stron, na wniosek, przeprowadzi wszelkie konieczne dochodzenia, w∏àczajàc przes∏uchanie ekspertów i Êwiadków lub osób podejrzanych o naruszanie przepisów celnych, jak równie˝ weryfikacje, inspekcje oraz post´powania wyjaÊniajàce w zwiàzku ze sprawami obj´tymi niniejszà umowà. 2. The Customs Authority of either Conctracting Party shall, upon request, conduct any necessary investigation, including the questioning of experts and witnesses or persons suspected of having committed an offence and undertake verifications, inspections and fact finding inquires in connection with the matters referred to in the present Agreement. 3. Na wniosek, organ proszony o pomoc mo˝e zezwoliç funkcjonariuszom organu wyst´pujàcego z wnioskiem na obecnoÊç na obszarze celnym jego Paƒstwa podczas prowadzenia przez jego funkcjonariuszy dochodzeƒ w sprawach, które dotyczà organu wyst´pujàcego z wnioskiem. Funkcjonariusze ci mogà byç równie˝ obecni podczas prowadzenia dochodzeƒ, w których nie biorà czynnego udzia∏u ani nie posiadajà prawnych i dochodzeniowych uprawnieƒ na mocy prawa wewn´trznego drugiej Strony. Funkcjonariusze organu wyst´pujàcego z wnioskiem obecni na terytorium Paƒstwa organu proszonego o pomoc powinni przedstawiç urz´dowe pe∏nomocnictwo na ka˝de ˝àdanie. Nie mogà oni byç umundurowani i uzbrojeni. 3. Upon request, the requested Authority may allow officials of the requesting Authority to be present in the customs territory of its State, when its officials are investigating offences which are of concern to the requesting Authority. Such officials may also be present at investigations in which case they shall not participate actively in such investigations nor shall they exercise any legal or investigative powers granted by the domestic laws of the latter. 4. Organ wyst´pujàcy z wnioskiem, je˝eli o to wystàpi, zostanie powiadomiony o czasie i rodzaju dzia∏aƒ podj´tych dla realizacji wniosku. 4. The requesting Authority shall, if it so requests, be advised of the time and place of the action to be taken. 5. Funkcjonariusze organu wyst´pujàcego z wnioskiem, upowa˝nieni do prowadzenia post´powaƒ wyjaÊniajàcych naruszenia przepisów celnych, mogà zwróciç si´ do funkcjonariuszy organu proszonego o pomoc z proÊbà o przejrzenie odpowiednich ksiàg, rejestrów, dokumentów i innych informacji oraz baz danych i przekazanie wszelkich informacji i dokumentów dotyczàcych naruszenia. 5. Officials of the requesting Authority, authorised to investigate offences of customs legislation, may ask that officials of the requested Authority examine relevant books, registers, documents and other information or data-media and supply any necessary information and documents relating to the offence. Artyku∏ 7 Article 7 PoufnoÊç Confidentiality 1. Informacje lub wiadomoÊci otrzymane przez organy celne Umawiajàcych si´ Stron, zgodnie z niniejszà umowà, b´dà traktowane jako poufne i nie b´dà przekazywane innym osobom, z wyjàtkiem przypadków przewidzianych niniejszà umowà. 1. Any information or communications received by the Customs Authorities of the Contracting Parties, pursuant to this Agreement, shall be treated as confidential and shall not be communicated to any person, except as provided for in this Agreement. If the requested Authority does not have the information requested, it shall endeavour to obtain such information as if acting on its own behalf and on behalf of the requesting Authority. Officials of the requesting Authority present in the territory of the State of the requested Authority shall at all times, upon request, be able to furnish proof of their official capacity. They shall not be in unifrom nor carry arms. Dziennik Ustaw Nr 202 — 12657 — Poz. 1710 Takie informacje i wiadomoÊci otrzymajà wszelkà dodatkowà ochron´ ich poufnoÊci i tajemnicy, jaka jest przewidziana w prawie wewn´trznym Paƒstwa, którego organ celny je otrzymuje. Such information and communications shall enjoy any additional protection as to their confidentiality and secrecy as may be provided for in the national law of the State of the Customs Authority which received them. 2. Informacje i dokumenty, otrzymane w ramach wzajemnej pomocy, mogà byç wykorzystane jedynie dla celów wymienionych w niniejszej umowie, ∏àcznie z wykorzystaniem w post´powaniach sàdowych i administracyjnych. 2. Information and documents received in the course of mutual assistance may only be used for the purposes specified in the present Agreement, including the use in judicial and administrative proceedings. 3. Postanowienia ust´pu 1 niniejszego artyku∏u nie b´dà stosowane w sprawach dotyczàcych naruszeƒ zwiàzanych ze Êrodkami odurzajàcymi i substancjami psychotropowymi. Takie informacje mogà byç przekazywane innym organom w Paƒstwie organu wyst´pujàcego z wnioskiem, bezpoÊrednio zaanga˝owanym w zwalczanie nielegalnego obrotu narkotykami. 3. The provisions of paragraph 1 of this Article shall not apply to cases concerning offences relating to narcotic drugs and psychotropic substances. Such information may be communicated to other authorities in the State of the requesting Authority directly involved in combating illicit drug traffic. 4. Organ wyst´pujàcy z wnioskiem nie b´dzie wykorzystywa∏ dowodów i informacji uzyskanych, zgodnie z niniejszà umowà, dla celów innych ni˝ okreÊlone we wniosku bez wczeÊniejszej pisemnej zgody organu proszonego o pomoc. 4. The requesting Authority shall not use evidence or information obtained pursuant to this Agreement for purposes other than those stated in the request without the prior written consent of the requested Authority. Artyku∏ 8 Article 8 Eksperci i Êwiadkowie Experts and witnesses Na wniosek, organ proszony o pomoc mo˝e upowa˝niç swoich funkcjonariuszy, je˝eli wyra˝à oni zgod´, do wyst´powania w charakterze ekspertów lub Êwiadków w post´powaniach sàdowych lub administracyjnych, w sprawach obj´tych niniejszà umowà, na obszarze celnym Paƒstwa drugiej Umawiajàcej si´ Strony, oraz do przygotowania przedmiotów, dokumentów lub poÊwiadczonych kopii, które mogà byç potrzebne w takich post´powaniach. Upon request, the requested Authority shall authorize its officials, if they so consent, to appear as experts or witnesses in judicial or administrative proceedings in respect of the matters covered by this Agreement in the customs territory of the State of the other Contracting Party and produce such objects, documents or authorized copies thereof, as may be needed for the proceeding. Any request for such an appearance must indicate the matter and in what capacity the official shall testify, as well as the time and place of the proceedings. Artyku∏ 9 Article 9 Forma i treÊç wniosków o pomoc Form and substance of requests for assistance 1. Wnioski, stosownie do niniejszej umowy, sporzàdzane b´dà w formie pisemnej. Do wniosków b´dà za∏àczane dokumenty niezb´dne do ich realizacji. Je˝eli b´dzie tego wymagaç pilnoÊç sytuacji, mogà byç przyjmowane tak˝e wnioski w formie ustnej, lecz b´dà one niezw∏ocznie potwierdzone w formie pisemnej. 1. Requests pursuant to the present Agreement shall be made in writing. Documents necessary for the execution of such requests shall accompany the request. When required, because of exigency of the situation, oral requests may also be accepted, but shall be confirmed in writing immediately. 2. - e)krótki opis sprawy, zwiàzek mi´dzy oczekiwanà pomocà a sprawà, której dotyczy, oraz kwestie prawne z nià zwiàzane.

Wszelka wymiana korespondencji mi´dzy Umawiajàcymi si´ Stronami b´dzie odbywaç si´ w j´zyku angielskim. 3. Any correspondence between the Conctracting Parties shall be submitted in English. Artyku∏ 10 Article 10 Wyjàtki od obowiàzku udzielania pomocy Exemptions from the liability to render assistance 1. Je˝eli Umawiajàca si´ Strona proszona o pomoc uzna, ˝e pomoc, o którà wystàpiono, naruszy∏aby jej suwerennoÊç, porzàdek publiczny, bezpieczeƒstwo lub inne istotne interesy jej Paƒstwa lub gdyby mia∏a naruszyç tajemnic´ przemys∏owà, handlowà lub zawodowà, mo˝e odmówiç udzielenia pomocy lub uzale˝niç jà od spe∏nienia okreÊlonych warunków lub wymagaƒ, uwa˝anych za konieczne. 1. If the requested Concracting Party considers that the assistance requested for would be prejudicial to the sovereignty, public order, security or any other essential interest of its State, or that it would violate an industrial, commercial or professional secret it may refuse to provide such assistance or provide it subject to certain conditions or requirements as it may deem necessary. 2. If the Customs Authority of one Conctracting Party requests assistance which it itself would be unable to provide, it shall draw attention to that fact in the request. Compliance with such a request shall then be within the discretion of the requested Authority. 3. If assistance cannot be rendered, the decision and the reasons for the refusal shall be forwarded in writing to the requesting Authority without delay. 4. Pomoc mo˝e byç od∏o˝ona w czasie przez organ proszony o pomoc w przypadku, gdyby kolidowa∏a z prowadzonym dochodzeniem, procesem lub post´powaniem sàdowym. Assistance may be postponed by the requested Authority on the ground that it will interfere with an ongoing investigation, prosecution or proceeding. In such a case, the requested Authority shall consult with the requesting Authority to determine if assistance can be given subject to such conditions as the requested Authority may require. Artyku∏ 11 Article 11 Koszty Costs 1. The Customs Authorities of the Contracting Parties shall waive all claims for reimbursement of costs incurred in the execution of the present Agreement, with the exception of expenses for experts, witnesses and costs for interpreters other than government employees. 2. Je˝eli organ proszony o pomoc nie jest w∏aÊciwym organem do realizacji wniosku, po odpowiednich konsultacjach przeka˝e on wniosek do w∏aÊciwego organu, który b´dzie realizowa∏ wniosek, zgodnie z kompetencjami okreÊlonymi prawem, lub doradzi organowi wyst´pujàcemu z wnioskiem w sprawie przyj´cia w∏aÊciwej procedury dla takiego wniosku. Wszelka pomoc udzielana w ten sposób b´dzie przekazywana organowi wyst´pujàcemu z wnioskiem za poÊrednictwem organu proszonego o pomoc. 2. If the requested Authority is not the appropriate authority to comply with the request, it shall, after proper consultation, transmit the request to the appropriate authority, who shall act upon the request according to its powers under the law or advise the requesting Authority of the appropriate procedure to be followed regarding such a request. Assistance provided in this way shall be forwarded to the requesting Authority by the requested Authority. Artyku∏ 13 Article 13 Stosowanie umowy Implementation of the agreement 1. W razie koniecznoÊci mogà oni dokonaç wzajemnie szczegó∏owych ustaleƒ co do jej stosowania. 1. The President of the Central Board of Customs of the Republic of Poland and the Director General of the Department of Customs and Value Added Tax of the State of Israel shall communicate directly or through authorized representatives in order to deal with issues arising out of the present Agreement, within their competence and in accordance with national legislation. Where necessary, they may mutually agree on detailed arrangements for implementation thereof. 2. The Customs Authorities of the Contracting Parties shall meet in order to discuss the application of this Agreement and to discuss any other matters concerning the relations between them, when necessary or upon the request of one of the Customs Authorities. Artyku∏ 14 Article 14 Terytorium stosowania Territorial applicability Niniejsza umowa b´dzie mia∏a zastosowanie na obszarach celnych Rzeczypospolitej Polskiej i Paƒstwa Izraela. The present Agreement shall be applied in the customs territories of the Republic of Poland and the State of Israel. Artyku∏ 15 Article 15 WejÊcie w ˝ycie i wypowiedzenie Entry into force and termination 1. Umawiajàce si´ Strony powiadomià si´ drogà dyplomatycznà o spe∏nieniu wszystkich wewn´trznych wymogów prawnych koniecznych do wejÊcia w ˝ycie umowy. Umowa wejdzie w ˝ycie po up∏ywie szeÊçdziesi´ciu dni od dnia przes∏ania noty póêniejszej. 1. The Contracting Parties shall notify one another through diplomatic channels when all necessary national legal requirements for entry into force have been fulfilled. The Agreement shall enter into force sixty days after the last notification has been sent. 2. Niniejsza umowa jest zawarta na czas nieokreÊlony. Mo˝e byç wypowiedziana w drodze notyfikacji przez ka˝dà z Umawiajàcych si´ Stron; w takim przypadku utraci moc po up∏ywie szeÊciu miesi´cy od dnia przes∏ania takiej noty. 2. This Agreement shall be of unlimited duration. It can be terminated by notice through diplomatic channels by any of the Contracting Parties; in such a case it shall cease to be in force six months from the day on which such notice has been sent.
