Les Plénipotentiaires des Gouvernements des Pays-membres de l’Union postale universelle réunis en Congr¯s ∫ Beijing, vu l’article 30, paragraphe 2, de la Constitution de l’Union postale universelle conclue ∫ Vienne le 10 juillet 1964, ont adopté, sous réserve de ratification, les modifications suivantes ∫ ladite Constitution. 1. Konstytucja jest podstawowym aktem Zwiàzku. Zawiera ona zasadnicze przepisy Zwiàzku.
2. The Constitution shall be the basic Act of the Union. It shall contain the organic rules of the Union.
3. La Constitution est l’Acte fondamental de l’Union. Elle contient les r¯gles organiques de l’Union. Dziennik Ustaw Nr 131 — 8798 — Poz. 1208
4. Regulamin generalny zawiera postanowienia zapewniajàce stosowanie Konstytucji i funkcjonowanie Zwiàzku. Obowiàzuje on wszystkie kraje cz∏onkowskie.
5. The General Regulations shall embody those provisions which ensure the application of the Constitution and the working of the Union. They shall be binding on all member countries.
6. Le R¯glement général comporte les dispositions assurant l’application de la Constitution et le fonctionnement de l’Union. Il est obligatoire pour tous les Pays-membres.
7. Âwiatowa Konwencja Pocztowa, Regulamin poczty listowej oraz Regulamin dotyczàcy paczek pocztowych zawierajà wspólne przepisy dotyczàce mi´dzynarodowej s∏u˝by pocztowej, jak równie˝ postanowienia dotyczàce us∏ug przesy∏ek listowych i us∏ug paczek pocztowych. Akty te obowiàzujà wszystkie kraje cz∏onkowskie.
8. The Universal Postal Convention, the Letter Post Regulations and the Parcel Post Regulations shall embody the rules applicable throughout the international postal service and the provisions concerning the letter-post and postal parcels services. These Acts shall be binding on all member countries.
9. La Convention postale universelle, le R¯glement de la poste aux lettres et le R¯glement concernant les colis postaux comportent les r¯gles communes applicables au service postal international ainsi que les dispositions concernant les services de la poste aux lettres et des colis postaux. Ces Actes sont obligatoires pour tous les Pays-membres.
10. Porozumienia Zwiàzku i ich regulaminy regulujà mi´dzy krajami cz∏onkowskimi, które sà ich stronami, us∏ugi inne ani˝eli te, które dotyczà przesy∏ek listowych i paczek pocztowych. Obowiàzujà one tylko te kraje.
11. The Agreements of the Union, and their Regulations, shall regulate the services other than those of the letter post and postal parcels between those member countries which are parties to them. They shall be binding on those countries only.
12. Les Arrangements de l’Union et leurs R¯glements r¯glent les services autres que ceux de la poste aux lettres et des colis postaux entre les Pays-membres qui y sont parties. Ils ne sont obligatoires que pour ces pays.
13. Regulaminy okreÊlajàce Êrodki, których stosowanie jest konieczne dla wykonania konwencji i porozumieƒ, sà uchwalane przez Rad´ Eksploatacji Pocztowej, zgodnie z decyzjami podj´tymi przez Kongres.
14. The Regulations, which shall contain the rules of application necessary for the implementation of the Convention and of the Agreements, shall be drawn up by the Postal Operations Council, bearing in mind the decisions taken by Congress.
15. Les R¯glements, qui contiennent les mesures d’application nécessaires ∫ l’exécution de la Convention et des Arrangements, sont arr˘tés par le Conseil d’exploitation postale, compte tenu des décisions prises par le Congr¯s.
16. Ewentualne protoko∏y koƒcowe za∏àczone do aktów Zwiàzku wymienionych w ust´pach 3, 4 i 5 zawierajà zastrze˝enia do tych aktów.
17. The Final Protocols annexed to the Acts of the Union referred to in paragraphs 3, 4 and 5 shall contain the reservations to those Acts.
18. Les Protocoles finals éventuels annexés aux Actes de l’Union visés aux paragraphes 3, 4 et 5 contiennent les réserves ∫ ces Actes. 19. Akty Zwiàzku przyj´te przez Kongres sà podpisywane przez pe∏nomocników krajów cz∏onkowskich.
20. The Acts of the Union arising from the Congress shall be signed by the plenipotentiaries of the member countries.
21. Les Actes de l’Union issus du Congr¯s sont signés par les plénipotentiaires des Pays-membres.
22. Regulaminy sà uwierzytelniane przez Przewodniczàcego i Sekretarza Generalnego Rady Eksploatacji Pocztowej.
23. The Regulations shall be authenticated by the Chairman and the Secretary-General of the Postal Operations Council.
24. Les R¯glements sont authentifiés par le Président et le Secrétaire général du Conseil d’exploitation postale.
25. Konstytucja jest ratyfikowana przez Kraje-Sygnatariuszy w mo˝liwie najkrótszym terminie.
26. The Constitution shall be ratified as soon as possible by the signatory countries.
27. La Constitution est ratifiée aussitôt que possible par les pays signataires. Dziennik Ustaw Nr 131 — 8799 — Poz. 1208
28. Zatwierdzanie aktów Zwiàzku innych ni˝ Konstytucja nast´puje wed∏ug postanowieƒ konstytucyjnych poszczególnych Krajów-Sygnatariuszy.
29. Approval of the Acts of the Union other than the Constitution shall be governed by the constitutional regulations of each signatory country.
30. L’approbation des Actes de l’Union autres que la Constitution est régie par les r¯gles constitutionnelles de chaque pays signataire.
31. Je˝eli jakiÊ kraj nie ratyfikuje Konstytucji lub nie zatwierdzi innych aktów podpisanych przez siebie, Konstytucja i inne akty zachowujà pomimo to wa˝noÊç dla krajów, które je ratyfikowa∏y lub zatwierdzi∏y.
32. When a country does not ratify the Constitution or does not approve the other Acts which it has signed, the Constitution and other Acts shall be no less valid for the other countries that have ratified or approved them.
33. Lorsqu’un pays ne ratifie pas la Constitution ou n’approuve pas les autres Actes signés par lui, la Constitution et les autres Actes n’en sont pas moins valables pour les pays qui les ont ratifiés ou approuvés. 34. Administracja pocztowa** kraju cz∏onkowskiego ma prawo przedstawiç bàdê na Kongresie, bàdê mi´dzy dwoma Kongresami propozycje dotyczàce aktów Zwiàzku, których jego kraj jest stronà.
35. The postal administration of a member country shall have the right to present, either to Congress or between Congresses, proposals concerning the Acts of the Union to which its country is a party.
36. L’administration postale d’un Pays-membre a le droit de présenter, soit au Congr¯s, soit entre deux Congr¯s, des propositions concernant les Actes de l’Union auxquels son pays est partie.
37. Jednak˝e propozycje dotyczàce Konstytucji i Regulaminu generalnego mogà byç zg∏aszane tylko na Kongresie.
38. However, proposals concerning the Constitution and the General Regulations may be submitted only to Congress.
39. Toutefois, les propositions concernant la Constitution et le R¯glement général ne peuvent ˘tre soumises qu’au Congr¯s.
40. Ponadto propozycje dotyczàce regulaminów przedstawiane b´dà bezpoÊrednio Radzie Eksploatacji Pocztowej, z tym ˝e wczeÊniej muszà zostaç przekazane, za poÊrednictwem Biura Mi´dzynarodowego, administracjom pocztowym wszystkich krajów cz∏onkowskich.
41. Moreover, proposals concerning the Regulations shall be submitted direct to the Postal Operations Council but must first be transmitted by the International Bureau to the postal administrations of all member countries.
42. En outre, les propositions concernant les R¯glements sont soumises directement au Conseil d’exploitation postale, mais elles doivent ˘tre transmises au préalable par le Bureau international ∫ toutes les administrations postales des Pays-membres. 43. Kraje cz∏onkowskie, które nie podpisa∏y niniejszego protoko∏u, mogà do niego przystàpiç w ka˝dym czasie.
44. Member countries which have not signed the present Protocol may accede to it at any time.
45. Les Pays-membres qui n’ont pas signé le présent Protocole peuvent y adhérer en tout temps.
46. Kraje cz∏onkowskie, które sà stronami aktów znowelizowanych przez Kongres, ale które ich nie podpisa∏y, powinny do nich przystàpiç w mo˝liwie najkrótszym czasie.
47. Member countries which are party to the Acts renewed by Congress but which have not signed them shall accede thereto as soon as possible.
48. Les Pays-membres qui sont parties aux Actes renouvelés par le Congr¯s mais qui ne les ont pas signés sont tenus d’y adhérer dans le plus bref délai possible.
49. Dokumenty przystàpienia odnoszàce si´ do przypadków uj´tych w ust´pach 1 i 2 powinny byç przekazane Dyrektorowi Generalnemu Biura Mi´dzynarodowego, który notyfikuje rzàdom krajów cz∏onkowskich o ich z∏o˝eniu.
50. Instruments of accession relating to the cases set forth in paragraphs 1 and 2 shall be sent to the Director-General of the International Bureau, who shall notify the Governments of the member countries of their deposit.
51. Les instruments d’adhésion relatifs aux cas visés aux paragraphes 1 et 2 doivent ˘tre adressés au Directeur général du Bureau international. Celui-ci notifie ce dépôt aux Gouvernements des Pays-membres. Dziennik Ustaw Nr 131 — 8800 — Poz. 1208 Artyku∏ V Article V Article V WejÊcie w ˝ycie i okres obowiàzywania Protoko∏u dodatkowego do Konstytucji Âwiatowego Zwiàzku Pocztowego Entry into force and duration of the Additional Protocol to the Constitution of the Universal Postal Union Mise ∫ exécution et durée du Protocole additionnel ∫ la Constitution de l’Union postale universelle Niniejszy protokó∏ dodatkowy wejdzie w ˝ycie dnia 1 stycznia 2001 r. i pozostanie w mocy przez czas nieokreÊlony. This Additional Protocol shall come into force on 1 January 2001 and shall remain in force for an indefinite period. Le présent Protocole additionnel sera mis ∫ exécution le 1er janvier 2001 et demeurera en vigueur pendant un temps indéterminé. Na dowód czego pe∏nomocnicy rzàdów krajów cz∏onkowskich sporzàdzili niniejszy protokó∏ dodatkowy, który mieç b´dzie takà samà moc i to samo znaczenie, jak gdyby jego postanowienia by∏y zamieszczone w samym tekÊcie Konstytucji, oraz podpisali go w jednym egzemplarzu, który zostanie z∏o˝ony u Dyrektora Generalnego Biura Mi´dzynarodowego. Jedna jego kopia dor´czona zostanie ka˝dej stronie przez rzàd kraju, w którym odby∏ si´ Kongres. In witness whereof the plenipotentiaries of the Governments of the member countries have drawn up this Additional Protocol, which shall have the same force and the same validity as if its provisions were inserted in the text of the Constitution itself, and they have signed it in a single original which shall be deposited with the Director-General of the International Bureau. A copy thereof shall be delivered to each party by the Government of the country in which Congress is held. En foi de quoi, les Plénipotentiaires des Gouvernements des Pays-membres ont dressé le présent Protocole additionnel, qui aura la m˘me force et la m˘me valeur que si ses dispositions étaient insérées dans le texte m˘me de la Constitution, et ils l’ont signé en un exemplaire qui est déposé aupr¯s du Directeur général du Bureau international. 53. ———— ** WczeÊniej u˝ywano wyra˝enia — „wnioski”. ** WczeÊniej u˝ywano „Zarzàdy pocztowe”; od 1994 r. francuskie wyra˝enie „administration postale” u˝ywane w ró˝nych aktach UPU jest t∏umaczone na j´zyk polski jako „administracja pocztowa”. Po zapoznaniu si´ z powy˝szym protoko∏em, w imieniu Rzeczypospolitej Polskiej oÊwiadczam, ˝e: — zosta∏ on uznany za s∏uszny zarówno w ca∏oÊci, jak i ka˝de z postanowieƒ w nim zawartych, — jest przyj´ty, ratyfikowany i potwierdzony, — b´dzie niezmiennie zachowywany.
